Local Law No. 11 - 2021
This local law shall be known as the “Amendment of the Adoption of the NYStretch Energy Code
2020, supplement to the 2020 Energy Conservation Construction Code of New York State” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
The Town adopted the NYStretch Energy Code 2020 supplement to the 2020 ECCCNYS, published
by the New York State Energy Research and Development Authority, by enacting Local Law No.
10 of 2021. Subsequent to its enactment, the Town learned that section R403.6.2 of the NYStretch
Energy Code is at odds with section M1505.4.1 of the 2020 Residential Code of the State of New
York. The purpose of this amendment is to excise section R403.6.2 from the NYStretch Energy
Code as adopted by the Town of Mamaroneck.
Section 2 – Renactment of a section to the Mamaroneck Code:
Section 106-40.1 of the Code of the Town of Mamaroneck hereby is amended and the following is
substituted in its place:
§106-40.1 Adoption of NYStretch Energy Code 2020.
Except for section R403.6.2 thereof, the NYStretch Energy Code 2020 supplement to the 2020
ECCCNYS, published by the New York State Energy Research and Development Authority, shall
be enforced in full in the unincorporated area of the Town of Mamaroneck. Notwithstanding the
foregoing, the NYStretch Energy Code 2020 supplement shall not apply to persons who either
have or will have obtained building permits or have or will have submitted complete applications
for building permits prior to the effective date of this law.
Section 3 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.
