BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened at 5:00PM. TAKEN OUT OF ORDER Washington Square Parking Law Additionally Present: Doris Block, Traffic Committee Chair The Town Board reviewed a memo form Bill Maker with six suggested modifications to the proposed law th based on comments received at the Public Hearing on June 4. Some additional suggestions from the Board Members’ discussed were: create a citizens committee, consider removing all regulations, change restricted parking to 9:00-1:00 with no other limitations, install pay and display meters from 10:00-3:00 with no residential permit, have all buildings vote on a proposal, create a special district to finance additional parking spaces along New Jefferson, mail survey to every resident. After the discussion the Town Board asked Mr. Maker to rewrite the law with the changes as outlined in his memo, with the addition of the reduced fee to $20.00. The Town will hold another public hearing in September. Update – Westchester Joint water Works (WJWW) Supervisor Seligson gave a recap of the current situation regarding WJWW. It was stated that Mr. Canetta, th the Director of the WJWW will be at the July 9 Town Board Meeting. The Town Board reviewed a memo from Mr. Altieri dated June 12, 2014, detailing matters regarding the WJWW that have impact for the Town of Mamaroneck, as well as having relevance for discussing the 2014/2015 water rate increase. Attachments included were: WJWW 2013 Earnings Distributions, WJWW Preliminary 2014 Budget and Local Water Fund Requirements, WJWW Capital Improvements, and WJWW Rate Increase History. Supervisor Seligson stated that these large scale projects have been continually discussed at the WJWW meetings. The Board Members were asked to review the documents distributed this evening and be prepared to vote on a water rate at the July meeting. Town Noise Ordinance Supervisor Seligson stated that she has been contacted by a resident on Lafayette Street who has lived through major construction on Barella Lane and now dealing with additional construction from a neighbor. He would like the Town to consider modifying the ordinance to minimize construction on the weekends. The Town Board will add this as an item to the July meeting agenda. Councilwoman Elkind Eney noted that the Planning Board is also discussing this matter and will be bringing a recommendation to the Town Board. 1 June 18, 2014 Update – Westchester County Housing Settlement Supervisor Seligson reported that the Westchester County Board of Legislators met with the Westchester Officials to discuss changes to the Housing Settlement. It is unclear how the Board of Legislators will move forward, but the situation is very contentious. NEW BUSINESS The Town Board reviewed the local law drafted for this evening’s Public Hearing and noted that it needed some correcting in terms of the current number of handicapped spaces as well as their locations. The Board would also like the name of the law to be changed to ‘codifying’ not ‘establishing’, as these spaces already exist but do not have coinciding legislation. The Town Board also reviewed and discussed the consideration of the local law authorizing the Energize New York Program. It was noted that this was mistakenly listed on the Regular Agenda and should have only been part of the Worksession Agenda. The Town Board discussed the terminology in the draft which refers to ‘proportionately’. Additionally, the Board had asked for verbiage to be included that reflected their discussion of a capping mechanism. Mr. Maker and Mr. Altieri will do a red lined redraft. Supervisor Seligson noted that she has been asked by Steve Moser and Mith Green for the Town to apply for a ‘Bike Friendly Community’ label. Supervisor Seligson stated that Russell Heller, the summer intern, will take a look at the application. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT th The Town held a lively public hearing at the last board meeting on June 4 regarding proposed parking legislation for resident parking permits in the Washington Square area. Thank you to all the residents that attended and participated. We discussed the situation at our work session tonight and reviewed the comments. Town Attorney Bill Maker provided us with a memo outlining the 5 key issues he recognized from the hearing. The Town Board has asked him to include the 5 issues in revised legislation that we will review at our next board meeting. The Town Board plans to hold another public hearing on the revised legislation in September when people have returned from vacations. We hope to open the public comment period after our next meeting July 9, 2014 to allow people to comment before the public hearing as well. The Sustainability Collaborative has drafted a preliminary Sustainability Plan that will be distributed to participants of the charette workshops and others who have been involved in the process. I attended the Volunteer Recognition event at Sarah Neuman Nursing Home and presented a proclamation on behalf of the Town and the Village of Mamaroneck thanking the volunteers for their service. I noticed Fran and Mario Antonelli, and Tony Marsella specially. I also attend the Sheldrake Environmental Center’s Party on the Pond with Jaine Elkind Eney. We provided proclamations for the three honorees there which included Carol Cassazza Herman and the two women who own Recologie store. I attended a Housing Settlement meeting at the County discussing how to move forward with the stalemate between the County and HUD regarding the Settlement. I spoke briefly at the Summit breakfast about our underground infrastructure and how it relates to our quality of like and Long Island Sound. Larchmont Mayor Anne McAndrews, Steve Altieri and Mamaroneck Village Manager Rich Slingerland did an excellent job talking about the infrastructure on the panel. Steve and I met yesterday with two members of the Sustainability Collaborative who would like the Town to be the first community in Westchester County to apply for Bicycle Friendly Community status. The Town is looking into creating a shared services arrangement with the City of New Rochelle for the Pryer Manor area. Steve and I will attend a meeting with County staff tomorrow to talk about reducing inflows and infiltrations creating large flows and volumes of water in sewer pipes. The Town applied for two grants recently. One is from the NYS DOT to build a sidewalk on Weaver Street between Murray Ave. and Bonnie Way. The other is for green infrastructure including a green roof, porous pavement 2 June 18, 2014 parking lot, rain harvesting system and rain garden and porous pavers all here at the Town Center from NYS Consolidated Funding Application. Reminder to everyone, gasoline powered leaf blowers are prohibited from June 1 to September 30 in the Town of Mamaroneck. They are not allowed. Please tell your landscapers and gardeners not to use them. Thank you. CITIZEN’S COMMENTS Don Ibelli, of Leafy Lane addressed the Board. Mr. Ibelli stated that he had heard from neighbors that the Town was considering a parking changes on Leafy Lane. In response, it was stated that the current legislation is regarding parking on Murray Ave up to Leafy Lane, not including Leafy Lane. The Parade ends with a Carnival in Harbor Island that continues through July ___. There being no further business to come before the Commission, on motion of Commissioner Katz, seconded by Commissioner Elkind Eney, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1.Consideration – Energize New York Program Deferred until July 9, 2014 4 June 18, 2014 2.Discussion – 2014 Water Rate Increase Mr. Altieri explained that it is the time of year when the WJWW and the participating municipalities are notified by the City of New York as to what the water rate will be for the WJWW. Subsequently this leads to a discussion of the rate for the participating municipalities within the WJWW. The rate from the City of New York for 2014 will be 5.1%. Mr. Altieri continued by stating that part of the discussion is the proposed capital projects in the amount of $854,960.00 over the next two years. The most significant project is the conceptual study for the water main UV Alternative-Shaft 20 Connection - a new water main that would draw water from Shaft 20. The project estimate is $590,000 with the Town share being 117,410.00. Mr. Altieri continued by addressing some of the other capital projects and stated that Tony Canetta the Director for the WJWW will be at the next Town Board meeting to discuss the water rate. The Town is considering a rate increase of between 7 - 8%. Supervisor Seligson stated that the Town Board is anticipating a vote on this increase at the next Town Board Meeting. 3.Salary Authorization – Town Comptroller’s Office On motion of Councilman Murphy, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board does hereby appoint Wendy Li to the full-time position of Administrative Intern in the Comptroller’s Office effective June 19, 2014 at an annual salary of $59,421.00. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 4.Authorization – IMA – City of New Rochelle-Road Resurfacing On motion of Councilman Murphy, seconded by Councilman Odierna, the following was approved, WHEREAS, in 2013 the Town of Mamaroneck along with the Villages of Pelham Manor, Pelham, Village of Mamaroneck, the Village of Larchmont and the City of New Rochelle, joined together to issue a consolidated road resurfacing project, and WHEREAS, the project proved successful and was an excellent example of shared services. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal Agreement with the City of New Rochelle in order to publicly bid and award a contract for implementing a street paving resurfacing contract, and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to sign said agreement on behalf of the Town. NOW THEREFORE, BE IT RESOLVED, that Nathalie Orans be appointed as Member G of the Recreation Commission, and BE IT FURTHER RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 31, 2019. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 7.Approval – Change of August Meeting Date On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve changing the thth August Town Board Meeting date from August 6 to August 13. 6 June 18, 2014 APPROVAL OF MINUTES On motion of Councilwoman Elkind Eney, seconded by Councilman Odierna, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of May 28, 2014. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Murphy noted that he and the Town Board attended a wonderful social event and congratulations go pout to Jessica Katz’, Abby’s daughter on the occasion of her Bat Mitzvah. Councilman Murphy highly recommends the Fireman’s parade as a wonderful event to attend, as well as the Carnival th and excellent Village of Mamaroneck July 4 fireworks. On behalf of Supervisor Seligson Councilman Odierna attended the Bronx River Sound Shore Audubon Society honoring Mary Davis. The event was held at Five Island Park. He attended the LMC-TV Annual Awards Show at the VFW, adding what a wonderful affair it was at its new venue. Also on behalf of Supervisor Seligson, Councilman Odierna attended the Teens for Community event at the local Chabad, an th event recognizing teens in our Community. The Healthy Mamaroneck Fair was held on June 14. It was held in conjunction with the Hispanic Resource Center and was a packed event. Councilwoman Katz was unable to attend the Library Meeting as it was held during tonight’s meeting, but she read a written report. Her other liaison assignments will meet next week. Councilwoman Elkind Eney attended the Recreation Commission Meeting at which they reviewed the summer programs and visited the Ice Rink to see the status of the improvements. Grievance Day was held yesterday and the Town received half of the amount of claims that it did last year – a testament to the work done on revaluation. She and other Town Board Members attended the ‘Party on the Pond’ benefitting the Sheldrake Environment Center and honoring the amazing body of work of Carol Cassaza Herman. Councilwoman Elkind Eney attended the Planning Board Meeting at which an interesting permit was discussed in which property owners discussed property lines and set backs involving a stream. It appears that in the Town’s wetlands law the property lines go into the center of the stream. Supervisor Seligson questioned the validity of that noting the Town law does have required buffer zones. Supervisor Seligson stated that this should be reviewed. Councilwoman Elkind Eney attended the Sustainability Collaborative Meeting at which they presented the first draft of the Sustainability Plan. Councilwoman Elkind Eney noted how well the Collaborative coalesced the information from the various charettes into a very impressive document. Councilwoman thth Elkind Eney announced other July 4 events including the Village of Larchmont’s July 4 events at Flint Park th and Bastille Day on July 13 from noon to 9:00pm. Councilwoman Katz added that the Town is moving ahead with web site redesign, noting a mockup of the front page is ready for review.
