We are committed to excellence, professionalism, courtesy and devotion to duty. OPERATING ENVIRONMENT/WORKLOAD INDICATORS The Town Board serves as the Board of Fire Commissioners,and governs the five square miles of the Town of Mamaroneck Fire District. The Alternative Veterans exemption offersa limited exemption from real property taxesfor Town, County and Schoolfor qualified owners who have rendered military service to the United States during defined periods of war. The Town lawcurrently allows for a qualifying wartime Veteran’s property to receive an exemptionequal to 15% of its assessed value, witha cap at$54,000. Veterans who served in a combat theateror combat zone receive an additional 10%, with a cap at $90,000. Additionally, those veterans who received a service- connected disability compensation rating receive half (½) of their service-connected disability rating as a percentage off their assessment, with a cap at$180,000. The newly adopted County level maximums are $75,000(wartime), $125,000(combat) and $250,000(disability). TheTownof Mamaroneck has 355Veteransthat benefit from theseexemptions; 63in the Village of Larchmont, 139 in the Village of Mamaroneck and 153in the Unincorporated Town. The approximate impactto ourtaxpayersby adopting these new levels would increasethe tax of an average residential property in theUnincorporated Town by $3.78per year and.52¢per year fora property located in one of the Villages, for a total town-wide impact of $15,200. The most recent changesto these specified levels were in 1996 and 2006. Historically,the Town has always mirrored the County’sadopted Alternative Veteran exemptionlevels.This proposed increase would appear on the Town’s 2022 assessment roll and impact taxesextended in 2023. (B&L) is pleased to provide this letter proposal to progress the New Jefferson Street at North Chatsworth Avenue Pedestrian Improvement project from the feasibility stage to the construction document development stage. In response to the verbal Town Board comments received at the September 1, 2021 meeting, we have confirmed the preferred alternative and finalized the feasibility study. Included with this proposal letter is our scope and fee to develop the preferred alternative to construction level documents. A.Scope Three concept alternatives were developed, with Alternative B-1 selected as preferred and recommended for implementation. Alternative B-1 consists of additional pavement striping to define positioning of legal parking spaces, and installation of additional signage and pavement striping to increase pedestrian visibility and increase motorists awareness of the crossing point. Improvements at this intersection will be completed entirely within the Town’s right-of-way, is consistent with the NYSDOT Pedestrian Safety Action Plan (PSAP), and results in a net loss of one (1) parking space. Luft, Assistant to the Town Administrator DATE: October 29, 2021 SUBJECT: Website Redesign – Mood Board and Template Based on the information and pictures submitted for the website redesign, the consultants have provided us with two items: a mood board and a template. Prior to moving forward, your feedback is requested. These two documents serve as the “bones” of the new website. The mood board provides a sample of the artistic foundation. If approved, these would be the colors used throughout the website. The pictures provide an idea of how the colors would tie in to the overall feel of the Town. While these pictures are being considered for the homepage, we have the ability to change them at any time, including after implementation. The template is the bare structure of the website and is meant to be very high level. It shows the general placement for items on the homepage. There are two versions provided. In connection with its consideration of those applications, the Planning Board - -in consultation with and relying upon the professional staff of the Town - - has made findings that placement of swimming pools that utilize toxic chemicals to sanitize pool water in close proximity to wetlands and watercourses holds the potential for creating unique and serious hazards to environmentally-fragile habitats that are required to be protected under Chapter 114 of the Town Code entitled “Wetlands and Watercourses.” A number of express conditions were drafted initially to address these particular hazards to wetlands and watercourses. Most of the conditions center upon requirements that would be imposed upon applicants to maintain their pool properly and to discharge wastewater in a manner that would not harm the surrounding environment. In reviewing the proposed conditions, however, the Planning Board realized that the proposed conditions have more general applicability, i.e., they should apply to all swimming pool applications that come before the Planning Board. Accordingly, on recent applications, the Planning Board has imposed conditions on its approval of swimming pools,whether or not they are located near a wetland or watercourse. Applicants have accepted these additional conditions and they have been made part of the approval resolutions. It is recognized that applications for swimming pools that come before the Planning Board represent only a small subset of the pool applications processed by the Buildings Department pursuant to § 192 of the Town Code. In connection with the Planning Board’s review of § 192 of the Town Code, we have worked closely with Richard Polcari, the Town’s Building Inspector, Robert Wasp, the Town’s Engineer, Elizabeth Aitchison, the Town’s Environmental Planner, Anthony Oliveri, the Town’s Consulting Engineer, and Lisa Hochman, Counsel to the Planning Board. The purpose of the review was to seek a more comprehensive regulation of swimming pools within the Town, without regard to whether the pool application comes before the Planning Board or not. The Planning Board identified a limited number of changesthat, if adopted (1) would address issues that are not expressly covered by existing regulations, (2) are specifically aimed at protecting the environment of the Town, (3) are reasonable and would not place an undue burden onan applicant seeking a pool construction permit, and(4) represent best practices that would benefit residents of the Town generally. Accordingly, the Planning Board recommends consideration and adoption by the Town Board of the following amendments (Items labeled 1-3) to the Town Code of the Town of Mamaroneck: - - - - - - Current Title: 192-5. Design and Construction Standards Proposed amendment: 1. The title of § 192-5 shall be amended to read: “Design, construction, maintenance and wastewater-discharge standards;” Current Subsection H: H. Disposition of wastewater. All wastewater shall be discharged into a public storm drain or sanitary sewer. Where wastewater cannot be disposed of because of the lack of the above-mentioned facilities, it shall be disposed of by means of dry well or series of wells, provided that such wastewater will not overflow in any instance onto abutting property or flood the existing leaching fields of a septic tank system. \[Amended 7-17-1996 by L.L. No. 14-1996\] Proposed Amendment: 2. Subsection H of §192-5 shall be amended in its entirety to read: “Disposition of wastewater. All wastewater from a swimming pool shall be discharged in a manner to protect the environment (including, without limitation, the protection of any adjacent wetlands or watercourses) from harmful chemicals and other forms of contamination. In the design of swimming pools, first preference shall be given to the discharge of wastewater into a sanitary sewer. If a sanitary sewer is not available, wastewater shall be discharged into a public storm drain. If neither a sanitary sewer nor public storm drain is available, wastewater shall be discharged into a dry well or series of dry wells of sufficient capacity. Finally, if none of the foregoing options are available or feasible, with the prior approval of the Town Engineer, discharge is permitted onto the pool owner’s property immediately adjacent to the pool, provided (a) such discharge point is not within 250 feet of a wetland or watercourse and (b) such discharge is not under site conditions or other circumstances that would require, if it were a public pool, issuance of a State Pollutant Discharge Elimination System (SPDES) permit. On-site discharge of wastewater shall be undertaken at a rate and in a manner to reduce soil erosion, including, as appropriate, through use of an energy dissipation device designed for such purpose. In lieu of on-site discharge, wastewater may be discharged into an appropriate tank vessel for handling, transport and disposal off-site by a licensed waste hauler. Without regard to the method of discharge and removal, in no instance may wastewater be permitted to flow onto a wetland or watercourse, onto existing leaching fields of a septic tank system, into a street (either directly or indirectly) or onto any other property. Pool water to be discharged (other than into a tanker vessel) shall be tested prior to discharge and have a pH level between 6.0 and 9.0 prior to discharge. If chlorine is used for sterilization, the chlorine level of the water to be discharged shall be tested prior to discharge and be less than or equal to 0.1 ppm (parts per million) and not cause foaming, discoloration or other degradation of the receiving waters.” Current Subsection I: I.Filtering, sterilizing and auxiliary equipment. Filtering, sterilizing and auxiliary equipment shall be adequate to maintain the sanitary quality of pool water during each period the pool is in use. Equipment containing gases or disinfectants capable of giving off irritating, toxic or flammable fumes shall be located in ventilated rooms or structures. All rooms or structures shall be well lighted and equipped with safeguards in case of chlorine leaks. All equipment shall be so constructed or housed so that it may be used without causing any noise or disturbance to persons residing adjacent to or near the pool. Proposed amendment: 3. Subsection I of §192-5 shall be amended to read in its entirety: “Filtering, sterilizing and auxiliary equipment; Filtering and sterilizing procedures. Filtering, sterilizing and auxiliary equipment shall be a type of re-circulating, closed filter system approved by the Building Inspector, Town Engineer or other duly- appointed representative of any other state or local regulatory body with jurisdiction, as applicable, and adequate to maintain the sanitary quality of pool water during each period the pool is in use. Chemicals for disinfecting pools and any other pool-related chemicals capable of giving off irritating, toxic or flammable fumes shall be stored in sealed containers. Pool filters shall be cleaned and organic waste removed in a manner that avoids any contamination of the property immediately adjacent to the swimming pool or of any abutting property, including, if applicable, any wetland or watercourse. For the purposes of this section and for no other purpose, the following terms are defined as follows: AREA The square footage of the horizontal plane on which an air-conditioning system or its pad is situated. CENTRAL AIR-CONDITIONING SYSTEM Asystemthatconsistsofoneormoreheatexchanges,blowers,filters,supply,exhaustand return-air systems and any apparatus installed in connection therewith. EXISTING CENTRAL AIR-CONDITIONING SYSTEM Any air-conditioning system that existed on September 1, 2001. PAD Any artificial surface on which an air-conditioning system is situated. REPLACEMENT SYSTEM Any central air-conditioning system that replaces either: (1) An existing air-conditioning system, or (2)Acentralair-conditioningsystemthatwassituatedatthesamelocationasanexisting central air-conditioning system B.Anexistingcentralair-conditioningsystemshallnotberequiredtomeetthecurrent zoningrequirementsunlesssuchsystemismovedfromwhereitwaslocatedonSeptember1, 2001.
