PRESENT: Supervisor Jaine Elkind Eney Councilwoman Abby Katz Councilwoman Sabrina Fiddelman Councilman Jeffery L. King Councilwoman Robin Nichinsky ALSO PRESENT: Christina Battalia, Town Clerk Meredith S. Robson, Town Administrator Connie Green O'Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney Lindsey Luft Assistant to the Town Administrator CALL TO ORDER - WORK SESSION The Worksession of the Town Board was called to order by Supervisor Elkind Eney, then on motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Worksession was unanimously opened at 5:00 p.m. Review of Bids — TA-21-16 On -Call Town Infrastructure Repairs Additionally Present: Rob Wasp Town Engineer The On -call Infrastructure Repairs contract is "designed to provide agreed -upon unit prices for various categories of common contractor work. This award provides the ability to assign small projects through an existing publicly advertised and authorized contract. Work intended to be awarded would be limited to small public works improvements valued at less than $35,000." Mr. Wasp further explained details of the contract. The Town Board was enthusiastic about this contract, and its ability to help the Town get work done efficiently and timely. Awarding of this contract is on the regular agenda for this evening. Review — IMA — Waverly Avenue Bridge Sidewalk Additionally Present: Rob Wasp Town Engineer The Town Board reviewed an IMA between the Town of Mamaroneck and the Village of Mamaroneck with respect to the reconstruction of the Wavery Avenue Bridge. Mr. Maker further explained that although the Town of Mamaroneck is authorized through municipal law to maintain all bridges within the Town of Mamaroneck, they are authorized to enter into intermunicipal agreements regarding the construction, repair and maintenance of these bridges. The Waverly Avenue Bridge located in the Village of Mamaroneck, under the jurisdiction of the Town of Mamaroneck, will be reconstructed under the management of the Village of Mamaroneck. This IMA speaks to that arrangement. This will not be approved this evening and will be added to a future Town Board meeting agenda. Mr. Wasp spoke of the property located at 311 Waverly Avenue and the negotiations taking place for the right-of-way needed for the re -construction of the bridge, specifically it's widening for the addition of a sidewalk. Review — COVID Pol The Town Administrator asked the Town Board for their feedback on the Town's policy for COVID and whether to require vaccination, or testing for unvaccinated employees, adding that this would be helpful in discussions with labor council and the CSEA. The Town Board is not inclined to move to required vaccinations, or testing. Upon being asked, Ms. Robson responded, that there is no consistency in what other municipalities are requiring. Ms. Robson spoke of the difficulty in enforcing the Town's mask mandates at the Ice Rink. Ms. Robson advised that the Town is currently assessing employee COVID leave to address federal leave allotments. January 19, 2022 Review - Retirement Reporting for Elected and Appointed Officials The Town Clerk reported that Justice Meister will be re -certifying his previous log of activities, and Councilwoman Nichinsky will not be enrolling in the retirement system. Therefore, only Supervisor Elkind Eney, due to her newly elected role, will be completing a three-month log of activities. Once completed, the Town will adopt the required reporting resolution. Review — Laserfiche Public Portal As explained by the Town Clerk, the Town has been preparing and is now ready to launch the Laserfiche Public Portal. Details of which were included in a memo from the Town Clerk dated January 14, 2022. This portal will be titled Document Library and will make available to the public many documents that are housed in the Town's Electronic Document Management System (Laserfiche). There is a resolution before the Town Board for approval this evening. Due to the location of the meeting at the Senior Center, a visual review of the portal will be demonstrated to the Town Board at the February 2, Town Board worksession. Discussion — Senior and Disabilitv Tax Exemption Mr. Maker explained from his memo dated January 14, that due to the pandemic, there was an executive order that allowed assessors to renew applications for tax exemptions based on age or disability, without a formal application. Governor Hochul has authorized the option for communities to continue the policy. There is a resolution before the Town Board this evening approving this continued policy. Review — IMA — Bus Shelter The Town Board reviewed a memo from Connie Green O'Donnell dated January 14, 2022 discussing the IMA between Westchester County and the Town of Mamaroneck which details the agreement between Westchester County, the Town and Signal Outdoor, Inc., to operate and maintain the bus shelters in the Town of Mamaroneck. Authorization of this IMA is on the regular agenda OUT OF ORDER New Business Supervisor Elkind Eney reported that the organization REALM, having been in conversation with the Town regarding a location at the Town Center for a commemorative structure, is seeking a more specific commitment from the Town as to whether the hill at Town center would be an acceptable location. This would involve the relocation of the 'school bell', the picnic table and the commemorative bench. REALM would like this verbal 'okay', to engage artist proposals. The Town Board is comfortable with the relocation of these items in order to accommodate a site -specific commemorative structure. Supervisor Elkind Eney reported on the legislative redistricting. "The problem with the current proposed Congressional maps is that the proposed maps split both the Town of Mamaroneck and the Village of Mamaroneck into two Congressional Districts. Larchmont and parts of the Town and Village of Mamaroneck would be in a district with Northeast Bronx and parts of Queens, being split from other Sound Shore Communities. This will dilute our voices and make it harder to get attention for the issues that matter specifically to our community, like flooding..." State Representatives, Shelly Mayer and Steve Otis are advocating for the Sound Shore area. Supervisor Elkind Eney is working with the Mayors of the Village of Larchmont and Village of Mamaroneck on a letter to the Independent Redistricting Commission. EXECUTIVE SESSION On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss employment history of a particular individual and potential litigation. On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Board unanimously agreed to resume the Worksession. 2 January 19, 2022 Discussion — Purchasing Fire Trucks Additionally Present: Fire Chiefs Shaun Hughes, Tom Broderick and Alex Rapp, and former Chief Joe Russo Chief Hughes addressed the Town Board. The Fire Department is actively seeking to enter into a contract with Seagrave Fire Apparatus for the purchase of two fire apparatus. Engine 37 was flooded and destroyed during Hurricane Ida, and Engine 51 has aged out and reaching its end of life. The Fire District will be holding a referendum on bonding for these purchases in March of 2022, but in order to begin the lengthy time line for ordering the apparatus, the Fire Department is seeking authorization to sign the agreement. The agreement would be subject to approval by special election. It was noted that the contract will be corrected to refer to a mandatory referendum, not a permissive referendum. Former Chief Joe Russo a member of the Fire Department Fire Truck Purchasing Committee, addressed the Town Board with details of the specs for the apparatus. Authorization is on the Fire Commissioners agenda for this evening. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Elkind Eney at 8:00 p.m. Supervisor Elkind Eney noted that the Town Board met for a worksession beginning at five o'clock this evening. SUPERVISOR'S REPORT Welcome to the January 19, 2022 meeting of the Town Board of the Town of Mamaroneck. The Town Board met today for a Worksession starting at 5:00, which is open to the Public Last week we had our swearing in ceremony. Unfortunately, due to COVID, we were unable to have an in -person public reception, but it was nevertheless a wonderful event. I look forward to working with the Town Board and staff this year for the benefit of our community. Fortunately Sunday night's storm wasn't as bad as predicted and we didn't have any snow accumulation. 1 will take this opportunity to remind you that, for the safety of the public, the Town requires property owners to clear the sidewalks in front of their property of snow within 24 hours of a snow event. In addition, for those of you that have a fire hydrant in front of your property, the fire department requests that you clear the hydrant of snow so that they will be able to access the hydrant without wasting time to clear it, in the event of an emergency. The Federal Government has made at home COVID Tests available for free. Go to COVIDTests.gov to sign up to have the tests mailed to your home -shipping is free, too. One set of 4 tests will be available for each household. We still have available at the Town Center for distribution to the public some KN-95 masks that were distributed by the County to each municipality. The masks we have here are for residents of the unincorporated area of the Town only. If you live in the Village of Mamaroneck or the Village of Larchmont, masks will be available to be distributed to you by your Village. After every United States Census, which happens every 10 years, the Congressional Maps (and state representative maps) are redrawn to reflect the changing population. This process is called redistricting and its purpose is to create Congressional Districts that are relatively equal in population so that representative democracy can continue. The problem with the current proposed Congressional maps is: They split BOTH the Town of Mamaroneck and the Village of Mamaroneck into two Congressional Districts. Larchmont and part of Mamaroneck would be in a district with the 3 January 19, 2022 North East Bronx and part of Queens, being split from the other Sound Shore Communities. This will dilute our voices and make it harder to get attention for the issues that matter specifically to our community, like flooding, and make it more difficult for local officials to interface with the federal government to meet the needs of our constituents. It will also create confusion among the residents of our community when seeking constituent services. They also split the Sound Shore into two districts, making it difficult to advocate for important regional issues like flooding and Long Island Sound. This is about all of us getting the funding, attention and representation that we deserve to face the challenges we share as a community. PUBLIC HEARING — "2021 Increase in the Tax Exemption for Cold War Veterans" law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, a Public Hearing will be held on Wednesday, January 19, 2022 at 8:00 PM or as soon thereafter as is possible, to consider the "2021 Increase in the Tax Exemption for Cold War Veterans" law, at the Mamaroneck Senior Center, 1288 Boston Post Road, Larchmont, New York. Purpose: The Town provides a partial tax exemption for certain real property owned by certain veterans. The underlying statute for this exemption has been amended to increase the exemption. The Town Board determines that it is fitting for the Town to increase the exemption to the maximum amount allowed by law. Mr. Maker explained the law, noting that the Town typically follows the State with respect to exemptions, and this law does just that. Supervisor Elkind Eney asked if any Town Board Members or the public wished to comment. There were no additional comments or questions. On motion of Councilwoman Nichinsky, seconded by Councilman King, the Public Hearing was unanimously closed. On motion of Councilwoman Nichinsky, seconded by Councilwoman Fiddelman, the following Local law was approved: 4 January 19, 2022 Local Law No. 1 - 2022 This local law shall be known as the "2021 Increase in the Tax Exemption for Cold War Veterans" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1— Purpose: The Town provides a partial tax exemption for certain real property owned by certain veterans. The underlying statute for this exemption has been amended to increase the exemption. The Town Board determines that it is fitting for the Town to increase the exemption to the maximum amount allowed by law. Section 2 — Amendment of a current section of the Mamaroneck Code: Section 195-32 A and B of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: § 195-32 Amount of exemption; limitations. A. Qualified residential real property shall be exempt from taxation to the extent of 15% of the assessed value of such property; provided, however, that such exemption shall not exceed $75,000 or the product of $ 75,000 multiplied by the latest state equalization rate for the Town. B. In addition to the exemption provided by this article, where the Cold War veteran received a compensation rating from the United States Department of Veterans Affairs or from the United States Department of Defense because of a service -connected disability, qualified residential real property shall be exempt from taxation to the extent of the product of the assessed value of such property multiplied by 50% of the Cold War veteran disability rating; provided however, that such exemption shall not exceed $250,000 or the product of $250,000 multiplied by the latest state equalization rate for the Town, whichever is less. Section 3 — Severabilitv: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 — Effective Date: This Local Law shall become effective upon filing with the Secretary of State. In addition to the exemption provided by paragraph A of this subdivision, where the veteran served in a combat theater or combat zone of operations, as documented by the award of a United States campaign ribbon or service medal, or the armed forces expeditionary medal, naval expeditionary medal, marine corps expeditionary medal, or global war on terrorism expeditionary medal, qualifying residential real property also shall be exempt from taxation to the extent of 10% of the assessed value of such property; provided, however, that such exemption shall not exceed $50,000 or the product of $50,000 multiplied by the latest state equalization rate for the Town, whichever is less. C. In addition to the exemptions provided by paragraphs A and B of this subdivision, where the veteran received a compensation rating from the United States Veteran's Administration or from the United States Department of Defense because of a service -connected disability, qualifying residential real property shall be exempt from taxation to the extent of the product of the assessed value of such property multiplied by 50% of the veteran's disability rating; provided however, that such exemption shall not exceed $250,000 or the product of $250,000 multiplied by the latest state equalization rate for the Town, whichever is less. For the purpose of this paragraph, where a person who has served in the active military, naval or air service during a period of war died in service of a service connected disability, such person shall be deemed to have been assigned a compensation rating of 100%. 6 January 19, 2022 Section 3 — Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. The above resolution was put to a roll call vote: Nichinsky Aye King Aye Fiddelman Aye Katz Aye Elkind Eney Aye CITIZEN'S COMMENTS Supervisor Elkind Eney asked if anyone in the audience wished to address the Town Board. George Roniger, of the Larchmont Gardens' Civic Association (LGCA) addressed the Town Board. Mr. Roniger had two comments, one which has already been reported by the Supervisor, that being the redistricting. The LGCA will certainly encourage letter writing as requested by the Supervisor. Mr. Roniger wanted to call to the Town Board's attention the recent tree limb removal by Con Edison of a tree on W. Garden Road. The extreme cutting of the tree limbs, and the lack of notification is upsetting, and the Association would like to add their voice in the need to amend our tree law. Supervisor Elkind Eney responded that a draft amendment to the tree law is currently under review by Town staff. STAFF COMMENTS/PRESENTATIONS Police Chief Paul Creazzo presented his quarterly report and is entered into the record as follows: TOWN OF MAMARONECK POLICE DEPARTMENT CHIEF'S REPORT 4t" QUARTER, 2021 The following is a breakdown of some of the activities of the department from October 1't to December 31t" 2021. OVERALL ACTIVITY Total Calls 2640 Criminal Cases 80 Auto Accidents 60 49 w/ no injury, 11 w/ injury Medical Service Calls 174 Both regionally and locally, the crime trends are focused on three main areas: Identity Theft, Stolen Vehicles and theft from vehicles. We did have a few package thefts during the holiday season however it was not as prevalent compared to previous years. Target hardening is the best advice I can give residents to help protect themselves. Target hardening is where you take away criminal opportunities by making it harder for the criminal to complete their desired act. In terms of Identity Theft, target hardening is tricky. Residents are advised to safeguard their personal identifying information and monitor financial and credit transactions closely. This includes refraining disseminating your information indiscriminately and shredding documents with personal information on them. 7 January 19, 2022 When it comes to stolen vehicles and theft from vehicles, the public can do their part by removing keys and fobs from vehicles, locking doors, parking in well -lit areas or installing motion activated exterior lighting and installing security cameras. It is a good practice to establish a 913M routine every night where you make sure valuables are removed from your vehicle, lock your vehicles and make sure your exterior lights are on or ready to activate. In addition, while not a trend, we did recently have a residential burglary. The event took place in the evening hours. With daylight savings upon us, do not let potential burglars know you are not home. If you are not home, put a light on a timer or leave one on. TRAINING ACTIVITY The members of the Department completed 216 hours of training. Some of the training included: • Active Shooter Instructor Training x 3 • Real Time Crime Center Training x 6 COMMUNITY OUTREACH/EVENTS • Staffed an informational table/demonstration at the Food Truck Festival on Oct 2nd • Participated in a Coffee with a Cop at McDonald's on Oct 6tn • In conjunction with VMPD, we attended the Village's Community Night on Oct 1st • We kicked off the special needs registry. Response has been light. • We will be reinstituting our Child Safety Seat Program. We have selected Officers to participate and they are registered to attend a certification class in late February in Ossining. The class was originally slated for January however COVID concerns have pushed it later. • While unfortunately the Halloween drive-thru was cancelled, our Patrol Officers were able to distribute some of the candy while out on Halloween patrol. • The PBA has conducted two fundraisers: o For the third year, the PBA conducted a special Autism Patch and Challenge Coin sale benefitting Christopher's Voice which is a New Rochelle based Autism organization o For the second year, the PBA held a pink patch and challenge coin sale in October to promote Breast Cancer Awareness and to benefit the charity necessitiesbag.org, which provides essentials kits to patients who have under gone breast cancer surgery. • We participated in Operation Blue Santa/Good Night Lights on December 21'. This is an event sponsored by the County Police where Police and Fire apparatus are decorated in holiday lights and then collectively displayed for the children at Maria Ferari's Children's hospital at Westchester Medical Center. It is always a fun event and this year there was an overwhelming countywide response. • In keeping with tradition, through the PBA, we were a "Toys for Tots" collection point in the PD lobby. Participation was good. MISCELLANEOUS We have commenced the process of rewriting and updating our Department Policy Manual to ensure that it complies with all NYS law and industry standards. We have also started to work on having the Town of Mamaroneck Police Department meet all requirements for becoming a NYS accredited agency. Accreditation Manager training is scheduled for late March and we have registered for seats in the class. We currently have one vacant position. We have identified a qualified candidate and we will present the candidate for hiring under affairs of the Town later in the meeting. With your approval, we intend to complete the hiring process by the end of January. In the area of shared services we have joined the Westchester Real Time Crime Center. It is a countywide initiative to aid in investigations and the dissemination of intelligence. Additionally we are doing our due diligence regarding participating in a shared service records management system and possibly a radio system through either the County Police or the MTA Police. Lastly, and most important, our Officers have been working hard the last 21 months through the pandemic to maintain continuity of operations. Due to their efforts we continue to provide uninterrupted 24/7 service to the residents. 91 January 19, 2022 In closing, we wish Supervisor Elkind-Eney the best as she begins her first term as Supervisor and look forward to working with her and the rest of the Board and we would also like to publicly extend our welcome to Councilwoman Nichinsky as she starts out her tenure with the Board. Authorization — Purchasing of Fire Trucks On motion of Commissioner Fiddelman, seconded by Commissioner King, it was RESOLVED, that the Town of Mamaroneck Board of Fire Commissioners does hereby authorize the Town Administrator to execute a contract with Seagrave Fire Apparatus, LLC of Clinton, WI, to furnish two (2) units of Seagrave model TB50CT Marauder Pumper, for the price of $1,844,452.00; $929,195.00 for the first pumper and $915,257.00 for the second pumper, contingent upon the contract providing that it will become null, void and of no further effect, if the electorate votes not to approve the bond that the Town will require in order to fund the purchase The above resolution was put to a roll call vote: Commissioner Nichinsky Aye Commissioner King Aye Commissioner Fiddelman Aye Commissioner Katz Aye Commissioner Elkind Eney Aye 3. Authorization — Contract TA-21-16 On -Call Town Infrastructure Repairs On motion Councilman King, seconded by Councilwoman Nichinsky, the following was approved, WHEREAS, on December 9, 2022, the Town publicly opened and read six (6 ) bids for Contract TA-21-16 On -Call Town Infrastructure Repairs. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award TA-21-16 On -Call Town Infrastructure Repairs, to the three lowest responsible bidders meeting all of the Town's requirements, as follows: Lowest responsible bidder - Peter J. Landi Inc, for the total unit pricing of $598,100.00 Second lowest responsible bidder — Paladino Concrete Creations Corp., for the total unit pricing of $761,355.00 Third lowest responsible bidder — ELQ Industries, for the total unit pricing of $854,710.00 and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contracts on behalf of the Town. Resolution — Laserfiche Weblink Public Portal On motion of Councilman King, seconded by Councilwoman Fiddelman, the following was approved, WHEREAS, as the world has moved further into the digital age, residents require and expect the efficiency and availability of information that comes from online technologies; and WHEREAS, the Town of Mamaroneck in response has created a Weblink (Public Portal) through Laserfiche, the Town's Electronic Document Management System; and WHEREAS, documents have been scanned into the following public access folders: Annual Reports, Budgets, Cemetery Records, Housing Authority, Land Use, Local Laws, Master Plans, 10 January 19, 2022 Minutes, Meeting Packets, Policies/Procedures/Manuals, Reports/Studies/Surveys, Roadways/Traffic, and Town History, and WHEREAS, the records contained in the public access folders have been analyzed and curated to be made available to the public, and WHEREAS, the IT Director and the Town's Information Security consultant have determined that access by the public through the Laserfiche Public Portal is operationally feasible and can be securely implemented, and WHERAS, the Town's Laserfiche Administrator, will implement and maintain the folder level permissions in the Laserfiche Repository, and the IT Director will implement and maintain the appropriate security controls as defined by the Town's Cyber Security Policy. NOW THEREFORE BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the access of the Laserfiche Weblink (Public Portal) to the public, and the contents of the public access folders to be available and viewed by the public, and BE IT, FURTHER RESOLVED, that the Laserfiche Public Portal will not be available to the public until after February 2, 2022. Authorization — Renewal of Senior and Disability Tax Exemptions On motion of Councilwoman Fiddelman, seconded by Councilman King, the following was approved, Whereas, on December 26, 2021, Governor Kathy Hochul issued Executive Order No. 11, declaring a State disaster emergency for the entire State of New York due to the COVID-19 pandemic, and Whereas, this State disaster emergency has resulted in limited access to the Town Center where the Assessor maintains her office and has rendered many of the Town's senior citizens and individuals with disabilities homebound, making it difficult, if not impossible, for many of these people to file their real property tax exemption applications in person, and Whereas, many within these categories further, lack the ability to file such applications online, and Whereas, in recognition of the above problems caused by the pandemic, Governor Hochul issued Executive Order No. 11.1 on December 26, 2021, extending Executive Order No. 11, and Whereas, this extension, among other things, modifies subdivisions 7, 7-a and 8 of section 459-c of the Real Property Tax Law and subdivisions 5, 5-a, 5-b, 5-c and 6 of section 467 of the Real Property Tax Law, the effect of which permits the Town Board to adopt a resolution that (a) directs the Assessor to grant exemptions on the 2022 assessment roll to all property owners who received such exemptions on the 2021 assessment roll either because they are senior citizens with limited income or individuals with disabilities and limited income without the need for such persons to file renewal applications to request such exemptions, and (b) eliminates the requirement that the Assessor mail renewal applications to such persons, and Whereas, Executive Order 11.1 further allows the Town Board the option to include procedures by which the Assessor may require a renewal application to be filed if she has reason to believe that an owner who qualified for the exemption on the 2021 assessment roll may have since changed his/her primary residence, conveyed the property to him/herself and another person, transferred the property to a new owner or died, and Whereas, the Town Board wishes to exercise the option given to it by Executive Order No. 11.1 12 January 19, 2022 NOW THEREFORE, BE IT RESOLVED, that pursuant to the authority granted by Executive Order No. 11.1, issued by the Governor of the State of New York, the Town Board hereby directs the Assessor to grant exemptions on the 2022 assessment roll to all individuals who received the senior exemption on the 2021 assessment roll and all individuals who received the exemption on the 2021 assessment roll because they were recognized as a person with disabilities and limited income, without requiring any such individuals to file renewal applications for their exemptions, except that the Assessor may, in her sole discretion, require a renewal application to be timely filed if she has reason to believe that an individual, who qualified for the aforementioned exemption on the 2021 assessment roll, may have since changed his/her primary residence, conveyed the property to him/herself and another person, transferred such property to a new owner or died, and BE IT FURTHER RESOLVED, that if the Assessor requires such renewal application be filed, she shall notify the owner of the subject property of such requirement by regular mail, and with such notice shall transmit instructions on how to file the renewal application, and BE IT FURTHER RESOLVED, that such renewal application may be returned by mail or by making an appointment to drop it off at the Town Center, 740 West Boston Post Road, Mamaroneck, NY 10543, either by delivering to the Assessor's office or by leaving it with the receptionist sitting at the desk at the main entrance to the Town Center.
