MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE
TOWN OF MAMARONECK HELD ON AUGUST 13, 2014, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was unanimously
opened at 5:00PM.
Public Housing Agency Administrative Plan
Additionally Present: Anna Danoy, Director of Community Services and Housing
Ms. Danoy presented to the Town Board the Public Housing Administrative Plan and highlighted some of the
more significant statutory changes. This discussion is in anticipation of setting the required public hearing in
order to adopt the Plan. The full Plan will be available on the Town’s website tomorrow.
OUT OF ORDER
Right of Way – 9 Locust Terrace
Additionally Present: Mrs. Reilly, homeowner 9 Locust Terrance
The Town Board reviewed a letter from the Attorney for the Reilly family explaining the current situation with
their front stairs which crosses the Town’s right-of-way. The stairs are the only access to the home. The
homeowners are asking the Town to grant them permission to maintain and leave the structures as currently
exists. The Town Board instructed Mr. Maker to work with the homeowner’s Attorney to draft a right-of-way
agreement.
Larchmont Library – Use of Village Center
Supervisor Seligson updated the Town Board on the ongoing discussion of the Library taking over the existing
Village of Larchmont Community Room adjacent and below the Library. There are three different scenarios for
how this could be done, and at this time it appears the Village of Larchmont Board of Trustees is mixed on a
decision. The Town Board is open to the concept, but ultimately the decision is with the Village of Larchmont.
Proposed Washington Square Resident Parking Legislation

Additionally Present: Doris Block, Chair of the Traffic Committee, Ralph Engel, Washington Square Area Resident
and John Irving Washington Square Area Resident.
The Town Board reviewed a revised red- lined draft of the legislation prepared after the Town Board’s last
discussion. The Board went through the legislation line by line. A number of changes were made and Mr. Maker

will redraft it for review at the September 3 meeting. Because a number of the changes are significant the
Board will not be able to set a public hearing until after the draft legislation is complete and reviewed at the
September meeting.
ADDED ITEM
Letter with Proposal from Ralph Engel
The Board reviewed a proposal by Mr. Engel in which the Virginia A. McGuire Foundation offered matching funds
to construct approximately 30 additional parking spaces on New Jefferson Street. The Town Board acknowledged
this generous offer but added it would still require a significant monetary expenditure by the Town that will have
to be discussed within the Capital Budget for 2015.
ADDED ITEMS
Supervisor Seligson noted that the Town has received additional correspondence from Eleanor Sherman, adding
that she may come and address the Board in the Court Room session.
Supervisor Seligson noted that the Sustainability Collaborative is anticipating a draft of the Sustainability Plan in
September.
Update – New Rochelle Sewer District Inflow/Infiltration
Supervisor Seligson stated that the NYS Department of Environmental Conservation (DEC) is not implementing
the closure of bypass events from the overflow retention facilities as per the consent order, pending review of
the stipulation agreement. The Town Board reviewed the draft Stipulation Agreement, agreed upon by the
Town, the other New Rochelle District municipalities and Westchester County. The Agreement has been
forwarded to the DEC for review. Should the NYS DEC approve the stipulation agreement the municipalities in
the New Rochelle Sanitary Sewer District (which includes the Town) would need to complete an inflow and
infiltration remedy plan by March 2017.
Update – Progress of Energy Service Contract
The Town Board reviewed an update report on the progress to date of the Town’s Energy Service Contract. The
report was broken down by the various energy conservation categories. It was reported that the project at the
Ice Rink is on schedule.
Mamaroneck Towers – Pilot Payment
Mr. Altieri explained that the Mamaroneck Towers located on Halstead Avenue in the Village of Mamaroneck is
about to undergo extensive renovations. The building is an apartment complex built in 1993 under the HUD
section 202 program for low income senior citizens. Currently the building has tax exempt status and the
redeveloper is proposing a new structure as follows:
“ the new structure assumes that there will be taxes, in the form of a Westchester County Payment in
lieu of Tax Agreement, of $75,000. This annual tax payment will be split by the various taxing

jurisdictions based on what their relative share of the taxes if it were fully taxed. These PILOT
payments will increase 2.5% per year. The PILOT is proposed to be modeled on 2012 PILOT adopted by
Rye for Rye Manor. The PILOT would be in effect for 32 years, a term that is consistent with extended
use period that we will be agreeing to keep Mamaroneck Towers affordable.”
It was noted that the redeveloper will be instructed that they would still need to apply for the tax exempt status
so that it is officially on record.
Update – Affordable Housing Meeting
Supervisor Seligson informed the Town Board that she and Mr. Altieri met with a developer who is looking at
possible sites for affordable housing development. One site in particular is the Town Commuter Lot 1. This
would involve building over the existing lot so as not to limit the current parking. The Town Board would like
the developer to create a rendering of their proposal.
ADDED ITEMS
Update on Sustainability Collaborative
Supervisor Seligson reported that the Sustainability Collaborative was awarded a technical grant for a near zero
waste analysis from the Columbia Capstone Group. The Sustainability Collaborative will facilitate the grant; there
is no obligation on the Town.
Mr. Altieri explained that the Town is beginning the process of request for proposals from Insurance Brokers.
There is a time issue involved and a request to add this item to the agenda this evening. Mr. Altieri is
recommending a consultant be hired to oversee the RFP process, and is recommending the Lawley Westchester
Group LLC. The Town Board reviewed a proposal from The Lawley Westchester Group and added this item to the
regular agenda for this evening.
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to
enter into an Executive Session to discuss, potential appointments to Boards and Commissions, and
Certiorari/Litigation involving John Porzio Associates.

On motion on Councilman Murphy, seconded to Councilwoman Elkind Eney, the Board unanimously agreed to
enter into a closed session to receive advice of counsel.
ADVICE OF COUNSEL
On motion of Councilwoman Katz, seconded by Councilman Odierna, the Board unanimously voted to end the
Executive Session and Advice of Counsel Session.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening,
adding this is an open meeting that all residents’ are welcomed to attend.

SUPERVISOR’S SUMMARY REPORT
It has been a busy and successful summer in the Town of Mamaroneck. We had a successful camp season
and successful concert season. The Monday night concerts were well attended and we only had one rain
out night that was rescheduled. The Energy Performance Contract to update the ice rink, Town Center, fire
house and street lights has been progressing. All the updates have been completed at the fire house. The
lighting, window film and building envelope work has been completed in the Town Center. The dual fuel
boiler and air conditioning upgrades are expected in September. The street light conversions to LED lights
will begin next week. The ice rink has a new chiller, boiler, tubing for ice, and the 2/3rds of the dasher
boards are up. They will begin making ice August 25 and ice is scheduled to be ready September 1, right on
schedule. The website update is almost complete and should go live in the next month. Road resurfacing on
several Town roads will begin next week. The Sustainability Collaborative has been meeting to refine the
interim draft Plan for a More Resilient and Sustainable Mamaroneck.
CERTIFICATE OF APPRECIATION – DEFERRED UNTIL SEPTEMBER 3, 2014.
CITIZEN’S COMMENTS
Eleanor Sherman, of 283 Murray Avenue, addressed the Town Board. Ms. Sherman read a prepared statement
which included but was not limited to comments referring to previous correspondence to the Town about her
neighbor’s trees along the two property lines that she feels are dangerous. Ms. Sherman has also notified the
Town regarding trees along Murray Avenue at Forest Avenue which she feels are also dangerous and has
additionally corresponded with the Town with respect to tree legislation she feels the Town should enact. Mr.
Altieri responded by stating that for clarification Ms. Sherman is stating her opinion as a non-certified arborist
about Town trees. , Additionally, Mr. Altieri stated that Ms. Sherman is asking the Town to take a position on
trees on private property for which the Town has no jurisdiction. Mr. Altieri also clarified that the Town does
have a tree ordinance, adding the Town has been granted certification as a Tree City. In order to have that status
the Town must, and does, have continuous full time tree crews, all with certification.
Ruth Campanelli, of Barnard Road, addressed the Board. Ms. Campanelli stated that she is happy to hear that the
Town may consider an aerating system at the Garden’s Lake. She will suggest to the Larchmont Gardens’ Civic
Association (LGCA) that they partake in discussing this project. Ms. Campanelli still feels there should be a day
sticker for occasional train station parkers. As previously addressed, the condition along the Brook, specifically
the gap between the blacktop and the earth, is a hazardous condition. The dog waste reciprocals are overflowing
and in need of more disposal. There is an electrical unit at the top of Falls Road and Cooper Lane that is full of
graffiti. It should be raised like the one they raised along Fernwood Road. The Duck Pond planting was so
successful, but now there is no view of the Pond. Ms. Campanelli feels the beauty of the Pond is now lost.
Supervisor Seligson commented that the plantings were done as part of a Westchester County Grant for flood
mitigation and conservation. Supervisor Seligson stated that she personally think it looks wonderful, as she
understands the good it is doing. Although she disagrees that it looks bad, the Town will contact the County to
ask if cutting back some planting near the benches might be acceptable and still be within the grant.

LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New
York, and pursuant to a resolution of the Mamaroneck Town Board adopted on July 9, 2014 a Public
Hearing will be held on Wednesday, August 13, 2014 at 8:00 PM or as soon thereafter as is possible
at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “The Four
Handicapped Parking Spaces in the Washington Square area and the One Handicapped Parking
Space on Myrtle Boulevard” Law.

Purpose:
The purpose of this local law is to codify the handicapped parking spaces on North Chatsworth
Avenue, Murray Avenue, Washington Square and Myrtle Boulevard.
The full text of this Amendment is stated below and can also be examined and copies obtained at
the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and
August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, New York
PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an
opportunity to be heard and that all persons are invited to submit written comments at or prior
thereto.

On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously
opened.
Supervisor Seligson asked if anyone wished to comment on the proposed Local Law.
Supervisor Seligson stated that this law will not change or move any existing handicapped spaces, but rather
to codify the existing spaces.
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Public Hearing was
unanimously closed.
On motion of Councilman Murphy, seconded by Councilwoman Katz, the following Local law was approved:
Local Law No. 3 - 2014
This local law shall be known as the “The Four Handicapped Parking Spaces in the Washington
Square area and the One Handicapped Parking Space on Myrtle Boulevard” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows:
Section 1 – Purpose.
The purpose of this local law is to codify the handicapped parking spaces on North Chatsworth
Avenue, Murray Avenue, Washington Square and Myrtle Boulevard.
Section 2 – Creation of handicapped parking spaces on North Chatsworth Avenue
There shall be two (2) handicapped parking spaces on North Chatsworth Avenue. One shall be in
front of, and on the same side of the street as the property known by the postal address of 21 North
Chatsworth Avenue. The other shall be in front of, and on the same side of the street as the
property known by the postal address of 16 North Chatsworth Avenue. Each space shall be located
on North Chatsworth Avenue approximately 260 feet northwest from the corner formed by the
curbs on North Chatsworth Avenue and Myrtle Boulevard.
Section 3 – Creation of a handicapped parking space on Murray Avenue
There shall be one (1) handicapped parking space on Murray Avenue in front of, and on the same
side of the street as the property known by the postal address of 14 North Chatsworth Avenue.
This space shall be located on Murray Avenue approximately 245 feet north from the corner formed
by the curbs on Murray Avenue and Myrtle Boulevard.

Section 4 – Creation of a handicapped parking space on Washington Square
There shall be one (1) handicapped parking space on Washington Square in front of, and on the
same side of the street as the property known by the postal address of 1 Washington Square. This
space shall be located on Washington Square approximately 200 feet southwest from the corner
formed by the curbs on Washington Square and North Chatsworth Avenue.
Section 5 – Creation of a handicapped parking space on Myrtle Boulevard
There shall be one (1) handicapped parking space on Myrtle Boulevard in front of, and on the same
side of the street as the property known by the postal address of 172 Myrtle Boulevard. This space
shall be located on Myrtle Boulevard approximately 220 feet southwest from the corner formed by
the curbs on Myrtle Boulevard and North Chatsworth Avenue.
Section 6 – Signs to be erected and painting to be done
An appropriate sign or signs shall be erected on North Chatsworth Avenue, Murray Avenue,
Washington Square and Myrtle Boulevard indicating the location of each handicapped parking
space. If deemed appropriate by the Superintendent of Highways, any of the handicapped parking
spaces also may be painted to indicate the area restricted to handicapped parking.
Section 7 – Severability
Should any court of competent jurisdiction declare any provision of this Local Law invalid or
unconstitutional, such declaration of unconstitutionality or invalidity shall not affect any other
provisions of this Local Law, which may be implemented without the invalid or unconstitutional
provisions.
Section 8 – Effective Date
This Local Law shall become effective on the date that it is filed in the office of the Secretary of
State.

Commissioner Elkind Eney reported on the Fire Council Meeting at which they discussed the Alarm Room
renovation as being complete and the three new volunteers attributed to the efforts of the SAFER Grant.
There being no further business to come before the Commission, on motion of Commissioner Elkind Eney,
seconded by Commissioner Katz, the Commission unanimously adjourned and the Town Board reconvened.
AFFAIRS OF THE TOWN
1.Appointment – Coastal Zone Management Commission
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following was approved,
WHEREAS, with the resignation of Pam Michels as a Member of the Coastal Zone Management
Commission a vacancy now exists.
NOW THEREFORE, BE IT
RESOLVED, that Tara Anderson be appointed a Member of the Coastal Zone Management
Commission, and
BE IT FURTHER

RESOLVED, that the foregoing appointment shall be effective immediately upon the
appointee taking and subscribing the oath mandated by section 25 of the New York Town
Law and shall expire on August 31, 2016.

2.Set Public Hearing – Public Housing Administrative Plan
It was explained that the US Department of Housing and Urban Development (HUD) requires Public Housing
Agencies under the regulations governing the Section 8 Housing Voucher Program to hold a public hearing each
year on the Section 8 Housing Administrative Plan.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was unanimously
RESOLVED, that
the Mamaroneck Town Board does hereby set the date for a Public Hearing on the
Section 8 Housing Administrative Plan, for October 1, 2014 at 8:00PM in the Court Room of the
Town Center, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a
newspaper appointed as an official newspaper, and that said Notice, be posted.
3.Adoption of Hazard Mitigation Plan
On motion of Councilman Odierna, seconded by Councilman Murphy, it was unanimously
RESOLVED, that the Mamaroneck Town Board finds that the adoption of the Town of
Mamaroneck Multi-Hazard Mitigation Plan is hereby declared to be a Type II Action, with no
impact under the New York State Environmental Quality Review Act (SEQRA) and requiring
no further action.
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following was approved,
WHEREAS, the Town of Mamaroneck, with the assistance from Environmental Technologies Group,
has gathered information and prepared the Town of Mamaroneck Multi-Hazard Mitigation Plan;
and
WHEREAS, the Town of Mamaroneck Multi-Hazard Mitigation Plan has been prepared in
accordance with the Disaster Mitigation Act of 2000; and
WHEREAS, the Town of Mamaroneck is a local unit of government that has afforded the citizens an
opportunity to comment and provide input in the Plan and the actions in the Plan; and
WHEREAS, the Town of Mamaroneck has reviewed the Plan and affirms that the Plan will be

updated no less than every five years;
NOW, THEREFORE, BE IT RESOLVED, by Supervisor and Town Board that the Town of Mamaroneck
adopts the Town of Mamaroneck Multi-Hazard Mitigation Plan as this jurisdiction’s Natural Hazard
Mitigation Plan, and resolves to execute the actions in the Plan.

of man hole riser rings as part of the Capital Project 2014-13 Road Resurfacing/Sidewalk Improvements

On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the following was approved
WHEREAS, on July 24, 2014 the Town publicly opened and read two bids for Contract TA-14-11 – 20
Yard Refuse Collection Trucks.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award TA-14-11 – 20 Yard Refuse
Collection Trucks to the lowest responsible bidder, Sanitation Equipment Corp of North Paramus, NJ
for a cost per vehicle at $133,812.00, a total for two vehicles of $ 267, 624.00, and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to execute said Contract on behalf of
the Town.

6.Report of Bids – TA-14-13 Winding Brook Drive Bridge Replacement

On motion of Councilman Odierna, seconded by Councilman Murphy, the following was resolved,
WHEREAS, on July 30, 2014 the Town publicly opened and read three bids for Contract

TA-14-13 Winding Brook Drive Bridge Replacement, and
WHEREAS, the Town’s estimate for just the Bridge replacement was $170,000.00, and
the lowest bid received for the bridge replacement was $340,250.00, and
WHEREAS, it is recommended that the Town reject the bids received and move forward
with the temporary bridge until new bids specifications are prepared based on a possible redesign.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby reject the bids received for Contract TA-
14-13 Winding Brook Drive Bridge Replacement.

7.Salary Authorization – Police Department
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved,
WHEREAS, with the retirement of Detective Robert Reynolds, a vacancy exists in the position of
Detective as well as the Department’s Youth Officer, and
WHEREAS, it is the recommendation of Chief Rivera that William Maier, a Police Officer with the
Town since 1998 be promoted to the position of Detective.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby promote Office William Maier to the
position of Detective at an annual salary of $110,965 effective August 14, 2014.

8.Authorization – Intermunicipal Agreement – Village of Scarsdale – Assessment Review
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved,
WHEREAS, in order to avoid any potential conflict of interest, the Town is being asked to represent the
Town of Scarsdale in a tax grievance proceeding involving a Village of Scarsdale Trustee.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal Agreement

with the Town of Scarsdale as approved by the Town Attorney, and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to sign said Intermunicipal Agreement
on behalf of the Town.

REPORT OF COUNCIL
Councilwoman Elkind Eney stated that she and the Board attended the retirement party for Detective Bob
Reynolds. We all wish him good luck on his next chapter of life, adding what a wonderful impact he has had on
th
the Town - he will surely be missed. On July 16 she along with Supervisor Seligson and Councilman Murphy,
th
attended the SHORE/I CARE fundraiser honoring Larchmont Avenue Church Pastor Bill Crawford. On July 18 she
and Supervisor Seligson attended the first Mamaroneck Invitational Swim Meet at Hommocks Pool. It was a
st
wonderful family event- great swimming. On August 1 the Board attended the Senior Center BBQ where ‘Chef
Altieri’ grilled up some wonderful food as usual. Councilwoman Elkind Eney noted that she previously reported
th
on the Fire Council Meeting. On August 5 she attended the Recreation Commission’s Annual Meeting at which
they reviewed the summer programming, adding how impressed she was with the Directors of the programs and
how enthusiastic they were about new programs for next year. Councilwoman Elkind Eney and Councilwoman
Katz went on a site visit of Winged Foot Club to view some environmentally sensitive areas. Councilwoman
Elkind Eney noted that tomorrow night the Village of Mamaroneck will hold a block party on the Avenue – a
great night out!
Councilwoman Katz chuckled and thanked Councilwoman Elkind Eney for reminding her of all the events they’ve
attended. Councilwoman Katz also attended a number of Coastal Zone Management Commission Meetings,
adding this was the reason for her site visit to Winged Foot. The Commission is continuing to move ahead on
updating the Local Watershed Revitalization Program.
Councilman Odierna spent much of the last few weeks on his boat examining the water ways of Long Island
Sound. Councilman Odierna noted that of particular interest and also alarming was the clear evidence of the
hypoxia problem in the sound. Councilman Odierna noted that there was a particular area that appeared on his
radar as having no visible life along the sea bed. Councilman Odierna stated that although much has been done
to clean up the Sound, there are still visible signs of significant problems.
Councilman Murphy noted that this was a spectacular summer and he hopes everyone enjoys the remainder of
it.
Supervisor Seligson noted that she attended the Town Village School Meeting, at which they discussed the
various capital projects within the municipalities and the school district. She and Steve Altieri met with a
potential affordable housing developer and viewed potential sites. At the recent Westchester Joint Water Works
Meeting they continued discussing ways to provide UV light treated water to the entire Westchester Joint Water
Works jurisdiction – a very expensive issue. Supervisor Seligson noted her attendance at the Westchester County
Board of Legislators Energy & Environment Committee, at which they discussed storm water reconnaissance
plans for flooding issues, adding there is a long list of priorities among the municipalities. Supervisor Seligson
was interviewed on Cablevision’s “Meet the Leaders Program”, noting it appears to be running quite frequently.
Finally, she wanted to publicly thank Steve Altieri for all his work on the Senior BBQ. So much effort goes into
this and it is so appreciated not only by the Board, but by the many seniors.
