TOWN OF MAMARONECK,
held, April 5th, 1922.
The meeting was called to order by Supervisor Burton
at 10.45 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Collins and Shafer,
Town Clerk Sherman,
Counsellor Gamble.
The minutes of the meetings of March 15th and 30th, 1922
were read and upon motion approved.
Captain Nichol was present and requested the purchase
of 9 new fire helmets for the Weaver Street Fire Company.
Upon motion, duly seconded and upon
ROLL CALL, it was voted that the
requisition for 9 new fire helmets
for the Weaver Street Fire Company
be referred to the Captain and the
Town Clerk with the power to pur-
chase same.
A communication from Frederick P. Boehm was received
and read in relation to the cancellation of a school tax for
1915 receipt for payment attached to the communication. The
matter was referred to Counsellor Gamble to draft a proper res-
olution to correct error.
A policy and bill was received and presented from
H. M. Whitaker, insuring the plans in the competition for the
new Weaver Street fire house.
Upon motion, duly seconded, and upon
ROLL CALL, it was voted that the Sup-
ervisor be and he hereby is authorized
and empowered to pay the premium on
the policy for the plans of the weaver
Street fire house after same had been
submitted for proper audit.
The bonds of the Police Commissioners was received
and presented and upon motion duly seconded and upon
ROLL CALL, it was voted that the bonds
of the Police Commissioners of the Town
of Mamaroneck be filed with the Town
Clerk and that the premium of said bonds
be made a proper town charge.
The following resolution was offered by Justice Shafer
and seconded by Justice Collins;
WHEREAS, upon the report of the new fire
house Committee this Board did on Nov-
ember 10th, 1921, adopt a resolution award-
ing. James W. O'Connor Architect, the sum
of $500.00 as first prize upon his plans
submitted under the competitive terms,
such plans having been adjudged the best
plans, now therefore be it
RESOLVED, that the Supervisor be and
he hereby is authorized and empowered
to pay the said James W. O'Connor the
aforesaid sum of $500.00 awarded as
aforesaid upon his filing with the
Supervisor a proper voucher therefor.
The question being taken upon the foregoing resolution,
same was upon ROLL CALL, unanimously adopted.
A communication from the Board of Assessors was received
and read requesting permission to use an automobile in their field
work. It was the sense of the meeting that the request be denied,
the members of the Board being of the opinion that more efficient
work could be accomplished with the horse and carriage as now
being used.
The following resolution was offered by Justice Boyd
and seconded by Justice Shafer:
WHEREAS, Senate Bill No. has been
brought to the attention of the Town
Board of the Town of Mamaroneck and
is now before his Excellency Hon.
Nathan L. Miller, Governor of the State
of New York, for his signature and
enactment into Law, which bill, by its
terms would amend the Motor Vehicle
Highway Law as now constituted by pro-
viding for the payment of all fees
and fines collected by by Town and
Villages for violations of said Motor
Vehicle Highway Law to the State, and
WHEREAS, under the said Law as now
constituted, said fees and fines coll-
ected for violation of the aforesaid
law are paid over to the benefit of
the respective Towns or Villages wherein
said violation occurs, and
WHEREAS, the Boston Post Road which is
one of the main arteries of travel,
carrying the heaviest load of traffic
of any highway in the State traverses
the Town of Mamaroneck for a considerable
distance and
WHEREAS, the Town of Mamaroneck is there-
for responsible and liable under the law
for the proper regulation of traffic
along said Boston Post Road and the proper
policing thereof, the expense of which
is a considerable burden to the Town, and
WHEREAS, the enactment into law of the
aforesaid amendment would therefor deprive
the Town of Mamaroneck of a large amount
of revenue to which it justly and equit-
ably entitled to recompense it at least
in part for the obligations and expense
imposed upon it under the law and the de-
privation of which would be absolutely
unequitable and unjust, therefor be it
UNANIMOUSLY RESOLVED, that this Town Board
do hereby record its disapproval and opp-
osition to the aforesaid amendment to the
Motor Vehicle Law and does hereby respect-
fully request His Excellengy, Hon. Nathan
L. Miller, Governor of the State of New York
to veto the aforesaid bill.
The question being taken upon the foregoing resolution,
same was unanimously adopted.
Counsel reported in relation to the Josphthal matter
and stated that same had been settled.
Upon motion, duly seconded and upon
ROLL CALL, it was voted that the
Supervisor be and he hereby is auth-
orized and empowered to pay expenses
incurred in the settlement of the
Josephthal action upon the approval
of Counsel.
The Committee for the new Weaver Street Fire House were
present with the Architect Mr. Mink who presented the form of
contract and also form of specifications. Same was referred to
Counsel fo his approval as to the legal status and obligations
of the Town.
Upon motion, it was voted to adjourn and meet with the
Committee and the Architects of the Weaver Street Fire House on
Wednesday evening April 12th, 1922.
