BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was unanimously opened at 5:00PM. Preliminary Review – 2015 Capital Budget The Town Board reviewed an initial Capital Project report as submitted to the Town by the Department Heads. Mr. Altieri noted that this initial review of Capital Projects is earlier than usual, but he wanted the Board to have a chance to review and digest these requests. Mr. Altieri walked the Board through the schedule highlighting some of the emphasized projects. Supervisor Seligson would like funds included that would address the edging/curbing along the Brook and along Hommocks Road, places where curbing is not possible but some form of edging needs to be applied. Councilwoman Elkind Eney asked to include the proposal from Ralph Engel regarding the additional parking on New Jefferson Street. Supervisor Seligson asked the Board to consider this list and see what personal wish lists they would like addressed. The Board discussed the timing of legislation needed in order to overide the tax cap. Review of Draft Sustainability Plan with Sustainability Collaborative Additionally Present: Representatives from the Sustainability Collaborative, Tony Gelber, Chair, Frank Owens, Elizabeth Radow, George Roniger, Michelle Lewis, Mitch Green and Steve Moser. The Board received a PowerPoint presented by Tony Geller and Mitch Green highlighting the draft Sustainability Plan and the proposed initial budget. The Collaborative is asking the Board to review the plan, give feedback and establish a budget line item in the amount of $25,000. The Board and the Collaborative will readdress the plan and any Town Board feedback in a few weeks. Sustainable Westchester Organization Supervisor Seligson stated that as previously discussed the Town would like to support and join the Sustainable Westchester Organization, to that effort she would like to add the payment of dues in the amount of $1,000. as an added item to this evening’s agenda. 1 October 1, 2014 Washington Square Parking – Myrtle Boulevard/Baldwin Avenue The Town Board reviewed a memo from Mr. Altieri outlining what was heard at the Public Hearing regarding Washington Square Residential Parking legislation, specifically, that Myrtle Blvd be included in the residential parking district now that that street is zoned business and residential. Mr. Altieri is recommending that Baldwin Avenue which has issues with commuter parking and residents’ without driveways also be included in a Home Rule Request. Mr. Altieri and Mr. Maker will work on draft Home Rule legislation. New Business Mr. Maker distributed a red-lined version of the amendment to the restricted parking on Murray Avenue law which is on the Agenda this evening for setting a public hearing. Supervisor Seligson notified the Board that her Uncle may submit a bid for the current RFP issued by the Town with respect to insurance . Supervisor Seligson also noted that there is a small amount due toward the retirement gift for Phyllis Wittner and asked that she submit a claim form in the amount of $350.00 for that expense. On motion of Councilwoman Katz, seconded by Councilman Murphy, the Board unanimously agreed to enter into an Executive Session to discuss the Durham Road litigation. EXECUTIVE SESSION Durham Road Litigation On motion of Councilman Murphy, seconded by Councilwoman Katz, the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT The Town’s updated and new website went live last week and is up and running. It will continue to be a work in progress and a living document. Information will be routinely updated and the latest information regarding Town meetings and issues will be available. Please let us know if you find typos or mistakes on the website. Our web administrator is my assistant and the Sustainability Coordinator, Andrea Grenadier. Her phone number is 381-7806. Her email is agrenadier@town ofmamaroneck.org. We think you will find the new website more helpful and easier to use. There is a new Sustainability page that addresses environmental initiatives and there are pictures of elected officials and some employees. The Sustainability Collaborative presented the draft Plan for a Resilient and Sustainable Mamaroneck at our work session tonight. The Plan calls for improving our resiliency to weather events, improving our sustainability for the future and enhancing our quality of life. The Town might be one of the few communities that did not pay a consultant to write a sustainability plan. We are 2 October 1, 2014 very lucky to have 6 dedicated residents who are writing ours with input from other residents and the Town Board. The Collaborative will incorporate comments into a revised and fuller version of the Plan. They hope to present it for adoption in November. The Board discussed joining Sustainable Westchester in the work session tonight also. Sustainable Westchester is the merged entity of two regional environmental consortiums in the County. They will help municipalities address energy, waste, and other municipal issues. The Columbia University Capstone Group has chosen the Town for a project as part of their master’s program. They will work with the Town to develop ways to reduce solid waste and help the Town become a near-zero waste community. Steve and I met with the group on Saturday morning at the Sanitation Facility at the Town yard. They are an impressive group of experienced, interested and pretty young people. th The preliminary Town budget will be delivered by Steve Altieri to the Town Board October 15, at our next Town Board meeting. We began an early discussion about the capital budget this evening. The Paine to Pain half marathon was held Sunday September 21. This is the race organized by the Sound shore Runners Club and Eric Turkewitz on the Colonial Greenway. The Colonial Greenway is a 15 mile trail loop through 5 municipalities that includes parts of the Leatherstocking trails. Over 700 people registered for the event. Runners sponsored by companies and running clubs participate. I was honored to hold the finish line for the first place woman finisher. The finish is at the New Rochelle high school track where they had a DJ, food stalls, running equipment, race mementos, and lots of spirit. Finally, please come to the Town ribbon- cutting to celebrate the newly renovated reopening of the Hommocks Ice Rink on Sunday October 19 at 10:30 in the morning. There will be free open session skating and hot chocolate. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. PRESENTATION – Local Waterfront Revitalization Plan - LWRP Annual Report Alan Mason, a member of the Coastal Zone Management Commission presented the Eighteenth Annual Report of the Town of Mamaroneck - Village of Larchmont Coastal Zone Management Commission. Mr. Mason noted that the Commission is working on a rewrite of the Local Waterfront Revitalization Program (LWRP), noting that the program was established a number of years ago and needs to be updated. Mr. Mason stated that there are a number of large projects currently taking place in our community, and it will be interesting to see this reflected in next year’s report. Purpose: The Town under the regulations governing the Section 8 Housing Voucher Program is required to hold a public hearing each year on the Section 8 Housing Administrative Plan. Anna Danoy, Director of Community Services and Housing presented the 5 Year Administrative Plan. Ms. Danoy highlighted the three new Statutory Changes and the Town’s seven updates and policy changes. Supervisor Seligson thanked Ms. Danoy for her excellent Executive Summary, which made it possible for the Board not to have to read the 400 plus pages of the Plan. Supervisor Seligson asked if anyone wished to comment on the Administrative Plan, and there was not. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously closed. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby accept the Town of Mamaroneck PHA Five Year and Annual Plan 2015-2020 and Administrative Plan 2015, as prepared and submitted by Anna Danoy, Director of Community Services and Housing. Ms. Stahl stated that her family is in fear that the trees in question will fall on her home. They sit in wells which make it difficult to determine their status, as well as causing unsafe standing water conditions. Large branches have previously falling and struck the house. Her family is committed to tree preservation and were it not for their unsafe condition and fear of falling, they would not be asking for their removal. The Board noted that the tree policy is for the replacement of a 2” sapling, but that seems insufficient with the removal of 4 very large trees. The Board asked Ms. Stahl if she would be willing to replace these trees with more mature and or additional trees. Ms. Stahl said she would be very willing. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was RESOLVED, that the Mamaroneck Town Board does hereby grant the property owners of 21 Winged Foot Drive, Kevin and Allison Stahl, permission to remove four Sweet Gum trees from their property and replace them with either six (6) 2” saplings or four (4) 4” saplings whose specimen type to be discussed with the Town’s Environmental Planner, Elizabeth Paul. Do to the age of many of the existing computer operating the Windows XP it was determined to be more cost effective to replace the computer itself. The Town will be able to purchase at a reduced price through the NYS Aggregate Buy Contract. NOW THEREFORE, BE IT, RESOLVED, that the Mamaroneck Town Board does hereby approve the consulting agreement with Smith and Pucillo Architects to prepare a schematic design for a fee of $9,000 and a design development for the fee of $11,000., and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to sign said agreement on behalf of the Town. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 7.Set Public Hearing – Repeal of Wednesday Parking Restriction – Murray Avenue Mr. Altieri explained that previously students were dismissed from school early on Wednesday’s. Accordingly, the time period prohibiting parking and standing on Murray Avenue, created by Local Law No.1-1995, was adjusted to take that schedule into consideration. Students are no longer dismissed from school early on Wednesday’s and therefore, there is no reason to continue a Wednesday adjustment to the time period when parking and standing is prohibited. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on amending Local Law No 1-1995 to repeal the Wednesday parking restriction from the law, for October 15, 2014 at 8:00PM in the Court Room of the Town Center, and 9 October 1, 2014 BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 8.Authorization – Sustainable Westchester Dues Supervisor Seligson explained that Sustainable Westchester is the merged entity of two regional environmental consortiums in the County. They will help municipalities address energy, waste, and other municipal issues. The Town Board discussed this previously and would like to pay the dues for membership. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the payment of dues in the amount of $1,000 for the years 2014 and 2015 to Sustainable Westchester. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye APPROVAL OF MINUTES – September 17, 2014 On motion of Councilman Odierna, seconded by Councilwoman Katz, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of September 17, 2014. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Murphy welcomed in the fall season. Councilman Murphy announced the upcoming th Candidate’s Debate and Presentations at the Town Center Courtroom on October 8 . He encouraged citizens’ to come out and to be informed. Councilman Odierna had no liaison meetings to report on as the Zoning Board met at the same time as the Town Board. Councilwoman Katz attended the Southern Westchester Food Festival at Harbor Island last weekend, adding it was a lot of fun. Coastal Zone Management Commission met and discussed the new house on Weaver Street, this will be a tear down and will not have a basement, noting that it is interesting to see the effects of new regulations on construction. Although the house has more square feet, there is less impervious surface due to a shorter driveway. An important statement made earlier by Mr. Mason, and something Phyllis Wittner felt was the greatest accomplishment of the LWRP, was the inclusion of the entire Town, whereby now any project application can be referred to the Coastal Zone Management Commission. 10 October 1, 2014 Councilwoman Elkind Eney attended the Westchester Municipal Officials Dinner at the Kittle House in Pound Ridge. The discussion was “ Hudson Valley Regional Council and Funding Opportunities for Municipalities”. Councilman Odierna did some nice follow up, and we will have to thank him if any opportunities come our way. She and Supervisor Seligson attended the Larchmont Art Show on September 20th, always one of her favorite events - the weather was beautiful and it was well attended. On th September 27 the Library held Big Truck Day a staple event in the community. Chief Joe Russo asked that th she announce that on October 18 from 5-7pm Coach Bob Laufarb will DJ a dance party for older adults at the Larchmont Village Center. No registration is required and it is in conjunction with the Town of Mamaroneck Fire Department and At Home on the Sound. Supervisor Seligson wished a happy birthday to her friend Elsa McElroy who turned 11 years old today! Supervisor Seligson and Steve Altieri attended a tabletop exercise for an emergency response to a catastrophic cyber-attack. It was interesting to see how many of the key functions of the Town are not governed by computers, adding most are public safety functions like police and fire and do not require computers. She also noted the wonderful Arts Festival, adding that she purchased a handmade wooden box from Town resident Kevin Crowe. Supervisor Seligson attended the Ambulance District Board meeting at which they brought the Village of Larchmont, MEMS and VAC together to discuss the Ambulance District budget and operations. She was very pleased to see three Town of Mamaroneck trucks at the Big Truck Day, as well as coverage by LMC-TV. It is with sadness that she reports the passing of Irving Scharf. Irving was an active citizen who was very interested in the Town and shared his opinions. Our sympathy and condolences go out to his family. Councilman Murphy added that Irving was a former Chairman of Conservative Party for many years. He was such an active participant in our community, adding that he very enjoyed the many discussions they had.
