HomeMy WebLinkAbout2002_04_03 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON APRIL 3, 2002 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM, who then pointed out the location of exits. WESTCHESTER COUNTY UPDATE - Lois Bronz, County Board Chair. Supervisor O'Keeffe introduced and welcomed the new Chair of the County Board of Legislators, Lois Bronz. Ms. Bronz thanked her and the Board members for allowing her to speak tonight. She outlined her priorities during the next few years, noting the County Budget and fiscal issues top the list, as the increases to the budget have been projected over the next few years at around 20 to 25 percent, which has been further impacted because of the sales tax revenue decreases. She said another would be to open talks with the state regarding mandates they pass without reimbursement which puts the burden on us, especially for bus transportation and child Tap funds. She said we are presently in a drought emergency and have drafted actions to help alleviate the situation, although with the voluntary conservation measures people have cooperated with, has helped a great deal, but they are now mandatory. She has asked each county committee for a blue print of their goals, and has also endorsed a plan for acquisition of open space. She is looking into environmental issues, the protection of our interest in the arts emphasizing the difference it makes to our community. She also wants to organize a group to oppose the pipeline being proposed in Mt. Vernon, and many security issues both county wide and especially at Indian Point, attempting to listen to as many experts as possible before formulating a policy. Davids Island is another issue she will be reviewing; she wants to see it dedicated as a County Park. Everyone thanked her as did the other Board members. PRESENTATION - Robert Meglio - F.I.N.D. Fundraiser The Supervisor said Mr. Meglio was not in attendance this evening but stated there would be a hockey game held on April 6t" to help raise more funds to help our community residents who were impacted by 9/11. Councilwoman Myers added the event was a hockey game with the Moms against Dads, hoped everyone would come to support this good cause, many community merchants had donated towards the event. April 3, 2002 PUBLIC HEARING - Local Law - Parking Lots - Held Over BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:45 PM. Appointment - Chairperson - Human Rights Commission Councilman Odierna outlined Robin Nichinsky's resume, noting her willingness to always serve the community. On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that Robin Nichinsky is hereby appointed as a Chair of the Mamaroneck/Larchmont Commission on Human Rights of the Town of Mamaroneck to serve a term of office for two years effective April 3, 2002 and terminating on March 31, 2004. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 2. Adoption of Bonding Resolution - Capital Projects Mr. Altieri said there were two resolutions, the first was for the Myrtle Boulevard reconstruction completion and the remainder for borrowing. These bonding resolutions have been prepared by the Town of Mamaroneck bonding counsel, Wilkie, Farr and Gallagher and have been previously authorized by the Town Board. RECONSTRUCTION OF MYRTLE BOULEVARD As a result of changes that were made during the planning of the Myrtle Boulevard Streetscape Project additional funding is required. The bond resolution would authorize borrowing $125,000.00 for the balance of the Myrtle Boulevard Project. On motion of Councilman Odierna, seconded by Councilwoman Myers, the following resolution was adopted: A RESOLUTION AUTHORIZING THE ISSUANCE OF AN ADDITIONAL $125,000 SERIAL BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY COSTS OF THE RECONSTRUCTION OF MYRTLE BOULEVARD IN AND FOR SAID TOWN. WHEREAS, by bond resolution dated March 22, 2000, the Town Board of the Town of Marnaroneck, Westchester County, New York, authorized the issuance of$350,000 serial bonds of said Town to pay the cost of the reconstruction of Myrtle Boulevard, in and for the Town of Mamaroneck, Westchester County, New York, including sidewalks, curbs and other incidental improvements and expenses in connection therewith, a specific object or purpose, at a maximum estimated cost of$350,000; and WHEREAS, it has now been determined that the maximum estimated cost of such specific object or purpose is now $475,000, an increase of $125,000 over that previously authorized; and WHEREAS, it is now desired to authorize the issuance of an additional $125,000 serial bonds of said Town therefor; NOW THEREFORE, BE IT 3 April 3, 2002 RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the specific object or purpose of paying additional costs of the reconstruction of Myrtle Boulevard, in and for the Town of Mamaroneck, Westchester County, New York, including sidewalks, curbs and other incidental improvements and expenses in connection therewith, there are hereby authorized to be issued an additional $125,000 serial bonds of the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of such specific object or purpose is now determined to be $475,000, and that the plan for the financing thereof is as follows: a. By the issuance of the $350,000 serial bonds of said Town authorized to be issued pursuant to bond resolution dated and duly adopted March 22, 2000; and b. By the issuance of the additional $125,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is fifteen years, pursuant to subdivision 20(c) of paragraph a of Section 11.00 of the Local Finance Law, calculated from June 21, 2000, the date of the first obligations issued for such purpose. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 5. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. There shall annually be levied on all the taxable real of said Town a tax sufficient to pay the principal of and interest on such obligations as the same become due and payable. Section 6. Such bonds shall be in fully registered form and shall be signed in the name of the Town of Mamaroneck, Westchester County, New York, by the manual or facsimile signature of the Supervisor and a facsimile of its corporate seal shall be imprinted or impressed thereon and may be attested by the manual or facsimile signature of the Town Clerk. Section 7. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as he or she shall deem best for the interests of the Town; provided, however, that in the exercise of these delegated powers, he or she shall comply fully with the provisions of the Local Finance Law and any order or role of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. 4 April 3, 2002 Section 8. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Town by the facsimile signature of its Supervisor, providing for the manual countersignature of a fiscal agent or of a designated official of the Town), the date, denominations, maturities and interest payment dates, place or places of payment, and also including the consolidation with other issues, shall be determined by the Supervisor. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners of such serial bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by section 52.00 of the Local Finance Law, as the Supervisor shall determine. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150 -2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 11. Upon this resolution taking effect, the same shall be published in full in The Journal News, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Section 12. This resolution is adopted subject to permissive referendum in accordance with Section 35.00 of the Local Finance Law. The question of the adoption of the foregoing resolution was duly put to a vote on roll call which resulted as follows: Councilwoman Seligson VOTING AYE Councilman Odierna VOTING AYE Councilwoman Myers VOTING AYE Councilwoman Wittner VOTING AYE The resolution was thereupon declared duly adopted. 5 April 3, 2002 PURCHASE OF HIGHWAY DEPARTMENT EQUIPMENT In the 2002 Capital Equipment Budget, authorization was granted to purchase three pieces of equipment for the Highway Department. Included in the purchase was one ten yard dump truck, one pickup truck and one sport utility vehicle. The cost to purchase this equipment is $155,000.00. To break this down further, the dump truck is estimated at $100,000.00 the pickup truck $28,000.00 and the sport utility vehicle $22,000.00. The remaining $5,000.00 is to cover bonding expenses and the installation of two way radios and lights in the vehicles. On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the following resolution was adopted: A RESOLUTION AUTHORIZING THE ISSUANCE OF $155,000 SERIAL BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE PURCHASE OF HEAVY EQUIPMENT FOR SAID TOWN. WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; and WHEREAS, it is now desired to authorize the financing of such capital project; NOW THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the classes of objects or purposes of paying the cost of(a) the purchase of various vehicles for construction and maintenance purposes, each item of which costs more than $15,000 but less then $30,000, at a maximum estimated cost of$48,000, and Co) the purchase of a motor vehicle for construction and maintenance purposes costing $30,000 or more, at a maximum estimated cost of$107,000, in and for the Town of Mamaroneck, Westchester County, New York, including, in each case, original equipment and incidental expenses in connection therewith, there are hereby authorized to be issued $155,000 serial Section 2. It is hereby determined that the maximum estimated cost of such class of objects or purposes is $155,000, and that the plan for the financing thereof is by the issuance of the $155,000 serial bonds of the Town of Mamaroneck, Westchester County, New York authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid items costing more than $15,000 but less than $30,000 is ten years, pursuant to subdivision 28 of paragraph a of Section 11.00 of the Local Finance Law and that the period of probable usefulness of the aforesaid item costing more than $30,000 is fifteen years pursuant to subdivision 28 of paragraph a of Section 11.00 of the Local Finance Law.. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Report of Bids - Contract TA-02-08 - Refuse Collection Truck. The Administrator said the bids had been opened on March 18, 2002 for the purchase of a 25 yard refuse collection vehicle. He recommended accepting the bid of the second lowest bidder, bids were received from three firms and the lowest bid submitted was from Heil Environmental Industries for$132,442. The second low bid was submitted by Gabbrielli Truck Sales of the Bronx for$133,000, mainly why we are recommending this be awarded to the second lowest bidder was because the lowest bidder excluded items to the bid. Since there were bid exceptions taken by the low bidder, and there are minor difference in cost, authorization is requested to enter into a contract with Gabbrielli for the purchase of a 25 yard refuse collection vehicle. The low bidder, Heil Environmental Systems, submitted a bid of$132,442.00. The second lowest bidder Gabrielli Truck Sales, Ltd., submitted a bid of $133,000.00, and was fully compliant with the specifications. The third lowest bidder was Long Island Kenworth, with a bid of$137,360.00, and met or exceeded the specification in all areas. He said this was also recommended by Marco Gennarelli, Superintendent of Highways in a memo received previously by the Board. Heil Environmental Industries, Ltd. P.O. Box 1337, Bronx, NY 10475 133,000.00 Long Island Kenworth 3200 Horsblock Road, Medford, NY 11763 137,360.00 On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board hereby authorizes that Contract TA-02-08 for a Refuse Collection Truck be awarded to Gabbrielli Truck Sales, Ltd., the lowest responsible bidder, at a total cost of the $133,000; and BE IT FURTHER, 8 April 3, 2002 RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 4. Set Public Hearing - Installation of Stop Sign Salem Drive Mr. Altieri said the Traffic Committee had discussed traffic on Salem Drive and Split Tree Road because of concern caused by there being no traffic control device for traffic exiting Salem Drive onto Split Tree Road. Many pedestrians, children and others use this street, therefor the Traffic Committee is recommending the installation of a stop sign on Salem Drive. He said the attorney had drafted a local law to allow for the installation of the stop sign, so a public hearing is required to be scheduled to adopt this legislation. On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby set the date for public hearing for the Installation of a Stop Sign on Salem Drive for April 17, 2002 for at 8:15 PM; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ADDED ITEM Set Public Hearing -Amending Chapter 231, Water emergency The Town Attorney, William Maker explained this legislation would allow for the Code Enforcement by more than just the police, and was being drafted because of the added burden now caused by the drought emergency which will increase the load. A public hearing would have to be set on the adoption. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on amending the Town Code Chapter 231, Water for April 17, 2002 at 8:15 PM; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. 9 April 3, 2002 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 5. Designation of Hearing Officer - Police Department The Administrator said the Chief of Police has preferred charges against Police Officer Alexander Gizzo and according to the Town code when this is done a hearing officer is appointed to review the charges. This officer is appointed by the Board of Police Commissioners. He recommended Anthony Grant be appointed as the hearing officer. The Board then adjourned and reconvened as a Board of Police Commissioners, then following discussion, on motion of Commissioner Odierna, seconded by Commissioner Wittner, it was RESOLVED, that the Board of Police Commissioners of the Town of Mamaroneck does hereby appoint Mr. Anthony Grant to hear disciplinary charges preferred against Police Officer Alexander Gizzo. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 6. Salary Authorization - Highway Department Mr. Altieri said four people had been interviewed for the position of laborer in the Town's Highway Department. He recommended the Town authorize the hiring of Michael Povia, his experience includes grounds upkeep, carpentry and repair of small machinery, and has experience operating dump trucks and snow plows. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to Michael Povia, in the amount of $29,455.00, for his services as a laborer in the Highway Department effective April 15, 2002. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ADDED ITEM 7. Adoption - PBA Collective Bargaining Agreement 10 April 3, 2002 Mr. Altieri explained and recommended the renewal of the contract with all the changes. There was a change to the work schedule to help reduce overtime, and amendments to insurance and pensions for those newly hired. On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the agreement between the Town and the Town of Mamaroneck Police Benevolent Association for the years 2001, 2002, and 2003; and BE IT FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye The Supervisor and Board members all commended the Administrator for his work on the contract, stating they felt this was a fair and equitable contract. APPROVAL OF MINUTES -January 23, 2002 On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meeting of January 23, 2002 as amended. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ORAL COMMUNICATIONS George Roniger said he was here on behalf of the Larchmont Garden Civic Association, then asked in the face of the new regulations caused by the drought, does the Town have anyone to enforce the regulations. Mr. Altieri said the new code enforcement officer had started today. Mr. Roniger said there were several members who were pleased with the new pooper scooper signs, but said they do need some placed around the brook. Mr. Roniger speaking for only himself then said he had problems with the sizes of houses being built, Zoning Board should not be allowed to issue the variances, especially without seeing the impact to himself and at least two of his neighbors. The Supervisor replied the Board was looking at adoption of a more stringent floor area law. The Town Attorney added the law was presently being reviewed by the Planning Board. Mr. Roniger then said the Board should look closer at the people they have appointed to the Zoning Board. 11 April 3, 2002 SUPERVISOR REPORTS The Supervisor asked the Administrator to update us on organic waste. Mr. Altieri said the garbage men will first take the garbage then make a return trip to retrieve the organic waste. He said green stickers have been placed to inform residents when they have improperly bagged materials. He said residents should register their gardeners to allow then to bring materials to the Town garage, anyone with questions should call. Supervisor O'Keeffe said Westchester County called a meeting to discuss the drought situation, they set up a hot line at 914-813-5436 and email can be sent to LLG7 @Westchester.gov. We are presently in a drought emergency, stage one, which means there can be no water main flushing, vehicle washing by hoses, these measures will be enforced by local police and the Town is expanding the number of people able to enforce these measure. There will be fines levied. There then followed a long discussion on the drought. REPORTS OF THE COUNCIL Councilwoman Wittner attended a fire council meeting and they announced a Memorial Day observance at Memorial Park to be sponsored by the American Legion on Monday, May 27. ADJOURNMENT The Supervisor said that the next scheduled meetings would be April 17 and May 1, 2002. On motion of Councilwoman Wittner, seconded by Councilman Odierna meeting was adjourned at 9:50 PM.
