BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened at 5:00PM. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to enter into an Executive Session to discuss potential litigation and the employment history of a specific employee within the Community Services Department. EXECUTIVE SESSION Potential Litigation Employment History - specific employee within the Community Services Department. On motion of Councilwoman Katz, seconded by Councilman Odierna, the Board unanimously agreed to resume the Regular Meeting. Update – Washington Square Parking Law Implementation The Town Board reviewed a memo from Mr. Altieri dated November 14, 2014 outlining the implementation progress. The Town Board reviewed a draft letter to residents’ which included a draft permit application. The Town Clerk will manage the distribution of the information to the buildings, and uploading it to the web site. Mr. Altieri will send out a robo call next week. Mr. Altieri then discussed the two amendments to the legislation that need to be addressed and asked Mr. Maker to explain. Mr. Maker explained that, (1) the ‘except holidays’ needs to be added to the no parking on each street once a month and (2) there be a non-progressive fine structure due to its administrative difficulty in the Court. Setting a public hearing for these amendments is on the Regular Agenda for this evening. Update – Assessment Administration Village of Mamaroneck Mr. Altieri informed the Town Board that he and Town Assessor Pamela Valenza, met with Officials from the Village of Mamaroneck and the Town of Rye. This was the first meeting since the Village of Mamaroneck enacted legislation which eliminated the Village Assessor and adopted the Town’s Assessment Roll. The issues to be addressed are the specific exemptions, the Homestead Option and the discrepancy of Lot designations; for example Hampshire is classified in the Town of Mamaroneck as one Lot and in the Village of Mamaroneck as four Lots. Mr. Altieri noted that the Town has done its homework and now most of the work needs to be done by the Village of Mamaroneck. 1 November 19, 2014 Update – Ice Rink Fire Alarm System Mr. Altieri reported on steps being taken to address the issue of the fire alarm at the Ice Rink. Currently the humidity in the Rink is causing the fire alarm to activate. A few options have been discussed and the recommendation is, in addition to the dehumidifiers already installed, to install heaters to eliminate moisture. The cost for this is $13,900.00. ADDED ITEM Supervisor Seligson has been asked by a resident if the Town would consider extending the organic waste pickup farther into the fall, adding that this is an issue the Board has discussed in the past. The feeling is that residents have not completed their full fall clean up before the organic waste pick up ends. The Town Board thought this would be a positive change to implement next year. Update – Columbia University Cap Stone Report – Solid Waste Supervisor Seligson noted that the Capstone Group report should be completed in about a week. As the Board will recall, the Capstone Group has been studying how the Town can better reduce solid waste and increase recycling. Supervisor Seligson stated that a case study in the report does point to pay-as-you- th throw as a good initiative. A public presentation will take place on December 9 at Mamaroneck High School. Discussion – Employee Incentive Programs The Town Board reviewed a memo prepared by Connie Green O’Donnell outlining the proposed retirement incentive programs for the PBA, PFFA and CSEA. Connie Green O’Donnell explained in detail the various incentives. This item will be on the Regular Agenda for this evening. New Business Mr. Altieri noted that Westchester County has verbally approved funding for a senior bus. Funding would be $10,000 with the purchase being made by December 31, 2014. Currently it is in the Capital Budget for borrowing, but Mr. Altieri will keep the Board apprised should the County funding come through. The Town Board Members reviewed their various Board & Commission assignments with respect to reappointments. The Town Board Members noted the individual members they have spoken to or will be calling. The Town Board reviewed the Sewer Rent Law on the Regular Agenda this evening for setting a public hearing. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to enter into an Executive Session to discuss employment history of elected officials. EXECUTIVE SESSION Employment History of Elected Officials. On motion of Councilwoman Katz, seconded by Councilman Odierna, the Board unanimously agreed to resume the Regular Meeting. 2 November 19, 2014 CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:10 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT The Town Board continues to work on the 2015 budget through weekly meetings with Town Dept. Heads and the Town Administration. We are encouraged to be in a better financial situation than the past few years and plan to stay within the State-imposed tax levy cap. The budget meetings are open to the public and we encourage residents to attend if interested. The Town Highway Dept is busy picking up fall leaves. We are not able to pick up leaves contaminated with grass clippings, branches or other organic debris. The leaves are collected by the Town, but then transported to the County which will no longer accept the leaves if other organics are mixed in. I have been continuing to work with Sustainable Westchester, the merged organization of SWEAC and NWEAC. The initial meeting to elect a board of directors will be December 2, 2014. We had several very nice Veterans Day events in the Town. I want to thank VFW Post 1156, and American Legion Posts 90 and 347 for their Veteran’s Day services. It is an honor to participate in the ceremonies and we appreciate the Posts for including the community and reminding us of the importance of our Veterans. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. PUBLIC HEARING (S) – Water District Bonds The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING Town of Mamaroneck Water District No. 1 Westchester County, New York PLEASE TAKE NOTICE that the Town Board of the Town of Mamaroneck, Westchester County, New York, will meet at the Town Hall, in Mamaroneck, New York, in said Town, on th the 19 day of November, 2014, at 8 o’clock P.M., Prevailing Time, for the purpose of conducting a public hearing relating to the proposed increase and improvement of the facilities of the Town of Mamaroneck Water District No. 1 of said Town, being said Water District’s share of the cost of the improvement of facilities of the Westchester Joint Water Works of the Town/Village of Harrison, the Village of Mamaroneck and the Town of Mamaroneck (“WJWW”), being the installation of modular standby generators that will initially be located at the Rye Lake Plant to replace the current non-functioning propane standby generator, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $125,000 to the Water District at which time and place said Town Board will hear all persons interested in the subject thereof concerning the same. 3 November 19, 2014 The capital project described above is a “Type II Action” pursuant to the regulations promulgated under the State Environmental Quality Review Act (“SEQRA”) which will not result in a significant environmental effect and SEQRA compliance materials are available for inspection at the Office of the WJWW where they may be inspected during normal business hours. On motion of Councilman Murphy, seconded by Councilman Odierna, the following was approved: In the Matter of PUBLIC Increase and Improvement of the Facilities of the INTEREST Town of Mamaroneck Water District No. 1 of the ORDER Town of Mamaroneck, Westchester County, New York: WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has under consideration, a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and improvement of the facilities of the Town of Mamaroneck Water District No 1 of the Town (the “Water District”), being its share of the improvement of facilities of the Westchester Joint Water Works of the Town/Village of Harrison, the Village of Mamaroneck and the Town of Mamaroneck (together, the “WJWW”), being the installation of modular standby generators that will initially be located at the Rye Lake Plant to replace the current non-functioning propane standby generator, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $125,000; and WHEREAS, at a meeting of said Town Board duly called and held on November 5, 2014, an Order was adopted by it and entered in the minutes specifying the said Town Board would meet to consider said increase and improvement of the facilities of Water District No. 1, and to hear all persons interested in the 4 November 19, 2014 subject thereof concerning the same at the Town Hall, in Mamaroneck, New York, in said Town, on November 19, 2014 at 8:00 o’clock P.M., Prevailing Time; and WHEREAS, said Order duly certified by the Town Clerk was duly published and posted as required by law; and WHEREAS, a public hearing was duly held at the time and place set forth in said notice, at which all persons desiring to be heard were duly heard; NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. A RESOLUTION AUTHORIZING THE ISSUANCE OF $125,000 BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE INCREASE AND IMPROVEMENT OF THE TOWN OF MAMARONECK WATER DISTRICT NO. 1, IN AND FOR SAID TOWN. WHEREAS, the capital project hereinafter described has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation 5 November 19, 2014 promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, said regulations provide will not result in a significant environmental effect; and WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with the provisions of Section 202-b of the Town Law, and more particularly an Order dated the date hereof, said Town Board has determined it to be in the public interest to increase and improve the facilities of the Town of Mamaroneck Water District No 1 of the Town (the “Water District”), being its share of the improvement of facilities of the Westchester Joint Water Works of the Town/Village of Harrison, the Village of Mamaroneck and the Town of Mamaroneck (together, the “WJWW”), being the installation of modular standby generators that will initially be located at the Rye Lake Plant to replace the current non-functioning propane standby generator, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $125,000; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of the increase and improvement of the facilities of the Town of Mamaroneck Water District No 1 of the Town (the “Water District”), being its share of the improvement of facilities of the Westchester Joint Water Works of the Town/Village of Harrison, the Village of Mamaroneck and the Town of Mamaroneck (together, the “WJWW”), being the installation of modular standby generators that will initially be located at the Rye Lake Plant to replace the current non-functioning propane standby generator, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $125,000, there are hereby authorized to be issued $125,000 bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the plan for the financing of said specific object or purpose is by the issuance of the $125,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is 40 years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. To the extent not paid 6 November 19, 2014 from monies raised from said Water District in the manner provided by law, there shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as the Supervisor shall deem best for the interests of said Town, including, but not limited to, the power to sell said bonds to the New York State Environmental Facilities Corporation; provided, however, that in the exercise of these delegated powers, the Supervisor shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine consistent with the provisions of the Local Finance Law. Section 8. The Supervisor is hereby further authorized, at his or her sole discretion, to execute a project finance and/or loan agreement, and any other agreements with the New York State Department of Health and/or the New York State Environmental Facilities Corporation, including amendments thereto, and including any instruments (or amendments thereto) in the effectuation thereof, in order to effect the financing or refinancing of the specific object or purpose described in Section 1 hereof, or a portion thereof, by a bond, and/or note issue of said Town in the event of the sale of same to the New York State Environmental Facilities Corporation. 7 November 19, 2014 Section 9. The power to issue and sell notes to the New York State Environmental Facilities Corporation pursuant to Section 169.00 of the Local Finance Law is hereby delegated to the Supervisor. Such notes shall be of such terms, form and contents as may be prescribed by said Supervisor consistent with the provisions of the Local Finance Law. Section 10. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 11. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 12. This resolution, which takes effect immediately, shall be published in summary form in the official newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Councilman Murphy Aye Councilwoman Elkind Eney RECUSE Councilwoman Katz Aye Councilman Odierna Aye Supervisor Seligson Aye PUBLIC HEARING (S) – “Addition of Certain Titles to the List of Constables” Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on November 5, 2014 a Public Hearing will be held on Wednesday, November 19, 2014 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Addition of Certain Titles to the List of Constables” Law Purpose: The Town Board enacted new parking regulations for the Washington Square area that go into effect on January 1, 2015. To enforce that law as well as the laws regarding parking in the Town- owned parking lots and on Lester Place the Town Board may create the position of Parking Enforcement Officer. 8 November 19, 2014 Chapter 34 of the Code of the Town of Mamaroneck is entitled “Quality of Life Laws; Enforcement”. Section 34-2 grants to persons serving in certain positions the additional title of “Constable” and empowers Constables to enforce those quality of life laws that are listed in section 34-2. The purpose of this local law is to add the title of Parking Enforcement Officer to the list of Constables in section 34-2 and to add the chapter of the Code that contains the rules for Town-owned parking lots to the quality of life laws listed in section 34-2. In addition, the person who formerly possessed the title of Environmental Coordinator has been promoted to Environmental Planner. A person serving as Environmental Coordinator is a Constable. Accordingly, it is appropriate to add the title of Environmental Planner to list of Constables. This local law does so. The full text of this Amendment is stated below and can also be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, New York PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: November 11, 2014 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was unanimously opened. Supervisor Seligson explained that as part of the Resident Parking District discussion, there was an understanding that a parking enforcement officer would be created. This legislation establishes that position. Supervisor Seligson asked if anyone wished to comment. On motion of Councilman Odierna, seconded by Councilman Murphy, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved, Local Law No. 6 - 2014 This local law shall be known as the “Addition of Certain Titles to the List of Constables” Law. Section 2 – Amendment of a current section of the Mamaroneck Code: The definition of “Constables” in section 34-2 of the Code of the Town of Mamaroneck hereby is amended as follows: (a) the title “Environmental Planner” is added between the words “Coordinator, Fire”, and (b) the title “Parking Enforcement Officer” is added between the words “Inspector, police”. Section 3 – Amendment of a current section of the Mamaroneck Code: The definition of “Quality of Life Laws” in section 34-2 of the Code of the Town of Mamaroneck hereby is amended as follows: (a) subparagraphs (7) through (14) of paragraph A are renumbered (8) through (15), respectively and a new subparagraph (7) reading as follows: “Chapter 147, Parking Lots, Town-Owned” is added and will appear immediately after subparagraph (6) of paragraph A. (b) a new paragraph C is added to paragraph A that will read as follows: C. Local Laws. (1) Local Law No. 2-2010, Residential parking system for Lester Place. (2) Local Law No. 4-2014, Residential parking system for(a) Washington Square, (b) a section of North Chatsworth Avenue, (c) New Jefferson Street, and (d) Murray Avenue between Myrtle Boulevard and Leafy Lane. Section 4-Reaffirmation of the balance of the law: Except as amended by sections 2 and 3 hereof, section 34-2 of the Code of the Town of Mamaroneck shall remain the same. Section 5 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 6 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. After discussion of the size and type of generator it was decided to remove the generator from the Contract and purchase one separately. A credit of $135,000 was deducted from the contract price with Honeywell. The breakdown for the new generator is now as follows: Generator Purchase $52,850 Site Work $16,400 Electric Work $34,400 Total $104,650 On motion of Commissioner Elkind Eney, seconded by Commissioner Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the contract 11 November 19, 2014 with Nick Bruno Electric, LLC, in the amount of $34,400.00, for site work at the Weaver Street Fire House as part of the installation of a new generator. AFFAIRS OF THE TOWN 1.Authorization - Intermunicipal Agreement Westchester Joint Water Works Supervisor Seligson explained that as part of the Westchester Joint Water Works’ application to New York State Environmental Facilities Corporation (EFC) for a zero interest loan for the purchase of modular generators, the EFC is requiring that each Municipality adopt bonding resolutions for their share of the financing and to enter into an Intermunicipal Agreement with Westchester Joint Water Works and its participating Communities. The Town will hold a public hearing on the bonds as required, but does not anticipate issuing these bonds as the Westchester Joint Water Works is financing the project. On motion of Councilman Odierna, seconded by Councilman Murphy, the following was approved, WHEREAS, the Westchester Joint Water Works has applied for a grant and a zero interest loan from the New York State Environmental Facilities Corporation (EFC) to purchase modular generators to be used at their various pumping stations and water facilities, and WHEREAS, as a requirement from EFC, the Westchester Joint Water Works and its participating Communities must enter into an Intermunicipal Agreement. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal Agreement among the Town of Mamaroneck, Village of 12 November 19, 2014 Mamaroneck, the Town/Village of Harrison, and the Westchester Joint Water Works, and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to sign said agreement on behalf of the Town. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 2.Authorization – Employee Incentive Programs On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the following was approved, WHEREAS, the Town Board of the Mamaroneck has determined that escalating costs necessitate an effort to consider various options that would reduce Town expenditures, and WHEREAS, the Town of Mamaroneck has determined that offering a retirement incentive plan to employees in the bargaining units represented by the Town of Mamaroneck Police Benevolent Association (the “PBA”), the Town of Mamaroneck Professional Firefighters Association (the “PFFA”) and the Town of Mamaroneck Civil Service Employees Association (the “CSEA”) is a way to reduce the Town’s future expenditures. NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Mamaroneck hereby approves the terms and conditions of the Voluntary Retirement Incentive Plan (“the Plan”) negotiated between the Town and the PBA, the Town and the PFFA and the Town and the CSEA in the agreements attached hereto, which is conditioned upon, among other things, eligible PBA, PFFA and CSEA unit members resigning their employment for purposes of retirement on January 31, 2015, and BE IT FURTHER RESOLVED, that eligible employees shall have the opportunity to elect to participate in the voluntary Plan from December 1, 2014 through January 15, 2015, and BE IT FURTHER RESOLVED, that the Town Administrator is hereby authorized on behalf of the Town to enter into the Plan in the forms attached hereto, and take any and all actions as he deems necessary to implement and carry out the provisions of the Plan. This law creates a § sewer rent to be imposed upon the properties that discharge sewage into the Town of Mamaroneck’s sanitary sewer system. The rents will be used to operate, maintain and repair that sewer system and if deemed appropriate by the Town Board and not prohibited by General Municipal Law 453 (3), to expand such system. The Town Board finds that a sewer rent more § equitably distributes the cost of the sanitary sewer system because it is a function of usage computed based upon water consumption and is charged to all the users of that system, including tax exempt properties. On motion of Councilman Odierna, seconded by Councilwoman Katz, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Establishment of a Sewer Rent Law” Law, for December 3, 2014 at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 5.Set Public Hearing – Amendment to LL 4-2014 – Resident Parking District The purpose of the proposed Amendment is as follows: On September 17, 2014, the Town Board enacted Local Law No. 4-2014 establishing a residential parking system for(a) Washington Square, (b) a section of North Chatsworth Avenue, (c) New Jefferson Street, and (d) Murray Avenue between Myrtle Boulevard and Leafy Lane, effective January 1, 2015. When the Town staff reviewed the law as they were preparing for its implementation, the staff questioned certain provisions, specifically whether the absolute ban on parking between the hours of 9:00 AM and 11:00 AM on certain days should apply when those days are public holidays and whether it was practical, from an administrative standpoint, to have fines increase if there are multiple violations during a twelve month period. 14 November 19, 2014 Upon considering the staff’s comments, the Town Board finds that the absolute ban on parking between the hours of 9:00 AM and 11:00 AM should not apply on days that are public holidays. Furthermore, the Town Board finds that now that the Town has created the position of Parking Enforcement Officer, whose role will include regularly patrolling the Washington Square area and issuing tickets to motor vehicles violating Local Law No. 4-2014, there is no need to increase the fines for each violation within a twelve month period. A ticket, whose violation carries a fixed, standard fine, if issued on a number of occasions, should suffice to discourage repetitive violations. APPROVAL OF MINUTES On motion of Councilman Murphy, seconded by Councilwoman Katz, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of November 5, 2014. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Murphy noted the very moving Veterans’ Day Ceremony held at the American Legion Post 90 in the Village of Mamaroneck, adding that this is a very nice thing we do as a Community. He wished everyone a happy Thanksgiving. Councilman Odierna was away and sorry to have missed some of the Veterans’ Day events. He did attend the Kemper Memorial Service, noting he was particularly moved by the presentation by the young woman member of the Coast Guard. Councilman Odierna attended the Interfaith Council Thanksgiving, held at Saint Augustine’s Church – a wonderful evening. He noted the numerous Budget Meetings the Town Board has held. Councilwoman Katz attended the Westchester Joint Water Works Meeting. She also attended the Westchester Municipal Officials Dinner where the topic of ethics was discussed. Councilwoman Katz attended the Library Board Meeting, adding that all programs are doing well and they are moving forward with the Transformation Project. Councilwoman Elkind Eney noted that she has been a bit out of commission, so to speak. Councilwoman th Elkind Eney did attend the Fire Council Meeting on November 17, noting their discussion of the purchase of new apparatus.
