HomeMy WebLinkAbout1922_12_20 Town Board Minutes Meeting of the Town Board TOWN OF MAMARONECK, held, December 20th, 1922. The meeting was called to order by Supervisor Burton at 9.00 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins and Shafer, Town Clerk Sherman, Counsellor Gamble. The minutes of the meetings of November 15th and December 6th, were read and upon motion approved. The report of the Receiver of Taxes for the month of November, 1922, was received, read, ordered placed on file and is as follows: December 2nd, 1922. McGivney, Receiver of Taxes. The Police report for the month of November was received and read showing 49 arrests and fines amounting to $935.00. The report was ordered noted in the minutes and placed on file. The report cf the Building Commission for the month of November was received and read showing permits issued on fees collected amounting to $168.00. Ths report was ordered noted in the minutes and placed on file. The report of the Town Clerk for the month of Nov- ember was received and read showing licenses issued and fees collected amounting to $22.58. The report was ordered noted in the minutes and placed on file. A communication was received from the Board of Appeals stating the action of the said and at their meeting held on December 18, 1922, whereupon the following resolutions were presented and unanimously adopted: WHEREAS, the Board of Apepals of the Zoning Commission hove acted upon and have recommended to the Town Board that the appeal of Vincent L. Stouter to erect a two family residence on the east side of Locust Terrace, Dillon Park, within fifteen feet of the street line be granted and that the decision of the Building Commiss- ion be reversed, therefore be it RESOLVED, that the Town Board pursuant to Article 5, Section 26 of the Zoning Ordin- ance of the Town of Mamaroneck, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. WHEREAS, the Board of Appeals of the Zoning Commission have acted upon and have recommended to the Town Board that the appeal of Arthur R. Stanley for the erect- ion of a one family residence on the south side of Hillcrest Avenue, within thirty feet of the street line be granted and the decision of the Building Commission be re- versed, provided that no part of the pro- posed building shall be nearer the street line than the front wall of the building adjoining on the east and shall otherwise conform to all the requirements of the ordinance, therefore be it RESOLVED, that the Town Board pursuant to Article 5, Section 26 of the Zoning Ord- inance of the Town of Mamaroneck, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. WHEREAS, the Board of Appeals of the Zoning Commission have acted upon and have recommended to the Town Board that the appeal of Herman Bose for the erection of a three car garage on the west side of Weaver Street, partly in a business dist- rict and partly in a residence "A" district be granted, and the decision of the Build- ing Commission be reversed, therefore be it RESOLVED, that the Town Board pursuant to Article 5, Section 26 of the Zoning Ord- inance of the Town of Mamaroneck, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. A communication from the Larchmont and Mamaroneck Board of Real Estate Brokers was received and read offering their co-operation and advise to the Board in matters per- taining to Real Estate. The Communication was ordered re- ceived, noted in the minutes and the Clerk was instructed to reply acknowledging receipt of their offer. A communication from Alexander Meffert was received and read stating that there appears on the County Treasurer's books open taxes for the year 1870 and 1871 against property owned by his mother Mrs. S. T. Chayer. He submits a proposition to the Town Board offering to pay the flat amount of the tax due. The matter was referred to Counsel to report back. A communication from the Board of Assessors was received, read, ordered entered in the minutes, placed on file and is as follows: December 18th, 1922. Hon. Town Board, Mamaroneck, New York. Gentlemen: At a meeting of the Board of Assessors held this say. Mr. William Mulcahy was appointed Clerk to the Board from and after January 1st, 1923, to fill the vacandy caused by the continued absence of John Murray. Respectfully submitted, Town Board of Assessors, Sgnd, Ferdinand Fish. Chairman. A communication from the Village of Larchmont was received and read relating to the payment of taxes on prop- erty purchased from the water Company. the matter was referred to Counsel to report back. The following resolution was offered by Justice Boyd and seconded by Justice Shafer, which upon ROLL CALL was unanimously adopted. WHEREAS, Charles C. King, has made claim for refund of taxes, State, County and Town tax 1921, School taxes 1922, State County and Town taxes amounting $6.28 in toto $9.32, heretofore paid by him on lots 21 and 22, Block 43, Section 2 in the Town of Mamaroneck, paid by him manifestly in error, inasmuch as the tax records show that the owner of the property is Larchmont Gardens Company, WHEREAS, the Board of Assesors have recommended that said refund be made, therefore be it RESOLVED, THAT THE Supervisor be and he hereby is autorized and empowered and directed to refund to Charles C. King $13.71 for State, County and Town taxes 1921 on Lots 21 and 22, Block 43, Section 2 in the Town of Mamaroneck, heretofore paid by him in error, and to take his proper receipt therefor. The following resolution was presented by Justice Shafer seconded by Justice Collins, which upon ROLL CALL was unanim- ously adopted: WHEREAS, Lots 28 and 29 in Block 43 Section 2, of the Town of Mamaroneck have been assessed for sewer taxes in Sewer District #1 of the Town of Mama- roneck and said taxes have been paid, WHEREAS, a claim for refund of said taxes on the grounds that the property is not within Sewer District #1 and therefore not liable to an assessment of tax has been made, and WHEREAS, the Board of Assessors have reported to this Board that the aforesaid property is not in Sewer District #1 and not liable for the assessment they rec- commend the refund be made, and be it RESOLVED, that the Supervisor be and he hereby is authorized and empowered to refund $2.74 heretofore erroneously paid for taxes on Lots 28 and 29, assessed for the Sewer taxes in Sewer District #1 of the Town of Mamaroneck of Lots 28 and 29 Block 43, Section 2 of the said Town of Mamaroneck and to take his proper receipt therefore, and be it further RESOLVED, that the Supervisor, Receiver of Taxes and Board of Assessors be and they hereby are authorized and directed to make the proper corrections on the proper books and records or record as herein provided. The following resolution was submitted by Justice Collins and seconded by Justice Boyd, which upon ROLL CALL, was unaimously adopted: WHEREAS, a request has been received from Michael Doherty asking for reduction of the tax heretofore assessed on Lot 3, Block 19, Section 5, of the Town of Mama- roneck for the year 1921, from $8,000 to $1,000., on the grounds that the assess- ment was erroneously made, and WHEREAS, the matter has been referred to the Board of Assessors, and WHEREAS, the Board of Assessors after investigation have reported to this Board that the previous Assessors found the foundation of a large house and assumed that the house would be erected during the tax year and before the taxes for the year 1921 became a lien, but an examinat- ion by the present Board disclosed that nothing has been added to the foundation during the year and the taxes for 1921 have been revised to $1,000. and WHEREAS, the Board of Assessors found that the conditions do not warrant the assess- ment for $8,000 and recommend that the claim of Mr. Doherty be allowed, therefore be it RESOLVED, that the Supervisor be and he hereby is authorized and empowered to take such action as is necessary in the premises to have the assessment for the year 1921 against Lot 3, Block 19, Section 5, reduced from $8,000 to $1,000. , and be it further RESOLVED, that the Supervisor, Receiver of Taxes and Board of Assessors, be and they hereby are authorized and directed to make the necessary corrections on the proper books and records as herein provided. A communication from the Weaver Street Fire Company was received and read relating to Engineer Mathew Ireland. The communication was ordered received and placed on file. A communication with report attached was received from the State Commission of Prisons, the report covering the lock- up at the Town Hall. The comunication was read, ordered noted in the minutes and placed on file. A communication was received from the Board of Assessors stating that they had re-organized for the year 1923 and that they had appointed Ferdinand Fish, Chairman of said Board and William Mulcahy as Clerk Upon motion duly seconded, it was RESOLVED, that this Board approve the action of the Board of Assessors in re- organizing and the appointment of Ferd- inand Fish as Chairman and William Mul- cahy as Clerk of the Board of Assessors. Counsellor Gamble reports progress in the matter of the new hook and ladder apparatus. A communication was received from the Weaver Street Fire Company, stating that at the annual election of the fire company, the following officers were elected for the year 1923; Captain: Frank Nichol. 1st. Lieutenant; Frank McGeough. 2nd. Lieut. F. C. Birch. 3rd Lieut. J. L. Franck. Teasurer, J. B. Clifford; Secretary, L. F. William. Trustees, one year each: W.G.Bisset, Richard Thorburn and H. S. Worden. The communication was ordered placed on file and the election of the officers confirmed. Upon motion, the meeting adjourned at 10.30 P.M. Frederick M. Sherman Town Clerk.
