TOWN OF MAMARONECK,
held, October 4th, 1922.
The meeting was called to order by Supervisor Burton
at 10.50 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Collins, Dudley and Shafer,
Town Clerk Sherman,
Counsellor Gamble.
The minutes of the meetings of September 20th, 22nd,
and 25th, were read and upon motion approved.
Mr. Howell C. Perrin, Chairman of the Board of Appeals
was present and addressed the Board, stating the action taken
by the Appeals Board at their last meeting. He also asked the
approval of the rules and regulations of the Board of Appeals
by this Board, which was presented at the last meeting.
Counsellor Gamble stated that he had gone over the
rules and regulations and stated that in his opinion, the Board
should approve same, whereupon the following resolution was
offered by Justice Boyd and seconded by Justice Dudley, which
was unanimously approved:
RESOLVED, that this Town Board approve
the rules and regulations as adopted
and submitted by the Board of Appeals
of the Town of Mamaroneck, and be it
further
RESOLVED, that the Town Clerk be and
he hereby is authorized and empowered
to have same published in accordance
with the Law; and be it further
RESOLVED, that the Town Clerk be auth-
orized and directed to forward a cer-
tified copy of this resolution to the
Secretary of the Board of Appeals.
The rules and regulations are as follows:
1. Stated meetings of the Board shall be held monthly at
the office of the Town Clerk, at 8.30 o'clook in the evening, on
the last Thursday of the month, unless such day is a legal holiday,
in which case the meeting shall be held on the first Thursday
thereafter which is not a legal holidays.
2. Special meetings of the Board may be held at any time
upon adjournment publicly announced at any stated or properly
convened special meeting.
3. Any regularly scheduled stated or special meeting of
the Board may be adjourned for lack of quorum by those present
thereat, after the lapse of thirty minutes past the time for
which such meeting is called. In such event, notice of the time
and place of the adjourned meeting shall forthwith be mailed to
the absent members by the Secretary of the Board, or, in his
absence, by any member present designated for that purpose.
4. Every appeal shall be brought before the Board by the
filing of a notice of appeal in the form prescribed by the Board.
Such notices shall be distinctly addressed to the Board of
Appeals and shall be filed in the office of the Town Clerk. Each
notice of appeal shall be accompanied by a copy of the decision
or resolution of the Building Commission from which appeal is
taken, which copy shall be certified by the Secretary of the
Building Commission.
5. All applications for the location of public garages
or of public or livery stables within the boundaries of Business
Districts "C" shall be made in writing and filed in the same
place and manner as notices of appeal.
6. All notices of appeal and applications must be filed
on or before the 5th day of the calendar month in order to come
before the stated meeting of the Board for that month.
7. All appeals and applications to the Board must be
brought on for hearing at a stated meeting thereof in the first
instance. Thereafter they may be continued or adjourned for lack
of time or other cause to subsequent special or stated meetings
of the Board.
8. Notice of the initial hearings of all appeals and app-
lications shall be given by the posting thereof in at least four
conspicuous places in the unincorporated district of the Town at
least ten days before the hearing and by the publication thereof
in two Town newspapers once in each of the two weeks immediately
preceding the hearings.
9. A complete record of the meetings of the Board, showing
the members of the Board present thereat, and their respective
votes on each and every resolution shall be kept by the Secretary
of the Board.
10. Within five days after the final disposition of any
appeal or application by the 'Board, the Secretary shall transmit
a certified copy thereof to the Town. Board through the Town Clerk.

A communication from the Board of Appeals was received,
read, ordered spread upon the minutes and is as follows:
October 3rd, 1922.
To the Town Board,
Town of Mamaroneck, N.Y.
Gentlemen:
At a meeting of the Board of Appeals held September 28,
1922, several appeals were heard, and in each case a resolution
was adopted by the Board of Appeals recommending that the appeal
be granted, and the decision of the Building Commission be re-
versed.
The resolutions above rfiferred to read as follows:
RESOLVED, that the Board of Appeals recommend to the
Town Board that the appeal of John I. wilson for the erection of
a one story residence at 163 Murray Avenue, 4 feet from the easterly
side line, be granted, and the deeiffion of the Building Commission,
be reversed.
RESOLVED, that the Board of Appeals recommend to the
Town Board that the appeal of Oscar I. Addor for the erection of
a one family residence on the easterly side of Senate Terrace
near Colonial Avenue, 15 feet from the street, be granted, and
the decision of the Building Commission be reversed.
RESOLVED, that the Board of Appeals recommend to the
Town Board that the appeal of William H. Parsons to erect a one
family residence on the north easterly side of Glen Road and
Bungalow Road, the prrch of said residence being within thirty
feet of Bungalow Road, be granted, and the decision of the
Building Commission be reversed.
RESOLVED, that the Board of Appeals recommend to the
Town Board that the appeal of Henry Schroeder for the erection
of a one family residence on the north easterly side of Hill-
crest Avenue, 430 feet south westerly from Weaver Street, the
porch of said residence being within thirty feet from Hillcrest
Avenue, be granted, and the decision of the Building Commission
be reversed.
The members of the Board of Appeals feel that inas-
much as there has already been considerable delay in hearing
and deciding these appeals, owing to the time required to per-
fect the zoning ordinance, and to organize the Board of Appeals,
these appeals should be considered by your Board at its next
meeting to be held tomorrow night, October 4, 1822, provided
time permits.

Upon motion, duly seconded, the following resolutions
were offered and unanimously adopted
WHEREAS, the Board of Appeals of the
Zoning Commission have acted upon and
have recommended to the Town Board that
the appeal of John I. Wilson for the
erection of a one family residence at

WHEREAS, THE Board of Appeals of the Zoning
Commission have acted upon and have recomm-
ended to the Town Board that the appeal of
Oscar I. Addor for the erection of a one
family house on the easterly side of Senate
Terrace near Colonial Avenue, 15 feet
from the street be granted and that the
decision of the Building Commission be re-
versed, therefore be it
RESOLVED, that the Town Board pursuant to
Article 5, Section 26, of the Zoning Ordin-
ance of the Town of Mamaroneck, hereby con-
cents to and confirms the action of the
Board of Appeals in reversing the decision
of the Building Commission, and be it further
RESOLVED, that the Town Clerk sign for the
Secretary of the Board of Appeals, a certified
copy of this resolution.
WHEREAS, the Board of Appeals of the Zoning

to the Town Board that the appeal of William

porch of said residence being within thirty

of the Town of Mamaroneck, hereby consents
to and confirms the the action of the Board of
Appeals in reversing the decision of the
Building, and be it further
RESOLVED, that the Town Clerk sign for the
Secretary of the Board of Appeals, a certified
copy of this resolution.
WHEREAS, the Board of Appeals of the Zoning
Commission have acted upon and have recommended
to the Town Board that the appeal of Henry
Schroeder for the erection of a one family res-
idence at Hillerest Avenue, the porch of said
residence being within thirty feet of Hill-
crest Avenue be granted and that the decision
of the Building Commission be reversed, there-
fore be it
RESOLVED, that the Town Board pursuant to Art-
icle 5, Section 26 of the Zoning Ordinance of
the Town of Mamaroneck, hereby consents to and
confirms the action of the Board of Appeals
in reversing the decision of the Building
Commission, and be it further
RESOLVED, that the Town Clerk sign for the
Secretary of the Board of Appeals, a certified
copy of this resolution.
A communication from Michael Doherty was received and
read in relation to an error in assessment on his property. The
matter was referred to the Board of Assessors and Counsel to
report back to this Board.
A communication was received and read from C. C. King
requesting the refund of taxes which were erroneously assessed
against him. The matter was referred to the Board of Assessors
and Counsel to report back to this Board.
A communication from the Bureau of Elections was received
and read designating Frederick M.Sherman as Custodian of Voting
Machines, whereupon the following resolution was offered by Justice
Dudley and seconded by Justice Boyd, which upon ROLL CALL, was
unanimously approved.
WHEREAS, Frederick M. Sherman was hereto-
fore and on October 2nd, 1922, duly app-
ointed by the Bureau of Elections of
Westchester County, custodian of Voting
machines for the Town of Mamaroneck
under the provisions of Section 251
of the Election Law, therefore be it
RESOLVED, that the compensation of said
Custodian of voting machines be and the
same hereby is fixed at the sum of
$250.00., and be it further
RESOLVED, that the Supervisor be and he
hereby is authorized and empowered to
pay the aforesaid sum of $250.00 upon
presentation of a proper voucher there-
for after the same shall have been duly
audited.
Upon motion, the meeting adjourned at 11.30 P.M.
