Samela, Deputy Town Clerk CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. PUBLIC HEARING - Persons with Disabilities and Limited Incomes Partial Real Property Tax Exemptions Law The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on June 20, 2001, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of the following Local Law: The purpose of the Local Law is to "Grant a Partial Real Property Tax Exemption as Authorized by Section 459-c of the Real Property Tax Law to Persons with Disabilities and Limited Incomes." On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the hearing was declared open. The Attorney explained that this statute is mandated by the State of New York and is beyond the power of the Town Board to change. The exemption is broad enough to qualify most with disabilities encompassing those that are married and/or siblings who are also eligible if they meet the combined income guidelines. Under this provision only one exemption is allowed meaning if someone is both a senior and is disabled they can only apply for one of the exemptions. He then read sections of the proposed local law. Mr. Maker said that he had asked the Assessor, Susan Bickerstaff, if her office could administer this law and was informed by the Assessor that they could. The law applies to Town taxes only. Councilman Odierna said there seemed to be no flexibility in the law. Councilwoman Myers asked how disabled seniors can determine which would be the better exemption. The Attorney said the benefits are identical. The Supervisor asked if there was anyone who wished to speak either against or in favor of the proposed law, there were none. On motion of Councilwoman Myers, seconded by Councilman Odierna, the hearing was declared closed. June 20, 2001 On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following Local Law was adopted: Local Law No. 6 -2001 This local law shall be known as the "Persons with Disabilities and Limited Incomes Partial Real Property Tax Exemption" Law. Section 1 — Purpose: The State of New York has enacted legislation, codified as section 459-c of the Real Property Tax Law and entitled "Persons with disabilities and limited incomes". That statute went into effect on August 16, 2000. It enables a local government to adopt a local law, granting a partial exemption from real property taxes to persons with disabilities who have limited income. The purpose of this local law is to grant the exemption authorized by section 459-c of the Real Property Tax Law to real property owned residents of the Town of Mamaroneck who qualify for it. Section 2 — Definitions: For the purpose of this local law only, A. "Assessor" means the assessor of the Town of Mamaroneck. "Disability" means a physical or mental impairment, not due to current use of alcohol or illegal drug use, which substantially limits a person's ability to engage in one or more major life activities, such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and working. "Income" includes social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset (which may be offset by a loss from the sale or exchange of a capital asset in the same income year), net rental income, salary or earnings, and net income from self-employment, but shall be offset by all medical and prescription drug expenses actually paid by a person with a disability which were not reimbursed or paid for by insurance. "Income" shall not include a return of capital, gifts, inheritances or monies earned through employment in the federal foster grandparent program. (2.) In computing net rental income and net income from self-employment, no depreciation deduction shall be allowed for the exhaustion, wear and tear of real or personal property held for the production of income. Where title to the real property is vested in either a husband or a wife, "Income" shall include their combined incomes, except where the husband or the wife, or the ex- husband or ex-wife is absent from the property due to divorce, legal separation or abandonment, in which case only the income of the spouse or the ex-spouse residing at the real property shall be considered. If a person with a disability is receiving health-care as an inpatient of a residential health care facility as defined in section twenty-eight hundred one of the Public Health Law of the State of New York, the "Income" of such person shall be limited to the amount that such person's income exceeds the amount paid by such person or the spouse or a sibling of such person for care in such facility. "Income tax year" means the twelve-month period for which the owner or owners of the real property filed a federal personal income tax return, or if no such return is filed, the calendar year. E. In addition to a person or entity vested with title in fee simple absolute, "Owner" includes a tenant-stockholder of a cooperative corporation. A "Person with a Disability" is a person whose disability meets the criteria of Subsection B of this section and who (i) is certified to receive social security disability insurance (SSDI) or 2 June 20, 2001 supplemental security income (SSI) benefits under the federal Social Security Act, or(ii) is certified to receive Railroad Retirement Disability benefits under the federal railroad Retirement Act, or(iii) has received a certificate from the state commission for the blind and visually handicapped stating that such person is legally blind. An award letter from the Social Security Administration or the Railroad Retirement Board or a certificate from the New York State Commission for the Blind and Visually Handicapped shall be submitted as proof of disability. G. "Real property" means the real estate for which an exemption under this local law is sought. Real property includes real estate held in trust solely for the benefit of a person or persons who would be eligible to apply for an exemption, pursuant to this local law, were such person or persons vested with title to that real property in fee simple absolute. "Sibling" means a brother or a sister, whether related through half blood, whole blood or adoption. Section 3 — Exemption: Except as provided in Section 4 of this local law, (1) where the owner of real property (a) is a person with a disability, or(b) are one or more persons both of whom have disabilities, or(c) is a husband, wife or both and one of them is a person with a disability, or(d) are siblings, at least one of whom has a disability and (2) the income of the person with the disability is limited by reason of such disability, that real property shall be exempt from taxation by the Town of Mamaroneck to the extent set forth in the following table, provided an application for such exemption is made in accordance with the provisions of this local law: Percentage of Assessed Valuation Exempt Annual Income From Taxation 0 to $20,500.00 50% $20,500.01 to $21,499.99 45% $21,500.00 to $22,499.99 40% $22,500.00 to $23,499.99 35% $23,500.00 to $24,399.99 30% $24,400.00 to $25,299.99 25% $25,300.00 to $26,199.99 20% $26,200.00 to $27,099.99 15% $27,100.00 to $27,999.99 10% $28,000.00 to $28,899.99 5% $29,000.00 and above 0% Section 4— Limitations on the Exemption: Any exemption provided by this local law shall be computed after all other partial exemptions allowed by law have been subtracted from the total amount assessed. Notwithstanding the previous sentence, no real property may receive an exemption pursuant to both this local law and Article II of Chapter 195 of the Code of the Town of Mamaroneck. No real property shall be eligible for an exemption pursuant to this local law unless the real property is used exclusively for residential purposes, provided, however, that if any portion of such property is not used exclusively for residential purposes but is used for other purposes as well, only such portion that is used exclusively for residential purposes shall be entitled to the exemption provided by this local law; the real property is the legal residence of and is occupied in whole or in part by a person with a disability; except when that person is absent from the real property while receiving health-related care as an inpatient of a residential health care facility, as defined in section twenty-eight hundred one of the Public Health Law of the State of New York. Section 5— Cooperative Corporations: Although title to the real estate on which a co-operative apartment is located is vested in a co-operative corporation, for the purpose of this local law only, a person with a disability 3 June 20, 2001 who is a tenant-stockholder of a co-operative corporation shall be deemed to be vested with title in fee simple absolute to a portion of the real estate owned by the co-operative corporation. The portion deemed to be vested in a person with a disability shall be the total percentage calculated by dividing the number of shares of stock owned by the person with a disability by the number of outstanding shares of stock in the cooperative corporation. Provided the tenant-stockholder satisfies all of the criteria of this local law, the portion of the real estate owned by the co-operative corporation that is deemed vested in a tenant- stockholder who is a person with a disability shall satisfy the definition of"Real Property" in this local law and thus be eligible for the exemption created by this local law. Any exemption granted pursuant to this local law shall be credited by the Town of Mamaroneck against the assessed valuation of the real estate owned by the co-operative corporation. The reduction in real property taxes realized by the co-operative corporation under this local law shall be credited by that corporation against the amount of real property taxes payable by or chargeable to the tenant-stockholder who is a person with a disability. Section 6 —Application Procedure: Application for an exemption pursuant to this local law must be made annually by the owner, or owners of the property, on forms prescribed by the state board of real property services, and shall be filed in the office of the Assessor on or before June 1st of each calendar year. Notwithstanding the preceding sentence, proof of a permanent disability need be submitted only in the year an exemption pursuant to this local law is first sought or the disability is first determined to be permanent. By no later than March 31st of each year, the Assessor shall mail to each person who was granted an exemption pursuant to this local law on the latest completed assessment roll an application form and a notice that such an application must be filed on or before the taxable status date and be approved in order for the exemption to continue to be granted. Failure to mail such application form or the failure of such person to receive it shall not prevent the levy, collection and enforcement of the payment of the taxes on the real property owned by such person. Section 7 — Severability: Should any provision of this local law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 8 — Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The Supervisor reminded everyone the Fireman's Parade would be held on Monday, July 2. It will be starting at Mamaroneck Avenue School at 7:00 PM sharp. The raindate will be Tuesday, July 3. Fireworks will be held on July 4 at Harbor Island, Playland and at the High School. She said the results of the Fire Election for a new Fire Chief would be available at the next Town Board Meeting. Michael Liverzani has resigned because he has taken another position with the Town as the Administrator for the Ambulance District. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Myers, the Commission unanimously adjourned at 8:45 PM. 5 June 20, 2001 AFFAIRS OF THE TOWN 1. Authorization -Westchester Industrial Development Agency Agreement The Attorney explained the financing arrangement between Harjay and the IDA has ended and the IDA has conveyed title to this property back to Harjay. Harjay is asking the Town to enter into an agreement with them which it can record with the County Clerk to, in effect, remove the financing agreement from the public records. Councilwoman Seligson asked if this was common place. Mr. Maker replied that it was and the property would be restored to the tax roll, since the pilot payment was in lieu of taxes. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the following was adopted: WHEREAS, Harjay Corporation ("Harjay") and the Town entered into an agreement dated June 19, 1985 in connection with a financing arrangement between Westchester Surgical Supply Co., Inc. and the County of Westchester Industrial Development Agency (the "1985 Agreement") involving real property located in the town of Mamaroneck at 615 Fifth Avenue (Section 1, Block 131, Lots 333 and 334 and Section 1 Block 132 Lot 8); and WHEREAS, the transaction between Harjay and the County of Westchester Industrial Development Agency has been completed and all of the indebtedness repaid; and WHEREAS, the Town has been asked by Harjay to enter into an agreement which, in effect, would expunge the 1985 agreement from the public records of the County of Westchester. NOW THEREFORE, BE IT RESOLVED, that the Supervisor is authorized to enter into on behalf of the town of Mamaroneck an agreement with Harjay which would provide that the 1985 Agreement is of no further force or effect and shall be removed from the public records of the County of Westchester. Authorization - Lease Agreement - Commuter Parking Lot#1 Mr. Altieri explained that the lease agreement was between the Town of Mamaroneck and Manisbro Incorporated. Manisbro Incorporated is the operator of the automobile service station located on Vine Street adjacent to commuter lot# 1. This would provide the station with some parking now that we've demapped Vine Street and are only allowing permit parking there, and Manisbro previously parked customer vehicles on Vine Street. By creating commuter parking on Vine Street, we have eliminated the service station's customer parking. The Town has negotiated with the service station a lease agreement that would dedicate 14 spaces in commuter Lot#1 for the service station's use. The spaces to be 6 June 20, 2001 assigned to Manisbro would be those spaces immediately adjacent to the building. He said should there be any default in the rent of$4900 a year the Town could terminate the agreement, and should there be any other reason to terminate there is a provision for 60 days prior notice. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the lease agreement between the Town and Manisbro Incorporated for 14 permit parking spaces in Commuter Lot#1 at a rate of $350 per space for a total rental of$4,900; and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization - Certiorari Settlement On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby authorize the settlement of the following certiorari as recommended by the Town Attorney, William Maker, Jr.: Meadow Realty Co. 126 Library Lane Block: 913 Lot: 53 Year Assessment Reduced To Amount of Reduction 1999 $22,100 $16,000 $6,100 2000 $22,100 $16,000 $6,100 The Town will refund approximately $200.00; the School District approximately $2,440.00. Authorization - Sale of Surplus Equipment Mr. Altieri explained that the Town Board declared the Fire Department's 1992 Ford Mini Attack Pumper as surplus equipment. The sale of the equipment was authorized with a minimum bid of$30,000.00. On June 4, 2001, the Town opened sealed bids for the equipment., two bids were received and the highest bid was $28,000.00. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes that the sale of surplus equipment, a 1992 Ford Mini Attack Pumper, be awarded to Northeast Fire Apparatus, Inc. at a total cost to the of$28,000; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. Report of Bids TA-01-4 - Resurfacing Various Roads Mr. Altieri said two bids were received for this project the lower from ELQ Industries in the amount of$115,315. The estimate was for between $44 - $47 a ton for the asphalt, because costs have gone higher the cost per ton has increased to approximately $50 per ton. The low bid actually now exceeds the budgeted cost, so a transfer of funds from Highway to Capital Projects would have to also be done in the amount of$45,000. Councilwoman Myers asked if this will also have to be a consideration for next year's budget. Mr. Altieri said it would impact the highway budget next year, especially because of the increasing gas costs. Supervisor O'Keeffe said the alternative was to leave off streets that had been scheduled to be resurfaced which would be hard to do. Councilwoman Wittner said she would love to resurface the whole Town but it's difficult, but to keep up with the infrastructure resurfacing should be done as scheduled. There was a rather lengthy discussion on redoing sidewalks, curbs, and the impact of increasing costs. Councilwoman Myers pointed out with the new asphalt roads cars can go faster. Councilman Odierna said the double lines recently painted were done sloppily and the Administrator should talk to the contractor. The Administrator said a car had driven over it while wet. The Supervisor suggested cones be put up to prevent that happening. On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board hereby authorizes that Contract TA-01-4 be awarded to ELQ Industries, Inc , the lowest bidder, for the resurfacing of various roads in the Town of Mamaroneck at a total cost to the of$115,315; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Transfer of Funds On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes the Comptroller to transfer$45,000 from the Highway Fund - Unreserved Fund to the Capital Fund for Road Resurfacing 9 June 20, 2001 for the resurfacing of various roads in the Town of Mamaroneck. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ORAL COMMUNICATIONS 11 June 20, 2001 Councilman Odierna stated he had heard at a meeting last Tuesday the Town was looking for an employee for the Recreation Department. Mr. Altieri said that the Town was looking for a Recreation Leader to fill Jill Fisher's old position. Councilman Odierna suggested the opening be posted on the Town's website. Mr. Altieri said since this position has to be hired off the civil service list, it was not appropriate for that type of posting. The Councilman felt that Town residents should be made aware of positions that were available in the Town. They then discussed the pros and cons of the issue. WRITTEN COMMUNICATIONS The Supervisor read the following letter into the record. June 9, 2001 Mrs. Valerie Moore O'Keeffe, Supervisor Town of Mamaroneck 740 West Boston Post Road Mamaroneck, New York 10543 Dear Valerie, We are writing to express our heartfelt thanks for the wonderful job the Town of Mamaroneck Police Department did for the funeral of our mother(mother-in- law). The skill and professionalism displayed by all the police officers was most impressive. Their kindness and compassion were greatly appreciated by our entire family. The funeral procession was handled flawlessly under the direction of Lieutenant J. Michael Cindrich. The police officers, Patrolman Bob Ashley, Mike Arkins, Richard DiGraziano and Thomas Houlihan did an outstanding job. We are equally grateful to Sergeant Paul Degenhardt who, we later found out, went into work on his day off, on his own time, and put on a uniform to pitch in and help out. Harrington The Town Clerk reminded the Supervisor that a resolution had adopted regarding the Town Board meeting dates for the summer. ADDED ITEM: Dates of Summer Meetings On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the regular meetings of the Town Board will be held in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck at 8:15 PM during the months of July and August on July 18 and August 8, 200; and BE IT FURTHER, 12 June 20, 2001 RESOLVED, there will be a work session of the Town Board on June 27, 2001 at 6:00 PM in Conference Room A of the Town Center. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye The Supervisor said that there would be a meeting Thursday night at 7:00 PM at the Harrison Town House with members of the Thruway Authority regarding resurfacing of the thruway. She then said there was some confusion over a letter in today's newspaper regarding the redevelopment of Madison Avenue and Myrtle Boulevard. This area is not in the Village of Larchmont as stated in the letter; it's in the Town. The developer has had nothing to do with the proposed medians to be placed along Myrtle Boulevard. The property in question is privately owned. The builder can build whatever he wants as long as it is in compliance with Town Codes. The Administrator said that the new parking area on Vine Street should be completed within the next two weeks. The Town Clerk advised the Town Board that her office has taken in $140,000 in revenues for parking permits to date. The Supervisor said the Town has hired a code enforcement officer during weekend hours. Mr. Altieri said that the new person would work late Friday and Saturday afternoons to make sure that Town residents were not in violation as to the placement of garbage cans at the curb. The new enforcement officer had been able to cover the entire Town in two days. Mr. Altieri reminded all that there would be no recycling on Wednesday, July 4 and garbage would be picked up Monday, Tuesday, Thursday and Friday that week. He then said that residents would be receiving information within the next week regarding a pilot program for recycling organic waste (grass, leaves, twigs, branches, etc.) This must be set out on the curb. Organic waste can be placed in a garbage can or in a brown recycling bag. Plastic bags cannot be used. This waste will be taken to Port Chester then to New Jersey to be made into compost and then sold. This program will be mandatory by April 2002. The Supervisor reminded everyone that leaf blowers cannot be used from June 1 through September 15. REPORTS OF COUNCIL Councilwoman Myers said that the Youth Council had a very successful end of the year celebration at Harbor Island attended by over 200 kids. She also said that the Larch mont/Mamaroneck Tennis Team finished second in the finals and had received a trophy. Councilman Odierna said that the Election Reform Committee meeting was held on June 8. County Legislator George Latimer was in attendance, as was Ron Tocci, who had offered ideas which were workable. 13 June 20, 2001 Councilwoman Seligson said that there was a proposal before the Planning Board from Stop and Shop to regrade the parking lot and improve the islands. This would not affect the drainage system and would be completed within a ten day period. The store will also be closing for several weeks for renovations in the middle of August. ORAL COMMUNICATIONS Betty Miller of the Larchmont Gardens Civic Association said there would be a general meeting of the association this Thursday evening at 7:30 at the Weaver Street Fire House and former Supervisor Elaine Price, who is the Director of Consumer Affairs would be the guest speaker. Ms. Miller invited the Board to attend. She said that the thruway noise was a major concern. The noise seems to be getting worse. She mentioned that a former resident had donated three dogwood trees and a bench in memory of his wife. Unfortunately someone has removed the plaque from the bench. The Supervisor thanked the Women's Club of Larchmont for donating an American Holly Tree which will be planted at the corner of Palmer Avenue and Weaver Street. There will be a planting ceremony as soon as the tree arrives. ADJOURNMENT The Supervisor said that the next scheduled meetings would be July 18 and August 8.
