BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. Oral Communications - Dr. Alan Mason gave an update about the computerized flood control device at the Larchmont Reservoir. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:55 PM. Present were the following members of the Commission: Commissioner: Valerie M. FIRE REPORT FOR THE MONTHS OF SEPTEMBER AND OCTOBER 2001 Commissioner Wittner read the following reports submitted by Chief Michael Acocella which outline responses to calls made during the months of September and October. They summarize the nature and origin of calls, the number of personnel responding and the total times spent at fire calls. FIRE REPORT FOR THE MONTH OF SEPTEMBER NATURE OF CALLS: GENERAL 40 MINOR 13 STILLS 01 OUT OF TOWN 00 MONTHLY DRILL 01 EMS 16 TOTAL 72 TOTAL NUMBER OF MEN RESPONDING: 692 TOTAL HOURS RESPONDING: 54 HOURS AND 51 MINUTES FIRE REPORT FOR THE MONTH OF OCTOBER NATURE OF CALLS: GENERAL 36 MINOR 10 STILLS 00 OUT OF TOWN 01 MONTHLY DRILL 01 EMS 14 TOTAL 62 TOTAL NUMBER OF MEN RESPONDING: 570 2 November 7, 2001 TOTAL HOURS RESPONDING: 22 HOURS AND 01 MINUTES Commissioner Wittner read the following announcement: On Sunday, November 11, 2001 the Town of Mamaroneck FD will be participating in" Say Thanks to a Hero" luncheon. The National Hotel and Restaurant Trade Show at the Javits Convention Center in New York is sponsoring a culinary event to raise funds for The World Trade Center Relief Fund and The NYC Firefighters Widows and Children's Fund. A Team from our Fire Department is one of six culinary teams to prepare and demonstrate, in front of an audience, a gourmet meal for 50 people. Tickets for the event have been pre-sold to show participants and sponsors for$100.00 each, who will feast on our delights and have a chance to meet and chat with Emergency Service Workers that were involved with the incident of September 11. This event will take place over 4 days and raise $120,000.00. The members of our Department have donated the funds to purchase the food and necessary supplies. Our menu will include: Pumpkin Soup Grilled Quail Wild Rice with Cranberry and Pine Nuts Glazed Acorn Squash Tangerine - Pomegranate Relish Please wish us luck in our efforts. Channel 12 News has promised to cover the event. AFFAIRS OF THE TOWN 1. Authorization - Settlement of Certiorari On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby authorize the settlement of the following certiorari as recommended by the Town Attorney, William Maker, Jr.: Sebastian Contarino 115 Halstead Avenue Block: 901 Lot: 100 Year Assessment Reduced To Amount of Reduction 1999 $32,900 $23,800 $9,100 2000 $32,900 $22,000 $10,900 The Town will refund approximately $250.00. The School district will refund (or not collect) approximately $8,400.00. James A. Jackson 426 Center Avenue Block: 825 Lot: 379 Year Assessment Reduced To Amount of Reduction 1999 $48,600 $43,600 $5,000 2000 $48,000 $43,600 $5,000 3 November 7, 2001 2001 $48,000 $43,600 $5,000 The Town will refund approximately $150.00 for the years at issue. The School district will refund (or not collect) approximately $6,351.15. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 2. Authorization -Westchester County DWI Agreement Mr. Altieri explained that this was the renewal agreement between the County of Westchester and the Town for reimbursement of overtime in connection with the enforcement of DWI statutes. The County shall reimburse the Town in the amount of$11,400 for this enforcement activity. There is no increase in the funding for 2002. Authorization is requested to execute this agreement on behalf of the Town. On motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the agreement between the Town and the County of Westchester as amended to receive reimbursement for enforcement of DWI regulations; and BE IT FURTHER RESOLVED, that Westchester County will reimburse the Town to a maximum of$11,400 in 2002. NOW THEREFORE, BE IT FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization - Transfer of Funds - Capital Project#20-03 The Administrator said the sidewalk construction authorized by the Town Board in the above referenced capital project needs a final transfer of funds. He requested authorization to transfer$30,089.78 from the Highway Reserve Fund to Capital Project No. 20-03. On motion of Councilwoman Seligson, seconded by Councilman Odierna, it was RESOLVED, that the Town Board hereby authorizes the Comptroller to transfer$30,089.70 from Highway Reserve Fund to Capital Project No. 20-30 for sidewalk construction. Resolution - Standard Work Hours - Retirement Benefit The Administrator explained that according to the New York State retirement law, all municipal employees, whether they are part time or full time are eligible to receive retirement benefits. The part time employees are offered the membership in the retirement system as an option. The municipal employer, however, must establish a standard for crediting part time employees with retirement benefits. The retirement law further allows a municipal employer to designate between six and eight hours a day as the standard work hours for all appointed part time employees for purposes of retirement calculation. It is recommended to the Town Board that a resolution be adopted establishing six hours per day as the standard work hours for appointed part time employees. There was some discussion on the impact this would have and who would actually be effected by it. The Supervisor asked if a part timer were to work seven hours a day two days a week, would they be eligible. The Administrator replied it was based on credit for a service benefit and the numbers would be averaged out. This was just to establish a standard for the number of hours a part timer works. Following further discussion, on motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby establish six hours per day as the standard work hours for appointed part time employees. Request for Voting Machines - Mamaroneck Library The Town Clerk explained this is the yearly request from the Village of Mamaroneck Library to borrow two voting machines for their budget and trustee vote. She added that all costs for their use will be paid by the library. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the use of two voting machines to the Mamaroneck Library for the budget proposition and the election of three trustees on December 11, 2001. Set Public Hearing -Amendment to Local Law No. 4- 1998: Regulating Food Establishments Mr. Maker explained this amendment would modify the local law to include in the codification what are now just footnotes. There are footnotes which would be repealed and they would be assigned numbers. You will recall the confusion created recently by the footnotes that appear in sections 230-25,230-30 and 240-31 of the Codebook. We determined that the reason for the footnotes is that when Local Law No. 4 1998 was enacted, two of its sections were not given either alphabetical or numerical designations so that they could be added to a specific section of the Code. One of them is entitled "Pre- existing Food-Related Retail Business". We questioned whether it is in the best interest of the Town to retain that provision since it exempts preexisting food related establishments from the scope of the Local Law. He said the law requires site plan review for any expansion of the size of the building, the seating capacity or the parking area of a food related retail business established after the Local Law's effective date. A pre-existing establishment which wants to expand would not be subject to the review required by the Local Law however. The second footnote entitled "Penalties" provides for the fines that can be imposed for violations of the Local Law. The amendment would wipe out the exemption and adds a penalty. Councilman Odierna said he remembers when this law was adopted and it was the intent to keep existing business exempt, so why are we now changing that provision. It was decided to set the public hearing and discuss it at that time. The Attorney said the amendment must be sent to the Planning Board for comment as required by law. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby forward to the Planning Board the amendment to Local Law No. 4- 1998: Regulating Food Establishments be referred to the Planning Board for their consideration. Salary Authorizations - Recreation Town Clerk's Office RECREATION On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that as provided for in the 2001 Town Budget that the Town Board does hereby authorize the payment of salary to the following: Michael Chiapparelli, Director, Youth Hockey, $4,050 for season from 11/10/01 to 3/12/02. Michael Chiapparelli, Alternate Instructor, Youth Hockey, $16/hour, effective 11/10/01. James Erdman, Assistant Director, Youth Hockey, $1,200 for season from 11/10/01 to 3/12/02. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye SUPERVISOR REPORTS Supervisor O'Keeffe thanked Ed Clarke for the picture he donated to the Town. The picture is a reproduction of a post card showing 904 Boston Post Road. Mr. Clarke hired an oil painter to reproduce it. There will be a ceremony where it will be presented. She also thanked Councilman Odierna for his donation of a huge flag which once hung over the Brooklyn Navy Yard, and Councilwoman Myers for all her work on the walk being sponsored by Friends in Need. She has been instrumental in the involvement of the Youth Council. Councilwoman Myers reminded everyone the community walk would be held at 1 PM on November 24, beginning at Mamaroneck High School. The proceeds are earmarked to help the nine Larchmont/ Mamaroneck families who lost loved ones in the World Trade Center tragedy. She said in addition, the Village of Mamaroneck was holding their annual Turkey Trot next Sunday, November 18, starts at Harbor Island. Councilwoman Wittner said she had attended the Human Rights Commission meeting, they had welcomed a Rye Neck School principal and discussed the possible role the Human 8 November 7, 2001 Rights Commission could play in bringing more diversity to the School Board Selection Committee. The Coastal Zone Management Commission had discussed two wetland referrals, they were difficult applications as they were for changes with the 100 foot buffer, and its hard for the Commission to make recommendations when the house is already built and intrudes into the 100 foot buffer area. Councilman Odierna said the Recreation Commission would be discussing access to Hommocks Field by the school, the request is on the agenda. Councilwoman Myers said the Board of Architectural Review was canceled because there were no applications. She said the Traffic Committee would be meeting next week. In response to a question, Mr. Altieri updated them on the Myrtle Boulevard project, saying the trees were all planted, installation was beginning on the street lights, the decorative sidewalk was poured and was unacceptable, therefore new pouring will begin on Monday. It should be finished by the end of November. Councilwoman Myers then read the following into the record: LARCHMONT MAMARONECK COMMUNITY WALK LARCHMONT, NY. -A community walk to benefit Larchmont and Mamaroneck families affected by the Sept. 11 terrorist attacks will be held at 1 p.m. on Saturday, November 24 starting at the Mamaroneck High School on Boston Post Road. The event, which includes both a 2.5 mile walk and a 1 mile kids'walk, is unique in that it is designed specifically to financially help eight local families who lost an immediate family member in the World Trade Center attack. The charity walk is being organized through Friends In Deed(FIND), a non-profit organization founded specifically to oversee this and other events to help the local families. Walkers will be asked to solicit sponsors fi)r their participation. Organizers hope to attract 1,000 walkers and raise $ 100,000 through participants and business sponsors. Participants can pre-register for the event on Saturday mornings at Citibank in Larchmont or Sound Federal Savings in Mamaroneck Registration forms and sponsor sheets are available at these locations, as well as on the Friends In Deed website at www. FINDLMC.org.
