HomeMy WebLinkAbout1922_02_15 Town Board Minutes Meeting of the Town Board TOWN OF MAMARONECK held, February 15th, 1922. The meeting was called to order by Supervisor Burton at 9.00 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins, Dudley and Shafer, Town Clerk Sherman, Counsellor Gamble. Upon motion, it was voted to dispense with the reading of minutes of meetings not yet approved. The report of the Receiver of Taxes for the month of January 1922, was received, read, ordered placed on file and is as follows; February 1st, 1922. McGivney, Receiver of Taxes. The report of the Building Commission for the month of January was received, and read showing permits issued 3 and fees collected in the amount of $46.00 was ordered noted in the minutes and placed on file. The report of the Police Department for the month of January was received and read, showing 2 arrests and fines in the amount of $50.00. Same was orderd noted in the minutes and placed on file. The report of the Town Clerk for the month of January was received, read, ordered placed on file and is as follows: February 8th, 1922. Hon. Geo. W. Burton, Supervisor, Town of Mamaroneck, N.Y. Dear Sir; I beg to submit herewith my report of fees collected in the office of the Town Clerk for the month of January, 1922. as follows: Hunting licenses issued 67 $16.75 Dog licenses " 10 2.50 Marriage licenses " 1 1.00 Chattels filed 38 4.56 Total $24.81 Check covering above amount made to the order of the Supervisor. Respectfully submitted, sgnd, Frederick M. Sherman. Town Clerk. A communication was received from the Larchmont Gardens Association in relation to the letting of the new contract for the collection of ashes and garbage. Same was read and referred to later order of business. Justice Dudley reported on behalf of the Committee for the new Weaver Street Fire house and submitted the following resolution adopted by said Committee; Meeting of the Fire House Committe held February 5th 1922 with the following present: F.P. Shafer, Frank Nichols,H.M. Whitaker, Philip Burch, C.C. Merritt, George Moore and Geo. B. Dudley. After consideration and discussion it was moved by Captain Nichols and seconded by H.M. Whitaker, and adopted as follows: That the plans submitted by Messrs Eggers and Mink, Associated, meet with the app- ioval of this Committee and that the Town Board be urged to employ Messrs Eggers and Mink, Associated, as architects to complete plans and specifications for such building. The Committee appointed by this Board recommend that such action be taken. sgnd, Geo. B. Dudley. Chairman. Upon motion, duly seconded it was RESOLVED, that the report of the Committee for the new Weaver Street Fire House be and the same hereby is approved. The Clerk was instructed to notify Messrs Eggers and Mink to appear before this Town Board to arrange for their employment at a meeting to be held thursday evening February 23rd, at 8.30 P.M. Upon motion, duly seconded, it was VOTED, that the plans submitted in the competition be returned by the Town Clerk, and that the Board ex- press their appreciation to the competitors for the interest shown in the competition. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. Mr. Jubb appeared in relation to an accident on the Post Road to his partner George Waller and asked what relief the Town Board could extend for the injuries sustained. The matter was referred to Counsel. Mr. Clarence Werner appeared for his sister Estelle L. Titsworth in relation to erroneous assessment of her property and after full explanation the matter was referred to Counsel to report back. Upon the recommendation of Counsel and upon motion duly seconded, the following resolution was adopted. WHEREAS, Estelle L. Titsworth is the owner of certain property in Section 9, Block 109 of the Town of Mamaro- neck, and WHEREAS, the aforesaid property was erroneously assessed upon the books of the Receiver of Taxes inthe name of Estella L. Fitsworth, and WHEREAS, due to the aforesaid error the State, County and Town taxes and School tax District No. 1 for the year 1921 in the sums of $750.87 and $676.27 respectively remain unpaid, and WHEREAS, the owner of the aforesaid property has offered to immediately pay the full amount of said taxes less the amount of the accrued penalties, THEREFORE BE IT RESOLVED, that the Receiver of Taxes be and he hereby is authorized and directed upon the re- ceipt of $750.87 for school taxes for the year 1921, for School Tax District No.1 Town of Mamaroneck, N.Y., and $676.27 for State, County and Town taxes for the year 1921, to accept the Same in full payment of said taxes and to so mark his records. The question tieing taken 'upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. The next order of business was the opening of bids for the contract for the collection and disposal of ashes, garbage, swill, refuse, etc, in Fire Districts Nos. 1 and 2. The Clerk read the notice of Advertisement and upon motion, duly seconded, it was VOTED, that the bids received be now opened. The Clerk proceeded to open and read the bids which were as follows FIRE DISTRICT No. 1 Michael Carpino at least twice each week $3,800.00 " " 3 times each week, June to Sept, 4,100.00 William Poschan at least twice each week 4,000.00 " " 3 times each week, June to Sept 4,000.00 Gabriel Sganga at least twice each week 3,000.00 " " 3 times each week, June to Sept 3,000.00 Kreoll & Walsh at least twice each week 3,000.00 " " 3 times each week, June to Sept 3,400.00 FIRE DISTRICT No. 2 William Poschen at least twice each week 800.00 Kreoll & Walsh at least twice each week 790.00 All bids were accompanied by the required deposit of $100. Upon motion, duly seconded, it was VOTED, that the Board together with Counsel recess and go into executive session for deliberation on the award- ing of the contracts. Upon reconvening Justice Shafer offered the following resolution, seconded by Justice Boyd: RESOLVED, that the bid of Sganga and Librandi being the lowest bidders for the collection and disposal of ashes, swill, garbage and refuse in fire District No. 1 be and the same is here- by awarded to the said Sganga and Librandi at the price of $3,000.00 as provided in Paragraph 1A of the bid or estimate and of the proposal and specifications of Paragraph 15, provided they qualify in accordance with their bid and estimate and propo- sal by providing a proper bond and ex- ecute a contract in form satisfactory to Counsel and that the Supervisor be and he hereby is authorized and em- powered to execute said contract and the Clerk be authorized to attest the veal of the Town of Mamaroneck. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. The following resolution was offered by Justice Collins and seconded by Justice Dudley; WHEREAS, Kreoll and Walsh are the lowest bidders and Harold C. Kreoll of Kreoll and Walsh has stated to the Board that they do not desire to accept the contract for District No. 2 unless they receive the contract for District No. 1, therefore be it RESOLVED, that the bid of William Poschen being the lowest bidier for the collection and disposal of ashes, garbage, swill and refuse in Fire District No.2, be and the hereby is awarded to the said William Poschen at the sum of $800.00 same to be levied and assessed against the taxable property in Fire District No. 2, provided the said William Poschen qualifies in acc- ordance with his bid or estimate and prop- osal by providing a proper bond and ex- exute a bond satisfactory to Counsel, and the Supervisor be and he hereby is auth- orized and empowered to execute said con- tract and the Clerk be authorized to att- est the seal of the Town of Mamaroneck. The question being taken upon the foregoing resolution,, same was upon ROLL CALL, unanimously adopted. The communication of the Larchmont Gardens Association was then taken up and after due consideration it was VOTED, that the Clark be instructed to reply to the communication in relation to the collection of ashes and garbage stating that it would be impracticle to comply with same at this time. The following resolution was offered by Justice Collins and seconded by justice Dudley: RESOLVED, THAT the matter of the bond issue authorized by chapter 561 of the Laws of 1921 , entitled an "Act to pro- vide for the submission of a proposit- ion to the voters of Fire District No. 1 of the Town of Mamaroneck, New York, for the acquisition of a site by private purchase or condemnation., and the con- struction of a new fire house in said Fire District No. 1 of the Town of Mamaroneck neck, ******* etc. be and the same is hereby referred to the Supervisor and Counsel; and be it further RESOLVED, that the Supervisor, in con- junction with Counsel, take such action in connection with said bond issue as they may deem advisable to the end that said bonds may be sold at an early date. The question being taken uptn the foregoing resolution, same was upon ROLL CALL, unanimously adopted. The bonds of Supt. of Highways Anthes, Justice Shafer and Town Clerk Sherman were received and approved by Counsel and ordered placed on file. Upon the recommendation of Capital Decker it was upon motion, duly seconded, RESOLVED, that Frelerick G. Ellingham be appointed as patrolman of the Town Police and the Clerk be instructed to notify the Civil Service Commission of said appointment. The question being token upon the foregoing resolution same was upon ROLL CALL, unanimously adopted. At the suggestion of Capitan Decker, the Clerk was instructed to write to the Civil Service Commission asking for the new eligibility list. Upon the application of the Village Clerk and upon motion duly seconded, it was RESOLVED, that the request of the Village of Mamaroneck for the use of the voting machines at the village election be granted providing the village pay for the necessary expenses for their operation and return under the supervision of the custodian of voting machines. The following resolution was offered by Justice Shafer and seconded by Justice Collins. RESOLVED, that the rental of the rooms occupied by William A. Boyd as Justices Court be and the same is hereby fixed at the sum of $50.00 per month and that a lease be entered into between the owners and the Town for two years beginning January 1st,, 1922, lease to include heat, light, water and janitor service. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. Upon motion, the meeting adjourned at 11.30 P.M. Town Clerk.
