HomeMy WebLinkAbout2000_06_21 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON JUNE 21, 2000 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Charlene Indelicato, Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:40 PM, who then pointed out the location of exits. PUBLIC HEARING -Amendment to Chapter 17 of the Code of the Town of Mamaroneck The Notice of Public Hearing was read into the record. PLEASE TAKE NOTICE that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday June 21, 2000 at 8:15 PM or as soon as possible thereafter in the Court Room of the Town Center 740 W. Boston Post Road, Mamaroneck New York to consider the adoption of a proposed Local Law entitled Amendment to Chapter 17 of the Code of the Town of Mamaroneck 1967. The purpose of the Local Law is to amend Chapter 17 of the Code of Ethics to include the Deputy Supervisor in the definition of Sensitive Position. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared open. The Supervisor said this amendment to the law would add Deputy Supervisor to the list of sensitive positions in the Code of Ethics which makes sense as it is not presently included in the law. Councilwoman Myers said it was never included before because the position as always been held by a Town Board member. The Town Attorney said State law allows the position to be held by people other than elected officials, but in the code the position had been inadvertently left out. There being no further comment, on motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared closed. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the following Local Law was adopted: June 21, 2000 LOCAL LAW 8 -2000 This Local Law shall be known as an Amendment to Chapter 17 of the Town of Mamaroneck Code of Ethics Section 1. Intent: To amend Chapter 17 Section 17-4 of the Town of Mamaroneck Code of Ethics to include the Deputy Supervisor in the definition of Sensitive Position. Section 2. Amendment to Article 1, Section 17-4 Definitions: Section 17-4 SENSITIVE POSITION - The following positions entail potential conflicts of interest are deemed to be sensitive positions: Supervisor, Deputy Supervisor, member of the Town Council, Town Clerk, Deputy Town Clerk, Town Justice, Town Administrator, Counsel to the Town, Town Prosecutor, Superintendent of Highways, Superintendent of Recreation, Building Inspector, Assistant Building Inspector, Fire Chief, Deputy Fire Chief, Fire Inspector, Police Chief, Comptroller, Deputy Comptroller, Director of Public Housing, Public Housing Administrator, Town Engineer, or Consulting Engineer, Senior Engineering Aide, Assessor, member of the Board of Review, Real Property Appraiser, General Foreman, member of the Planning Board, member of the Zoning Board of Appeals. In the event that a new position is created at a later date which the Town Administrator deems to be sensitive, then such position shall be added to the list upon the adoption of a resolution by the Town Board. Section 3. Severability Should any provision of the Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law which may be implemented without the invalid or unconstitutional provision. Section 4. Effective Date: This law shall take effect upon filing with the Secretary of State. The roll call vote was taken as follows: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye BOARD OF POLICE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe, who then introduced Police Chief Richard Rivera. Present were the following members of the Commission: Commissioner: Valerie M. O'Keeffe Commissioner: Phyllis Wittner Commissioner: Judith A. Myers Commissioner: Ernest C. Odierna Commissioner: Nancy Seligson Chief Rivera reported the radar machine had been received by the Town earlier today. Supervisor O'Keeffe asked if this machine would also count cars, and she said many residents had approached her with requests for their neighborhoods being first to have it. She said they were aiming toward being both fair and judicious in its placement and use. 2 June 21, 2000 Councilman Odierna asked the Chief who would decide its placement. The Chief said it would be within his discretion as well as with his staff. Councilwoman Myers said the Traffic Committee should have input as to placement too, noting the machine is mobile and could be moved to different locations easily. 1. Authorization - Buckle Up New York Grant The Chief said he had applied for a grant to pay for overtime to help enforce the seat belt law. He said compliance is now at 75% and they are hoping to increase that another 10% by 2003. Having a strong presence during holiday like Labor Day helps to reinforce compliance, and everyone is given a ticket, there is zero tolerance. The grant would cover the overtime, which is voluntary for approximately four or five officers. Our goal is to increase seat belt usage in an effort to reduce serious injury or death from traffic crashes. These funds are in addition to any highway safety funding your county may have received through a strategic plan. Thank you for participating in this very important statewide program. Jackson, Jr. Commissioner The Supervisor thanked him, she said she had received thank you letters praising Officers Reynolds and Houlihan. Thereafter, on motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby authorize acceptance of the grant as outlined above in the amount of $4397. FIRE REPORT FOR MAY 2000 Commissioner Wittner read the following fire report: 4 June 21, 2000 The following report out lines responses to calls made during the month of May 2000. It summarizes the nature and origin of calls the number of personal responding and the total times spent at fire calls. NATURE OF CALLS: GENERAL 27 MINOR 13 STILLS 03 OUT OF TOWN 00 MONTHLY DRILL 01 EMS 12 TOTAL 56 TOTAL NUMBER OF MEN RESPONDING: 536 TOTAL HOURS RESPONDING: 20 HOURS AND 55 MINUTES Submitted by Michael Liverzani, Chief Councilwoman Myers said she had attended the wet down ceremony of the new truck. It was a nice occasion where she met the new fire volunteers who told her they had joined to help themselves learn more about the community. She thought that was a great reason and also gives more meaning by getting involved. Councilman Odierna added his admiration and said all the firemen and their families are dedicated making the Town protected and watched over. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Seligson, the Commission unanimously adjourned at 9:05 PM. AFFAIRS OF THE TOWN 1. Resolution - Set Date of July and August Town Board Meetings On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that the regular meetings of the Town Board will be held in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck at 8:15 PM on the first and third Wednesdays of each month except during the months of July and August, during which months meetings will be held on July 19,2000 and August 23,2000. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 2. Resolution - Dedication of Conservation and Parklands - ITEM HELD OVER There were items on the list that needed further clarification so it was decided to table the matter until the next meeting. 5 June 21, 2000 The Supervisor thanked Councilwoman Wittner for all the work she had put into this matter. Councilwoman Wittner said thanks should also go to the Town Assessor, Susan Bickerstaff. 3. Salary Authorizations - Conservation - Building Department - Recreation CONSERVATION On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the payment of salaries to the following at a rate of$8 per hour, for their services as conservation workers to clean and woodchip the trails, repair and build catwalks, cut back brush and perform other manual labor in the Town's conservation areas effective July 5, 2000 until September 1, 2000: Felix Gumbiner Joseph Vitti Mike Vozza Stephen Ampuero William Matthews John Aronson Jacob Edelstein Jonathan Warnow Justin Stein, who worked last summer will be new leader at $8.50 per hour. Resolution Domestic Relations Law The Supervisor said "I have checked with Pat DiCioccio and with Charlene Indelicato who has prepared a resolution giving me authority to perform the ceremony, which is attached". She said she very much appreciated the Board's consideration in this matter. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED. that the Town Board of the Town of Mamaroneck pursuant to Domestic Relations Law Section 11 (c) does hereby appoint Valerie Moore O'Keeffe as Marriage Officer, with authorization to solemnize marriages for the month August 2000; and BE IT FURTHER RESOLVED that this resolution shall be filed in the Town Clerk's office. Approval of Certiorari On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby authorize the settlement of the following certiorari as recommended by the Town Attorney, Charlene Indelicato: Mansbro, Inc. - 1-5 Vine Street Block 126 Lot 730 Town of Mamaroneck Year Assessment Reduced To Amount of Reduction 1999 $55,700 $35,000 $20,700 37% The Town will retired approximately $3,120 for the one year in question. Set Public Hearing - Parking The Town Clerk requested the Board set the public hearing date for rescinding parking to non-resident parkers for July 19, 2000. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the rescinding of parking to non- resident parkers for July 19, 2000 at 8:15 PM; and BE IT FURTHER, 10 June 21, 2000 RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye APPROVAL OF MINUTES On motion of the Town Board, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meetings of April 5, 2000, April 26, 2000 and May 3, 2000, and; BE IT FURTHER, RESOLVED, that the Town Board does hereby hold over the Board minutes from the April 12, 2000 meeting for further review. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye SUPERVISOR REPORTS Supervisor O'Keeffe reported the swimming pool at the Hommocks had suffered a calamity. The tiles were cracked and the pool would have to be closed for repairs. The pool is over 28 years old. The Administrator then explained the repairs would close the pool until mid-July. Alternate locations for the swim team to practice had been found. Residents with permits will be allowed to use them at the Saxon Woods pool; he noted the small pools are fine and will remain open. REPORTS OF COUNCIL Councilman Odierna said the Recreation Commission meeting had been totally focussed on the pool closing. There was to be a meeting of the Web committee tomorrow night. Councilwoman Myers had attended an education forum about Cable TV and municipal right with Ned Benton, very enlightening. She had spoken with Emily Spaulding about determining what and how to get the best possible deal for the community. Councilwoman Seligson thanked Phyllis Wittner and Supervisor O'Keeffe for work on the Long Island Sound program, "Listen to the Sound" and their support and commitment to the public hearing held. 11 June 21, 2000 Councilwoman Wittner said she had written a letter regarding resurfacing and curbs she would like added to the record. The Supervisor said it must be done on a rational basis, we need to lay out and follow a procedure. ADJOURNMENT The Supervisor said that the next scheduled meetings would be July 19 and August 23.
