BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Altieri, Town Administrator William Maker, Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:30 PM. Present were the following members of the Commission: Commissioner: Valerie M. Fire Claims: Commissioner Myers presented fire claims for authorization of payment , thereafter on Commissioner Myers' motion, seconded by Commissioner Wittner, it was RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: AAA Emergency 208.80 Avaya 8.17 Cleaning Systems 169.96 Con Edison 2.06 Excelsior Garage & Machine Works, Inc. 1,148.00 IOS Capital 169.74 Lauren Abinanti 100.00 Nextel 77.91 Poland Spring 105.90 Sound Shore Contracting Inc. 215.75 Sound Shore Cleaning Company 250.00 June 6, 2001 Total 2,456.29 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye There being no further business to come before the Commission, on motion of Commissioner Seligson, seconded by Commissioner Wittner, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. AUTHORIZATION - LEGAL SERVICES RETAINER Mr. Altieri explained that this was the third retainer extension agreement between the Town and Robinson, Silverman, Pearce, Aronsohn and Berman for legal services for the Planning and Zoning Boards. Under the terms of the agreement renewal, the base retainer would remain at $42,000 per year. Included in the base retainer is attendance at the regular meetings of the Planning and Zoning Boards and all time spent in preparation for those meetings. One change in the retainer for 2001 is payment for time spent on drafting of legislation and litigation that may arise for which the firm is retained to defend the Town. In the prior agreement the first fifty-five hours of time spent was included in the base retainer. Under the proposed agreement all time spent on legislation and litigation would be paid at the hourly rates stipulated in the agreement. This is an equitable amendment to the agreement. If approved the base retainer in 2001 would have remained at $42,000 for three years. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby approve the agreement between the Town of Mamaroneck and Robinson, Silverman, Pearce, Aronsohn and Berman for legal services for the Planning and Zoning Boards at a base retainer of$42,000 per year and all time spent on legislation and litigation would be paid at the hourly rates stipulated in the agreement, and; BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. LEAF REMOVAL - GARDENS LAKE Mr. Altieri explained that previously the Town had discussed the problem of the Gardens Lake and the increasing quantity of leaves that accumulate primarily on the south side of the lake near Rocky Road and near the Lakeside Drive Bridge. In 1998, the Town rented a dredging machine specifically designed for material removal from shallow lakes and ponds. 2 June 6, 2001 Aqua Dredge Inc. of Armonk, New York provided the machine. The Administrator stated that he and the Highway Superintendent met with Aqua Dredge to discuss the possibility of again renting the machine to remove the leaves from the lake. Authorization is requested to rent equipment from Aqua Dredge, Inc. for$2,400 per day for 15 days. Since the machine is currently working in the northern part of the county we could begin the work as early as June 11, 2001. On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the agreement between the Town and Aqua Dredge, Inc. to furnish specialized equipment, personnel, and insurance to undertake the work necessary to remove leaves and debris from Gardens Lake at a total cost of$38,500 which includes the daily rental of equipment and mobilization/demobilization of the equipment; and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes the Comptroller to transfer$42,000 from General Town General Fund to Beautification Fund the rental of equipment from Aqua Dredge, Inc. for leaf removal from Gardens Lake. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 3. DISCUSSION - PETITION FOR REMOVAL OF PARCELS FROM COUNTY SEWER DISTRICT The Supervisor explained that the Town has received a petition from a group of residents seeking to be removed from the Westchester County Mamaroneck Sewer District . The residents listed on the petition are from the unincorporated area and that portion of the Village of Mamaroneck near Hampshire Country Club. Currently, the residents living in these areas do not have municipal sewer service. However, the residents do pay Westchester County Sewer District tax from which they are seeking an exemption. Councilwoman Wittner stated there are other areas in the Town that are on septic. Mr. Altieri said the Town must initiate this procedure because we collect the taxes. He will draft a petition with the Town Attorney and present it to the Board at their June 20 meeting. 3 June 6, 2001 4. REPORT OF BIDS - TA-01-07 - MYRTLE PARK PLAYGROUND IMPROVEMENTS Mr. Altieri explained that the scope of this contract is phase two of the plan to upgrade and improve playground equipment at Myrtle Park. A new playground equipment unit will replace older equipment that is now installed in the small sandboxes on the west side of the playground near the tennis building in the park. The new equipment will meet revised industry standards for safety and handicapped accessibility. Since the entire site will be under construction to replace the playground equipment, it is a good time to replace the existing sidewalk that is in only fair condition. On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes that Contract TA-01-07 to P. Corsetti Contractors, the lowest responsible bidder, to upgrade and improve playground equipment at Myrtle Park and replace the existing sidewalk at a total cost of$69,450; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye TA-01-08 AERIAL LIFT BUCKET TRUCK The Administrator explained that the Town currently operates a 50 ft. Lift Bucket Truck that is used almost exclusively for tree maintenance. The replacement truck is a 38 ft. Lift Bucket Truck that will be used for street light maintenance but can also be used for tree maintenance with some limitations. Since the Lift Bucket will only be 38 ft. high when extended it obviously does not have all of the capabilities of our first line tree truck. To reduce the total price of the truck, the Town, this year, purchased the truck chassis on a New York State purchasing contract. The truck chassis will then be furnished by the Town to the lift bucket contractor for final assembly. Our savings is derived by eliminating the markup that would be charged by the truck chassis contractor for handling the chassis and lift bucket body. The savings is estimated to be 10 to 15 percent of the total cost of the vehicle. Pursuant to the New York State contract, the truck chassis for this vehicle cost $45,069.00. BID RESULTS: Contract TA-01-08 -Aerial Lift Bucket Truck Altec Industries, Inc. 250 Laird St., Plains, PA $36,789.00 Advanced Equipment 75 Cedarhurst Ave., Medford, NY $49,789.00 On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes that Contract TA-01-08 for an aerial lift bucket be awarded to Altec Industries, the lowest responsible, to furnish, assemble, and deliver the Aerial Lift Bucket Truck to the Town at a total coat of$36,789; and BE IT FURTHER RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. 4 June 6, 2001 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye TA-01-09 DUMP BODY/MATERIAL SPREADER Mr. Altieri explained that several years ago, the Town experimented with a newer technology dump body that could also serve as a salt spreader for winter storms. In the past, the Town has used a separate material spreader that is mounted into our dump trucks. The problem, however, is that once the spreaders are mounted in the dump trucks, they can not be used as dump trucks for the winter season without dismounting and remounting the material spreader. We have discovered that this type of dump body works extremely well and provides more flexibility for the use of our larger dump trucks. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board hereby authorizes that Contract TA-01-09 for a dump body/material spreader be awarded to Advanced Equipment, the lowest and only bidder, to furnish and deliver(1) one 7.5 cubic yard rear discharge dump body/material spreader at a total cost to the of$44,056; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. Salary Authorizations AMBULANCE DISTRICT ADMINISTRATOR The Town Attorney stated that the agreement between the Town and Michael Liverzani was in accordance with Civil Service Law. Mr. Maker was happy to have Michael on staff after 16 years of volunteer service to the Town as both a volunteer fire fighter and as Fire Chief. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to Michael Liverzani, in the amount of $62,500, for his services as Ambulance District Administrator effective May 29, 2001. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye 5 June 6, 2001 Myers - Aye Wittner - Aye O'Keeffe - Aye HIGHWAY DEPARTMENT On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to Dumas Gabbriellini, in the amount of $11.50 per hour, for his services as a summer laborer in the Highway Department effective June 18, 2001. Set Public Hearing - Tax Exemption Program for People with Disabilities The Town Attorney explained and on motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the Tax Exemption Law for People with Disabilities for June 20, 2001 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, 9 June 6, 2001 RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye APPROVAL OF MINUTES - February 14, 2001 On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meeting of February 14, 2001 as amended. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ORAL COMMUNICATIONS The Supervisor spoke about the following subjects: She said that there had been a very productive Revaluation Committee meeting regarding effects on co-ops and condos and thanked Chairman George Roniger. Mr. Roniger said that he would be very happy to meet with the Board to answer any questions they may have. There had been a ceremony at the Train Station Pond. Fountain is beautiful and they honored Vince Rinaldi who was an employee of the Highway Department who passed away. Congratulations to Highway Department for park work. Work was being done on Vine Street to add more commuter parking spaces. The work should be completed in about two weeks. The new plantings on Palmer Avenue and Weaver Street were very nice. Today was the Anniversary of D-Day, a day to remember all those who lost their lives. Barbara Bennet-Rhones had passed away after a long battle with cancer. She will be missed. The Supervisor then offered her sympathies and that of the Board. LMC-TV Awards Ceremony. Kelly, an employee of LMC-TV was given an award at the ceremony. Fun was had by all. Music was provided by the Circuit Riders conducted by Mr. Van Houghton. The ceremony can be seen on Channel 71. Councilman Odierna mentioned the Larch mont/Mamaroneck Memorial Day Parade and the Memorial Day Services at the Kempner Memorial, VFW and Myrtle Boulevard. He said that there would be an Election Reform meeting on Friday, June 8 in the Court Room at 8:45 AM and said that this would be their last meeting for a couple of months. 10 June 6, 2001 Councilwoman Myers commented on the all day work session held on June 1. Said that there was a lot accomplished. She thanked the Board of Architectural Review for their input. Councilwoman Myers spoke about the Larch mont/Mamaroneck Youth Council. Councilwoman Seligson said that the Memorial Day Services were very moving and that there seemed to be a better attendance this year. She said that the Larchmont Library celebrated their 75th Anniversary on Sunday. Supervisor O'Keeffe said that Sister Rita was retiring from the Larchmont Senior Center and wished her well. Councilman Odierna spoke about organic recycling enforcement and Myrtle Boulevard and Fifth Avenue Project regarding sidewalks, lights and streetscape. Councilwoman Wittner spoke about the Human Rights Commission. They were having continued discussions about giving a school award. Are reaching out to the community to find what they would like them to do. Seeing a rejuvenation of students getting involved. Coastal Zone Management Commission had a full agenda. Councilman Odierna reminded everyone that the School Bond Vote was on June 13. ADJOURNMENT The Supervisor said that the next scheduled meetings would be July 18 and August 15, 2001.
