BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Jaine Elkind Eney Councilwoman Abby Katz Councilwoman Sabrina Fiddelman Councilman Jeffery L. King Councilwoman Robin Nichinsky ALSO PRESENT: Christina Battalia, Town Clerk Meredith S. Robson, Town Administrator Connie Green O'Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney Lindsey Luft Assistant to the Town Administrator CALL TO ORDER - WORK SESSION The Worksession of the Town Board was called to order by Supervisor Elkind Eney, then on motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Worksession was unanimously opened at 5:00 p.m. Review — Organizational Agenda The Town Board reviewed the various resolutions of the organization meeting agenda. The Town Board discussed and then changed the first Town Board meeting in October from October 5t" to Monday, October 3rd Discussion and Consideration of Authorization — Hommocks Concession Stand The Town Board reviewed a red lined version of the License Agreement, which reflected changes based on the discussion at the prior worksession, and comments from the Recreation Department. Under this agreement the Community Room, will fall under the license agreement with the vendor. Users of the Community Room would be allowed to bring desserts such as birthday cakes. The Licensee will not be required to be open for all hockey games, and will work with rink staff on the games that the Concession Stand will be open. The Town Board discussed a request by the Licensee that liability from "a fire or other casualty by an act or neglect of the licensee", will be capped at the Licensee's maximum insurance coverage. The Town Board was inclined to agree but would request that the insurance cap be verified to be two million. Ms. Robson will discuss this with the licensee and she and Mr. Maker will work on applicable new language for the agreement. The Town will also waive one month of rent due to the length it has taken to finalize the agreement. On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the following was approved RESOLVED, that the Mamaroneck Town Board does hereby approve the License Agreement between the Town of Mamaroneck and Strada Food LLC, of Holtsville, New Yor, to operate a concession to serve visitors to the Hommocks Outdoor Pool Complex and the Hommocks Ice Rink, Subject to the confirmation of insurance coverage and amendment to 33 (b) to cap liability of Licensee to the Licensee's insurance cap. The above resolution was put to a roll call vote: Nichinsky Aye King Aye Fiddelman Aye Katz Aye Elkind Eney Aye 1 January 12, 2022 Discussion - Comprehensive Plan Supervisor Elkind Eney stated that a review of the virtual features of the Comprehensive Plan outreach is being reworked. The Town Board needs to focus on the Steering Committee and who those individuals will be. Supervisor Elkind Eney will speak with Joe Libretti of the Mamaroneck High School Civic class as a possible member. The Town Board will send the Supervisor additional names to consider and receive their possible interest. Discussion — Town Clerk Position Mr. Maker was asked to recap the options as detailed by the Town Administrator and Mr. Maker in previous memos, regarding the timing and requirements for changing the elected position to an appointed one, as well as the requirement and timing of a possible special election. The Town Board is also discussing an appointment to fill the vacancy. Updates - Multiple Topics Supervisor Elkind Eney stated that Town staff is continuing to review the draft 5G law as prepared by Mr. Maker. Supervisor Elkind Eney will be reaching out to Fields for Kids regarding feedback as discussed at the December worksession. Supervisor Elkind Eney noted that Mr. Maker has drafted an IMA between the Village of Larchmont and Town of Mamaroneck with respect to sanitation. This will be reviewed along with the documents requested by both Boards at the next joint meeting. The Town Board may change the date of the next joint meeting and will inform the Clerk accordingly. The Police Chief will be coming to the next Town Board with his quarterly update. It is expected that Senator Harckham's Leaf Blower bill will be voted on during the next legislative session. The Town Board will review the Town law after that. The Town's Tree law is under review by Town staff. The Climate Smart Community documents have been sent to the State by Sue Odierna. Councilwoman Katz stated that the Town will need to discuss the agreement with LMC Media on how to move forward with terms of use. Councilwoman Katz reported that the Board of Control interviewed two potential attorneys with respect to negotiating the franchise agreements, but no decision has been made. There is a list of questions being generated to address the Village of Larchmont's decision to no longer be a part of the Board of Control. Supervisor Elkind Eney stated that she received today, from James Staudt, Esq. Attorney for the Sanitation Commission and the Village of Larchmont , the title report for the Sanitation Commission property, she will be reviewing that with Mr. Maker as soon as possible. With the reassignment of liaison positions, Councilwoman Katz wanted to bring to the Town Board's attention that there are a number of Zoning Board applications that have received variances for illuminated signs, and the Town Board may want to review the sign law. Meister Town Justice — Sworn in by Town Justice, Jean Marie Brescia SUPERVISOR'S REPORT 1 am Jaine Elkind Eney and now I'm the new Supervisor of the Town. After being on the Town Board for 10 years, I'm delighted and excited to be serving you as Town Supervisor. 1 am honored by your support. We have a lot to be proud of in the Town of Mamaroneck. Natural Beauty, Long Island Sound, the diversity of our residents, a wonderful school system, an active business community, recreational facilities (like the Hammocks Park Ice Rink) and our proximity to New York City. One of the things that makes the Town of Mamaroneck so special is its longstanding tradition of good government. We run a transparent, responsive, progressive, inclusive, and civil government. 1 plan to continue that tradition, working with our dedicated, professional, and caring staff under the leadership of our new Town Administrator, Meredith Robson. She has gotten off to a great start ... a hurricane, a tropical storm and the explosion of COVID. 1 have full confidence in her given the way she's handled all that' has already been thrown at her. 1 am proud to be working with my colleagues on the Town Board —Abby Katz, Sabrina Fiddelman, Jeff King and the newest member of the team, Robin Nichinsky. They are committed to the Town and our residents. They work tirelessly and diligently, looking to the future, willing to ask the tough questions and make the hard decisions when necessary. 1 am also looking forward to working with our sister villages, the Village of Mamaroneck and the Village of Larchmont, because 1 believe we are truly better together. Our communities share many things and we will continue to look at ways we can streamline and consolidate services to improve government and save money for the taxpayers. We are also fortunate to have wonderful municipal partners with whom we work on regional issues like flooding and sewer repairs. I look forward to working with County Executive George Latimer and well as Legislator Catherine Parker. 1 also want to thank our State Representatives Steve Otis and Shelley Mayer for all of their help. All have been incredibly responsive when the Town seeks assistance on any number of issues. Always near to my heart, 1 want to thank our emergency service workers --police fire and ambulance --for their incredible bravery and commitment to protecting us every day. They leave their families to protect ours. We owe them all a debt of gratitude. 1 thank them from the bottom of my heart. The Town of Mamaroneck is blessed with many community -minded residents who volunteer their time and energy to serve on our many boards and commissions. We are grateful for the talent, skill and caring that they bring to the Town. We have openings on some of our boards and commissions now. If you are interested in volunteering, please contact me. Now 1 want to look ahead to some of the challenges we face: COVID seems to be overshadowing everything. It is a constantly evolving situation that affects our budget, the services that are expected by our residents and the manner in which those services are delivered. COMPREHENSIVE PLAN. We are about to embark on a year -long comprehensive plan update. The Comprehensive Plan sets forth a blueprint and vision for the future of our community and a road map for future actions by the Town Board. The starting point will be input from the residents... what do you want for our community. Be on the lookout for opportunities to participate in the coming months. Community outreach is critical to the success of the plan and is critical in helping the Town Board set priorities. 3 January 12, 2022 ZONING. One concern we hear from residents with increasing frequency relates to the number of tear downs and larger homes that replace them. As part of the Comprehensive plan process the Town will look at our zoning and planning process to see what changes can be made to address this situation AFFORDABLE HOUSING. The availability of a wide variety of housing options is an essential element of maintaining a diverse community, affordable housing being an integral part of that. The Town Board encourages, and is always looking for opportunities for more affordable housing in our community. ENVIRONMENT. The Town has been and continues to be at the forefront of the environmental arena. The goal is to reduce our energy use and carbon footprint. Not only is this good for the environment, but it saves us money. The Town was the 9th community in NYS to become a Climate Smart Community; just this week we submitted the paperwork for recertification. We have an active sustainability committee which recommends environmental projects to the Town Board. Some of the upcoming projects are: starting to prepare a Climate Emergency Action Plan, and a Tree Canopy Enhancement Plan. WE NEED TO BE ABLE TO REACH YOU. Ours is an open and transparent government. We want you to be informed about the goings on within the Town Government and how it impacts you. We have seen time and again, most recently through the pandemic and flooding, that Mamaroneck is a caring, involved and compassionate community. We all work together to enhance the community life that is important to each of us. And the Town Government plays a key role in protecting and enhancing the values and quality of life we all hold dear. We look forward to working together with the entire community to continue to move the Town of Mamaroneck forward. APPOINTMENT OF CIVIL OFFICERS On motion of Councilwoman Nichinsky, seconded by Councilwoman Katz, it was unanimously RESOLVED, that Jay Reynolds is hereby reappointed as Civil Officer of the Town of Mamaroneck to serve a term of office of one-year, effective January 1, 2022 and terminating on December 31, 2022, and BE IT FURTHER RESOLVED, that Frank Cioffi is hereby reappointed as Civil Officer of the Town of Mamaroneck to serve a term of office of one-year, effective January 1, 2022 and terminating on December 31, 2022, and BE IT FURTHER, RESOLVED, that the foregoing appointments shall be effective immediately upon the appointees taking and subscribing the oath mandated by section 25 of the New York Town Law. DESIGNATION OF TOWN BOARD MEETINGS On motion of Councilman King, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that the 2022 regular meetings of the Town Board be held at 740 W. Boston Post Road, Mamaroneck beginning at 5:00 PM on the following dates: January 12 and January 19 February 2 and February 16 March 2 and March 16 April 6 and April 20 May 4 and May 18 June 1 and June 15 July TBD August TBD September 7 and September 21 October 3 (Monday) and October 19 November 2 and November 16 December 7 and December 21 and 5 January 12, 2022 BE IT FURTHER RESOLVED, that said meetings, dates and places may be changed at the pleasure of the Board upon notice being given. DESIGNATION OF OFFICIAL NEWSPAPERS On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that The Journal News is hereby designated as the official newspaper of the Town of Mamaroneck for the purpose of publishing legal notices during 2022. DESIGNATION OF DEPOSITORIES OF FUNDS: On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was RESOLVED, that the following banks and trust companies are hereby designated as depositories for funds of the Town of Mamaroneck for the year 2022 to be: NYCLASS Investment Pool The Bank of New York Mellon JP Morgan Chase Bank, Mamaroneck Wilmington Trust Sterling Bank, Mamaroneck Webster Bank The above resolution was put to a roll call vote: Nichinsky Aye King Aye Fiddelman Aye Katz Aye Elkind Eney Aye DESIGNATION OF BANK SIGNATURES On motion of Councilwoman Nichinsky, seconded by Councilwoman Katz, it was RESOLVED, that all authority heretofore granted to withdraw funds, draw checks, transfer funds and other orders upon the Town of Mamaroneck accounts maintained at the aforesaid banks hereby is rescinded and revoked and hereafter such withdrawals, checks, transfers and other orders shall be authorized electronically. External transfers and checks require dual authorization either by signature or electronic approvals. Checks require signatures by the Town Supervisor and the Comptroller; external electronic transfers require electronic approval by the Town Supervisor or the Comptroller and Payroll Supervisor or Deputy Receiver of Taxes. BE IT FURTHER RESOLVED, that all withdrawals, checks, transfers and other orders relative to the Town of Mamaroneck PHA accounts at JP Morgan Chase and the Town of Mamaroneck PHA account at Sterling Bank, shall be authorized by the signatures of Anna Danoy, Director of Community Services and Public Housing, Tracy Yogman Town Comptroller, Jaine Elkind Eney Town Supervisor.
