MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON JANUARY 7, 2015, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was
unanimously opened at 5:00PM.

1.Update – Village of Larchmont 125 Anniversary Event

Additionally Present: Lynn Crowley, representing the 125 Anniversary Committee
Ms. Crowley gave the Town Board an update on the upcoming celebration. At this time there is nothing
specific being asked of the Town.
2.Sustainability Collaborative Structure
The Town Board discussed the approval process for expending the budgeted funds allotted to the
collaborative in the amount of $25,000. Specifically, they discussed a pre-determined threshold at which
the Collaborative would need to get from the Town Administrator or Town Board. Mr. Altieri also
suggested he would create a line item budget that the Board will look at and approve. The Town Board
reviewed draft legislation and agreed to change the requirement that members be residents of the Town.
Mr. Maker will do a revision for the next Town Board meeting.
3.Municipal Energy Program (MEP)
Mr. Altieri explained that the Town has an opportunity to purchase energy through the MEP at a lower rate
than the Town is purchasing through NYPA. Mr. Altieri reviewed the agreement with NYPA and determined
that the Town would have to give a one year notice if the Town were to separate entirely from NYPA. The
agreement does provide for a member to purchase some of its power from another agency. The Town has
notified MEP that if it can guarantee a rate lower than 006.6 cents per kilowatt hour (the NYPA rate) then
the Town will join the MEP consortium. The Town would use the program through MEP to power the street
lights and the Ice Rink. The Board discussed how, and if, this would affect the current ESCO with Honeywell.
Although Honeywell will benefit slightly the Town will as well, because the energy cost would be less. The
Town has issued a letter of intent to MEP, with the caveat that the rate be lower than NYPA and the Town
Attorney approval the agreement.
The Town Board discussed issues with the street lights and Mr. Altieri discussed the remedies being worked
on to solve specific issues.

4.General Review – Budget Submission Data
Mr. Altieri asked the Town Board to consider whether the current budget submission format is acceptable
or would the Board like to see some changes and if so what those changes might be. The Board discussed
suggested format changes, and Mr. Altieri will incorporate these into the budget process.
5.Discussion – City of Long Beach Sewer Lateral Law
The Town Board reviewed a memo from Mr. Altieri dated December 29, 2014 and Supervisor Seligson
explained that in light of the mandatory evaluation and repair of the sanitary sewer system to eliminate
sources of inflow and infiltration it is being suggested that the Town consider legislation similar to that
enacted by the City of Long Beach. The Long Beach legislation reads:
“This resolution is brought before the City Council seeking to amend the City’s Code in order to
reduce infiltration and inflow into the sanitary sewer system, groundwater and waterways, by
requiring inspection, testing, repair, replacement and ongoing maintenance of privately owned
sewer laterals within the City. Inspection will only be necessary by the owner at the time of sale of a
property or when renovation costs exceed fifty (50%) of the assessed value of the property. “
The mechanism Long Beach used to help residents pay for these repairs is through an insurance type
program in which everyone was lumped into the insurance plan. A vendor was found that would allow
residents to pay $10.00 per month as a premium and the vendor would then make the repairs when found.
Supervisor Seligson updated the Town Board on a meeting she and Steve attended with the NYS
Department of Environmental Conservation (NYSDEC) , the Westchester County Department of Facilities,
the County Attorney and the four municipalities in the New Rochelle Sewer System. As the Board recalls
the Town passed a resolution obligating ourselves to evaluate our sanitary sewer system and set out a plan
for repairs. That resolution required the municipalities to evaluate the sanitary sewer system and have a
plan completed by August 2017. The County approved this plan, but the DEC did not. The DEC wants the
evaluation and repairs to be completed by August 2017. Supervisor Seligson stated that everyone agrees
this is not possible and there is a lot of frustration among the municipalities. The culmination of the
meeting was that the County agreed to put pressure on the NYSDEC to accept this plan, already agreed to
by the four municipalities, and not shut down the overflow facilities as that would only exacerbate the
situation.
6.Solarize New York Program
One of the activities the Sustainability Collaborative is working on is a program known as Solarize New
York. Essentially vendors are chosen to provide the installation of solar panels in communities in New York
State and then municipalities adopt an expedited permit process. Mr. Altieri has discussed this with Ron
Carpaneto who advised that his Department is capable of handling these expedited permits. The Town will
need to amend its Fee Schedule to incorporate this fee. A resolution will be prepared for the next Town
Board Meeting.
ADDED ITEM
Mr. Altieri, Supervisor Seligson and Pamela Valenza attended a meeting with the Village of Mamaroneck
and representatives from ORPTS to discuss the Homestead Option. Although the Village of Mamaroneck
would like to move forward on this, the Town made it clear that the time line for implementation is
unattainable for this year; the Town would need to do a full valuation of all the condominiums.
7.2015 Organizational Agenda
Supervisor Seligson asked the Board to consider changing the March, and potentially April, Board Meetings.

The Town Board discussed and agreed to hold the March meetings on March 11 and March 25 . The

April meetings remain unchanged.
8.New Business
Supervisor Seligson noted that she received a call from County Legislator Catherine Parker today informing
her that the equalization rate for the County taxes, preliminarily, looks to be a reduction for Town residents
of their County tax rate of 1%.
Supervisor Seligson also noted that she and Steve attended a meeting of the Housing Authority, then asked
Councilman Murphy to elaborate. Councilman Murphy, who was also in attendance as the liaison,
explained that the Authority would like to refinance their bonds in order to make capital repairs to the
Hommocks Apartments. The Authority is asking the Town to guarantee the bonds, similar to was was done
with the original bonding. The Authority will need a resolution supporting the guarantee. At the invitation
of the Authority, the Town Board would like to have an on-site viewing of the Hommocks Apartment.
On motion of Councilman Murphy, seconded by Councilwoman Katz, the Board unanimously agreed to
enter into an Executive Session to discuss employment history of particular persons within the Police
Department.

to resume the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.
SWEARING IN CEREMONY – COUNCILMAN THOMAS MURPHY
Councilman Tom Murphy was sworn in by Town Clerk Christina Battalia
Supervisor Seligson and the Board all shared in congratulating Mr. Murphy and noting his continued
contributions to the Board.
STATE OF THE TOWN ADDRESS
Happy new year to everyone. The Town of Mamaroneck experienced a productive and positive
year in 2014. There were many capital improvement projects and well-attended programs. Our
financial situation improved due to the improvement in the economy and our efforts to recover
delinquent taxes and restore our fund balance. The Town provides a myriad of services to
residents including garbage collection, police, fire and ambulance service, road repair, snow
plowing, recreation programs, Town Court, building dept. services, senior citizen programs,
parking permits, and of course, tax collection. I will touch on some of the highlights of 2014 for the
Town.
The Town made great improvements to the Hommocks Ice Rink, Town Center, Fire House and
Street Lights this year. The Ice Rink needed repair and upgrading badly. The 2014 renovations
included the complete replacement of the entire ice making and dehumidification system to
improve the quality and increase the availability of the ice yet use less energy. In addition, new

lighting, and new dasher boards were installed along with new rubber floor matting. New
features of the rink also include a new event deck that will allow for year round use of the ice rink
facility. Hopefully residents see the new paint and appreciate the upgraded look and feel of the
rink. It’s warmer over the bleachers too as we now have radiant heat for those areas. The
upgrades will save $41,400 a year in energy use.
The Town Center and Fire House were both outfitted with weather stripping, window film and
programmable thermostats. The Town Center has new lighting, ventilators, new dual-fuel boilers
and vending misers that turn power lower on vending machines in times of low use. The Town will
save $34,000 a year in energy costs at the Town Center and $4,000 a year at the Fire House.
The Town changed its 1300 street lights to LED lights this year. These changes will save the Town
$106,000 a year in energy costs. The LED lights will require much less maintenance and last much
longer than the old lights. The Town has computer control over the lights allowing us to better
control and adjust them. There have been varied reactions to the new lights and we plan to adjust
them as best we can.
These upgrades were part of a project that allowed us to work with one contractor, Honeywell
Systems, and guaranteed the energy savings. The total energy savings of $190,000 a year will
cover the costs of the debt service of the renovations. Thank you to the Town Board and Town
Administrator Steve Altieri for having the courage and fortitude to embark on these big projects in
an innovative manner that will provide years of benefit and savings to the Town.
This was the first year that residents saw the reassessment project reflected in their taxes. The
Town will annually review selected neighborhood assessments and expects to complete a full
reassessment update in 2017.
The Town’s environment committee, the Sustainability Collaborative, worked hard this year to
develop a “Plan for A Sustainable and Resilient Mamaroneck”. The Plan’s fundamental goal is
preserving and enhancing the long term viability of the Town of Mamaroneck from environmental
and fiscal perspectives. The actions strive to make the Town more resilient to severe weather
events and more sustainable for the future. The volunteers on the Sustainability Collaborative
deserve a great deal of credit and thanks for their perseverance and dedication. There is a brief
summary of the draft plan and action items for 2015 on the Town’s website.
The Town also adopted an “All-Hazard Mitigation Plan” addressing the most extreme hazards to
our community. These two plans, the “All Hazard Mitigation Plan” and the “Plan for a Resilient
and Sustainable Mamaroneck” complement one another and form the basis of capital and
operational planning for the Town. The Town Highway Dept. resurfaced 3.38 miles of road and
replaced 3,850 feet of curbs and 1,640 feet of sidewalks. Four thousand seven hundred sixty
people participated in Town recreation programs in 2014. Five hundred seventy children attended
Town camps in the summer of 2014.
The Town was awarded 3 grants in 2014 that will partially fund projects to be implemented in
2015. One is to build a sidewalk extension on Weaver Street from Murray Avenue to Bonnie Way.
Another is to identify impediments to and write new language for sustainability in our
comprehensive plan and zoning code. The third is called Solarize Westchester and is a program led
by Sustainable Westchester to help municipalities market solar projects to residents at reduced
pricing.
The Town also received a technical grant from Columbia University’s Masters in Sustainability
Program Capstone Group to analyze and make recommendations for the Town to become a near-
zero waste community. The Group presented their findings in a most professional and helpful way
at MHS and we will review the recommendations throughout the year.
The Town continued its tradition of intermunicipal cooperation in working with several of our
closest municipal neighbors including the Village of Larchmont, Village of Mamaroneck and City of
New Rochelle. We participated in our second year of a joint road resurfacing contract to achieve
better pricing. We also initiated an Inter-Municipal Agreement with the City of New Rochelle to

provide certain services to New Rochelle residents for a fee who are situated within the geography
of the Town of Mamaroneck. This past fall the Town of Mamaroneck assumed property
assessment responsibility for that portion of the Village of Mamaroneck in the Town. All of these
examples of intermunicipal cooperation have improved our overall efficiency and provided savings
to the taxpayers.
The Town passed several pieces of legislation in 2014. One law that took almost a year of work
and negotiations is the Resident Parking Permit Law in the Washington Square Area. The intent of
this law is to provide more parking for residents of the area by preventing people, specifically
commuters, who do not live in the Area from parking for more than 3 hours between the hours of
9:00 am and 2:00 pm.
The other notable law is the Sewer Rent Law. This will remove the Town taxes related to sewer
costs from residents’ tax bills. The cost will be charged as a fee based on water usage to more
fairly charge for the service. This way residents have more control over their costs.
Before I close, one potential expensive infrastructure issue needs mentioning for 2015; the repair
of the sanitary sewer pipes in the Town. Westchester County is imposing this requirement on all
municipalities within the New Rochelle and Mamaroneck Sewer districts based upon a consent
order from the NYS Dept of Environmental Conservation and requirements of the Westchester
County Sewer Act. The Town will be required to reduce and remove the inflow and infiltration of
stormwater into the sanitary sewers. The sewer system in our area is very old and many pipes
have cracks, leaks or breaks. We don’t know what the exact costs will be for repair yet, but we
know it will be a lot.
Having said all this, as the Town Supervisor, I feel that the Town is in good shape and in good
hands. The Town Board and staff continue to be dedicated to running a good government and
providing a high level of service to the residents. Our budget for 2015 is solid, the economic
outlook has improved, and the Town is highly regarded in the County and in New York State. We
brought the 2015 Town Budget in below the NYS-mandated tax levy cap.

I want to thank my fellow Town Board members for their interest in, dedication to and hard work
for the Town. I also want to thank the Town department heads and employees for their continued
high level of service to the Town and their esprit de corps. Their individual expertise is critical to
our success as a local government. I have to especially thank Town Administrator Steve Altieri for
his leadership and indefatigable service to the Town.

On motion of Councilman Odierna, seconded by Councilman Murphy, it was

Violations Management Agreement with Complus Data Innovations dated December 8, 2014, for
the term of January 1, 2015 to December 31, 2017.

3.Report of Bids – TA-14-15 - Winding Brook Bridge
Mr. Altieri explained that this is the second time this project has been set out to bid. The first time was in
July of 2014, after which the Town rejected the bids, as the lowest bid was $340,000, and well over the
Town’s expected pricing.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved,
WHEREAS, on December 8, 2014, the Town publicly opened and read one bid for Contract TA-14-15
Replacement of Winding Brook Bridge.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-14-15 to the lowest
responsible bidder M. A. Bean Associates, Sanbornton, NH for a total of $ 239,000.00 and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to sign said contract on behalf of
the Town.

On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the following was approved
WHEREAS, on December 22, 2014 the Town publicly opened and read two bids for Contract TA-14-
17 Furnishing of Police Uniforms.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-14-17 to the lowest
responsible bidder New England Uniform LLC, Danbury, CT, for a total of $ 503.48 to provide
uniforms for the Police Department for the years 2015 and 2016, and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to sign said contract on behalf of
the Town.

7. Authorization – Establish Capital Project and Transfer of Funds – Water Main Project – Hommocks Road
Mr. Altieri explained that on “December 28, 2014 a water leak was discovered on Hommocks Road at
Eagles Knolls Road that required a response by the Westchester Joint Water Works. Upon inspection it was
discovered that the pipe was in deteriorated condition. This is one of the Town’s older water transmission
lines constructed of concrete asbestos. As a result the Westchester County Department of Health is
requiring replacement of approximately 230 feet of water main.”
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby establish Capital Project 2015-12
Water Main Project – Hommocks Road as outlined by the Town Comptroller in the following

WRITTEN COMMUNICATIONS

REPORT OF COUNCIL
Councilman Murphy attended the Housing Authority Meeting at which they discussed upcoming bonding
refinancing. Due to the very favorable interest rates, the authority would like to refinance some of its
original bonds in order to make some infrastructure repairs. It would like the Town to guarantee the bonds
similar to what was done in the 1990’s.
Councilman Odierna noted that things were quiet the last few weeks, but he did attend the Larchmont
th
Gardens’ Civic Association (LGCA) on January 5. They continue to discuss the aerators for the Duck Pond.
Councilwoman Katz had no liaison meetings.
Councilwoman Elkind Eney previously reported on the Fire Council Meeting.
Supervisor Seligson noted the two upcoming Dr. Martin Luther King, Jr. events being held by the Human
Rights of Larchmont & Mamaroneck. The Town Board congratulates Jane Orans on being this year’s
honoree.

Supervisor Seligson closed the meeting in memory of Joe Russo’s father who passed away last week and in
memory of Roberta Ronan. Roberta Ronan is the wife of Martin Ronan the Chair of our Ethics Committee.
Roberta was a wonderful person and active member in our community and she will be missed very much.
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the meeting was unanimously
adjourned at 9:00 PM
