HomeMy WebLinkAbout2001_10_17 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON OCTOBER 17, 2001 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. The 2002 Budget was provided to the Town Board for review at the October 17, 2001, work session meeting. AFFAIRS OF THE TOWN 1. Submission - Tentative 2002 Town Budget The Administrator explained since July Department heads have been preparing their tentative outline of requests for the 2002 budget. They were submitted and this document reflects those budget numbers. The highlights as proposed are an estimated expenditure totaling $21,360,000. These expenditures will require a tax levy of$13,429,770, revenues of $6,470,375 plus applying $1.4 million of surplus funds. He said the heaviest increase will be due to cost in health care costs and salaries. The increase amounts to 3.6% from the previous budget, for Town residents this averages to about a $126 per year increase in taxes. In the Villages of Mamaroneck and Larchmont the average increase will be approximately $4 per year over 2001. He said this budget provides for all services to continue in the current form, which the Board will review over the next several weeks. He added additional session may be necessary and is so will be announced. The Supervisor thanked him and reminded residents they were welcome to attend these budget sessions. 2. Petition - Removal of Hommocks Road from Westchester County Sewer District Mr. Altieri pointed out the Town had previously received a petition from a group of residents seeking to be removed from the Westchester County Mamaroneck Valley Sewer District. These residences are located in the unincorporated area of the Town and the Village of Mamaroneck. Residents on the petition are requesting removal from the Sewer District because they are not connected to, nor do they receive services from the municipal sanitary sewer systems of the Town, Village or County. He said the County Attorney's office had advised him of the procedures necessary to remove these properties from the district. The Town need only adopt a resolution and forward it to the County for their further action. Councilwoman Seligson commented it makes sense to remove them, but questioned whether there would be any chance they will be put on the system in the future and if that would be preferable. Mr. Altieri replied it was a difficult to assess, but since the properties in question are flat a pump would need to be provided for sewage, which has been avoided in the past. Councilwoman Wittner said there were other areas in the Town where the properties were not connected, would this resolution apply to them also. The Administrator said it would not. Councilman Odierna asked how many parcels would this resolution encompass. Mr. Altieri answered there are 35. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the following resolution was adopted: WHEREAS, the Westchester County Mamaroneck Valley Sewer District encompasses the Town of Mamaroneck, and WHEREAS, property owners within said sewer district are subject to Westchester County's sewer taxes, and WHEREAS, there are parcels of property located within the Town of Mamaroneck that are not serviced by sanitary sewers within the Mamaroneck Valley Sewer District, and WHEREAS, the Town of Mamaroneck Town Board urges the removal of these parcels from the Mamaroneck Valley Sewer District with said parcels being exempt from paying Westchester County Sewer Taxes, and WHEREAS, the Town Board has given this matter due consideration and finds the removal of said parcels to be in the best interest of the property owners. 2 October 17, 2001 NOW THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck Town Board hereby requests that the attached list of parcels be removed from the Mamaroneck Valley Sewer District thereby exempting them from paying the Westchester County Sewer Tax. (LIST OF PROPERTIES TO BE ADDED) DID NOT RECEIVE The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 3. Authorization - Transfer of Funds - Tree Fund Authorization was requested by Mr. Altieri to transfer funds in the amount of$3,000.00 from the Town of Mamaroneck Tree Fund, which are to pay for the cost of the fall tree planting program. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board hereby authorizes the Comptroller to transfer$3,000.00 from the Town of Mamaroneck Tree Fund Budget Account A8510.4178 to cover the cost of purchasing trees plus mulch and materials required for planting. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 4. Authorization - Settlement of Certiorari The Town Attorney explained that Ross Valenza, the former Town Assessor had negotiated this settlement of certiorari on behalf of the Town, the settlement provides for a $9,000 reduction for years 1999 and 2000. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby authorize the settlement of the following certiorari as recommended by the Town Attorney, William Maker, Jr.: Gjoko Shkreli and Lucy Shkreli 176 Myrtle Boulevard Block: 133 Lot: 642 Town of Mamaroneck 3 October 17, 2001 Year Assessment Reduced To Amount of Reduction 1999 $30,000 $21,000 $9,000 2000 $30,000 $21,000 $9,000 The Town will refund a total of approximately $2,700 for the years at issue. The School district will refund approximately $7,200.00. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 5. Salary Authorization On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that as provided for in the 2001 Town Budget that the Town Board does hereby authorize the payment of salary to the following: Nathaniel Hirshfield, Assistant Teen Night Supervisor, $45/night, gym, $35/night, Teen Center, effective 10/12/01. Tarara Musarell, Swim Instructor, change in salary from $18/hour to $20/hour. Wilma Tuusel-Dekock, Head Swim Instructor, change in salary from $20/hour to $21/hour. Brian Fay, Alternate Swim Instructor, $16.50/hour, effective 10/13/01. David Akin, Lifeguard, Hommocks Pool, $7/hour, effective 10/17/01. Albert Jenicek, Lifeguard, Hommocks Pool, $8/hour, effective retroactive to 10/6/01. Joshua Babb, Skating Instructor, Hommocks Park Ice Rink, $16/hour, effective 10/12/01. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ADDED ITEM Military Leave Mr. Altieri said this is not an issue with any of our employees right now but could become one in the future with two of our staff members. When an employee who is in the reserves is called to military duty, the Town is required to pay 22 days of full pay. It has been requested this be extended to at least 44 days while on leave from the Town. There is also an issue on when the salary difference is to be paid, but most municipalities have agreed to pay while the employee is on reserve duty. The Administrator recommended the salary for the pay differential be for six months, paid upon submission. On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the Town pay to their employees on have been put on active military duty, the differential in salary for a period not to exceed six months. The above resolution was put to a roll call vote: 4 October 17, 2001 Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Approval of Minutes On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meeting of July 18, 2001 as amended. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Councilwoman Myers read the following proclamation into the record: UNITED NATIONS WEEK WHEREAS, The United Nations was founded in 1945; and the anniversary of its founding is observed each year on October 24; and WHEREAS, following the events of September 11, 2001, the Secretary- General of the United Nations, the General Assembly, and the Security Council all condemned the terrorist attack on the World Trade Center, and called upon all states to work together to bring to justice the perpetrators, organizers, and sponsors, stressing that those supporting these perpetrators will be held accountable; and WHEREAS, the United Nations has a mandate to foster international cooperation in solving problems of an economic social, and humanitarian nature, and WHEREAS, if the United Nations is to continue its important work in the promotion of global health and the fight against infectious diseases, it must have the support from both the United States government and American citizens. NOW, THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck and the Town Boars members hereby proclaim the week of October 21 through October 28, 2001 as UNITED NATIONS WEEK IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 17'm day of October 2001. Councilman Odierna read the following proclamation into the record: SCHOOL BOARD RECOGNITION WEEK 5 October 17, 2001 WHEREAS, the members of New York's local school boards are community leaders who prove an invaluable resource as local decision makers; they respond to the respective needs of their communities, serving the interests of schoolchildren and preparing them for the future; and WHEREAS, during the week of October 22-26, 2001, it is fitting to support this annual celebration in recognition of the contributions of members of local school boards. Richard Carrol * Town of Mamaroneck Ambulance District Employee Supervisor O'Keeffe thanked all the volunteers who participated in the World Trade Center Disaster. REPORTS OF COUNCIL Councilman Odierna said on his recent visit to Canada he thought of the Myrtle Boulevard project wondering if it would be completed before the cold weather set in. The Administrator said the walks were done, benches were in, and they are waiting for the poles to be delivered. Councilwoman Wittner reported she had attended with her family the annual Firehouse Family day. Was a great day, well attended. She also mentioned that Friends of the Reservoir and The Life Center were combining their organizations and renaming it to Sheldrake Environmental Center. Councilwoman Myers reported a movement to organize a walk on the Saturday after Thanksgiving to benefit victims in our area from the World Trade Center. The walk is for 3 '/2 miles and asking for all residents to participate. She then inquired on the status of the Hommocks Pool, and asked if the staff is paid during close downs. Mr. Altieri said it was closed because of a problem with the filter system which was slated to be replaced in December, so Town is attempting to confirm dates for completion. As to the staff, the lifeguards are paid a certain number of hours to ensure they don't leave. Councilwoman Seligson reported the Planning Board had approved a special permit for the Cosi Restaurant in the Ferndale Shopping Center. She explained this chain is an upscale sandwich shop, will not overly stress the parking lot, and everyone seemed pleased about it. She said the Town would be accepted as a member of the Greenway at their next meeting. SUPERVISOR REPORTS Supervisor O'Keeffe said she had been invited to attend a meeting hosted by County Executive Spano to be briefed on the responsible handling of bio threats. Protocols had been worked out during the past few weeks, there is good infrastructure to deal with this. In case of an emergency residents should call the police, who have been given procedures to follow. Do not bring in questionable materials, better not to touch it. She said the protocol 8 October 17, 2001 on handling is posted on the website. Remember do not open strange mail, or if stained, taped and/or bulky. The Administrator then reminded residents that leaf collection had begun. Leaves are not to be bagged, they are to be raked loosely to the curb for pickup. They will try to pass through the Town at least once every ten days. The new brochures for next year should be ready in a few weeks for distribution. ADJOURNMENT The Supervisor said that the next scheduled meetings would be November 7 and Tuesday, November 20. On motion duly made and seconded the meeting was adjourned at 9:30 PM.
