COMMISSIONERS HELD ON MARCH 20, 2002 AT 8:15 PM IN THE
COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST

CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25
PM, who then pointed out the location of exits.
PRESENTATION -Westchester Joint Water Works -John Hock, General Manager
The Supervisor introduced John Hock, Manager of Westchester Joint Water Works( WJWW).
Mr. Hock said WJWW had been in existence since 1927 and was formed by the Town/Village
of Harrison, Town of Mamaroneck and the Village of Mamaroneck as a non-profit benefit
corporation. Revenues are generated and allocated according to use - meaning if the Town
of Mamaroneck uses 20% they then receive that percentage of revenues. The water is
bought from New York City and there are three water supply systems: Croton, Catskill, and
Delaware. The water moves down to us through two aqueducts to Kensico then from there
to Yonkers. They serve a population of 47,500, and have recently acquired a new wholesale
customer in Silver Lake.
Councilwoman Myers asked how the water actually gets pumped back to us. Mr. Hock said
by gravity not pumps which move downhill to us through Weaver Street.
Mr. Hock displayed maps, showing shaft connects and the water paths. He submitted a
report showing usage, and the recent, as well as historic periods of drought and steps taken
during those periods. (Attached at end of minutes)
The Board and Mr. Hock then discussed the drought situation and the Supervisor read the
emergency tactics being put into place during this phase:
The County of Westchester has declared a Phase I Drought Declaration.
Residents of the Town of Mamaroneck are asked to restrict wasteful,
inefficient, or non-essential use of water.
Therefore, effective immediately:
The use of hoses for street, driveway, sidewalk and/or automobile washing
is prohibited. (Washing a car with a bucket, however, is permitted.)
Lawn watering will be restricted to the hours of 5:00 AM and 9:00 A.M. and
7:00 P.M. and 9:00 P.M. only. An odd/even calendar day schedule will be
followed. Odd-numbered addresses may water lawns on odd-numbered
calendar days only, and even-numbered address on even- numbered

calendar days only. Houses with no addresses may water on odd-
numbered days.
All lawn watering will be prohibited when 0.1 or more inches of precipitation
is reported within the previous 24-hour period.
Water may be used to irrigate gardens, provided that one of the following
methods is used. a hand-held container, a drip irrigation system (including
soaker hose "leaky pipe"and emitter-type systems); or a hand-held hose
with an automatic shut-off device.
Use of water to clean building exteriors is prohibited.
Washers should be replaced in leaking faucets. Tenants should report leaks
to landlords and superintendents.
Swimming pools may not be filled more than once per year, with make up
water added as necessary. Should a Phase II Drought be declared,
however, private pools may not be filled. All pools must be equipped with a
recirculation filter. The use of children's wading pools is not restricted.
Don't let tap water run while shaving, brushing teeth or washing dishes.
Reduce time spent in the shower, and fill the bathtub only halfway.
Install water saving devices like low flow showerheads or flow restrictors
on sink faucets. Don't let tap run for cold water. Keep a container in the
refrigerator.
Don't use toilets as wastebaskets. Each unnecessary flush can waste 1.6 to
5 gallons of water.
Run only full loads in washing machines and dishwashers.
Plant drought-resistant trees, plants, and grasses.
Residents who violate the above restrictions by wasteful, inefficient or non-
essential use of water can be fined a maximum of$100 for the first offense,
$500 for the second offense, and$1,000 for the third or any subsequent
offenses.
The Supervisor and Board all thanked Mr. Hock for his presentation.

The meeting was called to order by Commissioner O'Keeffe at 9:20 PM.

2. Authorization - Transfer Funds - Purchase Ambulance
The Administrator explained .

RESOLVED, that the Board of Fire Commissioners hereby
authorizes the Comptroller to transfer$8,000 from
to for the purchase of a1994 Ford Ambulance
from VAC.

AFFAIRS OF THE TOWN
1. Appointment - Marriage Officer
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED. that the Town Board of the Town of Mamaroneck
pursuant to Domestic Relations Law Section 11 (c) does
hereby appoint Valerie Moore O'Keeffe as Marriage Officer,
with authorization to solemnize marriages until the end of her
term of office, December 31, 2003; and
BE IT FURTHER
RESOLVED that this resolution shall be filed in the Town
Clerk's office.

2. Approval of Certiorari
The Attorney explained the proposed settlements and recommended approval.

3. Set Public Hearing -Amendments to Parking Permit Regulations for Parking Lots 1 & 3
Mr. Maker explained the request to amend the regulations governing the issuance of parking
permits in lots 1 and 3. Specifically, in lot 1, a meter permit holder would be permitted to
apply two vehicle license numbers to the same permit. Those permit holders requesting this
option would pay an additional fee of$10, in the past only one plate was allowed so residents
would end up buying multiple permits. In parking lot 3, a limitation would be imposed which
would limit issuance of one permit per household to one 24 hour parking permit to each
household. Baldwin Avenue would be included as a part of parking lot#1 for resident meter
parking. We have discovered that these amendments will require a change in the Town's
local law on parking lots. Therefore, at your April 3 meeting, Council will provide a draft local
law for your consideration and to set a public hearing.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby set the date
for public hearing on amending Parking Permit Regulations
for Town Lots 1 and 3 for April 3, 2002 at 8:15 PM in the Court
Room of the Town Center; and
BE IT FURTHER,
RESOLVED, that the Town Clerk be authorized to publish the
notice of said hearing in a newspaper appointed as an official
source, and that notice be so posted.

4. Authorization - Engineering Services - Hommocks Park Ice
Mr. Altieri explained authorization was being requested to obtain engineering services to
design the layout for player benches, penalty boxes, and timekeeper's box at the Hommocks
Ice Rink. The Mamaroneck Youth Hockey Association has proposed changes to the design
of these facilities. In most hockey rinks, the player benches have two gates for players to get
on and off the ice during a game, but at Hommocks Ice Rink each player bench only has one
gate. This proves to be cumbersome for the younger players who are unable to climb over
the dashboards onto the ice. In order to accomplish the redesign of the player benches it will
be necessary to create a second level for the timekeeper's box. Also, the player penalty
boxes would be slightly expanded for older hockey players. MYHA has proposed this project
and is prepared to bear all costs for materials and labor to construct the improvements which
they estimate will be about $15,000. Because this is a Town facility, and the Town will
ultimately bear responsibility for the upkeep and maintenance of the improvements, the
preference is that a set of design drawings be prepared for this project. The design drawings
will establish a permanent record of the specifications for the construction. MYHA has asked
if the Town would bear the costs for the design of the improvements. The Town has received
three proposals for engineering services to prepare the structural design, details, notes, and
drawings for the proposed ice rink improvements. Below is a list of the proposals received:

2. Lawrence Gordon Architects, Larchmont, New York $5,100.00
3. Ainso and Associates, Pelham, New York $5,600.00

He recommended authorization to execute an agreement and award the bid to Grigg and
Davis Engineers for the design and improvements to the Hommocks Ice Rink.
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby approve the
agreement between the Town and Grigg and Davis Engineers
for engineering services for the design and improvements to
the Hommocks Ice Rink at a cost to the Town of$2,690.00; and
BE IT FURTHER
RESOLVED, that the Town Administrator is hereby authorized
to execute said agreement on behalf of the Town.

5. Authorization - Collection of Town and County Property Taxes
Mr. Altieri explained authorization by the Town Board was necessary to allow for the
collection of annual Town, County and Judicial taxes. The County property tax is assessed
in each community based upon the community's percentage of the total full property
assessed value for the County of Westchester. For the 2002 tax year, the Town's assessed
valuation is 5.2% of the County total. Therefore, this year the Town will collect $24.9 million in
Westchester County taxes. This represents an increase of 4% over 2001. For a resident with
an average property assessment of$20,000.00, their County tax bill in 2002 will be
approximately $3,000.00. This is an increase of 3.5% over 2001. In addition to the tax warrant,
Mr. Altieri also attached a copy of the breakdown of all property tax rates for 2002.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the following was
adopted:

You are hereby commanded pursuant to the provision of the Westchester
County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, and also
pursuant to resolution of the Town Board of the Town of Mamaroneck adopted
March 20, 2002, by authority of Chapter 313 of Laws of 1934, to receive and
collect from the several persons named in the Assessment Roll hereunto
annexed by the Westchester County Tax Law, Article 16, Chapter 852 of the
Laws of 1948, as amended, for the neglect to pay the Judicial, County, Town
and Town District Taxes, charges for services, exemptions removed, and
water arrears after the levy thereof as follows:

County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, the
reports provided for therein.
And you are further directed and commanded to proceed as directed and
authorized by said Westchester County Tax Law, Article 16, Chapter 852, Laws
of 1948, as amended.
And in case any person named in said Assessment Roll shall neglect or refuse
to pay his taxes or penalties (after giving the notices and waiting the time as

penalties with the costs and charges of such collections in the manner
provided by the Westchester County Tax Law, Article 18, Chapter 852 of the

6. Authorization - Resolution - Designation of Polling Places
The Town Clerk explained this was a resolution designating polling places for the upcoming
Primary and General Elections in 2002.
On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was

7. Salary Authorization - Recreation

RECREATION
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that as provided for in the 2001 Town Budget
that the Town Board does hereby authorize the payment of
salary to the following:
Lester Wauchope, Tennis Court Attendant, Memorial Park, $11.25 per hour,
effective 3/25/02.
Raymond Varian, Tennis Court Attendant, Memorial Park, $9.75 per hour,
effective 4/1/02.
Catherine Engstrom, Tennis Court Attendant, Memorial Park, $8.75 per
hour, effective 4/1/02.
Shaft Ammann, Skating Instructor, Hommocks Park Ice Rink, $16/session,
effective retroactive to 3/1/02.

BUILDING DEPARTMENT
Mr. Altieri explained that authorization was being requested to hire Joseph Saracino to serve
as a part time Code Enforcement Office for the Town. He will work approximately 20 hours
per week including some weekends.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the Town Board does hereby authorize the
payment of salary to Joseph Saracino, in the amount of
$15.00 per hour, for his services as Code Enforcement
Officer effective immediately.

ADDED ITEM
8. Authorization - Resolution - Davids Island
The Supervisor explained that the Town had received a letter from Mayor Idoni from the City
of New Rochelle asking the Town to pass a resolution in support of the County purchasing
David's Island and designating it as parkland.
Councilwoman Seligson said that this was a dream come true to hear that Westchester
County would like to purchase Davids Island as a park.
Following discussion, on motion of Councilwoman Wittner, seconded by Councilwoman
Seligson, the following resolution was adopted.
RESOLUTION REQUESTING THE STATE LEGISLATURE TO
INTRODUCE AND SPONSOR A BILL TO PERMIT
CONVEYANCE OF DAVIDS ISLAND TOGETHER WITH A
UTILITY EASEMENT CROSSING DAVENPORT NECK, BEING
WATERFRONT PROPERTY, TO THE COUNTY OF
WESTCHESTER.
WHEREAS, the City of New Rochelle owns a piece of property
located in Long Island Sound known as Davids Island; and
WHEREAS, the City of New Rochelle obtained ownership of
Davids Island from the United States Government, which had
previously used the Island as an army base known as Fort
Slocum; and
WHEREAS, the City of New Rochelle has entertained various
proposals for the redevelopment of the Island over the past
thirty years, including a nuclear power plant; high-rise, high-
density residential; and a private enclave for wealthy
residents, none of which have come to fruition; and

WHEREAS, the City of New Rochelle and the County of
Westchester began a joint study of the possible re-use of the
island, which included commercial mixed use, residential and
parkland possibilities; and
WHEREAS, it was determined by the City of New Rochelle
and the County of Westchester that the highest and best use
for Davids Island is for parkland; and
WHEREAS, the State of New York has previously indicated
that Davids Island meets the criteria of its Coastal
Management policies, which emphasize open space and
public accessibility along the waterfront of Long Island
Sound; and
WHEREAS, to best effectuate the plan for Davids Island to
remain open space/parkland in perpetuity, the City of New
Rochelle and the County of Westchester have announced the
sale of Davids Island from the City of New Rochelle to the
County of Westchester; and
WHEREAS, a utility easement crossing Davenport Neck must
also be conveyed to the County of Westchester, and
WHEREAS, the laws of the State of New York require the
State Legislature pass legislation allowing for the sale of
municipality-owned waterfront property to another
municipality; and
WHEREAS, during 1989 and 1990 the Town of Mamaroneck-
Village of Larchmont Coastal Zone Management Commission
advocated for adherence by potential developers and the City
of New Rochelle to the New York State Coastal Management
Program; and
WHEREAS, the proposal by the County of Westchester to buy
Davids Island for park purposes is in conformity with the
Mamaroneck-Larchmont Local Waterfront Revitalization
Program Policies 2, 9, 18, 19, 20, 22, 23, 25 and 44; and
WHEREAS, the concept of Westchester County buying
Davids Island first surfaced in 1994 with the proposal to
connect Davids Island with the County owned Glen Island
Park by ferry; and
Whereas, this Town Council continues to advocate for Davids
Island use as a park connected to the mainland by ferry
service.
NOW THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Mamaroneck
hereby respectfully requests the State Legislature introduce
and sponsor a bill, in the suggested form attached hereto, to
permit conveyance of Davids Island together with an existing
utility easement crossing Davenport Neck, being waterfront
property, to the County of Westchester; and
BE IT FURTHER
RESOLVED, that the Town Clerk is hereby directed to
forward certified copies of this resolution to Governor George
E. Pataki and our representatives in the State Assembly and

ORAL COMMUNICATIONS
Councilwoman Myers reminded everyone that Friends in Need (FIND) would be sponsoring a
charity hockey game, Moms versus Dads, on Saturday, April 6 at 5:30. The proceeds will
benefit the families who live in our community who were affected by the September 11
tragedy. She also stated that the Larch mont/Mamaroneck Tennis team would be starting up.
Try outs will be held on April 3, 4 and 5 at Flint Park in the morning. Matches will begin April
16. She mentioned that they had a very interesting Traffic Committee meeting and that she
attended the UN Association USA Group presentation.
Councilwoman Seligson attended the Beautification Committee meeting and discussed
plantings for the spring for consideration to the water shortage.
Councilman Odierna had been on vacation. He reported that there would be a Human Rights
meeting on Monday and that the Supervisor attended the Recreation Commission meeting in
his absence and said the Hommocks pool was scheduled to open April 1. He also reported
that there were four concerts being scheduled for this summer. Councilman Odierna
thanked LMC TV for the great coverage of the Town Board meetings and also mentioned the
deadline for the video contest was May 20 at noon.
The Supervisor said that the Larchmont Senior Center Art Show is being displayed at the
Library.
Councilwoman Wittner reported that the D.A.R.E. Ceremony was a pleasure to attend. The
entire police department supports the program and commended Officer Tom Houlihan for his
efforts. She congratulated the new Board members at the Village of Larchmont.
The Supervisor thanked the outgoing members of the Board of Trustees from Larchmont,
Trustee Ned Benton, Trustee Anne McAndrews and Mayor Cheryl Lewy for their service to
the community and welcomed Ken Bialo and new Board members and was looking forward
to working with them.

The Attorney thanked the Highway Department for installing the signs for the pooper scooper
law.
Councilwoman Wittner asked Mr. Altieri about residents who are using black plastic bags for
organic waste.
Mr. Altieri stated that next week residents will be receiving a flyer regarding organic waste
and leaves. These items must be placed in recyclable paper bags or in an open container.
No plastic bags will be accepted. This collection would take place on the second collection
day. He requested that residents notify the Town to register their gardener's names and
phone numbers so that they would be able to take the waste to the Town yard. There is no
fee for this registration or for dumping. The hours permitted for dumping are from 8:00 AM to
3:00 PM weekdays (no Mondays) and 8:00 AM to Noon on Saturday. Mr. Altieri also
mentioned that leaf blowers cannot be used from June 1 through October 15.
Mr. O'Gorman stated that the staircase located at the paper recycling area is in disrepair and
needs to be fixed.
The Supervisor updated the board on the airplane noise, saying she had talked to Nita
Lowey, who has received a reply on the questions submitted to them. She reported that
there would be a poetry reading on Monday at 7:30 PM at LMC TV.
ADJOURNMENT
The Supervisor said that the next scheduled meetings would be April 3 and April 17,2002.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers the meeting was
adjourned at 10:30 PM.
