CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30
PM, who then pointed out the location of exits.
The Supervisor introduced Ronny Reidy and his daughter, then read the following
proclamation into the record before presenting it to Mr. Reidy.
PROCLAMATION
ROLAND F. REIDY
WHEREAS, "Ronnie"is retiring as a Labor Foreman of the Town of Mamaroneck
Highway Department, and
WHEREAS, for thirty-two years he has faithfully discharged his duties; and
WHEREAS, his dedication, devotion and loyalty to Town residents has been
demonstrated repeatedly by his untiring performance of his duties.
NOW THEREFORE, BE IT,
RESOLVED, that 1, Valerie Moore O'Keeffe, Supervisor, and the members of the
Town Council of the Town of Mamaroneck hereby present this Proclamation to
ROLAND F. REIDY in deep appreciation, gratitude, and wish him many happy and
healthy years in his retirement.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the
Town of Mamaroneck to be affixed this 14th day of June 2002
Councilwoman Wittner said Ronnie's positive attitude will be missed.
Mr. Altieri said Mr. Reidy had been a very important part of the Highway Department and
thanked him.
Councilman Odierna thanked Mr. Reidy for a job well done on all of the Town projects which
he participated in.
The Supervisor mentioned Harry Fannelli who was also retiring after 8 years and Kevin Leddy
was retiring after 9 years of service.
PUBLIC HEARING - Proposed Adoption of Residential Floor Area Ratios (FAR)
June 20, 2002
The following Public Hearing Notice was put into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Thursday, June 20, 2002, at 8:15 PM or as soon thereafter as is possible, in
the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to
consider adoption of a local law entitled "Floor Area Ratio Law" law.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was
declared open.
The Supervisor introduced Mr. Frank Fish of Buckhurst, Fish & Jacquemart and Mr. Bill
Maker the Town Attorney.
An addendum was given to the Board by the Attorney.
The Supervisor asked if anyone in the audience would like to speak on the proposed
amendment.
Michael Marks of 22 Mohegan Road spoke. He stated that he was in support of the proposed
local law and thinks it is very rational and reasonable.
Arthur Wexler, who said he has been a member of the Zoning Board for 14 years, said
hardship as an appeal is no longer an argument, now there is a five prong test which must be
met.
Mr. Bordain asked if consideration had been given to affordable housing being converted to
upscale - housing, he was here as an observer from WRAIN - but speaking for himself the
concept seems a good one.
The Attorney answered this was not a possibility.
Jim Fleming - resident of the Village of Larchmont and an architect, said it is difficult to
impose the FAR (floor area ration) plan into an existing law. The Town has looked at other
communities which has those laws but they were originally part of their codes, and he said
he does not agree with the McMansion effect. He suggested the existing zoning be left as is,
except in cases where the building is torn down, then the average will come into play, which
allows for less of an effect on existing homes. The Village of Mamaroneck uses the footprint
in the code, and existing homes are exempt.
Councilwoman Myers asked him why he thought our proposed law looks at use. Mr. Fleming
replied because minor additions will be effected. Councilwomen Myers and Wittner both then
stated one can still change the law without affecting use.
The Attorney added if one wants to convert uninhabitable to habitable space, there would be
no problem unless they change or move out walls.
Frank Fish said the Village of Mamaroneck stated that what they did was put in the code that
an addition can be done as long as the footprint does not change, the dormer questions
include floor space.
Arthur Wexler, said as an architect he sees allowing bay windows on 20% of the building.
Homes from the 1920-30's give character, steep roofs and usable area when included in the
square footage. There are lots of problems with this if you want to keep the same slopes on
roofs. Those houses will be penalized because they would have to reduce size with this law.
He said he did an analysis. The R10 zone has lots that are substandard and would better fit
into the R7.5 zone. Those substandard lots would have to use a lower FAR.
The Supervisor asked if he was saying take the attic out of the equation. Mr. Wexler
answered yes, the dormer adds to the character.
Betty Miller, President of the Larchmont gardens Civic Assoc., said the FAR goes by lot size,
so why is that bad.

Mr. Maker asked Mr. Wexler what he would consider a modest addition. Mr. Wexler replied
1200 square feet, which is the average two story addition.
There then was a debate over additions, and the average percentages if the attic was
included. Supervisor O'Keeffe then asked if we take the attic out will it fix it. Mr. Wexler
quipped - almost.
Susan Flink, if you take attic out then you can build a bigger house, come to Country Lane to
see a McMansion.
Councilwoman Seligson said there is a difference between existing and new construction.
Ms. Flink then said what happened on her street with the new construction is out of
proportion. Mr. Maker said one house would not skew the average. She asked why height
was not included in the law. Councilwoman Seligson told her a ridge line law would address
height, but FAR does not.
Jackie Friedman, Country Lane said she had an emotional argument because every tree has
been destroyed on the construction site on her street. She asked why isn't more being done
to protect the trees.
There was then a debate over addition, average percentages, bulk, and whether the attic
should be included in the calculations of FAR.
Supervisor O'Keeffe stated the board would address the tree law, the Board would also
discuss the difference in putting the percentages on the attic, and recommended adjourning
the public hearing to the next meeting so they could clarify these issues. Mr. Maker
reminded her the law would then have to be referred back to the planning board again.
Councilwoman Wittner stated she does not agree the additions to the law are egregious and
there are not many new buildings.
Councilwoman Myers disagreed, saying it's a sign of the times, more and more buildings are
torn down and the Town needs to directly address both.
Frank Fish said the dormers would be easy to exclude if the footprint does not change. He
said there were two issues here, one issue is pure size, they seem to want a higher threshold,
when you get into additions changing the footprint that will make a significant difference.
Mr. Wexler said the problem wasn't the threshold, it was the attic being included in the FAR
calculation.
There followed a further discussion on what impact the attic would have. The Board said
there would be a special meeting on July 2, at 8:00 AM to discuss this further.
The Town Attorney suggested the board adopt a negative declaration on this matter.
The Supervisor summarized the discussion and suggested that this hearing be continued at
the next Town Board Meeting.
Mr. Maker said the new legislation if significantly modified would have to be presented to the
Planning Board.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board of the Town of Mamaroneck
does hereby find this action as a negative declaration; and
BE IT FURTHER
RESOLVED, the Town Board declares itself to be lead agency in
this matter.

TAKEN OUT OF ORDER
1. Adoption of Scoping Document -Zoning Petition - Forest City Daly
Mr. Frank Fish explained the Board had held a scoping session concerning the Forest City
Daly application. They got input from the public; therefore, items were amended and added
to the scoping document. We would now go through them and highlight additions. One of
the suggestions to be added was bicycles on page 3 under parking: the list is as follows:
Page 5 -2e - add a number 5 - Local Waterfront Revitalization Plan
Page 6 - 1 b - change wildlife to animals
Page 7 - under noise -2c - need to see impact on surrounding areas within 500 square feet
radius of the site.
Page 8 -4 1d - mistake make it a small `i'
2b - description of access routes north & south bound on 1-95 and Hutchinson River
Parkway.
Add 2A- 6 - ingress and egress to and from proposed building including Byron,
Myrtle, Maxwell and Madison.
Page 9 -2c - add as well as the businesses therein.
Page 13 - gross inducement population - add cumulative impact including projected plans by
neighboring municipalities.
The Administrator explained the final amendments will be now incorporated into the scoping
document and will be then distributed to the Board and will be available in the Town Clerk's
office.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board of the Town of Mamaroneck
does hereby accept the scoping document for the draft
environmental impact statement for the project submitted by
Forest City Daly; and
BE IT FURTHER
RESOLVED, that the Town Environmental Officer is hereby
directed to distribute the amended scoping document to the
appropriate agencies.

2. Authorization - Consultant Services - Property Appraisal
Mr. Altieri explained that Bonnie Briar Country Club has filed a tax appeal with the Town. We
need to outline a strategy in defending this tax appeal. A preliminary certiorari appraisal is
therefore recommended. He recommended Brian Kenney Appraisals, who had submitted a
proposal to conduct a preliminary appraisal of Bonnie Briar Country Club at a cost of$3500.
Mr. Kenney has conducted appraisal work for the Town in the past and we have been
pleased with his work.
On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board does hereby approve the
agreement between the Town and Brian Kenney Appraisals to
conduct a preliminary appraisal of Bonnie Briar Country Club
at a cost of$3,500 to the Town; and
BE IT FURTHER
RESOLVED, that the Town Administrator is hereby authorized
to execute said agreement on behalf of the Town.

3. Authorization - Transfer of Funds - Capital Projects #22-04 and #22-05
Mr. Altieri explained that authorization was needed to set up a project fund for sidewalk &
curbs in the amount of$292,000, and the project fund for resurfacing of roads in the amount
of$83,000, by transferring funds from the Highway Fund to the Capital Fund as per the 2002
Budget.
On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board hereby authorizes the
Comptroller to transfer$375,000 from the Highway Fund to
the Capital Fund for Project#22-04/ Sidewalk & Curbs
($292,000) and Project#22-05/ Resurfacing of Roads
($83,000).

4. Authorization - Tree Removal Town Property

The Administrator explained the reconstruction on the Town garage will start, and they will
need to remove a tree in the northeast corner of the lot, which is a 36 inch oak. The Board is
required to have a notice published, notify residents within 250 foot radius of the removal
and wait ten days after publication before deciding on whether to remove the tree or not.
He said his memorandum constitutes the required filing with the Town Board of a statement
regarding the location of the tree to be removed, the work to be completed and a description
of the area where the tree will be removed. Then with the Town Board's approval, we will
place this matter on the agenda for July 11, 2002 for final consideration.
On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board does hereby authorize the
removal of a 36" oak tree located in the northeast corner of
the Town yard site to accommodate the new recycling area
and truck storage lot at the Town yard.

CONSERVATION
Mr. Altieri stated that authorization is being requested to hire the following young people to
work in the Conservation areas for the summer. The crew will clean and woodchip the trails,
repair and build catwalks, cut back brush and perform other maintenance tasks.

summer conservation corps members effective July 8, 2002:

origin of calls, the number of personnel responding and the total times spent at fire calls.

The Supervisor read the following proclamations into the record:
PROCLAMATION RONDA LUSTMAN
WHEREAS, for six(6) years, RONDA LUSTMAN has unselfishly devoted her time
energy and efforts to the Mamaroneck Union Free School District, Board of
Education; and
WHEREAS, Ronda has served as President for two (2) years, Board Secretary for
two (2) years and Trustee for two (2) years; and
WHEREAS, her leadership has resulted in open communication and honest
debate on complex and emotional school issues. As President, Ronda has
conducted meetings with intelligence, graciousness and a sense of humor, and
WHEREAS, Ronda's advocacy for our children and the reputation of our school
district has fostered a positive community image
NOW THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor, and the members of the
Town Council of the Town of Mamaroneck hereby present this Proclamation to
RONDA LUSTMAN to honor and recognize her for her extraordinary service to
this community.

PROCLAMATION
LOUISE PEREZ
WHEREAS, for five (5) years, Louise Perez unselfishly devoted her time, energy
and efforts as President of the League of Women Voters of
Larchmont/Mamaroneck, and
WHEREAS, Louise has advocated for the League's mission of promoting political
responsibility through informed and active participation by all citizens in their
local, state and national governments by incorporating study and analysis of
issues until consensus is reached, and
WHEREAS, Louise had been a dedicated volunteer in numerous organizations,
for example as Chair of the Tri-Municipal Conservation Advisory Commission
(CAC) from 1992 through 1996 participating in Beautification Day and the
International Beach Clean-Up-Day; and
WHEREAS, during Louise's tenure the CAC undertook two significant projects,
the Storm Drain Painting Project- "Don't Dump- Drains to Long Island Sound",
and published "A Land Practice Guide for People Living and Working in the Long
Island Sound Watershed".
NOW, THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor, and the members of the
Town Council of the Town of Mamaroneck hereby present this Proclamation to
LOUISE PEREZ to honor and recognize her for her extraordinary service to this
community.
Oral Communications
The Supervisor spoke about the passing of Mr. Robert Miller, former Larchmont Trustee and
Judge George Burchell, former Town Supervisor. She offered her condolences to their
families.
The Supervisor attended a meeting at Metro North MTA Headquarters in New York City with
Marlene Kolbert and art and museum people, to look at slides submitted by 40 artists for the
mosaic for the Larchmont Train Station. The field was narrowed down to 4 finalists. On July
29, the panel will meet again and pick the winner.
Councilwoman Seligson wished everyone a "Happy Summer".
Councilwoman Myers said that the Larch mont/Mamaroneck Tennis Team was tied for first
place.
Councilman Odierna made mention of Hommocks pool being open and also of the summer
concerts being held at Memorial Park at 7:00 PM on the following dates: July 8 - Bid Band,
July 15 - Musical Variety, July 22 - Rock and Roll and July 29 - Dixie All Stars. July 3 the
Seniors will be having a BBQ at Memorial Park.
Councilwoman Wittner spoke about the Coastal Zone Management Committee's special
meeting held on June 10 with the Department of State. The Village of Mamaroneck was
invited to attend. Also made mention of the following:
June 17 - Indian Point Meeting held at Rye Brook
June 19 - Newburgh - Confederation of Councils
June 20 - Her Grandson graduated from pre-school
June 21, 22 - St. Vito's Festa

July 2 - Fireman's Parade
The Supervisor thanked Dr. Joshua Lipsman, County Commissioner of Health for getting the
pool open. She attended the Recreation Commission meeting to discuss the idea of forming
a committee to find more sports fields.
Councilman Odierna said that on July 1 the yellow ribbon had been removed from Memorial
Park. It can now be used again. Also, on July 1 enforcement of organic recycling will begin.
Tickets will be issued to violators.
ADJOURNMENT
The Supervisor said that the next scheduled meeting would be July 11, 2002.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the meeting was
adjourned at 11:40 PM .
