BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Samela, Deputy Town Clerk CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25 PM, who then pointed out the location of exits. PUBLIC HEARINGS STOP INTERSECTION - FERNWOOD ROAD WHERE IT INTERSECTS CLOVER STREET The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, Oct. 4, 2000 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a proposed Local Law entitled "Stop Intersection - Fernwood Road Where It Intersects Clover Street." Mr. Altieri explained that this matter had been brought before the Traffic Committee to consider the installation of a stop sign on Fernwood Road. The Traffic Committee generally has a policy where stop signs should be used as a way to control traffic going from a secondary street to a primary street. Stop signs should not be use to control the speed of traffic. The Committee is recommending that a stop sign be installed on Fernwood Road and Clover Street that will hopefully help control the traffic on both of these streets. On motion of Councilman Odierna, seconded by Councilwoman Wittner, the hearing was declared open. The Supervisor asked if there was anyone who would like to speak in favor of the proposed local law. Beth Boyle of 52 Fernwood Road spoke. She has been a resident for the past seven years. Two and a half years ago this matter was brought before the Traffic Committee, but they were not willing to look into it at that time. She has the unanimous support of all of her neighbors who are in agreement with the installation of the stop sign. They would like to see the stop sign come to fruition. Richard Mari, a member of the Traffic Committee, spoke against installing a stop sign; his was the only vote against installing the stop sign. He felt that this street did not warrant it. He said that he has observed the traffic pattern on Fernwood Road and feels that the sign is not justified. Bill Wolf of 53 Fernwood Road spoke in favor for the reasons stated by Mrs. Boyle. OCTOBER 4, 2000 There were also two other families in the audience, Dr. Densky of 72 Fernwood Road and Mrs. Henderson of 50 Fernwood Road who are in favor of the law. Councilman Odierna spoke in favor as long as the sign can be removed if it doesn't solve the problem. Councilwoman Myers compared this to the new stop signs that were installed on Harmon Drive which seem to be helping the speeding problem. She suggested using the speed meter on Fernwood Road to oversee the traffic situation. Councilwoman Wittner spoke saying that she does not recommend the use of stop signs to slow down traffic. The Supervisor stated she grew up in that neighborhood and that she was very familiar with the area and was in favor of the law. She wondered if W. Garden Road would then have the brunt of the traffic. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the hearing was declared closed. On motion of Councilwoman Myers, seconded by Councilman Odierna, the following Local Law was adopted: LOCAL LAW NO. 16 -2000 This Local Law shall be known as a "Stop Intersection at Fernwood Road Where It Intersects Clover Street." Section 1. Purpose: To regulate traffic on Fernwood Road at the intersection of Clover Street. Section 2. Regulation of Traffic: Vehicles shall be required to come to a full stop at such intersections where said stop signs are installed. Section 3. Sign to be Erected: Stop signs shall be installed in both directions on Fernwood Road at the intersection of Clover Street. Section 4. Severability: Should any provision of this Local Law be declared illegal or unconstitutional by a court of competent jurisdiction, to the extent that the other provisions of this Local Law can be implemented without such illegal or unconstitutional provision such other provisions shall remain in effect. Section 4. Effective Date: This Local Law shall take effect upon filing with the Secretary of State. The above local law was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye STOP INTERSECTION - HOWELL AVENUE AT THE INTERSECTIONS OF MEADOW PLACE AND HAWTHORNE ROAD The Administrator explained that this has been before the Traffic Committee in the past. The uniqueness of this situation is that Carleon and Howell Avenues often serve as shortcuts between Palmer Avenue and Weaver Street. The Howell Park community requested that stop 2 OCTOBER 4, 2000 signs be installed. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared open. The Supervisor asked of anyone would like to speak regarding the stop sign for Howell Avenue. David Getz of 70 Howell Avenue spoke in favor of the stop sign. He will be directly affected by the installation of the stop sign. He is concerned about the speed and flow of traffic. The Supervisor asked Mr. Altieri what the Traffic Committee's decision was on this matter. Steve responded by saying that they recommended the installation of the stop sign. Richard Mari spoke against the stop sign. He feels it's being used to control speeding and to aggravate the drivers using that route. There are stop signs on the side roads. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the hearing was declared closed. On motion of Councilman Odierna, seconded by Councilwoman Wittner, the following Local Law was adopted: LOCAL LAW NO. 17-2000 This Local Law shall be known as a "Stop Intersection at Howell Avenue at the Intersections of Meadow Place and Hawthorne Road." Section I. Purpose: To regulate traffic on Howell Avenue at the intersection of Meadow Place and Hawthorne Road. Section 2. Regulation of Traffic: Vehicles shall be required to come to a full stop at such intersections where said stop signs are installed. Section 3. Section 4. Effective Date: This Local Law shall take effect upon filing with the Secretary of State. The above local law was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 3 OCTOBER 4, 2000 NO LEFT TURN FROM MYRTLE BOULEVARD ONTO PRESTON STREET The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, Oct. 4, 2000 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a proposed Local Law entitled "No Left Turn from Myrtle Boulevard onto Preston Street." On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared open. The Supervisor asked if there was anyone who wished to speak on this matter. The time stated on the local law was corrected from 4:00 - 7:00 PM to 4:30 - 7:30 PM. Paul Schwendener of 27 Edgewood Avenue spoke in favor of the no left turn sign. A petition was signed by every resident on Edgewood Avenue and Preston Street. This is a request to reinstate of an old local law which was passed some years ago. Edgewood was widened sometime ago. There is no sidewalk on one side of the street. Traffic was monitored on four separate occasions during the rush hour period. The average number of cars traveling on Preston Street during rush hour ranges from twenty to twenty-six. Although these seem to be relatively low numbers, the cars drive extremely fast through the area. Katherine Wachs of 31 Edgewood Avenue spoke in favor. She suggested that the time frame be changed from 4:00 PM to 7:00 PM to 4:30 PM to 7:30 PM. The Supervisor addressed Ms. Wachs regarding this matter. Dr. Carl Nathan of 5 Edgewood Avenue said that he walks to the train station and is concerned for his safety and the safety of others walking in the area. He requested that Lieutenant Anderson use the speed monitor to observe the area for a while. Richard Mari, spoke against the local law. He said that he had mixed feelings and that we are getting carried away with controlling speed with signs. Perhaps lowering the speed limit would be another solution to the problem. Councilman Odierna asked Mr. Mari what the impact would be on Weaver Street. Mr. Mari said that the center line on Myrtle Boulevard near Weaver Street is more to the center and suggested that it be repainted slightly off center to allow for a left and right lane at the light. This would allow vehicles going toward the Duck Pond or making right turns to do so if there are cars making left turns onto Weaver Street. Peter Perciasepe a resident of 96 Myrtle Boulevard stated that there are three driveways on Preston Street that the residents will not be able to access. He is also concerned about the volunteer firefighters responding to fire calls making the left turn onto Preston Street. He referred to Myrtle Boulevard as a "speedway". At the Supervisor's request, Councilwoman Wittner read a letter into the record which was received from George Carroll. To: Town Board of the Town of Mamaroneck From: George Carroll(Hillside Road) Date: October 4, 2000 Re: Proposed regulation prohibiting left turns from Myrtle Boulevard onto Preston Street 4 OCTOBER 4, 2000 Twice a day five days a week during heavy commuter traffic off the ramp at the railroad station parking lot, it is often convenient(as well as helpful in relieving traffic congestion) to be able to avoid the Myrtle/Murray/Chatsworth intersection by turning up Myrtle and onto Preston and then via Edgewood to Murray or Echo or Emerson or wherever. Please bear this in mind as you consider the referenced proposal. Thank you. Councilman Odierna asked what the Traffic Committee's vote was on this matter was. Mr. Altieri said that is was one vote against and six in favor. The Supervisor said that she was concerned about the volunteers responding to fire calls. A discussion on this matter followed with Mr. Perciasepe, the Supervisor and the Town Attorney. Ms. Wachs asked about the old law. Mr. Perciasepe explained that the old law regarding no left turns onto Preston was not obeyed and the police never enforced it. The Attorney stated that volunteers should not be exempt for liability and safety reasons. Mr. Gordon Albert a resident of 17 Edgewood Avenue said the problem is that people have a disregard for speed and he would like to put a stop to it. A lengthy discussion followed regarding this local law. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared closed. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the following Local Law was adopted as amended: LOCAL LAW NO. 18-2000 This Local Law shall be known as a "No Left Turn from Myrtle Boulevard onto Preston Street Except for Fire Personnel Vehicles Displaying Emergency Lights". Section 1. Purpose: To prevent left hand turns from Myrtle Boulevard onto Preston Street between the hours of 4:30 PM and 7:30 PM Monday thru Friday except for fire personnel vehicles displaying emergency lights. Section 2. Sign to be Erected: A "No Left Hand Turn Between the Hours of 4:30 PM and 7:30 PM Monday thru Friday" to be erected on Myrtle Boulevard at the intersection of Preston Street except for fire personnel vehicles displaying emergency lights. Section 3. Severability: Should any provision of this Local Law be declared illegal or unconstitutional by a court of competent jurisdiction, to the extent that the other provisions of this Local Law can be implemented without such illegal or unconstitutional provision such other provisions shall remain in effect. Section 4. Effective Date: This Local Law shall take effect upon filing with the Secretary of State. The above local law was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye 5 OCTOBER 4, 2000 O'Keeffe - Aye NO TURN ON RED FROM MYRTLE BOULEVARD ONTO WEAVER STREET The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, Oct. 4, 2000 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a proposed Local Law entitled "No Turn on Red from Myrtle Boulevard onto Weaver Street." On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared open. Mr. Altieri explained that this matter was brought before the Traffic Committee at its last meeting. When cars attempt to make the right turn on red from Myrtle onto Weaver one has to pull out a bit and this makes it a very unsafe condition. On motion of Councilwoman Wittner, seconded by Councilwoman Myers , the hearing was declared closed. On motion of Councilwoman Myers, seconded by Councilman Odierna, the following Local Law was adopted as amended: LOCAL LAW NO. 19-2000 This Local Law shall be known as a "No Turn on Red From Myrtle Boulevard onto Weaver Street". Section 1. Purpose: To prevent turns on red from Myrtle Boulevard onto Weaver Street. Section 2. Sign to be Erected: A "No Turn on Red" sign to be erected on Myrtle Boulevard at the intersection of Weaver Street. Section 3. Severability: Should any provision of this Local Law be declared illegal or unconstitutional by a court of competent jurisdiction, to the extent that the other provisions of this Local Law can be implemented without such illegal or unconstitutional provision such other provisions shall remain in effect. Section 4. Effective Date: This Local Law shall take effect upon filing with the Secretary of State. He felt that this was very high and suggested that the Board request a listing of all outgoing phone calls to try to cut down on the expense. Mr. Altieri said that this would be looked into. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Seligson, the Commission unanimously adjourned at 9:45 PM. AFFAIRS OF THE TOWN 1. Resolution Pryer Manor Marsh Grant - Phase II Councilwoman Wittner explained that this resolution is part of a grant that was approved but because the grant is actually being funded in a different fiscal year than the grant was awarded we need a new resolution to accompany the grant. This Grant is the second phase of the restoration of the Pryer Manor Marsh. Briefly described, the first phase of the project 7 OCTOBER 4, 2000 is intended to restore the tidal influence to the Marsh. This will be accomplished by the installation of piping across Pryer Manor Road to reintroduce salt water to the marsh on the opposite side of the street. At this time, we are awaiting the completion of the survey of the area to prepare for construction of the piping. In order to proceed with Phase II of the project, the State Department of Environmental Conservation is asking that the Town adopt a second resolution showing its continued support for the project. Phase II will continue the restoration activities begun in Phase I of the Pryer Manor Marsh Restoration project. Salt penetration will be expanded to the periphery of the marsh, and invasive plant species will be removed and replaced with native salt marsh plants. The combination of activities will expand and improve aquatic habitat for resident and migratory fish and wildlife. Total Project Cost: $283,665 Bond Act Share: $210,000 Councilwoman Wittner read the resolution into the record: 1996 Clean Water/Clean Air Bond Act -- Title 3 Section 56-0303 Water Quality Improvement Projects and Environmental Protection Fund Article 17-14 Environmental Conservation Law; Performance Partnership Grants Public Law 104-134 Nonagricultural Nonpoint Source Projects Municipal Resolution Resolution authorizing the items listed below pursuant to the Clean Water/ Clean Air Bond Act of 1996. WHEREAS, the Town of Mamaroneck herein called the "Municipality", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that certain work, as described in its application and attachments, herein called the "Project", is desirable, is in the public interest, and is required in order to implement the Project; and WHEREAS, Article 56 of the Environmental Conservation Law authorizes State assistance to municipalities for water quality improvement projects by means of a contract and the Municipality deems it to be in the public interest and benefit under this law to enter into a contract therewith; NOW, THEREFORE, BE IT RESOLVED BY the Town Board of the Town of Mamaroneck 1. That Stephen V. Altieri, Town Administrator or such person's successor in office, is the representative authorized to act in behalf of the Municipality's governing body in all matters related to State assistance under ECL Article 56, Title 3. The representative is also authorized to make application, execute the State Assistance Contract, submit Project documentation, and otherwise act for the Municipality's governing body in all matters related to the Project and to State assistance; 2. That the Municipality agrees that it will fund its portion of the cost of the Project and that funds will be available to initiate the Project's field work within twelve (12) months of written approval of its application by the Department of Environmental Conservation; 8 OCTOBER 4, 2000 3. That one (1) certified copy of this Resolution be prepared and sent to the Albany office of the New York State Department of Environmental Conservation together with the Application for State Assistance Payments; 4. That this Resolution take effect immediately. Councilwoman Seligson also commented. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the above resolution was passed. Authorization -Architectural Service Reconstruction of VAC Building This item was deferred to October 18. 3. Authorization - Settlement of Insurance Claims Mr. Altieri explained that the following claims have been settled by the Town's insurance carrier, Coregis Insurance Company , who is now seeking the $1,000 deductible for each of the following claims from the Town. Mangienello, et al: DOL: 7/13/96 Anthony Colangelo: DOL 12/14/96 Victor Watson: DOL 7/17/98 Kathleen Ryan: DOL 4/23/99 Anne-Marie Simonsen: 10/14/99 Gail Vasilkioti: 2/5/98 On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby authorize the settlement of six insurance claims at a rate of$1,000 per claim to Coregis Insurance Company for a total cost to the Town of$6,000. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 4. Salary Authorizations - Building Department - Supervisor/Administrator's Office Assistant - Recreation -Ambulance District On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was 9 OCTOBER 4, 2000 RESOLVED, that the Town Board does hereby authorize the payment of salary to Muriel Garvey at an hourly rate of $11.50, for her services as a part-time Clerk in the Building Department effective October 4, 2000; and BE IT FURTHER, RESOLVED, that the Town Board does hereby authorize the payment of salary to Carol Braiotta at a salary of$30,620, for her services as a full time Office Assistant for the Administrator/Supervisor's office, effective October 10, 2000; and BE IT FURTHER, RESOLVED, that as provided for in the 2000 Town Budget that the Town Board does hereby authorize the payment of salary to the following: Cindy Ausiello Head Swim Instructor $21.00 per hour eff. Boston Post Road, Suite 301 The Supervisor announced that St. Clair Richard had retired as the editor of the Sound View News and the Town Board would like to honor her and wished her the best of luck. Councilwoman Wittner congratulated Councilman Odierna and his wife Camille on the birth of their third grandchild Michael Joseph. Councilwoman Myers suggested that all residents check their mail for the new Recreation schedule and calendar. She congratulated the Recreation Department on a job well done. She also mentioned that the Larchmont Youth Council was accepting applications. Councilman Odierna asked Mr. Altieri about the press release on enforcement activity. 11 OCTOBER 4, 2000 Mr. Altieri explained that the Town code enforcement officer will begin issuing summonses October 1 to residents who leave their garbage out earlier than the night before the morning pick-up. Residents will be given one warning, but after that will face a mandated appearance in Town Court and face fines ranging from $25 to $250. He then stated that the increased enforcement is needed to keep neighborhoods clean. It's starting to affect the appearance of the Town, and people who have worked really hard to maintain the appearance of their homes don't want to look at garbage all week long. ADJOURNMENT The Supervisor said that the next scheduled meetings would be October 18 and November 1.
