TOWN OF MAMARONECK,
held, May 17th, 1922.
The meeting was called to order by Supervisor Burton
at 9.00 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Collins, Dudley and Shafer,
Town Clerk Sherman,
Counsellor Gamble,
Sewer Comm. Stevens, Palmer and Mitchell.
The minutes of the meetings of April 5th, 12th, 19th
28th, 1922 were read and upon motion approved.
Supervisor Burton stated that the first order of
business was the reading of notice of sale of Sewer District
No. 1 of the Town of Mamaroneck Sewer Bonds in the sum of
$100,000 which the Clerk having read, it was upon motion duly
seconded,
RESOLVED, that the notice of sale
be and the same hereby is approved.
Upon motion duly seconded, it was
RESOLVED, that the bids received
pursuant to said notice, be now
opened.
The Town Clerk proceeded to open and read each of the
bids received, all of which were accompanied by a certified
check in the required amount and are as follows:
Geo. B. Gibbons & Co. $103,136.00 and accrued interest.
Sherwood & Merrifield, $104,630.00 and accrued interest.
Union National Corporation, $104,070.00 and accrued interest.
1st Nat'l Bank, Mt. Vernon, $103,750.00 and accrued interest.
Lamport, Barker & Jennings, $102,610.00 and accrued interest.
Upon motion, duly seconded, it was
RESOLVED, that the Board go into
executive session to tabulate and
consider the bids received.
The Board reconvened at 9.30 P.M.
The Supervisor stated that the Board had considered
all bids received and was ready to make the award.
Upon motion by Justice Dudley seconded by Justice
Boyd, it was
RESOLVED, that the bid of Sherwood
and Merrifield being the highest bid
of $104,630.00 and accrued interest
at the rate borne by the bonds from
the date of the bonds to the date
of payment of the purchase price be
accepted, and be it
FURTHER RESOLVED, that the Town Clerk
be and he hereby is authorized and
directed to return the checks of all
unsuccessful bidders upon receiving
their receipt therefor.
The question being taken upon the foregoing resolution,
same was upon ROLL CALL, unanimously adopted.
The report of the Receiver od Taxes for the month of
April was received, read, ordered placed on file and is as follows:

The report of the Town Clerk for the month of April,
1922 was received and read, showing fees collected during the
month of April amounting to $10.81. Same was ordered noted in
the minutes and placed on file.
The report of the Building Commission for the month
of April was received and read showing fees collected amounting
to $106.00. Same was ordered noted in the minutes and placed
on file.
The report of the Police Department for the month of
April was received and read, showing 12 arrests and fines in
the amount of $145.00. Same was ordered noted in the minutes
and placed on file.
The report of the Supervisor for the month of March
was received, read, ordered placed on file and is as follows:

A communication from the Public Service Commission
was received and read with a tariff attached affecting the
change of rates on the New York, Westchester and Boston Rail-
way Company. Same was ordered placed on file.
A communication from the Honor Roll Committee was
received and read inviting the Town Board to participate in
the Memorial parade in Mamaroneck Village. The communication
was ordered placed on file and the Clerk was instructed to
reply accepting the invitation.
A communication from Mr. R. C. Heather in relation to
the cutting of a tree at the corner of Weaver Street and Myrtle
Avenue was received and read and upon motion duly seconded, it
was

RESOLVED, upon ROLL CALL, that the
Supt. of Highways be and he hereby
is authorized and empowered to have
the necessary survey made of the
street lines to determine whether
the tree out down was Town property
or not.
A communication from James A. McDonald was received
and read asking the Town Board to cancel his bond as Collector
of Taxes of the Town of Mamaroneck in the year 1905 in order
that his sureties may be released from further obligation.
Whereupon the following resolution was offered and adopted:
RESOLVED: WHEREAS, it has been brought
to the attention of this Board that the
bond given by James A McDonald for the
faithful performance of his duties as
Collector of Taxes for the Town of Mama-
roneck in the year 1905 has never been
cancelled, and
WHEREAS, the bond is still a lien against
the property of both Principal and Sur-
eties on said bond on the records of the
County Clerk of Westchester County, be-
cause said bond has never been cancelled,
and
WHEREAS, a request has been made by the
said Principal that said bond be forth-
with cancelled that said liens may be re-
moved and
WHEREAS, it would appear to this Board that
said James A. McDonald has fully discharged
the duties of his position and has accounted
for and paid over funds received by him as
Collector of Taxes and that said bond should
be cancelled and that the failure to cancel
same heretofore has apparently been an over-
sight,
THEREFORE BE IT RESOLVED, that the bond of
James A. McDonald dated the year 1905 given
by him for the faithful performance of his
duties as Collector of Taxes for the Town of
Mamaroneck covering the term of office to
which he was elected, which term of office
has long since expired be and the same is
hereby cancelled and the said James A.McDon-
ald and the said Sureties on the aforesaid
bond, discharged of and from any and all
liability in connection therewith and be it
FURTHER RESOLVED, that a certified copy of
this resolution be filed in the office of the
County Clerk of the County of Westchester
and that the lien created by said bond on the
records of said County Clerk be discharged;
The Committee of the new Weaver Street Fire House
reported having met with the Architect on the 5th, 11th and 12th
of May and have completed the revision of the plans and specif-
ications.
The Zoning Committee reported having met with the
Zoning Commission on the 10th and 15th of May and report that
they have gone over the Ordinance as presented to this Board
and report progress.
A communication from the Board of Sewer Commissioners
in relation to rules, regulations and specifications as adopted
by them tras received, read, orderdd entered in the minutes and
is as follows:

Gentlemen:
We are enclosing herewith a copy of the Rules, Regul-
ations and Specifications as adopted by the Board of Sewer Comm-
issioners of Sewer District No. 1 and approved by Counsel Ralph
A. Gamble, for the purpose of having uniform sewer house connect-
ions to the sewer of this district.
We wish that you would make this an ordinance of the
Town, so that as to give it the proper force and so that we may
publish same in local papers. Thanking, you, we are,

RULES, REGULATIONS AND SPECIFICATIONS AS TO
SEWER HOUSE CONNECTIONS TO PUBLIC SEWERS IN
SEWER DISTRICT NO. 1 OF THE TOWN OF MAMARO-
NECK, NEW YORK.
REGULATIONS:
All Sewer house connections pipes shall be made only in
accordance to the following rules, regulations and specifications
herein specified.
PERMIT: No connection with or opening into any public sewer shall
be made excepting under and pursuant to a written permit issued by
the Board of Sewer Commissioners of Sewer District No. 1 of the
Town of Mamaroneck.
APPLICATIONS:
Applications for permits shall be made in writing to the
Board of Sewer Commissioners upon regular forms, signed by the
owner or his authorized agent.
SUPERINTENDANCE ANS INSPECTION:
All connections with or opening into any public sewer and
the laying of any house connection must be done under the superin-
tendance of the Board of Sewer Commissioners or of an Inspector,
Plumber or Engineer duly authorized by the Board of Sewer Commiss-
ioners to act for it. The said Board is to have absolute control of
the entire house sewer connection from the public sewer to the
house.
CONNECTIONS:
Connections with the public sewer may be made by a person
duly licensed by the Board of Sewer Commissioners, after having ob-
tained written permit therefor, said licensee shall be held respons-
ible and liable for any injury caused to the Town of Mamaroneck and
or the Board of Sewer Commissioners, the sewer, the public, and
or to the public street. After the making of opening for the
purpose of said connections, said licensee shall restore the
street and sidewalks to their original condition and to the sat-
isfaction of said Board of Sewer Commissioners.
BONDS:
Applications for license to do work under these regu-
lations shall be made in writing and said application shall be
accompanied by a bond in form and amount satisfactory to the
Board of Sewer Commissioners, conditioned to indemnify and save
harmless the said Town of Mamaroneck and or the Board of Sewer
Commissioners of Sewer District No. 1 of the Town of Mamaroneck
from any and or all damages arising from said connection with the
public sewer and or arising out of said work performed under said
application.
TRENCH OPENINGS;
In opening any street, the paving or ballast must be
removed with care and kept clean in order to replace same after re-
filling trench; gas and water pipes are to be protected and trench
guarded and lighted at night; every precaution must be taken to
prevent injury to persons or property during the progress of the
work.
PROTECTION OF ENDS OD PIPE:
The ends of all pipe not to be immediately connected to
house plumbing, shall be closed with a store ware cover and cem-
ented so as to be water tight.
PIPE:
The pipe shall be of first quality, salt glazed, vitri-
fied sewer pipe, not less than five inches interior diameter, to
the junction with the house plumbing.
LAYING:
The house connections sewer pipes shall be laid care-
fully and true to grades. A straight edge must be used to even up
the pipe. Where grades are at the minimum, a level shall be used.
The pipe shall be laid in jute the entire circumference of the
bell and there carefully cemented with Portland Cement, mixed one
of cement to one of sharp sand, after each joint is made, the
joint is to wiped on the inside.
MINIMUM GRADE:
The minimum grade shall be one quarter of an inch to the
foot. No less inclinations will be allowed except under special
conditions and then only under such grades, precautions and meth-
ods of laying as will be required by the Engineer of the said
Board. Curved pipe must be used at every deflection from a straight
line either horizontal or vertical. Only one building shall be
connected with the public sewer through one drain, except
under special permission of the Board of Sewer Commissioners.
FOR SEWER PURPOSES AND CELLAR DRAINAGE:
The connections are to be made for sewer purposes and
cellar drainage only. No ground water, cess pool, drain, catch
basin, gutter, storm, water, leader pipe, cistern, or privy vault
will be allowed to connect with said house connections. The pipe
must run continuously from the public sewer to the house, and be
used solely for household wastes and where necessary for cellar
drainage.
NOTICE THEREFOR:
Notice of writing must be given the Board of Sewer
Commissioners or their authorized agent 24 hours prior to the
beginning of any work upon any connections and only after the
granting of the permit, and no material shall be used until in-
spected and approved. The cover to the Y branch of the sewer shall
not be removed or any pipes laid except in the presence of said
agent.
RIGHT TO ENTER PROPERTY:
The Board of Sewer Commissioners or its agents or em-
ployees shall have the right to enter in and upon the premises
or property connected (or supposed to be connected) at any and all
times to make examinations and tests to determine whether the
leaders conveying roof or rainwater are connected either directly
or indirectly, with said sewer and also to ascertain whether any
of these rules and regulations are violated.
PENALTY:
It shall be a misdemeanor to do, or cause to be done, any
of the following acts, except herein provided. Any and all persons
or corporations guilty thereof shall be fined not less than Ten
($10.00) Dollars or more than Fifty ($50.00) Dollars. 1st to un-
cover the public sewer for any purpose or make connection therewith;
or to uncover the connection branches thereof; or to open any man
hole or flush tank, except with the written consent and under the
supervision of the Board of Sewer Commissioners or their author-
ized agent. 2nd, to throw or deposit, in any vessel or receptable
connected with a public sewer, any garbage, vegetable pairings,
ashes, cinders, rags or any other matter or thing whatsoever, ex-
cept facces, urine, water closet paper and liquid house slop or
to allow any house drain to be connected with any privy, vault or
cess pool or underground water of filth, except the soil pipes and
plumbing work of the houses or building as herein before provided.
3rd, to violate any section of the rules and regulations.
CONSTRUCTION OF ORDINANCE:
Nothing herein contained shall be deemed to limit or
abridge the power conferred upon the Board of Sewer Commissioners
of Sewer District No. 1 or of this Board, to make other rules and
regulations and ordinances either general or particular, so long
as such rules, and regulations and ordinances do not conflict woth
the provisions of any law, but if such rules and regulations and
ordinances hereafter enacted conflict with or are inconsistent
with the provisions of these regulations they shall be deemed in
so far as necessary to supercede these rules and regulations and
this ordinance.
These rules and regulations and ordinance shall not be
construed to in any way limit or abridge any Highway Law of
the State of New York, or any Health ordinance of the Town or the
provisions of the Laws of the State of New York relating to the
preservation of public health applicable to Towns.
ADOPTION AND REPEAL:
The foregoing rules and regulations and ordinance is
hereby adopted as a Sewer Ordinance of the Town of Mamaroneck.
This Ordinance shall take effect at once.
Uppn motion, duly seconded, it was
RESOLVED, that this Board approve the
rules and regulations as adopted and
submitted by the Sewer Commissioners
of Sewer District No. 1 and be it
FURTHER RESOLVED, that said rules and
regulations be adopted by this Town
Board as a Town Ordinance.
Upon motion, the meeting adjourned at 11.30 P.M.
