BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. Odierna CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25 PM, who then pointed out the location of exits. PRESENTATION - Tri-Municipal Human Rights Commission The Supervisor introduced Robin Nichinsky. "Thank you for inviting me here tonight. I am a parent at Central School and I'm here to talk about an exciting program that took place at our school this year---the Anti Defamation League's "A World of Difference" (ADL AWOD) Program." She said she was not really here on behalf of the Human Rights Commission, but had been requested to tell more about this program. The AWOD Program actually first came to our community following a series of local bias-related incidents a few years back. Peter Berendt, the Principal at Mamaroneck Ave School, received a grant from the Mamaroneck Schools Foundation, the Westchester Community Foundation and others to fund a multi-year comprehensive program in the school that is ongoing, and involves the school and community. AWOD trainers also did PEER training with students at MHS, which continues to this day through orientation of 9t" graders by peer trained upper classmen. At Central School, I followed the Mamaroneck Ave model and applied and received grant money from the same sources and others the Mamaroneck Schools Foundation, Westchester Community Foundation, Junior League, our PTA and Mamaroneck District. Through our program, we trained teacher aides throughout the district, did a 12 hour training through the Mamaroneck Teacher's Institute, had two evening family workshops and through voluntary teacher participation, had AWOD trainers work with virtually every child at Central School. The response was truly overwhelming. In all, the program reached over 400 students, and probably 200 adults. And Centrals' PTA has already offered to fund a small ADL program for next year. The program could not have happened without the support of the school district and Central's principal, Susan Luther, the parents who supported the program, and the participation of 100% of Central's teachers who overwhelmingly agreed to bring it to their classrooms. I know it has strengthened our school and community. I believe programs like AWOD not only build character and mutual respect, but help prepare our children to function in the diverse world we live in. June 7, 2000 1 would love to see the ADL program expand into the other schools within our district: Chatsworth, Murray Ave., and Hommocks and I would be happy to help and share my experiences with any interested parent or school member. Supervisor O'Keeffe asked if this program was geared just to grade schools, and thought it also would be good for adults, as it's a terrific idea. Mrs. Nichinsky said it could be adapted to other levels such as High School. The Supervisor said if they could reach a larger number of people who have the same goals it may help to expand the program. Councilwoman Seligson asked if there had been a formal outreach to the Parent/Teacher Association in the schools as they would be very supportive of this type of a program. Robin said not as yet. Everyone thanked her for attending and for the presentation. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:35 PM. Other Business Commissioner Wittner reported she had attended the Fire Council meeting on Monday night where they had discussed the three new Fire Chiefs attending a convention and the setting up of a training schedule for water rescues. There being no further business to come before the Commission, on motion of Commissioner Myers, seconded by Commissioner Seligson, the Commission unanimously adjourned at 8:40 PM. AFFAIRS OF THE TOWN 1. Reappointments - Recreation On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby reappoint Richard Conlan as a member of the Recreation Commission, to serve a term of office of 7 years, terminating May 2007; and BE IT FURTHER RESOLVED, that the Town Board does hereby reappoint James Drucker as a member of the Recreation Commission, to serve a term of office of 7 years, terminating May 2007. The above resolution was put to a roll call vote: Seligson - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Odierna - Absent The Supervisor stated both these appointees work hard and she was honored to have them continue to serve. 2. Update - Property Revaluation Committee Supervisor O'Keeffe said the Westchester Municipal Officials Association was enthusiastically supporting the passage of a resolution voting for county-wide revaluation. Mr. Roniger, the chair of the original REVAL Committee had agreed to reconvene the committee. Some of those 3 June 7, 2000 members when contacted had decided to bow out so new members will tonight be appointed to replace them. The people no longer serving are Ann McAndrews, Helen Langerfeld, Bing Millar, and Robert Katz. The continuing and new committee members are: George Roniger, Thomas Christian, Wynne Stern, Roger Hotte, Irving Scharf, Richard Seltzer, James Fleming, Richard Mumma and Kerry Moelis. They will be writing a supplement to the original report. Councilwoman Myers asked if they had set a time frame for the supplement. The Supervisor replied they had not, but it should not take more than a few months. 3. Authorization - Transfer of Funds Capital Project# 86-04 The Administrator said the budget for this year includes an appropriation of$83,000 for various improvements in the Town Center Building. The projects are to the Police Department, Building Department, Town Court and the Supervisor/Administrator's offices. A resolution is necessary to authorize the transfer of funds for the projects. Councilwoman Wittner asked what improvements were being made to the Police Department. Mr. Altieri responded they would be rebuilding the desk area and doing heating and air conditioner improvements. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes the Comptroller to appropriate $83,000 for Capital Project#86-04 for various improvements in the Town Center Building's Police Department, Building Department, Town Court and Supervisor/Administrator's Office. The above resolution was put to a roll call vote: Seligson - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Odierna - Absent 4. Authorization to Establish Capital Projects - Capital Project#20-1 Purchase of Highway Equipment The Administrator said authorization is being requested to establish the following capital projects to proceed with the implementation of the Town's 2000 Capital Improvement Plan. These capital projects specifically relate to the purchase of equipment for the Highway Department and the Garbage District. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes the establishment of Capital Project#20-1 for the purchase of highway equipment in the amount of$250,000 as follows: Aerial Bucket Truck $ 95,000 Two Pickup Trucks 50,000 Four Wheel Drive Backhoe 90,000 Bonding Costs/Equipment Accessories 15,000 The above resolution was put to a roll call vote: 4 June 7, 2000 Seligson - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Odierna - Absent Capital Project#20-4 - Purchase of Refuse Collection Truck On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes the establishment of Capital Project#20-4 for the purchase of a refuse collection truck in the amount of$120,000 as follows: Twenty-five Yard Refuse Collection Truck $110,000 Bonding Expense/Two-way Radio 10,000 The above resolution was put to a roll call vote: Seligson - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Odierna - Absent 5. Report of Bids - Contract TA-00-6 Replacement of Sidewalks and Curbs Mr. Altieri said bids were received from eight contractors, the lowest bid was for$219,806 from Rusciano Construction of Bronx, New York The bids received were: Vincent Rusciano Construction Inc. Hollers Avenue, Bronx, 10475 $219,806.40 Peter J. Landi, Inc. Main Street, Eastchester, 10709 $239,300.00 Acocella Contracting, Inc Gaylor Road, Scarsdale., 10583 $257,150.00 Dimar Contracting, Inc Maple Avenue, Tuckahoe, 10707 $272,966.30 Vernon Hills Contracting Corp. Boston Post Rd, Mamaroneck, 10543 $350,687.50 Included in the scope of this contract is the following: Replacement of 22,250 sq. ft, of concrete sidewalk Replacement of 6,300 sq. ft. of driveway aprons Installation of 38 handicapped curb ramps Installation of 500 linear feet of new stone curb Resetting 3,750 linear feet of existing stone curb Installation of 1,000 linear feet of new concrete curb The Administrator added in 1999, the total bid for sidewalk and curb reconstruction was $149,000. Increases in the quantity of work proposed, and unit prices have caused the rise in project cost. For instance between 1999 and 2000, the unit price for concrete sidewalk has risen from $4.60 per sq. ft. to $4.74 per sq. ft. If the Town Board wishes to proceed with the sidewalk project as originally proposed it would be necessary to amend the capital project appropriations. In order to avoid using surplus funds or borrowing money, the following recommendation is made to amend the capital project appropriations. Based upon our estimates we believe that funds can be reappropriated from the road-resurfacing project to the 5 June 7, 2000 sidewalk and curb project. Therefore, the road resurfacing appropriation will be amended from $175,000 to $55,000. The sidewalk and curb capital appropriation will be amended from $100,000 to $220,000 thus providing sufficient funds to award the bid contract. If this transfer is approved $70,000 will be available for road resurfacing using the $55,000 transfer and $15,000 carried over from the 1999 road -resurfacing project. If this is acceptable to the Town Board, the recommendation is to award Contract#TA-00-6 to the lowest responsible bidder meeting the specifications, Vincent Rusciano Construction of the Bronx, New York. In addition, authorization is requested to execute a contract with Rusciano Construction for$219,806.40 Councilwoman Myers asked why we thought the $175,000 originally budgeted could be reduced to $70,000 and still accomplish the same resurfacing, and wanted to know about the sharpness of the curbing. Mr. Altieri said prices are good on asphalt and to cut the sharpness they would have to shave them or go to granite or straight concrete, but everyone liked the look of the stone. There was then a discussion on locations and the types of materials, with the Supervisor noting they would be redoing the survey and other spots needing work would have to be determined. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board hereby authorizes that Contract TA-00-6 be awarded to Vincent Rusciano Construction, the lowest responsible bidder, for replacement of sidewalks and curbs in various areas of the Town at a total cost of$219,806; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. UPDATE - Commuter Parking Permits The Town Clerk reported on the availability of commuter parking permits in Lot#1 on Myrtle Boulevard and Vine Street is as follows: Parking Permits Permits Spaces Sold Available Resident Meter Permits 118 319 21** Daytime Permits 214 305 0 Non-Resident Permits (15 eligible) 10 11 0 **We have projected the sale of a total of 340 Resident Meter Permits. These will probably be sold out before the end of June. She reiterated her concern regarding running out of spaces. The Board discussed possible alternatives one of which was to restrict parking to Town residents only. 7. Resolution - Sale of Ward Lane 6 June 7, 2000 The Supervisor explained this property on Ward Lane had been discussed for a long time and it seemed appropriate to now proceed with the process to begin the sale. A resolution had been prepared by the Town Attorney to begin the procedure. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the Town Administrator to sell Town Property formerly known as Ward Lane which the Town Board has determined is unneeded for town purposes to abutting landowners pursuant to the survey prepared by Richard A. Spinelli, licensed surveyor on August 27, 1999 and attached hereto for$500 per parcel which sale is subject to a permissive referendum pursuant to Section 64(2) of the Town Law of the State of New York; and BE IT FURTHER RESOLVED, that the Town Administrator is authorized to execute quitclaim deeds with appropriate covenants and restrictions and any other such documentation required by law. Set Public Hearing -Amendment to Code of Ethics Councilwoman Wittner explained the purpose of the amendment would be to include the position of Deputy Supervisor in the Code under the definition of sensitive position. Councilwoman Myers stated apparently this position was not included originally because the position has always been held by a Town Board member, and now the position is held by Paul Winick, a non-elected resident, who had attended a Village of Mamaroneck meeting as an attorney which had caused some confusion. Supervisor O'Keeffe said she had watched the meeting and Mr. Winick had clearly stated he was speaking as an attorney, but having said that she was in agreement the position should be included as a sensitive position in the Code of Ethics. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the Amendment to the Code of Ethics June 21, 2000 at 8:15 PM; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. Salary Authorizations -Assessor - Highway - Recreation ASSESSOR'S OFFICE The Administrator said authorization was being requested to hire Ellen Donnelly to replace Melissa Lucente who was leaving. This would be part time only until a full time person could be found to replace the position. The Supervisor sent her congratulations to Melissa who was leaving because she had received a very good job offer in her field. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to Ellen Donnelly as a part-time Assistant Assessment Clerk effective June 1, 2000 at an hourly rate of $12. The above resolution was put to a roll call vote: Seligson - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Odierna - Absent HIGHWAY DEPARTMENT On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the promotion of Antonio Fiera to Parks Foreman at a salary of $44,515 effective June 5, 2000; and BE IT FURTHER RESOLVED, that the Town Board does hereby authorize promotion of Roland Reidy to Labor Foremen at a salary of $44,515 effective June 5, 2000. She said the Dogwoods that are being donated should be planted at the lake in the fall. She said Bill O'Gorman who had been a mainstay of their organization and who has done most of the work is retiring from most of his civic positions, he has been a credit to his community. Supervisor O'Keeffe agreed, saying she is appreciative of his community spirit, loyalty, and his always being able to provide information. Richard Newman, Mulberry Street, said he was concerned about the recent death caused by a tree falling on a gardener in the Town and wanted to know the Town's tree policy. He added that he had been in contact with friends from other communities and no where else had they heard of there being two deaths within a few years from falling trees. He was especially concerned since he has a five year old daughter who walks past the area where the tree fell. Mr. Altieri said this is an area of mature trees and when there is a report of a problem we send a crew in, two of whom are assigned to pruning and inspections. He said there could be rotting of trees with no obvious outward signs as was the case with this one. Mr. Newman asked if there would be any new program put into place. The Supervisor said there will be a discussion and a review of the situation to assess whether there was anything that 11 June 7, 2000 could have been done. She said there was not any visible signs on this tree of a problem. There was then a discussion on existing policy and review of new policies. WRITTEN COMMUNICATIONS The Supervisor read the following record into the record: May 25, 2000 Chief Richard Rivera Town of Mamaroneck Police Department 740 West Boston Post Road Mamaroneck, NY 10543 Dear Chief Rivera, Please accept our very sincere thanks for the help and assistance that you and your fellow officers have extended to our family and our neighbors-this week and in the past. When I found that our car had disappeared from our driveway on Wednesday morning, I held out little hope that we would see it again. You are to be commended on the remarkable job you and your department did in recovering our car in what was just a matter of hours. Whether it was when a tree fell through our roof last fall or our burglar alarm has gone off in the middle of the night, you have been there quickly and been ready to help. The "can do"attitude, spirit of community, and smiles that your officers have brought along with them have been welcome each time at our moment of need. Each of the officers that have had occasion to visit our home over the years have been a credit to your department and to our community. Most recently, Officer Donn Edmonds was there to help us. I understand that he has recently joined the force, transferring up from Midtown Manhattan. Please know that he did a terrific job handling the matter, and was a real pleasure to deal with. I enjoyed meeting him and hope our paths cross again in the not too distant future (hopefully under more pleasant circumstances!). Just as we have taken it for granted when your department has been there to help us before, I expect other members of our community have occasionally neglected to thank you as well. Please accept our thanks and acknowledgement of your support, and know that many others out here feel the same way. I am very proud that our community is so well protected by people who bring such compassion and enthusiasm to a difficult and dangerous profession. Danehy 6 Glenn Road Larchmont, NY 10538 REPORTS OF COUNCIL Councilwoman Seligson said she attended the May 24 meeting of the Zoning Board, they had discussed two applications close to environmental areas in the Town, and were sensitive to the 12 June 7, 2000 fact that these matters are difficult for both the ZBA members and the applicants. Secondly, she said on June 13 there would be a public hearing on a Long Island Sound preserve, including preserving open space around Long Island Sound. All the public is being urged to attend. Councilwoman Myers said she had attended the Traffic Committee meeting where there was a discussion about Weaver Street. We are waiting for a study on the changes made by the Parent/Teachers Association at Hommocks School concerning drop off patterns to alleviate the parking problem and to make it safer. She said there was to be an awards show at LMC TV tomorrow evening. And the Youth Council and the Recreation Department sponsored a outdoor movie at Hommocks field for 75 kids, the fields were sprayed for mosquitoes before anyone sat on them. SUPERVISOR REPORTS The Supervisor said she and the Town Board have met with the Larchmont Library Board and the Village of Larchmont Board where they discussed what happens to surplus funds in the budget. She thanked Mr. Dentzer who had explained how the financial database can be accessed. The newsletter had been sent out. She said this had been a sad week for the Town, and the Board, since hearing the of the man being killed by the tree falling, and her sympathies, and regards went out to the family. ADJOURNMENT The Supervisor said that the next scheduled meetings would be June 21, 2000 and July 19, 2000.
