MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE
TOWN OF MAMARONECK HELD ON FEBRUARY 4, 2015, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION
It was noted that Supervisor Seligson was absent. Deputy Supervisor Odierna conducted the Meeting.
On motion of Councilman Murphy, seconded by Councilwoman Katz, the Work Session was unanimously
opened at 5:00PM.
ADDED ITEM
Solarize New York
Additionally present: Frank Owen, member of the Sustainability Collaborative
At the previous Town Board Meeting the Town Board approved the expedited permitting process necessary
for participation in the program. Mr. Owen gave a brief history of how the program got started, noting that
Sustainable Westchester spearheaded the program. Sunrise Solar is the official contractor for the Larchmont-
Mamaroneck initiative. Mr. Owen discussed outreach, including the upcoming kickoff event at Tequila Sunrise,

Sunday February 8. Much is being done with the Mamaroneck School District to promote the program and
the benefits of solar energy. The Board also reviewed the financial, highlighting how residents can save
money. Mr. Owen suggested doing a public PowerPoint presentation at an upcoming meeting.
Town of Mamaroneck Housing Authority- Bond Refinancing/Guarantee
It was noted that Rick Cherry was scheduled to be at this meeting, but go delayed at work and would not be
attending.
The Town Board had a memo from Mr. Altieri dated January 30, 2015 outlining the details of the Town
guarantee, and the proposed resolution for that guarantee. It was explained that “in March of 2003 the Town
of Mamaroneck Housing Authority (Authority) issued $4,005,000 to refund and refinance the original bond
issue to construct the apartments. With interest rates again at a very low levels, the Authority is again seeking
to refund and refinance existing bonds and borrow an additional $650,000 for the replacement of the
building’s siding. There is expected to be a 5% present value savings over the term of the bond issue. The total
debt issue proposed is $2,850,000.” Mr. Altieri stated that he believes this to be a very safe debt, as the
Authority is financially sound and has always paid its bonds on time as well as rent payments to the Town.

New York State Mandated Government Efficiency Report
In order for residents to receive a tax rebate municipalities must submit a Government Efficiency Plan. Mr.
Altieri explained that at the last Department Head meeting the staff discussed the New York State
Government Efficiency Plan and what is required of the Town. Mr. Altieri’s memo to the Board explained that
“the Town must submit by June 1, 2015 a government efficiency plan to save 1% of the Town’s 2014 tax levy.
The savings must occur in 2017, 2018 and 2019 however the savings amount is the same each year; it is not
cumulative.” Mr. Altieri also explained that he, Connie Green-O’Donnell and Tony Siligato were on a call today
with New York State to discuss the Town’s taking over of the Assessment role for the Village of Mamaroneck;
unfortunately, the State is saying the Town cannot take credit for this. Mr. Altieri and Mr. Siligato also
attended a meeting at the County to discuss joining a County Efficiency Plan. Mr. Altieri stated that it may be
better to join the County then to create our own plan; this will be analyzed further.
Area Business Parking Permits
The Town Board heard from the Town Clerk that she has received feedback from businesses in the
Washington Square area who feel their employees have been negatively impacted by the new resident
parking law. The Town Clerk asked the Board whether they would like to hold back a number of meter permits
in Lot #1 in order to sell an Area Business permit in that lot. Due to the fact that the Village of Larchmont is no
longer selling commuter permits to Unincorporated Town residents, the Board feels these residents are most
in need; although the area business employees potentially must move their cars once during a work day, they
in fact have a place to park, whereas, the resident commuters on the other hand have no alternatives. The
Clerk was asked to not over sell as it appears the lot is very full.
Proposed Local Law-Sustainability Collaborative
There was no discussion, as the Board was happy with the final draft legislation for this evening’s public
hearing.
Proposed Amendment-Resident Parking Law - Lester Place
The Town Board would still like to review the original Lester Place Law before fully discussing this

amendment. The Board will continue the discussion at the February 25 meeting.
Proposed Agreement-City of New York-Police Training Expense
,
The Town Board reviewed a memo from Connie Green-O’Donnell dated January 292015. Ms. Green-
O’Donnell explained that in accordance with General Municipal Law Section 72-c, a municipality is entitled to
reimbursement of training costs for a Police Officer when that Officer is hired by another municipality within a
year of training. The City of New York filed a claim against the Town after the hiring of a Police Officer. The
Town has settled and the Agreement is before the Town Board this evening.
Proposed Local Law- Notification of Demolition Projects
The Town Board reviewed a draft legislation prepared by Mr. Maker. One change the Board requested was
that the law only apply to the principal structure. The Board also set the fine at $250.00. Mr. Maker will make
the noted changes and prepare a new draft for the next meeting.
Councilwoman Katz asked Mr. Maker if the Howell Easement was the same as the original. Mr. Maker stated
no, the original was from the 1930’s and very outdated.

On motion of Councilman Murphy, seconded by Councilwoman Katz, the Board unanimously agreed to enter
into an Executive Session to discuss the employment history of a particular employee.

On motion of Councilman Murphy, seconded by Councilwoman Katz, the Board unanimously agreed to
resume the worksession.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Deputy Supervisor Odierna at
8:00 PM, he then pointed out the location of the exits.
Deputy Supervisor Odierna noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.
In lieu of a Supervisor’s Report, Deputy Supervisor Odierna asked Mr. Altieri for a report on the recent snow,
of which Mr. Altieri did.

Deputy Supervisor Odierna asked if anyone in the audience would like to address the Board, and there was
not.
PUBLIC HEARING - Amended definition of ‘Area Resident’ for the residential parking system
The following Notice of Public Hearing is entered into the record as follows:

New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on January
21, 2015 a Public Hearing will be held on Wednesday, February 4, 2015 at 8:00 PM or as soon
thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York
to consider: “Amended definition of ‘Area Resident’ for the residential parking system for (a)
Washington Square, (b) a section of North Chatsworth Avenue, (c) New Jefferson Street, and
(d) Murray Avenue between Myrtle Boulevard and Leafy Lane” Law.
Section 1 – Purpose.
By Local Law 4-2014, the Town of Mamaroneck created a Residential Parking Area for the
Washington Square neighborhood on the following streets or sections of streets: Washington
Square, New Jefferson Street, the section of North Chatsworth Avenue between Myrtle
Boulevard and the northern boundaries of the lots on the opposite side of the street improved
with the buildings known by the postal addresses of 35 North Chatsworth Avenue and 40 North
Chatsworth Avenue and the section of Murray Avenue between Myrtle Boulevard and Leafy
Lane. The Town Board adopted this law pursuant to the power given by section 1662-d of the
New York Vehicle and Traffic Law.

approved:
Local Law No. 2 - 2015
This local law shall be known as the “Amended definition of ‘Area Resident’ for the residential parking
system for (a) Washington Square, (b) a section of North Chatsworth Avenue, (c) New Jefferson Street,
and (d) Murray Avenue between Myrtle Boulevard and Leafy Lane” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose.
By Local Law 4-2014, the Town of Mamaroneck created a Residential Parking Area for the Washington
Square neighborhood on the following streets or sections of streets: Washington Square, New
Jefferson Street, the section of North Chatsworth Avenue between Myrtle Boulevard and the northern
boundaries of the lots on the opposite side of the street improved with the buildings known by the
postal addresses of 35 North Chatsworth Avenue and 40 North Chatsworth Avenue and the section of
Murray Avenue between Myrtle Boulevard and Leafy Lane. The Town Board adopted this law
pursuant to the power given by section 1662-d of the New York Vehicle and Traffic Law.
The Town Board considers the section of Myrtle Boulevard lying between North Chatsworth Avenue
and Madison Avenue to be part of the Washington Square neighborhood. On that section of Myrtle
Boulevard, there are some residential units. The Town Board determines that owners of motor
vehicles, who reside on this section of Myrtle Boulevard, if otherwise eligible, should be allowed to
obtain WS Resident Parking Permits so that they can park their motor vehicles in the Residential
Parking Area defined in Local Law 4-2014.
Furthermore, when section 1662-d of the New York Vehicle and Traffic Law was enacted, the section
of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue lay in a Business
District: B zoning district. Afterwards, the Town Board rezoned this section of Myrtle Boulevard to a
Business-Residential District: B-R zoning district whose principal uses include multi-family housing.
Accordingly, there may be additional residential units constructed on the section of Myrtle Boulevard
between North Chatsworth Avenue and Madison Avenue.
This local law expands the definition of “Area Residents” so that owners of motor vehicles, who reside
on this section of Myrtle Boulevard, if otherwise eligible, may obtain WS Resident Parking Permits.
This local law shall not be construed as expanding the Residential Parking Area to include the section

of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue and the rules regarding
parking now in effect shall continue to apply.
Section 2 – Amendment of a current section of the Mamaroneck Code.
The definition of “Area Resident” that appears in section 219-2.1 B. of the Code of the Town of
Mamaroneck hereby is repealed and the following substituted in its place:
“Area Resident” means a person who resides within the Residential Parking Area or who resides on
the section of Myrtle Boulevard that lies between North Chatsworth Avenue and Madison Avenue. A
person who is employed by an entity that maintains a place of business on this section of Myrtle
Boulevard but who does not reside on this section of Myrtle Boulevard is not an “Area Resident”.
Section 3 – Severability.
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other
provisions of this Local Law, which may be implemented without the invalid or unconstitutional
provisions.
Section 4 – Effective Date.
This Local Law shall become effective upon filing with the Secretary of State.

Local Law No. 3 - 2015
This local law shall be known as the “Creation of a Sustainability Collaborative for the Town of Mamaroneck”
Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows:
Section 1 – Purpose.
The Town Board declares one objective of the Town of Mamaroneck is to preserve and enhance the long term
viability of the Town from both environmental and fiscal perspectives. To do so, the Town should engage, as
advisors to the Town Board, residents who have experience, expertise or a willingness to research ways that
the Town can accomplish this objective. By this local law, the Town Board creates an advisory body of citizens
to be called the Sustainability Collaborative for the Town of Mamaroneck.
Section 2 - Adoption of a new chapter of the Code of the Town of Mamaroneck.
The Code of the Town of Mamaroneck hereby is amended by creating a new chapter that provides as
follows:
Chapter 191
Sustainability Collaborative
§ 191-1. Establishment.
There shall be a Sustainability Collaborative in the Town of Mamaroneck. It shall serve as an advisor to the
Town Board and to such other authorities, boards, departments, committees, commissions and employees of
the Town as the Town Board may authorize from time to time. The Sustainability Collaborative’s role is
strictly advisory. It cannot bind or commit the Town or any of its authorities, boards, departments,
committees, commissions and employees to any contracts, or to undertake, or refrain from taking any action.
§ 191-2. Goals.
A.The goals of the Sustainability Collaborative are to make recommendations for
(i)maintaining and improving the quality of life in the Town,
(ii)developing programs and protocols designed to prepare, mitigate and/or respond to,
and from the aftermath of natural or other disasters,
(iii)preserving the Town’s natural resources,

(iv)wherever possible and cost efficient, continuing to deliver the same types and levels of
services to the community (or adding to or improving such services or the delivery
thereof) in ways that reduce pollution, conserve or reduce the consumption of energy
or make the use of town resources more efficient,
(v)improving the Town’s resiliency in combatting shortage of supplies and power if such
shortages arise, and
(vi)improving the Town’s long term ability to provide basic needs such as fuel, power,
food and water to the community.
B.The Sustainability Collaborative shall report its activities and make its recommendations to the
Town Board in September of each year and at other times either upon request of the Town Board
or on its own initiative.
Section 3-Amendment of a section of the Code of the Town of Mamaroneck.
Paragraph A of section 5-3 of the Code of the Town of Mamaroneck hereby is repealed and the following is
substituted in its place:
Except for current members of the Sustainability Collaborative, all members shall be residents.
Section 5 – Adoption of a new section of the Code of the Town of Mamaroneck.
Section 5-9 hereby is added to the Code of the Town of Mamaroneck and provides as follows:
§ 5-9. Sustainability Collaborative.
A.The Sustainability Collaborative shall consist of up to ten members. The Members shall be known as
Member A, Member B, Member C, Member D, Member E, Member F, Member G, Member H, Member
I and Member J. All of the members shall be appointed by the Town Board. Annually, the Town Board
shall designate which of the members shall serve as the Chairperson for that year. If at any time there
are fewer than ten members who have been appointed to the Sustainability Collaborative the “whole
number” (as that term is defined in NY General Construction Law § 41) shall mean the total number of
members who have been appointed to the Sustainability Collaborative.
B.Except for persons appointed in 2015, and except as provided in § 5-9 D of the Code, the terms of
office of each member shall be three years and shall expire on the 31st day of December of the year in
which the term expires.
C.The term of office of a member appointed in 2015 shall commence on the date selected by the Town
Board in its resolution making the appointment, but the term of office of:
(1) Member A, Member B and Member C shall expire on December 31, 2015,
(2) Member D, Member E and Member F shall expire on December 31, 2016, and
(3)Member G, Member H, Member I and Member J shall expire on December 31, 2017.
D.If a person is appointed or qualifies as a member after January 1 of the year in which the term of that
person’s office was scheduled to begin, that person’s term shall expire on the December 31st on which
that person’s term was scheduled to expire even though that person shall have served less than three
years.
E.
Section 6 – Severability
Should any court of competent jurisdiction declare any provision of this Local Law invalid or unconstitutional,
such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law,
which may be implemented without the invalid or unconstitutional provisions.
Section 7 – Effective Date
This Local Law shall become effective on the date that it is filed in the office of the Secretary of State

by Commissioner Elkind Eney, the Commission unanimously adjourned and the Town Board reconvened.

1.Re-appointment –Town of Mamaroneck Housing Authority Member
On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was unanimously
RESOLVED, that Rick Cherry be reappointed as Member B of the Housing
Authority, and
BE IT FURTHER
RESOLVED, that the foregoing appointment shall be effective immediately
upon the appointee taking and subscribing the oath mandated by section 25 of
the New York Town Law and shall expire on December 31, 2019.

The following resolution was offered by Councilman Murphy, who moved its adoption, seconded by

RESOLUTION DATED FEBRUARY 4, 2015
A RESOLUTION AUTHORIZING THE GUARANTEE BY THE TOWN OF
MAMARONECK, WESTCHESTER COUNTY, NEW YORK, OF THE PAYMENT OF THE
PRINCIPAL OF AND INTEREST ON CERTAIN REFUNDING INDEBTEDNESS AND
INDEBTEDNESS OF THE TOWN OF MAMARONECK HOUSING AUTHORITY AND
APPROVING THE FORM AND SUBSTANCE OF A GUARANTEE, AND PROVIDING
FOR OTHER MATTERS IN CONNECTION THEREWITH RELATING THERETO.
WHEREAS, the Town of Mamaroneck Housing Authority (the “Authority”) issued on March 25,
2003 its $4,005,000 Hommocks Park Apartment Refunding Revenue Bonds, 2003 (the “2003 Bonds”) to refund,
prior to maturity, the outstanding amount of a portion of the Authority’s Hommocks Park Apartments
Revenue Bonds, 1993, which were issued to finance the cost of the construction by the Authority of a 54 unit
garden style housing facility located in the Town of Mamaroneck (the “Town”), on land leased by the
Authority from the Town, which are affordable for rental by persons and families of low and/or moderate
income (the “Hommocks Park Apartments”);
WHEREAS, pursuant to Section 95 of the Public Housing Law the Town is authorized to
guarantee the principal and interest on indebtedness contracted by the Authority;
WHEREAS, pursuant to Section 95 of the Public Housing Law and a resolution of the Town
Board of the Town adopted on October 28, 2002, the Town guaranteed the principal of and interest on the
2003 Bonds; and
WHEREAS, there are now outstanding $1,855,000 of the 2003 Bonds (the “Refunded Bonds”);
and
WHEREAS, the Authority has further advised the Town that a refunding of the Refunded Bonds
by the issuance of refunding bonds in an amount not to exceed $2,200,000 at current interest rates will result
in a present value debt service savings for the Authority and decrease the amount of the Town guarantee
relating thereto; and

WHEREAS, the Authority has further advised the Town that it intends to issue bonds in an
amount not to exceed $650,000 to finance the cost of renovation by the Authority of the façade of the
Hommocks Park Apartments; and
WHEREAS, the Authority has notified the Town that it intends to issue its Hommocks Park
Apartments Revenue Bonds, 2015, in one or more series (the “2015 Bonds”) for the purposes of (i) refunding
the Refunded Bonds, (ii) financing the cost of renovation by the Authority of the façade of the Hommocks Park
Apartments, (iii) capitalized interest on the 2015 Bonds and (iv) certain costs of issuance of the 2015 Bonds
(collectively, the “2015 Project”); and
WHEREAS, the Town Board is desirous of authorizing the guarantee by the Town of the
principal of and interest on the 2015 Bonds to be issued to finance the 2015 Project;
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town as follows:
Section 1. The guarantee by the Town of the principal of and interest on the 2015 Bonds (the
“Guarantee”) is hereby authorized; provided, however, the maximum amount of such guarantee shall not
exceed in the aggregate $2,850,000.
Section 2. The Guarantee shall be evidenced by the execution and delivery by the Supervisor
of a Guarantee substantially in the form presented to this meeting and annexed hereto as Exhibit A. The form
and substance of the Guarantee are hereby approved. The Guarantee shall apply whether the 2015 Bonds are
issued and sold upon such terms and conditions that interest payable thereon shall be includable or
excludable in the computation of gross income of the owners thereof for purposes of federal income taxation.
In the event that the 2015 Bonds are refunded, the Guarantee may also apply to the payment of the principal
of and interest on any refunding obligations of the Authority.
Section 3. The Supervisor of the Town is hereby authorized, for and in the name of and on
behalf of the Town to execute and deliver the Guarantee, in substantially the form thereof presented to this
meeting with such changes, variations, omissions and insertions as the Supervisor shall approve. The
execution thereof by the Supervisor shall constitute conclusive evidence of such approval.
Section 4. The Supervisor of the Town, and all other officers, employees and agents of the
Town are hereby authorized and directed, for and in the name and on behalf of the Town, to do all acts and
things required or provided for by the provisions of the Guarantee and to execute and deliver all such
additional certificates, instruments and documents, pay all such fees, charges and expenses and to do all such
further acts and things as may be necessary, or in the opinion of the officer, employee or agent acting,

desirable and proper to effect the purposes of the resolution and to cause compliance by the Town with all of
the terms, covenants and provisions of the Guarantee binding upon the Town.
Section 5. This resolution shall take effect immediately upon the affirmative vote of at least
four council members of the Town Board.

On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the Easement Agreement
between Mark Shapiro & Mara Steinberg, residing at 65 Howell Avenue, Richard Fraser & Manga
Tatini, residing at 67 Howell Avenue, Edward & Sarah Keating, 8 Hawthorn Road, and Carol Akin,
residing at 1226 Palmer Avenue (collectively “Owners”) and the Town of Mamaroneck, for a
perpetual easement upon, under, through and across (a) the Easement Area to install connect,
construct, extend, lay, maintain, repair, replace or reconstruct the Drainage System and (b) over
the remainder of the Owners’ Property for the sole purpose of gaining ingress and egress by
persons and equipment to and from the Easement Area, and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to sign said Easement Agreement
on behalf of the Town.

the Town of Mamaroneck Ambulance District and the Larchmont/Town of Mamaroneck
Volunteer Ambulance Corps, for a period of five years commencing on February 1, 2015 and
ending on February 1, 2020, and

6.Authorization-Agreement with City of New York-Police Training Expenses

relief to local governments, a municipality is entitled to obtain reimbursement for the cost of
training when a member of the police force leaves for service with another municipal
corporation or a county sheriff.

REPORT OF COUNCIL
Councilman Odierna asked Mr. Altieri for an update on the street lights.
Mr. Altieri stated that currently the staff is being trained on the functioning of the software to run the street
lights. The Town is working on a number of issues from residents, and currently awaits the delivery of the back
shields. The Town is also working on adjusting intensity of lights in certain areas. Mr. Altieri did note a benefit
of the new lights is their ability to be turned up during the night while snow plowing has been taking place,
adding that this makes for a much safer situation for everyone.
Councilman Murphy noted the upcoming kick-off event for Solarize NY at Tequila Sunrise on Sunday, February
22, at 2:00pm.
Councilwoman Katz stated that all her meetings had been cancelled due to snow, adding that the Coastal Zone
Management Commission will meet next week on Monday, and continues to work on the Local Waterfront
Revitalization Plan. The Traffic Committee will meet next week in the Senior Center at the VFW.

Councilwoman Elkind Eney noted she too had many snowed out meetings. Councilwoman Elkind Eney noted
the Board attended the installation dinner for the Fire Department, adding a congratulations to Chiefs Noah
Goldberg, Paul Tortorella and Joe Russo. Councilwoman Elkind Eney attended the press conference on January
th
22, for the Village of Larchmont’s 125 Anniversary celebration, noting what a great beginning to a yearlong
celebration.
Councilman Odierna attended the meeting with the County Executive, previously noted by Mr. Altieri.
Councilman Odierna also attended the Zoning Board Meeting, noting of the six items on the agenda, four were
approved and two were adjourned.
ADJOURNMENT
The meeting was closed in memory of Michael Accocella, who was the Town’s Fire Chief from 1975-1976 and
again in 1991. Michael Accocella was a strong supporter of the Town and a wonderful citizen, we are sorry he
has passed away.

adjourned at 9:00 PM.
