BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Meredith S. Robson, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION The Worksession of the Town Board was called to order by Supervisor Seligson at 5:00 p.m. Additionally Present: Tracy Yogman Town Comptroller and Lindsey Luft Assistant to the Town Administrator On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened at 5:00 p.m. EXECUTIVE SESSION On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to enter into an Executive Session to discuss litigation regarding Westchester Joint Water Works, the employment history of a particular corporation, and an easement agreement. On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the Board unanimously agreed to resume the Worksession. Update – Madison Avenue Green Infrastructure Project and Intersection Studies Presenters: Tom Baird and Peter Christiano of Barton & Loguidice and Rob Wasp Town Engineer The Town Board reviewed with the consultant the Draft Feasibility Study for Myrtle Boulevard and North Chatsworth Intersection Study & New Jefferson Street at North Chatsworth Avenue Pedestrian Improvements, dated August 2021, via a PowerPoint. Next steps will be the final design plans, fine tuning the timing of the signal, and then put out to bid. Discussion – Restricting Overnight Parking on Garit Lane The Town Board was asked by residents of Garit Lane to readdress the overnight parking on Garit Lane. Ten residents (a majority) presented a petition in support of the no overnight parking to the Traffic Committee. The Town Board reviewed once again, the draft legislation, and would like to set a public hearing. This was added to the regular agenda for this evening. Discussion – Request for a Stop Sign at Rocky Road and Lakeside Drive The Traffic Committee was approached by a resident on behalf of the Larchmont Garden Civic Association, about a safety issue at the intersection of Rocky Road and Lakeside Drive. The Town reviewed draft legislation, and after discussion decided to defer the matter so that additional information can be obtained. 1 September 1, 2021 Review Community Services Contracts The Town Board reviewed service contracts with Westchester County for Senior Programing. Authorizing these contracts was added to the regular agenda for this evening. Review – Report of Bids TA-21-09 Janitorial Services Contract The Town Board reviewed the janitorial services contract for the Highway Garage, Mamaroneck Village Ambulance, Larchmont Volunteer Ambulance, the Police Department and the addition of the Hommocks Locker Rooms and Foyer. Awarding of this contract is on the regular agenda for this evening. Update – Sanitation Commission and Supervisor Seligson stated that this review tonight is for an update. Supervisor Seligson stated that the Sanitation Commission meets on September 15. The Commission will discuss whether Mr. Altieri will administer the Commission in 2022, and the possible District in 2023. The issue of transfer of assets will need to be addressed in any new configuration of the Commission. There is the question as to a possible hybrid Superintendent role between the Town and Village for 2021/2022. This will be addressed within the Commission as well as during budget discussions. Update - Hampshire Country Club Councilwoman Elkind Eney reported that the Recreation Commission is discussing the possibility of condemning and taking the property by eminent domain. The Recreations Commission feels that the Town is in need of its own improved pool. The Town Board had agreed pre COVID to do a study and cost analysis for optimal use. The Commission would like to move forward with the study. ADDED ITEM Spray Pool at Hommocks Pool As part of the grant process the Town will need to adopt a SEQR finding. This was added to the regular agenda for this evening. Tracy Yogman addressed the financials, stating that the grant funds are $250,000 and the Town portion was estimated at $650,000, making this project close to a million dollars. It was noted that the Dormitory Authority Grants are historically very slow to fund. The project will hopefully be completed in 2022. ADDED ITEMS Review of Investments Tracy Yogman presented the new Investment Policy. It is noted that this is in keeping with more current best practices. The current active policy was adopted in 1994. Update – Road Resurfacing (additional document was distributed) Rob Wasp prepared a memo for review of the various road resurfacing projects, which the Town Board reviewed. Review of Public Marihuana Discussion Supervisor Seligson stated that she has received approximately twenty emails and will forward them to the Town Clerk. She will not be reading them at the meeting this evening. It was again noted that the Town can opt out at this time but cannot opt out later. Conversely, the Town can opt in at any time. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 p.m. 2 September 1, 2021 Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this evening. SUPERVISOR’S REPORT Welcome to September! Since our last TB meeting, we celebrated Alan Casterella upon his retirement from working with the Town Highway Dept. for 38 years. The Highway Dept. transformed the Highway garage into a cool, hip party space. Over 100 people came to thank Alan for his service and joyful dedication to the Town. We were lucky to have been spared damage from Hurricane Henri last week, but are in the midst of remnants from Hurricane Ida this evening. Hopefully, the rainfall will not be excessive. The Town will hold its annual tri-municipal September 11 ceremony on Saturday, September 11 at 5:00 pm in Memorial Park. All are welcome to attend. The Town is beginning the 2022 budget process and the Town Board will being meeting with staff soon. Meredith Robson, our new Town Administrator continues to meet key people and learn about the workings of the Town. We recently met with staff of the Mamaroneck School District to discuss our shared services, the chair and director of the library and Larchmont Mayor Lorraine Walsh. I met with mayors and managers of Rye City, Rye Brook and Port Chester along with staff of WJWW to discuss water rates. We also mentioned the process of building a new filtration plant. This is a massive capital project required by the Federal EPA. WJWW has a special microsite on its website explaining the project. Go to WJWW.org and click on the red banner on the homepage for information. We have begun hearing from residents about marihuana dispensaries and places of consumption in the Town and it is a topic for tonight’s public comments as well. PUBLIC COMMENTS – Marihuana Regulations and Taxation There was no one from the public in attendance. Supervisor Seligson gave background information on the State legislation. It was noted that twenty emails have been received. The Town will need to decide on whether to opt out by December 31, 2021. There will be another opportunity for public comment at the September 22 Town Board meeting. CITIZEN’S COMMENTS Chris Mancino of 128 Valley Stream Road addressed concerns with how the pool was handled during COVID. Not having the opportunity for a family pass was costly to his family. Mr. Mancino is asking that the timed/pay by slot will not continue through the fall. He stated that residents are leaving for other options. Supervisor Seligson stated that the pool situation is complicated, and during COVID the pool lost $500,000 in revenue. Meredith Robson will talk with Recreation and review the fall procedures. BOARD OF FIRE COMMISSIONERS Commissioner Seligson called the Meeting to order, then on motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared open. FIRE CLAIMS On motion of Commissioner Elkind Eney, seconded by Commissioner Katz, it was RESOLVED that this Commission does hereby authorize payment of the following Fire Department Claims as approved by the Fire Chief and audited by the Comptroller’s Office: ATTACHMENT A The above resolution was put to a roll call vote: Commissioner King Aye Commissioner Fiddelman Aye Commissioner Elkind Eney Aye Commissioner Katz Aye Commissioner Seligson Aye There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Set Public Hearing – Installation of Stop Sign at Rocky Road and Lakeside Drive Deferred until further information is obtained. 2. Authorization – Contract TA-21-09 Janitorial Services On motion Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was approved, WHEREAS, on July 23, 2021, the Town publicly opened and read seven (7) bids for Contract TA-21- 09 Janitorial Services. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-21-09 Janitorial Services, to Commercial Building Maintenance Corp (CBM), the lowest responsible bidder meeting all of the Town’s requirements, at a total cost for a three year contract of $94,731.00, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. Appointment – Housing Authority Member On motion of Councilwoman Fiddelman seconded by Councilwoman Elkind Eney, it was 4 September 1, 2021 RESOLVED, that the Mamaroneck Town Board does hereby appoint Meg Deshpande as Member E of the Housing Authority, and BE IT, FURTHER RESOLVED, that the foregoing appointments shall be effective immediately upon the appointees taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 30, 2022. 4. Approval – Easement Ferndale Shopping Center Mr. Maker explained the Easement. On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Quiet Title Easement Agreement and Quick Claim Deed, and BE IT FURTHER, RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute the agreements and documents required by the County Clerk on behalf of the Town. Set Public Hearing – Elimination of Overnight Parking on Garit Lane On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Elimination of Overnight Parking on Garit Lane” Law, for September 22, 2021 at 8:00 p.m., at the Town Center, 740 West Boston Post Road, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. Authorization - Westchester County and New York State Contracts for Senior Programing On motion of Councilman King, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve Title III-C/NSP: Nutrition Services Contract, PY 2021, with the County of Westchester, and 5 September 1, 2021 BE IT FURTHER, RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute the agreement on behalf of the Town. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Wellness in Nutrition Program (WIN) and Nutrition Services Incentive Program (NSIP) Contract, PY 2021-2022, with the County of Westchester, and BE IT FURTHER, RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute the agreement on behalf of the Town. Investment Policy On motion of Councilman King, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the revised and updated Investment Policy as drafted by the Town Comptroller. SEQR Determination - Replacement of Hommocks Toddler Pool with Splashpad and Sprayground On motion by Councilwomen Fiddelman and second by Councilwomen Katz the following resolution was approved; WHEREAS, it has been determined that the Toddler Pool at the Hommocks Pool complex is in need of replacement and, WHEREAS, the Toddler Pool will be replaced with a Splashpad and Sprayground. NOW THEREFORE, BE IT 6 September 1, 2021 RESOLVED, that the Mamaroneck Town Board does hereby declare the project to be a Type II Action with no impact under the New York State Environmental Quality Review Act (SEQR) and requiring no further action, and BE IT FUTHER, RESOLVED, that the Mamaroneck Town Board does hereby declare itself the Lead Agency for coordinated SEQR Review of the project The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye APPROVAL OF MINUTES On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of August 17, 2021. REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting.
