HomeMy WebLinkAbout2015_02_25 Town Board Minutes February 25, 2015 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON FEBRUARY 25, 2015, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was unanimously opened at 5:00PM. Review of Capital Project Schedule Supervisor Seligson requested there be an elimination of overtime with the installation of new software in the Recreation Department. The Town Board discussed the Town Center Lot and it was recommended by Supervisor Seligson that due to potential grant opportunities and the time it would take to apply for them, she is suggesting this project be put off till 2016. The Town Board reviewed preliminary plans for the Police Station renovation. The Jefferson Street additional parking plan was discussed as well. Supervisor Seligson noted that she reached out to Mr. Engel to determine if, in light of comments that the parking problems have greatly decreased, the grant should still move forward. Although he agreed that parking has been relieved, he stressed that with the addition of the Cambiun, parking could become spare. Town Board members felt strongly that the project should move forward, noting that this is a matching funding and interest rates are remarkably low. The Water Improvement Project for Westchester Joint Water Works was discussed and Supervisor Seligson explained that this is a grant funded purchase of a modular generator. These funds are expected to be a grant but there is a requirement that the Town establish bonding, adding that this is similar to what was required of the Town for the previous Westchester Joint Water Works project. Additionally present: Ramona Salzillo Supervisor Seligson asked, that due to the resident in attendance interested in items four and six, the Town Board will move to those items. Demolition Notification Law Review The Town Board had draft legislation from Mr. Maker. The Town Board reviewed the law and determined it should move forward to a public hearing with the inclusion of a requirement that signage to be posted on the property notifying residents that the structure will be demolished. This would satisfy the issue of noncontiguous property owner notification. The Town Board will see another draft of the legislation at the next Town Board Meeting and anticipates setting a public hearing at that time. Rock Removal Law Review Supervisor Seligson reminded the Town Board of their previous discussions regarding this, adding that this has come about due to residents’ complaints about recent rock chipping. The Board discussed whether to reduce the number of days chipping is allowed no matter how much cubic feet is removed. Effectively changing the trigger from a volume amount to a total number of days allowed. 1 February 25, 2015 Supervisor Seligson asked Ms. Salzillo if she wished to speak. Ms. Salzillo spoke passionately about the difficulty of living with days and days of rock chipping. Additionally, she believes it is going on longer than the law allows. Ms. Salzillo would like the Town to review the allowed times of day for chipping, adding that currently it is being done up to 8:00pm. Ms. Salzillo summarized from a letter written by Maura Carlin. Ms. Carlin’s comments were received by the Town Clerk and noted as such for the record. Long Beach Sanitary Sewer Lateral Law Supervisor Seligson reiterated that the County will require municipalities in the New Rochelle Sewer District to videotape residential lateral sewer lines at the time of sale. Supervisor Seligson stated that she and Mr. Altieri attended a meeting with the vendor for the Long Beach Law. It was an informative meeting, adding that she believes the Long Beach plan is the correct way to go. Councilwoman Elkind Eney feels it would be prudent to speak with officials from Long Beach to discuss their experience. The Town Board also noted another concept of charging residents’ a fee to create a fund for repairs, versus an insurance option. Councilman Murphy suggested that adding a bathroom could be a trigger for videotaping the lateral lines. Mr. Altieri suggested finalizing the agreement with the State first, then discussing how to roll out a plan. Municipal Energy Program Review The Town Board was briefed by Mr. Altieri on the status of the program, and the Town Board reviewed the Agreement again. This is on the regular agenda for approval this evening. Amendment – Lester Place Legislation The Town Board is comfortable with the legislation and would like to add the setting of a public hearing to this evening’s Regular Agenda. The Town Board asked that a letter, with accompanying legislation, be sent out to the Lester Place residents notifying them of the public hearing. Added Items Hudson River Resolution Supervisor Seligson stated that at a recent meeting of the Westchester County Supervisors, there was discussion of support for a resolution regarding the removal of PCB’s in the Hudson River. The Supervisors’ were asked to have their municipalities pass the resolution by several Hudson environmental organizations. Supervisor Seligson is recommending the Town do so, and added that the Town should prepare a similar resolution asking for cleanup of the Long Island Sound. Appointments to the Sustainability Collaborative The Town Board briefly reviewed the list of appointees and the staggering of their terms. On motion of Councilman Murphy, seconded by Councilwoman Katz, the Board unanimously agreed to enter into an Executive Session to discuss the Employment History of the Building Department, Highway Department and Engineering Department, as well as potential litigation. EXECUTIVE SESSION Employment History of the Building Department, Highway Department and Engineering Department Potential Litigation On motion of Councilwoman Katz, seconded by Supervisor Seligson, the Board unanimously agreed to resume the Regular Meeting. 2 2 February 25, 2015 CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT The Highway Dept. has been busy with snow and ice control as we've had some severe weather. Thank you to the Highway Dept. for their hard work and good work. The Town is pleased to be part of Solarize Larchmont/Mamaroneck, a program that offers discounted pricing for solar energy to residents. The Town and 2 Villages are one of four municipalities in the County selected by Sustainable Westchester to participate in the program. Sustainable Westchester selected Sunrise Solar as the vendor to work with Larchmont and Mamaroneck. The Town has been working with the County and NYS Dept. of Conservation to agree on a work plan and timetable for repairing broken sewer pipes. The Town is required to begin the evaluation of the sewer pipes in 2015. We will be talking about this a lot in the future as it will require a lot of effort and resources. It will be expensive to fix the old sewer pipes in the Town. The Town Board discussed two proposed laws in the work session this evening. One has to do with rock removal and chipping. The Town is considering restrictions on time allowed to rock chip for all projects, not just those of a certain size. The other is consideration is to require notice to adjacent neighbors in the case of a house demolition. If we move forward with these laws, there will be public hearings to allow for public comment. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Murphy, the Board of Fire Commissioners was unanimously declared open. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 5.Authorization- Municipal Energy Program Agreement On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Agreement between the Town of Mamaroneck and Constellation Energy Resources to provide electricity for the Hommocks Ice Rink and the Town’s street lights at the guaranteed price of .06528 cents per kilowatt hour, for two years, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby amend the Cellphone Reimbursement List to include, Jenny Ayala, Arleen Silverman and Alicia Nowlin Downey. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the Engineering Agreement with H2M Architects & Engineers on behalf of the Westchester Joint Water Works, consisting of the municipalities of the Village of Mamaroneck, the Town of Mamaroneck and the Town/Village of Harrison, for engineering services for the Emergency Stand-by Generator at the Rye Lake Pump Station and Treatment Plant. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 13.Set Public Hearing – Amendment to Resident Parking on Lester Place On motion of Councilman Murphy, seconded by Councilwoman Katz, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Amendment to the Residential Parking Lester Place” Law, for March 11, 2015, at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, 10 February 25, 2015 RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 14.Resolution Regarding the Removal of PCB’s From the Hudson River On motion of Councilman Odierna, seconded by Councilman Murphy, the following was unanimously approved, ATTACHMENT B The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Murphy attended the informative and lively presentation by Robert Freeman of the Committee on Open Government. Mr. Freeman spoke about the Freedom of Information Law and the Open Meetings Law. Councilman Murphy attended the Housing Authority Meeting at which they continue to discuss bonding, adding that the Town Board approved the guarantee for that bonding at the previous Town Board meeting. They also discussed the unfortunate fire that occurred at the Hommocks Apartments. Councilman Odierna noted that he has been away. He thanked the Highway Department for the great job they have done clearing the roadways. Councilwoman Katz attended the kick-off event for Solarize NY at Tequila Sunrise last Sunday. Unfortunately, due to the density of trees around her home, her home does not qualify for solar panels. The Library has a lot of upcoming programs, specifically the LegoFest and the Spelling Bee; Residents are encouraged to visit their web-site for information. Westchester Municipal Officials Dinner hosted by the Village of Larchmont was held at the Larchmont Yacht Club and was a very nice event. Councilwoman Katz attended the Coastal Zone Management Commission, at which they approved an item for Horseshoe Harbor. They also continue to work on the Local Waterfront Revitalization Plan. At the Traffic Committee Meeting they are working on the parking issues around the Richbell Apartments, adding there are not a lot of solutions, but the Committee is working hard to find remedies for those residents. Councilwoman Elkind Eney noted her attendance as well, at the Solarize NY kick-off event; Councilwoman Elkind Eney noted that her home does qualify. The Hispanic Resource Center held a wonderful Valentine’s Day Party at Chat 19, adding what a valuable organization they are. Councilwoman Elkind Eney noted that she previously reported on the Fire Council Meeting earlier in the evening. Councilwoman Elkind Eney attended the Planning Board Meeting, noting that they are moving forward on a number of applications. Councilwoman Elkind Eney thanked the Village of Larchmont for a wonderful Westchester Municipal Officials Dinner. Councilwoman Elkind Eney and Councilwoman Katz attended the Association of Towns Annual Training School in New York City, adding that she learned a lot in two days; adding her appreciation for Steve and the staff – we really have a well-run government. Councilwoman Elkind Eney attended the th Recreation Commission Meeting on February 17 , and although we are all freezing, the Spring Brochure is nd in the mail. She also reminded residents’ to sign up for the Bunny Hop on March 22. The Recreation Department sponsored a Skate with the Rangers event, adding that she was happy to share the ice with Dave Maloney of the NY Rangers. Councilwoman Elkind Eney wished the MHS Varsity Ice Hockey Team good luck in tonight’s Section Quarter Finals against Mt. Pleasant at the Hommocks Ice Rink. 11 February 25, 2015 Supervisor Seligson noted meetings she has attended specific to Sustainable Westchester. Supervisor Seligson noted that she is on the Board of that organization, and at their recent meeting they initiated a Water Committee. Supervisor Seligson noted that this is a consortium of municipalities in Westchester County working on environmental issues, and was recently formed by combining the Northern and Southern Energy Action Councils. th The Board reminded residents of the upcoming Larchmont Library Budget Vote on March 10.
