BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: ALSO PRESENT: Supervisor Jaine Elkind Eney Councilwoman Abby Katz Councilwoman Sabrina Fiddelman (for Worksession) Councilman Jeffery L. King Councilwoman Robin Nichinsky Christina Battalia, Town Clerk Meredith S. Robson, Town Administrator Connie Green O'Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney Lindsey Luft Assistant to the Town Administrator CALL TO ORDER - WORK SESSION The Worksession of the Town Board was called to order by Supervisor Elkind Eney, then on motion of Councilwoman Katz, seconded by Councilman King, the Work Session was unanimously opened at 5:00 p.m. Discussion — Sanitation Commission Supervisor Elkind Eney stated that the compilation of documents was provided as information for the Town Board, and asked if anything additional was needed. Supervisor Elkind Eney will be meeting with Mayor Walsh prior to the February 17, joint meeting of the boards. This meeting is to establish the goals for the joint meeting on February 17. The Town Board asked for an entire cost analysis broken down by each option — District option, option to maintain Commission with an IMA, and the option to separate. Additionally, Supervisor Elkind Eney will ask Mr. Altieri to update his previous memo detailing the options. Councilwoman Katz asked for information on what other municipalities are doing with their commercial districts. Discussion - Poet Laureate The Village of Mamaroneck Committee for the Arts has asked if the Town would like to participate in seeking a shared Poet Laureate, and if so, would anyone like to be on this committee. The Town Board was open to a shared Poet Laureate, but with the current liaison responsibilities, has no one to sit on this committee. Demonstration - Laserfiche Public Portal At the previous Town Board meeting the Town Board approved the Laserfiche Public Portal, but because the meeting location was at the Senior Center, they did not receive the demonstration. Town Clerk, Christina Battalia, provided a demonstration of the public portal as well as the internal not public facing system. Discussion — Bond Resolution and Call for Election for the Purchase of Fire Apparatus for Fire District No. 1 Additionally Present: Tracy Yogman Town Comptroller Ms. Yogman presented from her memo to the Town Board dated February 2, detailing the replacement of Engine #37 and Engine #51. The proposed bonding is in the amount of $1,308,000.00. The resolutions needed to move forward are part of the Fire Commission agenda for this evening. Review — 2021 Capital Budget Amendments Additionally Present: Tracy Yogman Town Comptroller 1 February 2, 2022 The Town received a memo from the Comptroller detailing the three projects that need budget amendments, the senior passenger bus, the highway garage improvements, and the repairs due to Tropical Storm Ida. Approval of these amendments is on the regular agenda for this evening. Review — 2022 Capital Budget Amendments Additionally Present: Tracy Yogman Town Comptroller The Town received a memo from the Comptroller detailing the budget amendments needed for the fire apparatus purchase, the Fire Department HVAC and the ArcGIS Upgrade. Approval of these amendments is on the regular agenda for this evening. Review — Limited English Proficiency (LEP) Compliance Policy The Town Administrator explained that as required by the US Department of Housing and Urban Development (HUD) and part of the Town's Annual PHA Plan submitted and approved by HUD, the Town will need to approve Limited English Proficiency (LEP) Compliance Policy. Approval is on the regular agenda for this evening Review — 2022 Esri Professional Services — ArcGIS Upgrade and Improvements In response to Town staff needs, Esri Professional Services has proposed "the upgrade of the Town's existing ArcGIS enterprise server to allow for improved support and integration with expanded tools for field collection data." Funding for this project was planned as part of the approved 2022 Capital Projects Budget. Discussion — Mamaroneck High School (MHS) Murals Murals depicting Fenimore Cooper's literature and life, located at MHS, are slated to be removed or covered up as part of upcoming renovations at the High School. A meeting to discuss potential relocation is scheduled for Thursday February 3. The Town Clerk was asked to review the murals and give her feedback. Ms. Battalia stated that although the murals are significant for their historical value, their removal and relocation is costly, and given that several of the murals have imagery inconsistent with community values, she would not advise expending funds for their relocation. OUT OF ORDER New Business Councilwoman Nichinsky updated the Town Board on the recent meeting of the Sustainability Collaborative, of which she is now liaison. Councilwoman Nichinsky asked for feedback on how she should interact, specifically with respect to the Sustainability Collaborative's work on the Tree Law. Ms. Robson noted that Town staff is currently working on the tree law amendments, and suggested that she meet with the Sustainability Collaborative to make that clear that they should wait for the staff input before moving forward. Additionally, she will offer to attend their meetings to help interface the Collaborative with the Town. Supervisor Elkind Eney asked that moving forward during new business the Town Board members report on their liaison assignments. Supervisor Elkind Eney met today with Senator Schumer's legislative aid. Based on this meeting, she believes that the Senator's office has a good understanding of the needs in our area, specifically, sewers, the water filtration plant, our roundabout, etc. With respect to the new redistricting, the maps have been finalized and will be voted on shortly. Westchester County is together with parts of the Bronx and Queens and the North Shores of Suffolk and Nassau Counties. State Senator Mayer and Assemblyman Otis will make it known to our new representatives not to forget about Westchester. 2 February 2, 2022 EXECUTIVE SESSION On motion of Councilman King, seconded by Councilwoman Katz, the Board unanimously agreed to enter an Executive Session to discuss employment history of particular persons, potential litigation and sale of land. On motion of Councilman King, seconded by Councilwoman Katz, the Board unanimously agreed to resume the Regular Meeting. (return to) New Business Councilman King discussed with the Town Board the concept of joining with the Village of Larchmont on their plans to rebuild the current paddle tennis courts at Flint Park. The Town Board was very open to the idea and Councilman King will follow up with the Village. It was also suggested that Councilman King discussed the concept with the Recreation Commission. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Elkind Eney at 8:00 p.m. Supervisor Elkind Eney noted that the Town Board met for a worksession beginning at five o'clock this evening. SUPERVISOR'S REPORT Welcome to the February 2, 2022, meeting of the Town Board of the Town of Mamaroneck. The Town Board met today for a Worksession in Conference Room C starting at 5:00, which is open to the Public. Forget Punxsutawney Phil, our own Mamaroneck Phil did not see his shadow today so it looks like spring will be early this year! We introduced a new means of communication with the residents this month —This Month in Mamaroneck: Town Happenings. It will come out on or before the first of each month and list all of the events and meetings in the Town that month. One list of your fingertips. We had two near misses this week On Wednesday night there was a fire in one of the apartments in Town. Fortunately, there were no injuries and the fire was contained to one apartment with only minor water damage to the apartment below. Please remember to blow out candles when you leave the room/apartment and turn off/unplug electric devices like space heaters. And, when you leave the apartment, remember to close the door to impede the spread of a fire. 1 want to thank the TMFD, TMPD, and VAC for their quick response and professionalism in containing the situation. 1 also want to thank the residents who remained calm standing out in the cold waiting to return to their apartments. Finally, 1 want to thank the VOM and VOL fire departments and the Larchmont PD for their mutual aid assistance and the New Ro Fire Department for providing a FAST Team. Thankfully, the snowstorm this weekend resulted in lower accumulation than predicted. 1 want to thank our outstanding Highway department under leadership of John Beretto who plowed through the night to ensure public safety. 1 also want to thank the TMPD, TMFD and VAC for being on standby. Special thanks to the TMFD for cooking and providing food for all. Monday morning 1 attending the swearing in of new Town police officer Vincent Cuccia. PO Cuccia comes to us after serving in the City of Mount Vernon police department. Congratulations Police Officer Cuccia—you are joining a great crew. We wish you the best. And stay safe! We are continuing to work with the Village of Larchmont on a restructuring of the Joint Sanitation Commission. Meredith and 1 met last week with Mayor Lorraine Walsh and Village Administrator Justin Datino, along with Steve Altieri, superintendent and James Staudt, counsel in furtherance of the process. 3 February 2, 2022 The final Congressional Redistricting Maps are in. There is good news for the TOM, the VOM and the VOL. We are all in the same Congressional District with the other Sound Shore communities in Westchester —Port Chester, Rye Brook, Rye City, Southern New Rochelle and Pelham. The district also includes a small portion of the Bronx and Queens and large portions of the Sound Shore of Nassau and Suffolk Counties. When the new maps take effect in June, our Representative will be Tom Suozzi. Shelley Mayer and Steve Otis will remain our State representatives. We are about to embark on the Comprehensive Plan update. The comprehensive plan sets forth a blueprint and vision for the future of our community and a road map for future actions by the Town Board. We have hired the Land Use Law Center as our consulting firm to assist us with this effort. Anchored within Pace University School of Law, the Land Use Law Center promotes sustainable land use policies by providing strategic planning services to communities. They have been involved in numerous Comprehensive Plan updates in the Hudson Valley region. We have selected a dynamic Comprehensive Plan Steering Committee composed of individuals from many areas of our community. The starting point will be input from the residents... what do you want for our community. Be on the lookout for opportunities to participate in the coming months. Community outreach is critical to the success of the plan and is critical in helping the Town Board set priorities. On the fun side there were two special events at the Rink the weekend before last Our Recreation Department hosted a fun and well -attended character skating event. Enthusiastic boys and girls skated with everyone's favorite Police Dog. Also on Sunday, Mamaroneck Youth Hockey Association partnered with the NY Rangers to host a "Girls -Only Try Hockey for Free" event! Over 60 girls, ages 5-14, were on the ice trying hockey for the first time. Free rental skates and loaner equipment were provided. The girls also received a free NY Rangers souvenir hockey stick. CITIZEN'S COMMENTS Supervisor Elkind Eney asked if anyone in the audience wished to address the Town Board, and there was not. BOARD OF FIRE COMMISSIONERS Commissioner Elkind Eney called the Meeting to order, then on motion of Commissioner Katz, seconded by Commissioner Nichinsky the Board of Fire Commissioners was unanimously declared open. Fire Apparatus Purchase - Bond Resolution, Call for Election, Designation of Election Inspectors, Setting Meeting Time of Inspectors BOND RESOLUTION (subject to mandatory referendum) At a regular meeting of the Board of Fire Commissioners of Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, held at the Town Center, in Mamaroneck, New York, on the 2nd day of February 2022, at 8:00 o'clock P.M., Prevailing Time. The meeting was called to order by Commissioner Elkind Eney and upon roll being called, the following were PRESENT: Supervisor Jaine Elkind Eney Councilwoman Abby Katz Councilman Jeffery L. King Councilwoman Robin Nichinsky ABSENT Councilwoman Sabrina Fiddelman The following resolution was offered by Commissioner Abby Katz, who moved its adoption, seconded by Commissioner Robin Nichinsky, to -wit: BOND RESOLUTION DATED FEBRUARY 2, 2022. A RESOLUTION AUTHORIZING THE PURCHASE OF FIRE FIGHTING VEHICLES, INCLUDING APPARATUS AND EQUIPMENT FOR THE MAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $1,308,000, AND AUTHORIZING THE ISSUANCE OF $1,308,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; NOW, THEREFORE, BE IT RESOLVED, by the Board of Fire Commissioners of Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, as follows: 5 February 2, 2022 Section 1. The purchase of fire fighting vehicles for use by the Fire District, including incidental apparatus, equipment and expenses in connection therewith, in and for Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, is hereby authorized at a maximum estimated cost of $1,308,000. Section 2. The plan for the financing of such maximum estimated cost is by the issuance of $1,308,000 serial bonds of said Fire District hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is twenty years pursuant to subdivisions 27 of paragraph a of Section 11.00 of the Local Finance Law. Section 4. The faith and credit of said Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property in said Fire District, a tax without limitation as to rate or amount sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. Section 6. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such forth and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Fire District Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 7. The validity of such bonds and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or b) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 9. Upon this resolution taking effect, the same shall be published in full in the official newspaper of said Fire District for such purpose, together with a notice of the Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law. Section 10. This resolution is adopted subject to approval at a special election of said Fire District to be held on March 15, 2022. King Aye Councilwoman Robin Nichinsky Aye RESOLUTION CALLING A SPECIAL FIRE DISTRICT ELECTION The following resolution was offered by Commissioner Robin Nichinsky, who moved its adoption, seconded by Commissioner Abby Katz, to -wit: 6 February 2, 2022 WHEREAS, the Board of Fire Commissioners of the Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York has heretofore at this meeting adopted a bond resolution authorizing the purchase of fire fighting vehicles, including incidental apparatus, equipment, and expenses in connection therewith, at a maximum estimated cost of $1,308,000, which is subject to the approval of the qualified voters of said Fire District, NOW, THEREFORE, BE IT RESOLVED, by the Board of Fire Commissioners of Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. A special election of the qualified voters of Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, is hereby authorized to be held on the March 15, 2022, at the Weaver Street Firehouse, in Mamaroneck, New York, in said Fire District, between the hours of 3:00 o'clock P.M. and 9:00 o'clock P.M., Prevailing Time, to vote BY PAPER BALLOT upon the adoption or rejection of the bond resolution heretofore adopted at this meeting. Section 2. The notice of such special election shall be in substantially the following form, to -wit: 7 February 2, 2022 NOTICE OF SPECIAL ELECTION Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York NOTICE IS HEREBY GIVEN that, pursuant to Section 38.00 of the Local Finance Law and Section 179 of the Town Law, a special election of the qualified voters of Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, will be held at the Weaver Street Firehouse, 205 Weaver Street, in Mamaroneck, New York, in said Fire District, on March 15, 2022, between the hours of 3:00 o'clock P.M. and 9:00 o'clock P.M., Prevailing Time, for the purpose of voting by paper ballot upon the adoption or rejection of the following resolution: Bond Resolution A RESOLUTION AUTHORIZING THE PURCHASE OF FIRE FIGHTING VEHICLES, INCLUDING APPARATUS AND EQUIPMENT FOR THE MAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $1,308,000, AND AUTHORIZING THE ISSUANCE OF $1,308,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such forth and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Fire District Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 7. The validity of such bonds and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or b) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 9. Upon this resolution taking effect, the same shall be published in full in the official newspaper of said Fire District for such purpose, together with a notice of the Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law. 8 February 2, 2022 Section 10. This resolution is adopted subject to approval at a special election of said Fire District to be held on March 15, 2022. * * * * * * * * * * The polls will be kept open for the purpose of voting during the aforesaid hours, and the proposition will be in substantially the following form, to -wit: PROPOSITION Shall the bond resolution entitled: "A RESOLUTION AUTHORIZING THE PURCHASE OF FIRE FIGHTING VEHICLES, INCLUDING APPARATUS AND EQUIPMENT FOR THE MAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $1,308,000, AND AUTHORIZING THE ISSUANCE OF $1,308,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF.", duly adopted by the Board of Fire Commissioners of said Fire District on the 2nd day of February, 2022, be approved Pursuant to subdivision 4 of Section 179 of the Town Law, every elector of the Town who shall be a registered voter of the Town and who shall have resided in the Fire District for the period of thirty days next preceding the election which is the subject of this notice shall be qualified to vote upon such proposition.
