BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson ABSENT: Councilwoman Judith A. Myers The Supervisor said Councilwoman Myers was in California with her daughter, dropping her off for her first year at Stanford. ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25 PM, who then pointed out the location of exits. WESTCHESTER COUNTY UPDATE - County Legislator George Latimer This was held over PUBLIC HEARING - Proposed Community Development Block Grant The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, September 18, 2002, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the Community Development Block Grant Program. The purpose of this public hearing is to submit an application for funding under the Community Development Block Grant Program. The application will seek funding to complete streetscape improvements on the Boston Post Road between Dean Place and on Dillon Road, Edgewater Place, Locust Terrace and Parkland Avenue. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the meeting was unanimously declared open. The Administrator explained this was a federally funded grant program and the Town of Mamaroneck is part of the Westchester Urban County Consortium which participates in the program. The funding cycle for each period is three years and the new cycle begins in 2003 This application would apply for funding to improve the Boston Post Road, between Dean Place and Dillon Road - sidewalks, curbs and street lights, as well as for planting new trees in the area. The development Block Grant Program (CDBG) is a federal grant program. The projects must first meet one of three criteria to be eligible; benefiting low and moderate income people, aiding the prevention or meeting a community development need, which is probably where we fit. Additionally, funding will be sought to replace sidewalks and curbs on Dillon Road, Edgewater Place, Locust Terrace, and Parkland Avenue. Along with the infrastructure improvements, new trees will be planted as part of the project. The project as proposed will meet the objective of benefiting low and moderate income people in this area September 18, 2002 of Town. Currently an income survey is being conducted by Kathy Kopa in the project area to determine the benefit to the neighborhood. Like our other projects, we will request technical and design assistance from the Westchester County Planning Department. We have divided the project into two components: Boston Post Road and Dillon Park. In total, the project cost is estimated to be $526,000. We will likely seek half of the cost of the project, or$260,000 from the CDBG program. Staff is still reviewing the detail of the cost estimate for any further refinements that may be necessary. The final grant application is due to the County by September 30, 2002 If the project is acceptable, I am requesting authorization to complete the necessary grant application and submit it to Westchester County for consideration. Councilwoman Seligson said this was a great program, adding the County had to fight to have themselves included by the federal government which had originally excluded them. She also questioned curbs being refurbished and trees being removed. The Administrator explained the process of refurbishing them saying it was quite normal. Councilman Odierna noted the plan should state Edgewater Place not avenue and said he hoped this project could stay within budget and not go over as did Washington Square renovations. The Administrator replied the over budget items were caused by the Board modifying the plans and for the street lamps. Councilwoman Wittner said she was looking forward to seeing this project done. The Supervisor said she had heard comments regarding the Town always being given CDBG funds and this probably was because the application was literate and had well balanced numbers, not because of luck. Councilwoman Wittner said the corner of Boston Post Road and Dillon Road has no walkway to cross the street, she would like to see a walk light or at least make the existing one work. On motion of Councilman Odierna, seconded by Councilwoman Wittner, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following resolution was adopted: WHEREAS, the Town of Mamaroneck is applying to the Westchester County Department of Planning for a grant under the United States Housing and Urban Development Community Development Block Grant program, for a project in the Dillon Park neighborhood and Boston Post Road area, located within the jurisdiction of the Town Board of the Town of Mamaroneck; and WHEREAS, the Town of Mamaroneck has previously studied the Boston Post Road corridor and Dillon Park neighborhood; and WHEREAS, the Town of Mamaroneck has identified a need to conduct Capital Improvements to sidewalks, curbs, and lighting facilities in the Dillon Park neighborhood and southwestern section of the Boston Post Road; and WHEREAS, the construction of these improvements will result in the overall betterment of the area for both residents and local businesses; and WHEREAS, a public hearing was held by the Town Board of the Town of Mamaroneck on September 18, 2002, wherein public input was solicited on the proposed improvements. NOW THEREFORE, BE IT 2 September 18, 2002 RESOLVED, that Stephen V. Altieri, as Town Administrator of the Town of Mamaroneck, is hereby authorized and directed to file an application for funds from the Westchester County Department of Planning in accordance with the provisions of Title I of the United States Housing and Community Development Act of 1974, and upon approval of said request to enter into and execute a project agreement with the County of Westchester for such financial assistance to the Town for the Dillon Park/Boston Post Road Sidewalk Improvement Project. Ayes: Seligson, Odierna, Wittner, O'Keeffe Nays: None Absent: Myers AFFAIRS OF THE TOWN 1. Project Update - Inflow & Infiltration Removal Private Sources The Town Administrator said the Town was required to insure that all illegal connections to the sewer system be remedied by December 31, 2002. There are 150 such connections in the Town for which a chart was prepared to show the status of each, and so far we are in good shape as 86.9% in the New Rochelle district are done, and 70% in the Mamaroneck district, noting there had been a few summonses issued. Councilwoman Seligson asked if there was any other measures we could take to encourage compliance. Mr. Altieri said attempts are made to contact and to work with them when its not being done because of expense, but in most instances that is not a problem, property owners have been cooperative. He said nine summonses had been issued and our Court had been advised of the consent order the Town was under, so was sympathetic to the cause. Councilwoman Seligson explained the effect of the problem when these illegal connections are allowed -saying the sewage plants are unable to handle the flow when rain water gets mixed in and therefore the sewage is not treated properly before being released. She said the water in Long Island Sound has improved. 2. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 4 September 18, 2002 Myers - Absent Highway Department Mr. Altieri explained authorization was being requested to promote James Guinee from the position of Skilled Laborer to Tree Trimmer, he is will replace Kevin Leddy who had recently retired. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to James Guinee, and promotion to the position of Tree Trimmer at an annual salary of$44,395 effective September 26, 2002. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye Myers - Absent Community Services Department The Administrator said this was a request to appoint Arleen Silverman to the position of part time Intermediate Clerk with Community Services Department, Arleen had been working under a different title of Office Assistant, for the Community Services since August of 2001, and although she passed a written civil service exam for the Office Assistant position, she had not passed the typing test. To be in compliance with the County civil service law, Arleen must be taken out of the title of Office Assistant. The only other title we could transfer her into is Intermediate Clerk since Arleen has passed the civil service exam for this title, but the opening will not be available until December. To bridge the time gap Arleen must be placed in an approved non-competitive position at an hourly rate which is at the same rate she will be when she moves into the Intermediate Clerk position full time. Therefore the above request. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby appoint Arleen Silverman to the position of part time Intermediate Clerk in the Community Services Department and continue all conditions of employment and authorize the payment of salary at the rate of$19.58 an hour effective September 28, 2002. Referral to the Planning Board - Revised Floor Area Ratio Law (FAR) 5 September 18, 2002 The Supervisor said there was a new version of the FAR legislation and the Board was required to refer it for review by the Planning Board. Mr. Maker explained the changes that were made were significant. He tried to come up with a mechanism which would have the law make sense, which he thinks it does in this new version. He noted the section including attic space into the calculation was still part of the law even although there is a segment of the community who takes exception to it. The best thing at this point is to increase the dialogue and get more people invested in the process, noting the Town Board had spent a tremendous amount of time on this. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board of the Town of Mamaroneck does hereby refer the proposed change to the code known as the Floor Area Ratio Law to the Town's Planning Board for review and comment; and BE IT FURTHER, RESOLVED, that the Town Board does hereby set the date for public hearing on Floor Area Ratio Law to October 2, 2002 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye Myers - Absent SUPERVISOR REPORTS 6 September 18, 2002 The Supervisor stated the Town had received a rating of AAA, the highest financial rating possible. She had attended a ceremony for those receiving a service award for 20 years or more of service held by the International Mayor Association. She informed everyone that a Town employee, Kevin McWade, had been injured by a hit & run driver, our very alert Detective-Sergeant, Jerry McCarthy was able not only to find the person but because of his attention to detail was able to apprehend and connect him to a bank robbery. Con Edison had reported they went to the Marbourne neighborhood to inform residents they would be installing a meter by the end of the week to monitor the power outages they are experiencing. She had attended the event on Saturday sponsored by FIND to raise funds for the 9/11 victims in our area, there were many public officials in attendance, a nice ceremony with a great turnout. REPORTS OF COUNCIL Councilman Odierna said volleyball was available at Memorial Park, anyone interested in playing need only to ask the attendant for the ball, he requested a sign be put up notifying residents of the availability. He also said golf training had begun this evening for those 17 or older at a cost of$100 per person, and would run on Tuesdays & Thursdays during September and October. Saturday was beach clean up day and he invited everyone to come help, he would be at the Gardens Lake with his equipment to pick up goose poop. Councilwoman Seligson said anyone wishing to help in the clean up just needs to show up at a nearby waterway, and the Supervisor added if one could not pick up trash they could instead be an inventory person as all the trash collected is inventoried and reported on. Councilwoman Seligson also said she had attended the interfaith service events in the Villages of Larchmont & Mamaroneck which were held in remembrance of 9/11 and that they were a great service to our community. ADJOURNMENT The Supervisor said that the next scheduled meetings would be held on October 2, 2002 and October 16, 2002 On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the meeting was adjourned at 9:50 PM.
