HomeMy WebLinkAbout2021_02_24 Zoning Board of Appeals Minutes THE MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK HELD REMOTELY Via ZOOM ON FEBRUARY 24, 2021 Present via ZOOM: Arthur Wexler, Chairman, Stephen Marsh, Jonathan Sacks, Irene O'Neill, Robin Nichinsky, Carol Miller (Alternate) Absent: Seth Bronheim (Alternate) Also present via Zoom: Richard Polcari, Building Inspector, Lisa Hochman, Counsel to the Zoning Board of Appeals, Francine M. Brill, Zoning Board of Appeals Secretary, Abby Katz, Town Board Liaison CALL TO ORDER The meeting was called to order at 7:19 P.M. Ms. Hochman stated that tonight's meeting has been convened in accordance with the Governor's Executive Order 202.1, as extended, which suspends certain provisions of the Open Meetings Law to allow municipal boards to convene meetings via videoconferencing. She asked the Zoning Board Secretary to confirm that tonight's meeting had been duly noticed. Ms. Brill so confirmed. Ms. Hochman further stated that members of the public received notice on how to view and participate in tonight's public hearings in accordance with the Governor's Executive Order 202.15, as extended, she stated that this meeting is being broadcast live on LMC-TV (channel 35 on FIOS; channel 76 on Optimum) and online at LMCTV.org., and that a transcript will be provided at a later date. Ms. Brill called the roll and the Chair announced that there was a quorum present (via ZOOM). MINUTES Motion: To approve the minutes of January 27, 2021 with technical corrections. Moved by Jonathan Sacks, seconded by Irene O'Neill Action: Unanimously approved Vote: Arthur Wexler, Irene O'Neill, Stephen Marsh, Jonathan Sacks, Robin Nichinsky, Carol Miller (alternate) Application # 1 - Case No. 3204—Barbara and Michael Richter—88 Briarcliff Road— Public Hearing Motion: To open the public hearing Moved by Arthur Wexler, seconded by Jonathan Sacks Action: Unanimously Approved Brian Paddock, Architect, and Brian Richter owner were present via ZOOM. Mr. Paddock explained the second story addition for a master suite and renovation of the existing space for a home office. This is a nonconforming house and the addition is not expanding the footprint only going straight up. Mr. Paddock shared his screen and explained the interior changes and elevations. The roof will go above the existing roof line. The Board discussed the proposal. Mr. Polcari made an announcement inviting members of the public to comment. He further stated that there were no additional emails received or virtual hands raised concerning this matter. Motion: To close the public hearing Moved by Arthur Wexler, seconded by Irene O'Neill Action: Unanimously approved Motion: To approve the requested variance Moved by Jonathan Sacks, seconded by Stephen Marsh Action: Unanimously approved Application # 2- Case No. 3206—Jonas Littman— 1011 Old White Plains Road—Public Hearing Motion: To open the public hearing Moved by Arthur Wexler, seconded by Irene O'Neill Action: Unanimously Approved Jonas Littman and Rebecca Blake the owners were present via ZOOM. Mr. Littman explained the chosen location is the most cost effective place to install, and less visible. Neighbors from 1009 and 1007 have written in support of the placement. Mr. Roloff of 1015 Old White Plains Road requested a barrier fence or evergreens be planted to shield his view. The Board discussed his request and stated the house is over 200 feet from the proposed location and therefore they would not make it a condition, it would be at the applicant's choice. The distance requested was discussed as the applicant is requesting 16 feet but it is not necessarily corrected therefore an as-built survey would be required. Mr. Polcari stated it would be beneficial to ask the surveyor to plot the location before it is installed to make sure the 16 feet is met. Mr. Polcari made an announcement inviting members of the public to comment. He further stated that there were no additional emails received or virtual hands raised concerning this matter. Motion: To close the public hearing Moved by Arthur Wexler, seconded by Irene O'Neill Action: Unanimously approved Motion: To approve the requested variance Moved by Jonathan Sacks, seconded by Robin Nichinsky Action: Unanimously approved Application # 2- Case No. 3177—Stephanie and Edward McFadden — 15 Mardon Road — Public Hearing Motion: To open the public hearing Moved by Arthur Wexler, seconded by Irene O'Neill Action: Unanimously Approved Paige Lewis, Architect, and the McFadden's were present via ZOOM. Ms. Lewis explained the variance request for a deck on the side yard (rear of the House) on this lot with two front yards. Ms. Lewis shared her screen showing elevations and the interior floor plan, explaining why the deck as proposed is proud of the house. Mr. Wexler stated that a 36 foot deck is huge, Mr. Sacks asked if the deck could be made smaller by being brought back in line with the house therefore requesting less of a variance. Ms. Lewis showed the line as requested and the owners agreed, bring the request from 23.1 to 26.4. Mr. Polcari made an announcement inviting members of the public to comment. He further stated that there were no additional emails received or virtual hands raised concerning this matter.
