PRESENT: Supervisor Burton Justices Boyd, Collins and Dudley. Town Clerk Sherman Counsellor Gamble. Upon motion it was VOTED that the minutes of the pre- vious meeting be approved as printed. The report of the Receiver of Taxes for the month of January 1923 was received, read, ordered placed on file and is as follows: TOWN OF MAMARONECK Office of Receiver of Taxes. February 1st, 1923. The report of the Sewer Commission for the month of January 1923 was received and read, showing four (4) permits issued and fees collected amounting to $33.00. They also reported that during the year 1922 there was issued a total number of 162 permits and collected fees amounting to $1202.00. The report was ordered noted in the minutes and placed on file. The report of the Town Clerk for the month iofasafollows: 1923 was received, read, ordered placed on file and is as follows: TOWN CLERK'S OFFICE TOWN OF MAMARONECK N.Y. February Fifth, 1923 Geo. W. Burton Esq., Supervisor, Town of Mamaroneck, Mamaroneck, New York. Dear Sir:- I beg to submit herewith my report for the month of January 1923, showing licenses issued and fees collected as follows: Hunting Licenses issued 89 422.25 Dog Licenses " 15 3.75 Lost tags " 2 .50 Marriage Licenses " 8 8.00 Chattel Mortgages filed 35 4.20 Conditional sales " 8 .80 Total amount received, $39.50 Enclosed find check covering the above amount. Respectfully submitted, (Sgd.) Frederick M. Sherman, Town Clerk. The Supervisor stated that the next order of business would be the opening of bids for the removal and disposition of swill, garbage, ashes, etc. from buildings in Fire, Lighting and 4later Supply District No. 1, and Fire, Lighting and Water Supply District No. 2 of the Town of Mamaroneck. Upon motion duly seconded, it was RESOLVED, that the Board now proceed to open the aforesaid bids. The Clerk reported to the Board that he had received several bids and the Supervisor asked if all the bidders were present. The Clerk informed the Board that all bidders were present. The Supervisor then informed the bidders that subsequent to advertising for bids for the removal and disposition of swill, garbage, ashes, etc. from buildings in Fire, Lighting and Water Supply District No. 1 and 2 of the Town of Mamaroneck, that the Board, at the request of certain of the residents of said dis- tricts asked for an alternative bid from all bidders, said alter- native bid being for the cost of making the said removal 75 feet from the buildings instead of 50 feet as requested in the original bid. The Clerk reported that he had distributed the alterna- tive bids among the bidders and the Supervisor asked all the bidders if they had any objection to making an alternative bid as well as the original bid requested, and was informed by each bidder that he had no objection, and had submitted a bid in the alternative as requested and agreeing to be bound by such bid. The Supervisor stated to the bidders that the Town Board desired also to consider as an alternative a contract this year for a period of sixteen months, to wit, from February 26th 1923 up to and including June 30, 1924, and stated that this would bring the termination of the contract in the summer rather than in the middle of winter when the work was more severe. He thereupon asked all bidders if they would be willing to accept a contract if the Board determined to let it for the period of sixteen months on the basis of the bids, which they had submitted, that is dividing the total price of bid by twelve months and awarding the contract for the period of sixteen months on a per month basis so determined. All bidders stated that they would be willing to enter into such contract with the Town. The Clerk then proceeded to open and read the bids each of which was accompanied by a duly certified check or bid bond, as provided in the advertisement and specifications. Upon motion duly seconded, it was RESOLVED that the Board now go into Executive Session to tabulate the bids and consider the awarding of the contract. The Board then re-convened and the Supervisor stated that the Board had considered all the bids and were now ready to make the award. Upon motion by Justice Dudley seconded by Justice Boyd, it was RESOLVED, that whereas this Board has duly advertised for bids for the removal and disposition of swill, garbage, ashes etc. from Buildings in Fire, Lighting and Water Supply District No. 1 of the Town of Mamaroneck; and WHEREAS, alternative bids for said removal from a distance of seventy-five feet from the street line have also been received; and WHEREAS all bidders have agreed that they would be willing to accept a contract for sixteen months instead of for a period of one gear, as provided in said specifi- cations, at the same proportion per month as provided in the bids; and WHEREAS, the bid of John Milton Cross is the lowest bid submitted for such con- tract, which bid it is deemed best to accept in the interests of the Town of Mamaroneck; now therefore be it RESOLVED, that the bid of John Milton Cross for the removal and disposition of swill, garbage, and ashes from buildings in Fire, Lighting and Water Supply District No. 1 in the Town of Mamaroneck, to make said removal as set forth in the alternative bid from a dis- tance of seventy five feet from the street line, at a price of $250. per month, be accepted upon said John Milton Cross com- plying with all of the terms and condi- tions of said bid, alternative bid, pro- posal and specifications, executing a contract with the Town of Mamaroneck in accordance therewith, and filing the necessary bonds and insurance policies as provided in said advertisement, pro- posal and specifications, all in form satisfactory to counsel; and be it further RESOLVED, that said contract be entered into for a period of sixteen months, from February 27, 1923 to June 30, 1924, and that counsel be authorized and directed to prepare the necessary contracts; and be it further RESOLVED that the Supervisor and the Town Clerk be and they are hereby authorized and directed and empowered to execute the aforesaid contract on behalf of the Town when in form satisfactory to Counsel, and to affix the corporate seal thereto and to do any and all acts and take any and all steps which in their judgment may be deemed necessary to carry the aforesaid resolution into full force and effect; and be it further RESOLVED that the bids of all other bidders be rejected and the Town Clerk be authorized and directed to return the bids and bid bonds to all other bidders on receiving their re- ceipt therefor. Upon motion by Justice Collins, seconded by Justice Dudley, it was RESOLVED, that whereas this Board has duly advertised for bids for the removal and disposition of swill, garbage, ashes, etc. from Buildings in Fire, Lighting and Water Supply District No. 2 of the Town of Mama- roneck; and WHEREAS, alternative bids for said removal from a distance of seventy five feet from the street line have also been received; and WHEREAS, all bidders have agreed that they would be willing to accept a contract for sixteen months instead of for a period of one year, as provided in said specifications, at the same proportion per month as pro- vided in the bids; and WHEREAS, the bid of John Milton Cross is the lowest bid submitted for such contract which bid it is deemed best to accept in the interests of the Town of Mamaroneck; therefore be it RESOLVED, that the bid of John Milton Cross for the removal and disposition of swill, garbage, and ashes from buildings in Fire, Lighting and Water Supply District No. 2 in the Town of Mamaroneck, to make said removal as set forth in the alterna- tive bid, from a distance of seventy five feet from the street line , at a price of $62.50 per month, be accepted upon said John Milton Cross. complying with all of the terms and conditions of said bid, al- ternative bid, proposal and specifications, executing a contract with the Town of Mama- roneck in accordance therewith and filing the necessary bonds and insurance policies, as provided in said advertisement, proposal and specifications, all in form satisfactory to counsel; and be it further RESOLVED, that said contract be entered into for a period of sixteen months from February 27, 1923 to June 30, 1924, and that Counsel be authorized and directed to prepare the necessary contracts; and be it further RESOLVED, that the Supervisor and the Town Clerk be and they hereby are authorized, directed and empowered to execute the aforesaid contract on behalf of the Town, when in form satisfactory to Counsel, and to affix the corporate seal thereto and to do any and all acts and take any and all steps which in their judgment may be deemed necessary to carry the aforesaid resolution into full force and effect; and be it further RESOLVED, that the bids of all other bidders be rejected and the Town Clerk be authorized and directed to return the bids and bid bonds to all other bidders on receiving their receipt therefor. A communication from Paul Kohloff was received and read, tendering his resignation as constable for the Town of Mamaroneck. The communication was ordered, received, placed on file, and the resignation was accepted to take effect at once, and the Clerk was instructed to so notify Mr. Kohloff. The Town Clerk reported that the abstract of Town Accounts had been completed and had been placed on file. The Supervisor was requested to file copy of same with the Clerk of the Board of Supervisors. A communication from Walter W. Westall Esq. was re- ceived and read, relating to the sewer outlet on Palmer Lane abutting the de Wild property in Larchmont Gardens. The matter Engineer, The following resolution was presented by Justice Boyd, seconded by Justice Dudley, WHEREAS, the Town of Mamaroneck is an interested party in a litigation brought against the New York Inter Urban Water Company which litigation is now before the Court of Appeals of the State of New York, now, therefore be it RESOLVED, that the Supervisor be and he hereby is authorized and empowered to engage and employ special counsel upon such terms and at a cost within his discretion, to protect the interests of the Town of Mamaroneck in said litigation in the Court of Appeals. Question being taken upon the foregoing resolution the same was upon ROLL CALL unanimously adopted. The Board of Assessors requested the purchase of a map as compiled by the Sanborn Map Company for use in their office. Upon motion duly seconded, upon ROLL CALL, it was VOTED that the Supervisor be and he hereby is authorized to purchase such map for the Board of Assessors. Mr. L. Harold Bayley appeared before the Board and pre- sented petition and deeds of dedication for streets in Larchmont Gardens. The petition was ordered received, and was referred to Counsellor Gamble for his report. Upon motion it was VOTED to adjourn at 10.50 P.M. Frederick M. Sherman Town Clerk.
