CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM,
who then pointed out the location of exits.
There were no fire claims submitted for approval at this meeting.
Councilwoman Wittner said she had been unable to attend the Fire Council meeting this past
Monday because of the special meeting concerning the scoping document proposed by Forest
City Daly.

1. Adoption of Scoping Document -Zoning Amendment - Forest City Daly

2. Authorization Sale of Surplus Equipment
The Town Administrator explained there were a number of vehicles which could be designated as
surplus equipment that he could then put up for sale. The vehicles are no longer needed and he
recommended they be sold.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby authorize the

3. Authorization - Settlement of Certiorari
The Attorney explained the certiorari recommending its adoption
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby authorize the
settlement of the following certiorari as recommended by the
Town Attorney, William Maker, Jr.:

Supervisor O'Keeffe noted her vote for the settlement was with regret.
4. Appointment - Hearing Officer - Police
Mr. Altieri explained that previously the Board adopted a resolution appointing Mr. Anthony Grant
as Hearing Officer to hear disciplinary charges against Police Officer Alexander Gizzo. We have
learned Mr. Grant has another involvement with an attorney for Mr. Gizzo, so is therefore not able
to serve as the hearing officer. The recommendation is to appoint Howard Edelman to be the
Town's Hearing Officer in his place. Mr. Edelman has experience in police matters and is more
than qualified to act as Hearing Officer for the Town.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the Town Commissioners of the Town of
Mamaroneck does hereby appoint Mr. Howard Edleman to

replace Anthony Grand to hear disciplinary charges preferred
against Police Officer Alexander Gizzo.

5. Resolution -Waiver of Building Permit Fees - Highway Garage
The Administrator said in order to waive the fees for the construction at the Town garage, it
would be necessary for the Board to pass a resolution. This would encompass the contractors
submitting applications for the building permits without a fee, enabling us to keep records of all
the construction and inspections. Building permit fees are waived since they would just be
charged to the Town anyway.
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby authorize
waive all building permit fees in connection with the highway
garage reconstruction project.

6. Set Public Hearing - Local Law to Create Alternate Members To Zoning and Planning Boards
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby set the date
for public hearing to adopt a local law entitled "Creation of
the Position of Alternate Member for the Board of Appeals
and the Planning Board for June 20, 2002 at 8:15 PM in the
Court Room of the Town Center; and
BE IT FURTHER,
RESOLVED, that the Town Clerk be authorized to publish the
notice of said hearing in a newspaper appointed as an official
source, and that notice be so posted.

Councilwoman Myers asked if the alternate would attend all meetings and get the necessary
training needed.

The Supervisor answered they should not be held to attendance requirements.
Councilwoman Wittner said training would be a good reason for them to go and learn. There was
then a discussion on the alternates.
7. Resolution - Set Town Board Meetings for July and August 2002
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the regular meetings of the Town Board will
be held in the Court Room of the Town Center, 740 West
Boston Post Road, Mamaroneck at 8:15 PM during the
months of July and August for Thursday, July 11 and
Wednesday, August 21, 2002.

8. Resolution - Revised 2002 Deferred Compensation Plan (457)
The Administrator stated in a memo to the Town Board in the year 2000 the Town Board adopted
a resolution to amend the New York State Deferred Compensation Model Plan to include
modifications required by the IRS to satisfy the New York State Deferred Compensation Board's
policy of permitting participants in 457 plans to receive larger initial distributions of funds at
retirement followed by smaller payments in later years. Now a resolution is required for the Town
to adopt provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA)
which became effective on January 1, 2002. This resolution adopts the amended and restated
Model Plan which was compiled by Nationwide Retirement Solutions, our Administrative Service
Agency. The Board is being asked to accept it as written.
On motion of Councilman Odierna, seconded by Councilwoman Myers, the following resolution
was adopted:
WHEREAS, the New York State Deferred Compensation
Board (the "Board"), pursuant to Section 5 of the New York
State Finance Law ("Section 5") and the Regulations of the
New York State Deferred Compensation Board (the
"Regulations"), has promulgated the Model Deferred
Compensation Plan for the employees of the Town of
Mamaroneck, (the "Model Plan") and offered the Model plan
for adoption by local employers;
WHEREAS, The Town of Mamaroneck, pursuant to Section 5
and the Regulations, has adopted and currently administers
the Model Plan known as the Deferred Compensation Plan for
Employees of the Town of Mamaroneck;
WHEREAS, effective January 1, 2002, the Board amended the
Model Plan to adopt provisions of the Economic Growth and
Tax Relief Reconciliation Act of 2001 ("EGTRRA") as they
apply to the Model Plan and to adopt modifications that
update certain administrative provisions to accommodate
prospective state-of-the-art methods and procedures;

WHEREAS, the Board has offered for adoption the amended
and restated Model Plan to each Model Plan sponsored by a
local employer in accordance with the Regulations; and
WHEREAS, upon due deliberation, the Town of Mamaroneck
has concluded that it is prudent and appropriate to amend
the Deferred Compensation Plan for Employees of the Town
of Mamaroneck by adopting the amended and restated Model
Plan.
NOW THEREFORE, BE IT
RESOLVED, that the Town of Mamaroneck hereby amends
the Deferred Compensation Plan for Employees of the Town
of Mamaroneck effective June 5, 2002 by adopting the
amended and restated Model Plan effective January 1, 2002.

HIGHWAY DEPARTMENT
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby authorize the
payment of salary to Chris Gonch, in the amount of$37,200,
for his services as Motor Equipment Operator in the Highway
Department effective June 10, 2002; and
BE IT FURTHER
RESOLVED, that the Town Board does hereby authorize the
payment of salary to J. Roger Gutierrez , in the amount of
$37,200, for his services as Motor Equipment Operator in the
Highway Department effective June 10, 2002.

Approval of Minutes -April 3, 2002
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was

Board minutes from the meeting of April 3, 2002 as amended.

ORAL COMMUNICATIONS
Ruth Campanella, Larchmont Gardens Civic Association, said there were many complaints about
noise from the thruway.
The Supervisor explained it was coming from the type of surface the Thruway Authority had
chosen which is called diamond grind, it's quiet but causes a whining sound.
Ms. Campanella said there were problems with rubbish and the organic waste, some people are
putting it in plastic bags, ignoring the mail and communications which say not to. One house had
five bags out all weekend long, someone has to notify them.
Supervisor O'Keeffe said the Town had given out 68 notices and eight summonses since it was
decided to give out tickets.
The Administrator said the Town now has an enforcement officer who works 15 hours a week
covering 44 miles of streets. There then was a lengthy discussion on notifications, regulations,
on compliance.
SUPERVISOR REPORTS
The Supervisor reported she had attended a meeting at the county where safety at Indian Point
had been discussed. Mr. Spector, an engineer described how plumes would emanate if there was
a leak. It was interesting but many questions were left unanswered. There will be other meetings
to discuss technical questions, they asked for an expert inspection and have workable
evacuation plan.
Supervisor O'Keeffe thanked Councilwoman Seligson for chairing the Davids Island reunion.
She spoke on the scoping session which was held on June 3rd on the Forest City Daly
Application. It had been well attended and informative. There had been a session beforehand
with the land use board members, where we had all been instructed by the Town Attorney, Bill
Maker, and Frank Fish on the step by step process with regard to the Forest City application. We
are now ready to outline the final scope.
REPORTS OF COUNCIL
Councilwoman Myers said the public has to June 17 to submit any further comments in writing
regarding the Forest City application.
Councilwoman Wittner said the Board had a bus tour of the Town on May 16 from 5:00 to 7:00
PM, to further enlighten them on the floor area ratio law. The Building Inspector, Ron Carpaneto
had prepared a list of houses for them to see. She found it informative and her impression was
the law was not too restrictive.
Councilwoman Myers said the tour was helpful and the proposed law is not overly restrictive.
She added the League of Women Voters had hosted four women from Uganda introducing them
to our residents and held a number of events. Three of the women are appointed and one
elected, it is a s program through the Department of State and they have sent some of our people
to Uganda. Councilwoman Myers said she also wanted a round of applause for Councilwoman
Wittner for the Volunteer Recognition Dinner which she had put together to honor volunteers and
Department Heads, it was wonderful. She also thanked the Youth Council for their help in
serving.
Councilwoman Seligson added it was a fabulous event, and is part of what makes this a great
place to work and to celebrate our Town. She had attended a Greenway meeting where signage,
and maintenance had been discussed, everything is slow moving and is frustrating. She also
attended a meeting of the Zoning Board on May 22"d

Councilman Odierna said he had attended the Human Rights meeting where they discussed how
Hispanic men are being used for work and then not receiving payment. They don't report this
because of their fear of the authorities, they want to find a way to not judge, but to help them. He
had a discussion on the water quality in the Village of Mamaroneck, and it was being surmised
the coliform in the Harbor is from a non-human source, and is worth investigating.
The Administrator then in response to a question said the pool was still closed because the
school district has still not gotten the permit and clearance from the Health Department. The
Town has contacted them and asked for some feedback and dialogue on the problem.
ADJOURNMENT
The Supervisor said that the next scheduled meeting would be June 20.
The meeting was unanimously adjourned at 10:10 PM.
