OF THE TOWN OF MAMARONECK HELD ON NOVEMBER 20,
2001 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER,
740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30
PM, who then pointed out the location of exits.
AFFAIRS OF THE TOWN
1. Authorization -Architectural Services Agreement - Police Headquarters
The Administrator explained that the Town Police Department is a sixteen year old facility
and it has become necessary to do renovations to several areas. A feasibility study has been
submitted by A. R. Bacon Architecture, P. C. in the amount of$9,450 for their services.
Councilwoman Myers asked if this was just a feasibility study. Mr. Altieri said yes.
Councilwoman Seligson asked if this cost was just to address the renovation issues. Mr.
Altieri said it was.
Councilman Odierna asked if this item could be put out for bid. Mr. Altieri said that this was
not a bid item since it did not involve construction costs.
A brief discussion followed. The Town Board decided that they would like to see more than
one estimate before making a decision. This item was deferred until December 5.
2. Set Public Hearing -Amendment to Zoning Ordinance - Regulation to Air Conditioners
Mr. Altieri explained that the Town Planning Board has reviewed the proposed amendment to
the Town Zoning Ordinance regarding the installation of air conditioning units. Existing
central air conditioning units shall not require a building permit or a letter of completion from
the Building Department. A replacement unit shall not require a building permit or a letter of
completion from the Building Department if such unit is not larger in cubic feet than the unit
it replaces and does not sit on a pad or other artificial surface whose square footage is
larger than the pad or other artificial surface on which the unit which it replaces sat. All other
central air conditioning units shall require a building permit and a letter of completion from
the Building Department.

On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby set the date
for public hearing on the Amendment to the Zoning
Ordinance for the Regulation of Air Conditioners for
December 5, 2001 at 8:15 PM in the Court Room of the Town
Center; and
BE IT FURTHER,
RESOLVED, that the Town Clerk be authorized to publish the
notice of said hearing in a newspaper appointed as an official
source, and that notice be so posted.

3. Salary Authorization - Recreation
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that as provided for in the 2001 Town Budget
that the Town Board does hereby authorize the payment of
salary to the following:
Jeremy Lynch, Lifeguard, Hommocks Pool, $8.25 per hour, effective
retroactive to 11/2/01.
Peter Hooke, Lifeguard, Hommocks Pool, $7.50 per hour, effective
retroactive to 11/2/01.
Sean Bave, Lifeguard, Hommocks Pool, $6.50 per hour, effective
retroactive to 11/2/01.
Peter deVoogd, Instructor, Youth Hockey Program, $8.00 per hour,
effective retroactive to 11/10/01.
Scott Smith, Assistant Instructor, Youth Hockey Program, $6.00 per hour,
effective retroactive to 11/10/01.
Jeff Warren, Assistant Instructor, Youth Hockey Program, $6.00 per hour,
effective retroactive to 11/10/01.
Paul Tucker, Assistant Instructor, Youth Hockey Program, $5.00 per hour,
effective retroactive to 11/10/01.
Mark Merl, Assistant Instructor, Youth Hockey program, $5.50 per hour,
effective retroactive to 11/10/01.

Mr. Altieri explained that the Hommocks Pool would be closed from January 1 through March
31, 2002 for repair work.

4. Resolution to Change Town Board Meeting Dates
The Supervisor stated that it would be necessary to change the Town Board meeting dates in
January 2002 from January 2 and 16 to January 9 and 23. The swearing in ceremony would
be held at the January 9 meeting.
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the regular meetings of the Town Board
originally scheduled for January 2 and January 16, 2002 be
changed to January 9 and January 23, 2002 in the Court
Room of the Town Center, 740 West Boston Post Road,
Mamaroneck at 8:15 PM.

The Supervisor told everyone that Mr. & Mrs. Epstein had donated an American flag which
was on the wall outside the court room in honor of Mrs. Epstein's father who served in World
War II and also in memory of those lost in the World Trade Center tragedy of September 11.
APPROVAL OF MINUTES - September 19, 2001

On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
unanimously
RESOLVED, that the Town Board does hereby approve the
Board minutes from the meeting of September 19, 2001 as
amended.
On motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was
unanimously
RESOLVED, that the Town Board does hereby approve the
Board minutes from the meeting of October 3, 2001 as
amended.
WRITTEN COMMUNICATIONS
The Supervisor then read the following letter from the Westchester Municipal Officials
Association regarding Bill S.4744. This bill would let Westchester County regulate taxi and
livery vehicles. The Supervisor said that she would like the Board to pass a resolution
allowing her to write to the Governor asking him to veto this bill.

re: S.4744 - Veto Recommended
Dear Mr. McGuire:
The Town of Mamaroneck in Westchester County, NY, strongly opposes S.4744.
This bill would provide authority to the counties of Westchester, Putnam and
Rockland to regulate taxicabs, limousines and livery vehicles and would
supersede local laws or ordinances adopted by a City, Town or Village located in
such counties.
As you know, the municipalities in Westchester County currently have the
responsibility for the regulation of taxicabs, limousines and livery vehicles. This
proposed bill would usurp municipal home rule. For many communities the
authority to regulate and license taxicabs and limousines is extremely important
in order to ensure good service for their residents. For example, municipalities
through this authority are able to regulate the appearance and condition of cabs,
cleanliness of cabs, service levels, rates and consumer complaints ranging from
discourtesy to outright discrimination in the selection of passengers. This
proposed bill would instead give this authority to the County which may not be
able to devote the same amount of time and effort to the consumer friendly and
civil rights issues that many municipalities can.
For this reason, the Town of Mamaroneck opposes this bill and recommends that
it be vetoed.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby authorize a
letter be written to Governor Pataki requesting that he veto
Bill S.4744; and
BE IT FURTHER
RESOLVED, that the Town Supervisor is hereby authorized to
execute said document on behalf of the Town.

ORAL COMMUNICATIONS
Betty Miller, Larchmont Gardens Civic Association President, addressed the Board. She
asked about the progress of the lighting project for the island in the lake.
Mr. Altieri said that the electrical work would be completed by next week.
She then asked about the schedule for leaf pick up.
Mr. Altieri said that the Highway Department was working overtime to pick up the leaves and
this should be completed by the week before Christmas. Pick ups were scheduled between
October 15 and December 15 and that there would be three to four pickups per street. The
Town has seven trucks, two payloaders and twenty highway employees working on leaf
pickup.
A brief discussion followed on the dumping of leaves into the lake and other areas around
the Town.

Ms. Miller wished everyone on the Board a happy Thanksgiving.
Councilwoman Myers reminded everyone about the Community Walk being held November
24 at 1:00 PM. There will be pre-registration on Friday, November 23 from 11:00 AM to 3:00
PM. The fee at that time is $10 per person. Pre-registrants will receive a free T-shirt. If not
pre-registered the fee will be $15 the day of the walk. There is also a family fee of$35. The
purpose of this walk is to raise funds to help the local Larchmont and Mamaroneck families
who were directly impacted by the World Trade Center tragedy. This event is being
sponsored by FIND (Friends in Deed). It is a 2.3 mile walk. Walkers are looking for sponsors.
Corporate sponsors and donations are welcome. Free refreshments will be served
afterwards.
The Supervisor thanked Councilwoman Myers and the Youth Council for efforts in organizing
this event. She also thanked Mr. Altieri for his help in coordinating the walk.
The Supervisor reminded everyone that on Sunday, December 2 at 6:00 PM LMC TV would
be sponsoring a dinner at the Larchmont Yacht Club honoring Beverly Brewer-Villa. The
Supervisor read the following certificate of recognition:
CERTIFICATE OF RECOGNITION
BEVERLY BREWER-VILLA
BEVERLY BREWER-VILLA is a real friend to the Mamaroneck community.
BEVERLY is the President of the Community Action Program Center in the Village
of Mamaroneck. She also sits on the Board of the Hispanic Resource Center, is
involved with the Local Summit and has held various positions with the
Washingtonville Housing Alliance and the Mamaroneck Senior Housing Center.
BEVERLY is held in high esteem and affection by her fellow workers and the
people she has served.
Today, because of BEVERLY BREWER-VILLA 'S knowledge, professionalism,
creativity and her outstanding contribution to the Larch mont/Mamaroneck
community she is being honored and presented with the 2001 SUNNY AWARD
from LMC/TV.
NOW THEREFORE, BE IT
RESOLVED, that I Valerie Moore O'Keeffe, Supervisor, and members of the Town
Council of the Town of Mamaroneck hereby present this Certificate of Recognition
to BEVERLY BREWER-VILLA to honor and recognize her for her service to our
community.
IN WITNESS WHEREOF, I have hereunto set my band and caused the seal of the
Town of Mamaroneck to be affixed this 2"d day of December 2001.
REPORTS OF COUNCIL
Councilwoman Seligson said that the Planning Board had met after their budget meeting to
review freshwater wetlands permits and review the proposed air conditioning law.
Councilman Odierna said that the Recreation Commission had reviewed requests for use of
the fields. He mentioned that all were invited to the "skate with the characters" program at
the ice rink.
Councilwoman Wittner said that all of her meetings were scheduled for next week. She also
mentioned that the Larchmont Seniors held a very successful bazaar.
The Supervisor stated that the Board had met with Diane Courtney and Bill Dentzer from the
Larchmont Library regarding the library budget. She also mentioned that there would be a

joint meeting in February to further discuss the library budget, that the Library was
celebrating its 75th anniversary and that circulation in the library has risen.
Councilman Odierna thought it might be a good idea to do something on Thanksgiving for
seniors who did not have family and had no place to go. He asked the viewing audience if
anyone had ideas regarding this matter.
The Supervisor thanked the Weaver Street Fire Department for cooking and delivering
Thanksgiving dinners in the community. Community Services also assisted in delivering the
dinners.
Councilman Odierna thought it might be fun to have a "hot chocolate and cookie party" for
the tree lighting ceremony at the lake.
Mention was made of the ribbon cutting ceremony for the new playground at Memorial Park
on Saturday, December 1, at 9:30 AM.
ADJOURNMENT
The Supervisor said that the next scheduled meetings would be December 5 and December
19, 2001.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the meeting was
adjourned at 9:15 PM. A Happy Thanksgiving was wished to all.
