MINUTES OF A SPECIAL MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK HELD NOVEMBER 15, 1983, IN THE AUDITORIUM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF MAMARONECK,LARCHMONT, NEW YORK CALL TO ORDER The meeting was called to order by the Chairman at 8:15 P.M. ROLL CALL Present: Mr. A. William Boraczek, Chairman Mr. Egbert R. Hardesty Mr. Stephen K. Carr Mr. Peter D. Mosher Mr. J. Rene Simon Also present: Mr. William Paonessa, Building Inspector There was a Court Stenographer present and his transcript will be part of the record. PUBLIC HEARING The Chairman declared the hearing open and the Secretary presented for the record the affidavit of publication of (:: the notice of hearing. Mr. Boraczek read the Public Notice. APPLICATION NO. 1 - CASE 595 AND 649 PLEASE TAKE NOTICE that the Board will review the variance granted for Case No. 595 application of LMR Associates to determire whether all conditions have been satisfied. This was adjourned from the meeting of October 26, 1983. Mr. Edmund S. Purves of 12 Center Avenue, Larchmont, rep- resented the applicants LMR Associates and stated that since the adjournment of the October meeting they had met with representatives of the Pine Brook District Property Owners Association and several others and they think they have come up with a plan that will be acceptable. The revised plan would be modified showing two stories in- stead of the three stories originally proposed and would be approximately 26 ft. high. The rentable area would be cut down from 45,000 sq. to 41,000 sq. ft. and a variance would be required for 205 cars. Mr. Purves said they had also agreed to change the ingress and egress and agreed to share the cost of a traffic light. Mr. Purves further said it would be necessary to submit new plans and file a new application. Mr. Boraczek asked if the applicant was withdrawing his original application and Mr. Purves said he would like to have some communication with those present as to their thoughts. Mr. Purves further said that he had spoken to Mr. Kalos, the Chairman of the Planning Board as to whether or not they could meet with the Planning Board at their December meeting to discuss the question of the EIS. Mr. Mosher and Mr. Carr both questioned as to whether or not Mr. Purves wanted to withdraw his previous application and Mr. Mosher questioned as to if the application was with- drawn at this point whether they could hear the case as it might prejudice any future application. Mr. Purves said he felt that in the interest of the Community he thought it would be helpful to hear comments and it was decided the application would be heard at this time. Mr. Boraczek pointed out that if the original application was in front of the Board and if the Board voted and turned the application down the applicant could not come before the Board for six months unless a new application was sub- mitted with a drastic change. Mr. Boraczek suggested that the first ones to speak should be representatives of the various groups. Mr. Engel of 6 Rockwood Drive, Larchmont, represented the Pine Brook group and said that they had a meeting on Saturday and about nine residents of the Town of Mamaroneck were COpresent. The Chairman questioned Mr. Kalos, the Chairman of the Planning Board, who was present, as to whether he had any comments and Mr. Kalos said no. Mr. Kalos said the Planning Board had accepted the Environmental Impact Study and Mr. Mosher ques- tioned as to the recommendations that the Planning Board had sent to the Zoning Board. Mr. Kalos pointed out that he had voted against the acceptance and on a vote of 3 to 2 the Board had voted to accept the Final Environmental Impact Statement. Mr. Kalos, also, pointed out that if the appli- cation is withdrawn and a new application submitted the Planning Board will have to decide whether the Statement that they had accepted is still acceptable. Mr. Martin Zavell, who is on the Town of Mamaroneck Traf- fic Committee was present at the meeting and said that at their meeting on October 17, 1983, Mrs. Battelle and Mr. Sussen had mentioned the application but they had never been asked by the Planning Board or the Zoning Board to discuss the application with them. Mrs. Joan Williams of the Village of Larchmont Planning Commission said that both the Village Planning Commission and Traffic Commission were opposed to a three story build- © ing. Mr. Mosher asked Mrs. Williams if her Planning Com- mission had approved the plans for the five story bank and she answered no. Mr. Mosher, also, asked Mrs. Williams about the mini mall next to Shopwell and if the Village had a traffic study at that time. Mrs. Williams said they Ar had a County traffic study before them and their position is that a three story building would add more traffic than necessary. Mr. Engel pointed out that the traffic study for the appli- cants was made by experts hired by the developer and was made during a vacation period. It was pointed ott that the Town of Mamaroneck has more stringent parking restrictions than the Village. A representative of the Chatsworth Avenue PTA spoke in op- position to the three story building and said they were concerned for the school children. Mr. Charles Eckenwalder of 39 Coolidge Street questioned about the parking and Mr. Otto Rosenberger said he was op- posed to the building and also questioned about the parking. Mr. Finkelstein of Shadow Lane said he was concerned about cars that would come through their street. Mr. Marshall Kaplan of 99 Madison Avenue spoke in opposi- tion and said a variance is granted on hardship and in his opinion there is no hardship. Mr. Kaplan, also, said that traffic studies are made at unappropriate times. © Mr. Everett Bovard of 21 Woods Way said he supported what Mr. Engel said. Mr. Guy Scutaro of 2 Lundy Lane and Mrs. Doris Sandstrom of 92 Carleon Avenue spoke in opposition. Mr. H. Smith of 37 Iselin Terrace said he agreed with his neighbors in reference to the dangers in terms of traffic. Mr. G. Schiff of 11 Coolidge Street said he agreed with most of his neighbors on traffic but very little had been said about air and noise pollution. Mr. Robert Fisher of 60 Harrison Drive said he opposed the whole proposal because of the impact it will have on the Town of Mamaroneck especially the Police Department and supported everything that had been said. Mr. Francis Fanning of 1 Robins Nest Lane said he was op- posed and Mrs. Horowitz of 37 Harrison Drive said she was concerned about the traffic problem and the impact on Harri- son Drive. Mr. David Creedon of 24 Pine Brook Drive said he was con- cerned about a possible increase in robberies because of added traffic. Mr. Anderson of 4 Bayard Street and residents of 20 Coolidge Street and 5 Beach Avenue spoke in reference to the appli- cation. Mrs. Pat McNamara of 2 Robins Nest Lane spoke in opposition © and Mrs. Barbara Barish of 7 Robins Nest Lane also spoke. Mr. Purvis requested that the application be withdrawn.
