Beginning with project initiation, the five- phase process will take place over the next six-to-eight months. The attached project phases breakout sheet provides a brief overview of each phase. I would like to take this time to discuss certain aspects with all of you. Prior to the meeting, please review the color scheme of the website and what items you consider crucial to be displayed on the homepage. As you can see in the attached in-place redesign sheet, we will be able to change the color palette, overall layout/structure, as well as use different types of widgets. Wasp, P.E., C.D.T. rwasp@townofmamaroneckNY.org Town Engineer INTERDEPARTMENT MEMORANDUM DATE: September 16, 2021 TO: Nancy Seligson, Town Supervisor Town Board Members CC:Meredith, Town Administrator FROM: Robert Wasp, P.E., Town Engineer SUBJECT: Recommendation of Contract Award TA-21-13 – Reconstruction of Municipal Sidewalks & Curbing GENERAL: Bid procurement was recently completed for the proposed reconstruction of sidewalks and curbing along Homer Ave. and Dimitri Pl. The project involves replacement of approximately 2,500 linear feet of new sidewalk and concrete curbs on Homer Ave. starting at the Murray Ave. intersection and on Dimitri Pl. at the Dante St. intersection until both roads terminate. Final bid documents were prepared by the Town Engineering Department as part of a five year sidewalk and curbing plan. th On September 15, 2021, seven (7) bids were received for the referenced contract as summarized on the attached bid tabulation table. The apparent low bidder is C.M.C. Contractors, Inc. at a submitted base bid price of $181,550.00. C.M.C. Contractors, Inc. has completed similar projects that entails new sidewalk and curbing in multiple locations. The Engineering Department contacted the references enclosed within the submitted bid and was informed that they come highly recommended, withholding a good standing with one company for more than a decade. Submitted bids were evaluated by the Engineering Department and no errors or omissions that could potentially impact the viability of their bid price have been identified at this time. The Engineering Department recommends authorization of contract award to C.M.C. Contractors, Inc. based upon their submitted base bid amount of $181,550.00. Previously prepared construction cost estimates had budgeted the Town construction scope notably higher than the received bid pricing. Incorporation of a contingency budget in the amount of 18,000.00 for potential unforeseen additional work is also recommended for inclusion. Overall projected costs of $199,550.00 are fully contained within the available balance allocated to the capital project. Please feel free to contact me with any questions. DOCUMENT TO FOLLOW – UPDATE – SANITATION COMMISSION DRAFT RESOLUTION WHEREAS, the Town of Mamaroneck (the "Town") and the Village of Larchmont (the "Village") currently handle the collection and disposal of solid waste and other refuse cooperatively by operation of the Larchmont-Mamaroneck Joint Garbage Disposal Commission (the"Commission"); and WHEREAS,the Commission was established by State Legislation in 1938 for the primary purpose of constructing and operating an incinerator; and WHEREAS, the operation of the incinerator was terminated many years ago; and WHEREAS, in or about June of 1973 the respective governing bodies of the Town and the Village passed resolutions (the "1973 Resolutions") adopting a plan for the Commission to perform the collection and other functions which had previously been performed by their own separate Sanitation Departments; and WHEREAS, the function performed by the Commission has evolved over time into primarily a collection and off-site disposal operation; and WHEREAS,the annual Commission budget is funded primarily with funds provided to the Commission by each of the two municipalities; and WHEREAS, the governing bodies of the Town and the Village are in active discussions regarding an updated permanent arrangement for conducting and funding the functions now being performed by the Commission; and WHEREAS, these discussions and/or the implementation of their conclusions will not be completed before the Commission's 2022 budget season; and WHEREAS, the Town and the Village, by adoption of this resolution, are providing for their respective financial contributions to fund the Commission's budget for the interim calendar year of 2022. NOW THEREFORE, BE IT RESOLVED as follows: 1. Notwithstanding anything to the contrary in any prior statutes, resolutions or agreements,the Larchmont Mamaroneck Joint Garbage Disposal Commission budget for calendar year 2022 shall be funded forty-one (41%) percent by the Village of Larchmont and fifty-nine (59%)percent by the Town of Mamaroneck. 2. The Town and Village Boards will continue to work on a mutually agreeable updated arrangement for handling solid waste and other refuse with a goal of commencing an updated arrangement on January 1, 2023. 1 3. The interim funding contribution agreement described in paragraph"1"above shall remain in effect for the entirety of calendar year 2022. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: September 18, 2021 Resident Feedback Requested on Come to the Wednesday, September 1 or Wednesday, September 22 Town Board meeting to express your opinion on the decision of whether the Town of Mamaroneck should opt out or not from the sale and on-site consumption of cannabis in regard to the recent New York State cannabis legislation, Marihuana Regulation and Taxation Act (MRTA). Background: On March 31, 2021 Governor Cuohuana Regulation and taxed cannabis industry in New York. While sale of adult-use cannabis is not expected until late 2022 or early 2023, the following provisions took effect immediately. Any individual 21 or older may: (a) possess, display, purchase, obtain, or transport up to 3 ounces of cannabis and up to 24 grams of concentrated cannabis; (b) transfer, without compensation, to another person 21 or older, up to 3 ounces of cannabis and up to 24 grams of concentrated cannabis; (c) use, smoke, ingest, or consume cannabis or concentrated cannabis unless otherwise prohibited by state law; (d) possess, use, display, purchase, obtain, manufacture, transport or give to any person 21 or older cannabis paraphernalia or concentrated cannabis paraphernalia; Under the MRTA What Can Local Municipalities Control? Local municipalities have been granted little control under the MRTA. Essentially municipalities have two options: Ban retail dispensaries and on-site consumption establishments within their jurisdictions by opting out of the MRTA Set parameters in which these types of business could function within their boundaries. If such establishments are allowed within a municipality, a municipality may pass regulations governing the time, place and manner of the operation, as long they do unreasonably impracticable. Municipalities will receive 75% of the local excise tax related to the sale of cannabis in the municipality. What Does it Mean f- Local municipalities have the right to opt-out of the MRTA, which means that retail dispensaries and on-site consumption establishments may not be established within their boundaries. In order to opt-out, a municipality must pass a local law to that effect prior to December 31, 2021. If a municipality opt-outs of the MRTA, it still has the ability to opt back in at a later date. If a municipality does not opt out before the December 31, 2021 deadline, then the municipality does not have the ability to opt-out in the future and is required to allow licensed retail dispensaries and on-site consumption establishments indefinitely. What Restrictions does the MRTA Impose and What are the Benefits to Municipalities? The MRTA calls for the creation of a Cannabis Control Board and Office of Cannabis Management that would function in a similar manner to the New York State Liquor Authority. These agencies would set the rules for operation and permitting requirements for cannabis related establishments. These two agencies do not have members appointed yet. It will take time before they will be able to promulgate rules or regulations. As a result, it is expected that cannabis related establishments will not be operational until late 2022 or early 2023. A local excise tax will be imposed on the sale of cannabis products by a retail dispensary. The tax will be the retail dispensary is located. The municipality in which the sale takes place will receive 75% of the taxes collected and the County government will receive the remaining 25%. Where is the Town of Mamaroneck in the decision making process? The Town Board has not made a decision yet. Before making the decision, we want to hear from residents of the Town about what they think and feel about the sale of cannabis. Please come to the September Town Board meetings (Wednesday, September 1 or Wednesday, September 22) to share your feedback during the Citizen Comments portion of the Town Board meeting at 8:00 pm in the Town Center Court Room.
