HomeMy WebLinkAbout1922_02_18 Town Board Minutes Meeting of the Town Board TOWN OF MAMARONECK held, February 18th, 1922. The meeting was called to order by Supervisor Burton at 9.00 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins and Shafer, Town Clerk Sherman, Counsellor Gamble . Upon motion it was voted to dispense with the reading of minutes of meetings not yet approved. Supervisor Burton brought to the attention of the Board the matter before the Legislature entitled an "Act to legalize the acts and proceedings of the Common Council, the Mayor and Board of Water Supply of the City of Mount Vernon, in contracting for the purchase and use of all the water mains and appurtenances, located in the City of Mount Vernon, of ths Ner York Inter Urban Water Company. He advised the Board to request our representatives in the Legislature to defeat this measure. Whereupon the following resolution was offered by Justice Collins and seconded by Justice Shafer; WHEREAS, in 1914 a proposition was in progress to sell to the City of Mount Vernon, the water pipes, etc., owned and operated by the New York Inter Urban Water Company, all within the limits of the said City and thus dismember the water supply system of said Company; and WHEREAS, in October 1914, the Conservation Comm- ission refused to approve said proposition, among other reasons set forth, was the great injustice which would ensue to the reaming mun- icipalities connected with the said system. Again in 1915 the same refusal was handed down by the Commission embracing the same reason; and WHEREAS, in 1920, a contract was negotiated by and between the New York Inter Urban Water Com- pany and the City of Mount Vernon, which would affect this dismembermant, still without the consent and approval of the Conservatibn Commiss- ion. The legality of this contract and the action of the parties thereto, is assailed by the Village of Pelham and the Town of Mamaroneck for the reason among others because the approval of the Conservation Commission was not secured and be- cause of the great injustice and injury to these contesting and also the other communities and inhabitants affected thereby, is; Villages of Mamaroneck and Rye and Town of Harrison; and WHEREAS: litigation of this matter is now before the Court of Appeals and not yet decided and further so are informed that an act is about to be presented to this legislature ( Copy of which is hereto attached ) which if passed will over ride a possible decision of the Court of Appeals declaring such before mentioned contract illegal; and WHEREAS, this annexed bill is strictly to the benefit of the parties to this partic- ular contract, regardless of the injury of the other communities, (5) and we believe is contrary to the recognized policy of the State Legislature and in this case gives decided advantage to one community without ragard to the equity of the others; also taking away from the Conservation Commiss- ion one of the most valuable functions pro- vided for by law; therefor be it RESOLVED, that the Town Board of the Town of Mamaroneck. does most strenuously oppose the passage of this act and respectfully urge their Representatives in the Legislat- ure to use all honorable means to defeat this measure and further urge them to grant the opponents of this bill a hearing in Committee before being reported out. The question being takan upon the foregoing resolution, same was upon ROLL CALL, unanimosuly adopted. Upon motion the meeting adjourned at 10.30 P.M. Town Clerk
