BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Jaine Elkind Eney Councilwoman Abby Katz Councilwoman Sabrina Fiddelman Councilman Jeffery L. Robson, Town Administrator Connie Green O'Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney Lindsey Luft Assistant to the Town Administrator CALL TO ORDER - WORK SESSION The Work Session of the Town Board was called to order by Supervisor Elkind Eney, then on motion of Councilwoman Katz, seconded by Councilman King, the Work Session was unanimously opened at 5:00 p.m. Review — New Harmon Drive Sidewalk Improvements Bid Award The Town Administrator recapped the New Harmon Drive Sidewalk Improvements bids, noting that the first/lowest bidder had significant deficiencies that were discovered. Therefore, the recommendation is to proceed with the second bidder Vernon Hills Contracting Corporation which was within budget. The Town Board was in favor. Approval of the contract is on the regular agenda for this evening. Review — Town Center Restrooms Bid Award Additionally present: Tracy Yogman, Town Comptroller The Town Administrator reviewed the project and noted that the first through third lowest bidders of the project all had significant deficiencies that were discovered therefore would recommend the fourth lowest bidder Camili & Sons for the restroom renovations. The Town Board discussed the need to ensure proper ventilation and a countertop area in the new bathroom. Rob Wasp confirmed via phone -call that ventilation had been addressed. The Town Board agreed to adding an additional $6,000 to the contingency budget to cover the inclusion of a vanity/countertop that was also wheelchair accessible. The desire to include a baby changing station was also noted. Approval of the contract plus the added $6000 contingency, for a total contingency of $16,340, is on the regular agenda for this evening Review — Extension of Consultant Services — Tectonic The Town Board reviewed the need for the Town to extend the agreement for consultant services for trenchless repairs with Tectonic Engineering Consultants. The Town Administrator noted that Phase 2 of the work they are doing is already part of the contract. Councilwoman Abby Katz requested a list of the areas where the trench work will be conducted. All were in favor and the extension of services is on the regular agenda for this evening. Discussion -- Accessory Dwelling Unit ("ADU") Resolution The Town Supervisor provided an update on the impending legislation on ADU's noting that public comment had resulted in the ADU legislation being removed from the Governor's budget; however, is now included in Senator Harckham's Bill in a slightly different format. Town Attorney Bill Maker highlighted the differences between the two and then suggested the Town of Mamaroneck proposed Resolution be amended and reviewed at the next meeting. March 2, 2022 OUT OF ORDER (Review of Library Proposed Budget FY 2022-2023 moved to later in meeting) Review — 2022 Capital Budget Amendments Additionally present: Tracy Yogman, Town Comptroller The Town Comptroller presented two recommendations for 2022 Capital Budget Amendments. The Ice Rink Summer Floor Insulation was for an increase in budget of $1,369.76 in the difference in actual verses budgeted cost on the Project 2021.71. The second recommendation was to transfer the balance of funding for Building and Highway Department software upgrades totaling $58,000 to the Munis capital account for Energov and Munis software upgrades. Review — 2021 Operating Budget Amendments —Year End Additionally present: Tracy Yogman, Town Comptroller The Town Comptroller recommended two budget amendments for approval. The first was for Youth Programs in Recreation for $31,358; the second, adjusting technology expenses from Part Town to General Fund in the amount of $163,611. Discussion -- Prvor Manor Road The Town Attorney explained the results of a second title search by Benchmark Research regarding Pryor Manor Road and reviewed a map highlighting the portion of the road owned by the Town of Mamaroneck and the City of New Rochelle. Supervisor Elkind Eney will notify the residents with the update and inform them that the Town does in fact own portions of the roadway and will work with New Rochelle on a resolution. Discussion -- Town Logo The Town Board discussed the Human Rights Committee's review of the history and suitability of the Town of Mamaroneck logo. The Town Supervisor will forward to Nancy Pierson the Historic Minutes that were found mentioning the creation of the logo. Further discussion of the Town logo should be part of the Comprehensive Plan. NEW BUSINESS/OUT OF ORDER - Board Member Update — Robin Nichinsky Councilwoman Nichinsky provided an update on the Sustainability Collaborative's goals, the top three of which are: food scrap collection (currently on hold awaiting next steps with Larchmont Mamaroneck Sanitation Commission); leaf blowers; and third, a new tree law. The Town Administrator noted that the Tree Law project had been delayed for a number of reasons but will be reviewed in the coming weeks. The Town Supervisor requested that Robin let the Collaborative know that we are behind, but still on it. Councilwoman Nichinsky reviewed a letter from Ralph Engel, in which he suggested amendments to the two-year renewal requirement for Special Use Permits. Mr. Engel would like to come to a Town Board meeting to address these with the Town Board. Proiect Update — Weaver Street Sidewalk The Town Administrator updated the Town Board, noting that nothing is yet finalized on the Weaver Street Sidewalk, as at least one homeowner had many questions. The Town Board revisited the merits of installing a guardrail. Councilman King again felt strongly that a guardrail should be installed for safety concerns, but the Town Board would like to move forward without a guardrail, feeling it was safer to have a sidewalk without a guardrail than no sidewalk at all. EXECUTIVE SESSION On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to enter an Executive Session to discuss potential litigation and the employment of a particular individual. On motion of Councilwoman Katz, seconded by Councilman King the Board unanimously agreed to resume the Regular Meeting. 2 March 2, 2022 Review — 2022/2023 Larchmont Library Budget Additionally Present: Lauren Gottfried, Library Chair, Laura Eckley, Library Director and Library Board Members Linnet Tse and John McGarr Lauren Gottfried began the presentation by highlighting the services and programs provided during the Pandemic. Specifically, noting curbside pickup of materials; a model throughout the County. The Larchmont Library received notification of award of a large SAM grant for $500,000 through the offices of Steve Otis and Shelley Mayer. The Larchmont Library also received a $175,000 grant to be used to install LED replacement lights. Of note in the proposed budget is a 2% increase in the Library Budget — in contrast to last year's decrease of 1% in funding as requested by the Village of Larchmont. Ms. Gottfried described the damage from Ida and highlighted the repairs that had been completed to date and that the shelves in the lower level would hopefully be installed by April, allowing the library to resume business as usual in the lower level as soon as completed. Laura Eckley, the Library Director, also reviewed the damage of Ida to the Lower Level. Ms. Eckley noted that the Budget assumes a return to most of the normal programing, as well as the majority of staffing to a pre -pandemic level. Councilwoman Fiddelman asked about the energy costs in the budget. Ms. Eckley then reviewed the improvements made 2021 including those in the Building Monitoring Systems (BMS). The BMS provides greater efficiency in the heating and cooling of the Library, hopefully providing an offset to any rise in fuel costs realized in 2022. Ms. Eckley also pointed out that E books, which took off during the pandemic have not slowed and have continued to grow. The Library is charging late fees again, but fees are significantly down because of automatic renewals. Councilman King asked Ms. Eckley about the Library Friend's fundraising work, which Ms. Eckley then described. Ms. Eckley then presented a few successes, including that the Library once again won "Best of Westchester!" Award. The Town Board asked several other budgeting questions, praised the Library for their many outstanding community services and events, then thanked the Library Board and Director for their time and for operating so effectively during the Pandemic. The Town Board will add the approval of the Library Budget to the regular agenda. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Elkind Eney at 8:00 p.m. Supervisor Elkind Eney noted that the Town Board met for a work session beginning at five o'clock this evening. SUPERVISOR'S REPORT Welcome to the March 2, 2022 meeting of the Town Board of the Town of Mamaroneck. The Town Board met today for a Work Session in Conference Room C starting at 5:00pm, which is open to the Public 1 want to update you about the Comprehensive Plan update. We had the Kick -Off Meeting for the Comprehensive Plan Steering Committee last night. It was a wonderful first meeting. 1 think we have a great NEW steering committee —they are energetic, enthusiastic, engaged and involved. It was clear that the consulting team was professional and on point. You will be hearing about this a lot in the coming months. Please be on the lookout for opportunities to participate. Community outreach is critical to the success of the plan and is critical in helping the Town Board set priorities. At the February 16, 2022, Town Board Meeting 1 reported to you that as part of the Governor's Executive Budget for FY2023, two amendments to NYS land use laws were proposed. One amendment would require every municipality in the state to authorize the creation of one Accessory Dwelling Unit ("ADU") per residential lot. The other, a Transit Oriented Development ("TOD") mandate, would require every municipality to permit development of at least 25 dwelling units per acre on any residential -zoned land within % mile of a rail station, in our case a Metro North train station. 3 March 2, 2022 The concern was that both proposed amendments are worded in a way which, for all practical purposes, removes our locally determined land use process called Home Rule and do not provide and affordability component. Last week we got word that the Governor removed both of these provisions from her budget. The Town of Mamaroneck is always seeking opportunities for affordable housing in our community -- this proposal failed to address that goal, while taking away Home Rule We continue to work with the Village of Larchmont Board on a restructuring of the sanitation commission. Being that there are no public hearings tonight, the next item on the agenda is Citizen comments. CITIZEN'S COMMENTS Supervisor Elkind Eney asked if anyone in the audience wished to address the Town Board, and there was not. STAFF PRESENTATION Shaun Hughes, Town of Mamaroneck Fire Chief, provided an update on the Town of Mamaroneck Fire Department, highlighting the following: • Town of Mamaroneck Fire Department (TMFD) has 50 volunteers and 14 career staff. • TMFD includes 3 Engines, 1 Ladder, 1 Rescue, 1 Utility. • F.A.S.T. (Firefighter Assist Team) provides mutual aid to all sound shore departments. • Average 1200 calls per year, but realized a jump to 1400 calls in 2021 due to storm Ida. • TMFD responds to a vast territory, including 1-95 and Saxon Woods Trails. • There will be a vote to approve two new engines (1 lost in Ida, 1 up for replacement) on March 15tn at the TMFD firehouse on Weaver Street from 3pm to 9pm. • The TMFD is happy to assist at community events including the Bunny Hop 5K Race, Food Truck Festival, and helped during COVID to distribute essential supplies to the community. • Currently working with high schools on a senior internship initiative for students to learn more about the fire service. Doubtful for 2022, but definite for 2023. • Working on a "Close the Door" fire safety program, to present to residents in all apartments within the Town of Mamaroneck hopefully during May of this year. BOARD OF FIRE COMMISSIONERS Commissioner Elkind Eney called the Meeting to order, then on motion of Commissioner Katz, seconded by Commissioner Nichinsky, the Board of Fire Commissioners was unanimously declared open. Award of Bid — New Harmon Drive Sidewalk Improvements On motion of Councilwoman Katz, seconded by Councilman King, the following was approved, WHEREAS, on February 4, 2022, the Town publicly opened and read seven (7) bids for Contract TA-22-01 NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award TA-22-01 to Vernon Hills Contracting Corporation, the lowest responsible bidder meeting all the Town's requirements, for a total base bid amount of $240,630, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute the contract and any related documents necessary to carry out its implementation on behalf of the Town. Award of Bid — Town Center Restroom Renovations On motion of Councilwoman Fiddelman, seconded by Councilman King, it was WHEREAS, on January 25, 2022, the Town publicly opened and read seven (7) bids for Contract TA-22-02 NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award TA-22-02 to Camilli & Sons, the lowest responsible bidder meeting all the Town's requirements, for a total base bid amount of $189,660, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute the Contract and any related documents necessary to carry out its implementation on behalf of the Town.
