BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney , the Work Session was unanimously opened at 5:00PM. Additionally present as an observer was Town resident Victor Tafur. Upon being asked, Mr. Tafur stated that he was interested in the discussion of the 2015 goals and initiatives. 1.Municipal Energy Program Update Mr. Altieri stated that the Town is moving forward with purchasing power from the Municipal Energy Program (MEP) for the street lights and the Ice Rink at the guaranteed rate of 6.6 cents per kilowatt. Supervisor Seligson noted that an added benefit of joining this program is the Town’s eligibility for NYSERTA grants, noting that NYPA does not have the same grant opportunities that NYSERTA does. There appears to be four other municipalities in Westchester participating in this program to form the consortium. TAKEN OUT OF ORDER 2.Review of Notification Requirements-Demolition Projects Supervisor Seligson stated that in response to resident complaints, it seems reasonable to have some form of neighbor notification when a home is to be razed. The Town Board discussed what time frame for notification seemed appropriate. Mr. Maker was asked to draft legislation which addresses a 5 day notice to contiguous homeowners when 50% or more of a structure will be demolished. 3.Energize New York Update Mr. Maker stated he had a recent meeting with the Town’s bond council and representatives from Energize New York. On motion of Councilwoman Katz, seconded by Councilman Murphy, the Town Board agreed to enter into a closed session to receive advice of counsel. On motion of Councilman Murphy, seconded by Councilwoman Katz the Work Session was continued. Supervisor Seligson stated that the Town will not move forward with the Energize New York Program. 1 January 21, 2015 4.Review of Mechanical Rock Removal Law This matter is being addressed due to neighbor complaints with respect to a pool being constructed on Durham Road. The current legislation does not require the limiting of rock removal via chipping if the amount of rock being removed is less than 2,000 yards. Supervisor Seligson stated that these residents are asking the Town Board to consider amending the law in order for a smaller amount of removal to trigger the law. The Board will ask Ron Carpaneto for his advice on what amount of rock is typically removed for a pool and then consider incorporating that into the law. 5.Review of Sustainability Collaborative Law The Town Board reviewed the draft legislation and discussed whether their intent is to grandfather the existing member who is not a resident of the Town, but rather a resident of Rye Neck. The Board would like to grandfather this member, who everyone agrees have been doing an excellent job, but moving forward to maintain the Committee Members as Town residents. The Board will be setting a public hearing for this legislation this evening. 6.Review of 2015 Goals and Initiatives The Town Board reviewed the goals and initiatives list prepared for discussion. The Board reviewed each item and added traffic, specifically, the Weaver Street corridor as an item. Mr. Altieri will send the Town Board previous studies by the Department of Transportation for their review. The Town Board invited Mr. Tabur to speak. Mr. Tabur spoke of his interest in the Town addressing the sanitary sewer lines with respect to inflow and infiltration. Mr. Tabur noted that he is currently active in the Village of Mamaroneck Coastal Management Commission. Mr. Tabur also offered his time and knowledge to the Town in developing a plan to move forward addressing these issues. ADDED ITEM Councilwoman Elkind Eney and Mr. Altieri updated the Town Board on the dasher board problems at the Hommocks Ice Rink. Gaps are developing in between the dasher board panels that are causing an unsafe condition. This was caused by the boards having been delivered during warm weather and now shrinking due to the cold weather. Honeywell is working on repairing the problem, and a plan is currently being implemented. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Town Board agreed to enter into an Executive Session to discuss the Employment History of particular employees within the Police Department and litigation regarding Certiorari. On motion of Councilwoman Katz, seconded by Councilman Murphy, the Town Board unanimously agreed to resume the Work Session. 7.Consideration of Letter to NY Legislature/Governor-Tax Cap Requirements The Town Board reviewed the letter with no discussion. 8.Consideration of Letter to NY Legislature/Governor- Funding for Infrastructure Deferred 2 January 21, 2015 9.Amendment - Resident Parking – Lester Place The Town Board reviewed the draft legislation. Councilwoman Katz commented that the purpose clause did not seem to be in keeping with the purpose clause as stated in the Lester Place Law, adding the Lester Place legislation was enacted to address issues of parking by a neighboring community’s apartment building and not because of commuter parkers. Mr. Maker will review the purpose clause. 10.Amendment - Washington Square Parking Law The Town Board reviewed the draft legislation and felt it was ready for a public hearing. The Town Board will set a public hearing for this at this evening’s meeting. 11.New Business Mr. Altieri stated that he has heard from two residents that they received tickets for parking in the Washington Square area without permits. Mr. Altieri advised the parties that overall the policing and permitting has been implemented with very minimal issues and that over 150 tickets have been issued. If there are tickets residents’ feel are disputable, they should be addressed through the Court. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:10 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT The Town recently experienced a sudden ice storm that created dangerous conditions resulting in many calls for assistance to our emergency services. Thanks to the Fire Dept, Ambulance Corps and Police Dept for working well together to respond to all the calls and serve the community. The Fire Dept also responded to a house fire recently that could have resulted in more serious damage, but the TMFD contained the fire to the first floor and there were no injuries. The community celebrated Martin Luther King Jr. Day with several events. Two events held at the local libraries were excellent. Congratulations to Jane Orans who was honored with the community Martin Luther King Award for her many years of service and generosity to the community. We had a TVS meeting last week. TVS stands for Town Village School and is a gathering of the chief elected officials in the three municipalities with the school superintendents from the two school districts to discuss community issues. We started working to develop our state mandated efficiency plan. The Town Board discussed our priority actions for 2015 and plans to adopt the plan as amended. It is certainly available to the public as well. Just a reminder, in the event of snow, homeowners are responsible for clearing snow from sidewalks adjoining their property. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. PUBLIC HEARING (S) – “Amendment of the Sewer Law” The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING 3 January 21, 2015 LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on December 17, 2014 a Public Hearing will be held on Wednesday, January 21, 2015 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Amendment of the Sewer Law” Purpose: On December 3, 2014, the Town Board enacted Local Law No. 7-2014, establishing a Sewer Rent Law in the Town of Mamaroneck. Upon further review, the Town Board determines that certain amendments should be made to the law. This law contains those amendments. Section 2 – Amendment of sections in Chapter 174 of the Mamaroneck Code: The full text of this Amendment is stated below and can also be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Mr. Maker explained the Town Board incorporated into the Sewer Rent Law a mechanism for protesting ones bill, this amendment clarifies that process. Supervisor Seligson asked if anyone wished to comment on the proposed Local Law. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following Local law was approved: Local Law No. 1 - 2015 This local law shall be known as the “Amendment of the Sewer Rent Law” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: On December 3, 2014, the Town Board enacted Local Law No. 7-2014, establishing a Sewer Rent Law in the Town of Mamaroneck. Upon further review, the Town Board determines that certain amendments should be made to the law. This law contains those amendments. Section 2 – Amendment of a section in the Mamaroneck Code: The definition of SEWAGE appearing in section 174-2 of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: SEWAGE means water-carried human or animal wastes, and any other waste, whether or not it contains organic matter. 4 January 21, 2015 Section 3 – Amendment of a section in the Mamaroneck Code: Section 174-3. D. of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: D. Any system user who maintains that his/her/its sewer rent should be reduced for any given year may make one application to the Town Board for a reduction in that year’s sewer rent. Such application must be in writing, and be supported by evidence that proves either (i) that the system user’s water consumption was less than the water consumption that was used to calculate the system’s user’s sewer rent for that year or (ii) that the amount of the system user’s water consumption that actually was discharged into the sanitary sewer system was less than the amount of water consumption used to calculate the system user’s sewer rent. Section 4 – Creation of a new section for the Mamaroneck Code: Section 174-3. of the Code of the Town of Mamaroneck hereby is amended to include the following: E. If the Town Board reduces a sewer rent pursuant to section 174-3 D (ii), that system user’s sewer rent shall be recalculated based upon the portion of that system user’s water consumption that actually was discharged into the sanitary sewer system, and not 90% of that system user’s water consumption. Section 5 – Reaffirmation of Chapter 174 of the Code of the Town of Mamaroneck: Except as hereby amended, Chapter 174 of the Code of the Town of Mamaroneck shall continue in full force and effect. Section 6 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 7 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Commissioner Abby Katz reminded residents to dig out any fire hydrants located in front of your home, adding that this is a very helpful precautionary measure. Supervisor Seligson noted the recent home fire and thanked the Fire Department for an excellent job - thankfully no one was injured. There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1.Authorization - IMA Westchester County-Repository for Criminal Imaging On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal Agreement between the Town of Mamaroneck and the County of Westchester to continue 6 January 21, 2015 using the Repository for Integrated Criminal Imaging (RICI), allowing for the electronic transmission and storage of criminal records and police blotter information. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award the professional services for an SPCC Plan to Woodard and Curran in the amount of $5,100.00. NOW, THEREFORE, BE IT, RESOLVED, that the Mamaroneck Town Board does hereby promote Police Officer Thomas Hollywood to the position of Sergeant, effective February 2, 2015. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 7.Set Public Hearing-Amendment- Washington Square Resident Parking The ‘purpose’ section of the draft amendment is entered into the record for the explanation of setting a public hearing as follows: Section 1 – Purpose. By Local Law 4-2014, the Town of Mamaroneck created a Residential Parking Area for the Washington Square neighborhood on the following streets or sections of streets: Washington Square, New Jefferson Street, the section of North Chatsworth Avenue between Myrtle Boulevard and the northern boundaries of the lots on the opposite side of the street improved with the buildings known by the postal addresses of 35 North Chatsworth Avenue and 40 North Chatsworth Avenue and the section of Murray Avenue between Myrtle Boulevard and Leafy Lane. The Town Board adopted this law pursuant to the power given by section 1662-d of the New York Vehicle and Traffic Law. The Town Board considers the section of Myrtle Boulevard lying between North Chatsworth Avenue and Madison Avenue to be part of the Washington Square neighborhood. On that section of Myrtle Boulevard, there are some residential units. The Town Board determines that owners of motor vehicles, who reside on this section of Myrtle Boulevard, if otherwise eligible, should be allowed to obtain WS Resident Parking Permits so that they can park their motor vehicles in the Residential Parking Area defined in Local Law 4-2014. Furthermore, when section 1662-d of the New York Vehicle and Traffic Law was enacted, the section of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue lay in a Business District: B zoning district. Afterwards, the Town Board rezoned this section of Myrtle Boulevard to a Business-Residential District: B-R zoning district whose principal uses include multi-family housing. Accordingly, there may be additional residential units constructed on the section of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue. This local law expands the definition of “Area Residents” so that owners of motor vehicles, who reside on this section of Myrtle Boulevard, if otherwise eligible, may obtain WS Resident Parking Permits. This local law shall not be construed as expanding the Residential Parking Area to 10 January 21, 2015 include the section of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue and the rules regarding parking now in effect shall continue to apply. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Amended definition of ‘Area Resident’ for the residential parking system for (a) Washington Square, (b) a section of North Chatsworth Avenue, (c) New Jefferson Street, and (d) Murray Avenue between Myrtle Boulevard and Leafy Lane” Law for February 4, 2015, at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 8.Set Public Hearing-Amendment-Sustainability Collaborative Legislation On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Creation of a Sustainability Collaborative for the Town of Mamaroneck” Law for February 4, 2015 at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 9. Settlement of Certiorari On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Town Board hereby authorizes the settlement of the following tax certiorari on the following terms: Subject: Camdell Realty LLC Address: 2082-2084 Boston Post Road Larchmont, NY 10538 Section/Block/Lot: 6/13/242 Town of Mamaroneck/Village of Larchmont Year Assessment Amount of Reduction Reduced Assessment 2010 $29,500 $6,590 $22,910 2011 $29,500 $5,400 $24,100 2012 $29,500 $6,880 $22,620 The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye WRITTEN COMMUNICATIONS None 11 January 21, 2015 REPORT OF COUNCIL th Councilwoman Elkind Eney attended on January 9 the LMC-TV New Year’s Party, at the Hommocks Ice th Rink Community Room, adding she even rented some skates and ‘tested out’ the new rink. On January 11 she and other Board Members’ attended the Human Rights Committee in conjunction with the Friends of the Library, their Dr. Martin Luther King, Jr. Event. The event featured Keesha Gaskins, Director, Democratic Practice, the Rockefeller Fund, who spoke about Voting Rights. Jane Orans was given the Martin Luther King, Jr. Award for her contribution to the community exemplifying Dr. Martin Luther King, Jr.’ s ideals. On th January 13 Councilwoman Elkind Eney attended the Recreation Commission Meeting, at which they discussed the state of the rink and the upcoming spring brochure. Councilwoman Elkind Eney noted that the Planning Board did not meet this month. Councilwoman Elkind Eney announced the upcoming Bunny Hop 5K run/walk being held by the Town Recreation Department in conjunction with the Fire Department. nd This event will be held on March 22 . Councilwoman Katz noted how much she enjoyed the Dr. Martin Luther King, Jr. event and noted the various cross-section of residents in attendance. Councilwoman Katz also attended the Library Board Meeting, noting that they are gearing up for ‘Brick Fest’. More as a resident, than a Councilmember, she attended the Mamaroneck School Board’s Listening Tour’, a forum for the School Board to receive feedback from the community. Councilman Odierna attended a bicycle planning meeting, at which they are discussing maximizing and properly using the grant received from the Rotary Club to purchase and install bike racks in the community. th On January 8 Councilman Odierna attended the Mamaroneck Chamber of Commerce Meeting. Councilman Murphy had no liaison assignment meetings. Councilman Murphy stated how impressed he was with the words of Mark Levy during the Dr. Martin Luther King, Jr. event. Mr. Levy characterized Jane Orans, the award recipient, as the “moral compass of our Community”. Councilman Murphy could not agree more with that statement, adding that the award went to a very deserving individual in our community. Town Clerk Christina Battalia spoke of her attendance at the Laserfiche Conference last week. Ms. Battalia noted that Laserfiche is the Town’s Electronic Data Management System, adding that one of the goals of the Town will be the implementation of an agenda automation process through Laserfiche. Supervisor Seligson noted her attendance at the recent Sustainability Collaborative Meeting, noting that they have a packed agenda. Supervisor Seligson noted the hard work this committee is doing and thanked them for the hard work. ADJOURNMENT Supervisor Seligson closed the meeting in memory of a Susan Sirkman, who lost her battle with cancer two weeks ago. Susan Sirkman was a wonderful member of our Community and the beloved wife of Rabbi Sirkman.
