Luft, Assistant to the Town Administrator DATE: May 28, 2021 SUBJECT: Love Your Food Update The Love Your Food grant program, funded through the New York State Department of Environmental Conservation (DEC), has faced challenges due to the COVID-19 pandemic. We are pleased to be moving forward with various modified initiatives to continue to educate the community on how to reduce their wasted food. There are two agreements on the Affairs of the Town portion of the agenda, one for in- person cooking demonstrations and one for the production of an educational video series. The Down to Earth Farmer's Market (Farmer's Market) has been operating and we have found a vendor whom we wish to engage for cooking demonstrations. Aditi Goswami is a frequent vendor at the Farmer's Market with her business, Calcutta Kitchens. Ms. Goswami prides herself on her culinary creativity. The objective of the food demonstrations is to show how commonly discarded food scraps can be transformed into nutritious meals. The grant provides funds for fifth grade students in the Mamaroneck School District (District) to partake in a field trip to the Greenburgh Nature Center (GNC) for three years. Due to the pandemic, no field trips have occurred to date, therefore we requested approval from the DEC to provide a video series in lieu of one year of field trips. We received approval and are ready to produce the videos. To ensure professional quality videos, we have decided to engage LMC Media in this initiative. There is just over one full year of the grant remaining, and we are hopeful to conduct in- person field trips for the 2021-2022 school year. Given that this still leaves one year of field trips remaining, we anticipate requesting a one-year extension from the DEC. ACTION REQUESTED: That the Town Board authorize the Deputy Town Administrator to execute the two above mentioned agreements. Page 8 of 62 Town of Mamaroneck ,Fawn Center 740 West Boston Post Road, Mamaroneck, NY 10543-3319 Memorandum To: Supervisor and Town Board Connie Green O'Donnell -Deputy Town Administrator Re: Resolution -State and Municipal Facilities Capital Program (SAM Grant) Hommocks Spray Pad Date: May 27, 20921. Senator Shelley Mayer has nominated the Town of Mamaroneck to receive to receive a $250,000 grant through the SAM Grant for the Hommocks Pool. The SAM Grant program is administered by the Dormitory Authority of the State of New York (DASNY). Originally the Town had considered improvements to the Hommocks Pool Facility that included the installation of a spray pad, reconstruction of the Training Pool and other related improvements. The estimated cost of the project was originally $1.6million but rose to $2.9million based upon increases in construction costs. As a result the project scope was scaled back to just the replacement of the existing kiddy pool (Mushroom Pool) with a spray pad. The existing Mushroom Pool is in serious disrepair and the base of the pool has actually tilted due to underground settlement. The cost for the project is estimated to be $600,800. With the grant, the Town's share of the project would be $350,800. So that we may still take advantage of the State Grant we have completed the Preliminary Application which is attached to this memo. The application has been completed and submitted to Senator Mayer's office. A requirement of the application is a resolution of the governing body committing to the sponsor's share of the project. The sponsor in this case being the Town. If the Town Board wishes to move forward with the grant and the project the recommendation is that the attached resolution be adopted. I Stephen V. Included in the complex is the main indoor swimming pool, a smaller training pool and a kiddy pool for very young children. The Town operates the pool facility which serves the entire Town of Mamaroneck (population 29,000) including the Villages of Larchmont and Mamaroneck as well as the unincorporated Town. The project proposed at this time is the replacement of the kiddy pool with a splash pad and associated play equipment used in aquatic facilities of this type. The existing kiddy pool was constructed 20 years ago. In that time the infrastructure of the kiddy pool has deteriorated severely. There are undetectable leaks in the kiddy pool and the concrete base has shifted due to underground conditions. The substitution of a splash pad for the existing kiddy pool will provide the Town the opportunity of increasing the number of children that can use the facility at any given time. By expanding the facility and improving its condition the Town can better meet the demand by the residents for the use of the facility. The next step is to begin to review various protocols and procedures in order to implement components of the plan. The report was divided into eight major topic areas: 1. Community Policing 11. Bias Free Policing 111. Training IV. Use of Force Policies/Methods of Engagement V. Equipment Used by the TMPD VI. Review of Complaint/Procedures/Oversight and Officer Discipline VII. Disclosure of Data VIII. Rec*mmendati*ns to New York State- Civil Service Law IX. Recommendations to Westchester County The goal of this exercise is to not just change protocols and procedures but also to change the culture of policing. Using the major topic areas, the Police Chief and I will be formulating changes to meet the goals of the report. The proposed plan will be presented to the Town Board and Racial Equity Task Force for review and comment. Subsequently, portions of the plan may require formal adoption by the Town Board that serves as the Board of Police Commissioners. During the course of our work we will seek input from the Town's General Counsel and Labor Counsel on some of the proposals. This is to insure compliance with both current State law and the collective bargaining agreement with the Town's Police Union. With respect to training, we will propose a training plan that encompasses the current training requirements as well new training requirements to meet the goals of 0% Printed on Recycled Paper Page 15 of 62 #1 ot the report. There will budget considerations for training that must be evaluated by the Town Board as we look to identity the optimal training program for the department. We will also work with Westchester County in regards to the training component of the plan. Westchester County officials have previously indicated a willingness to host new training programs for the municipal police departments in the County. Our goal is to have a draft of the plan for review by the end of July. Understand that at this point our plan for reform and reinvention is based upon the most recent best practices for reformed policing. We are however cognizant of the fact that at both the State and Federal level police reform bills are under consideration. Depending upon the results of those legislative efforts further review of the Town Police Department's reform plan would be required. As a general proposition, the reform and reinvention plan will be a fluid document requiring periodic review by the Town. Attached is a notification from the Westchester County Department of Planning in connection with the membership of the municipalities in the Urban County Consortium. The notice reminds municipalities that unless they specifically seek to remove themselves from the consortium, their membership will automatically renew MESIMM We wanted to review this matter with the Town Board prior to the deadline. The Town has been a member of the consortium since the 1970's. During that time we have been awarded a number of CDBG grants including: • Two Boston Post Road Streetscape Projects ® Installation of a Flood Relief Valve- Larchmont Reservoir • Washington Square Streetscape Project • Playground Construction- Larchmont Acres • Infrastructure Construction- Hommocks Park Apartments • Replacement of Harmon Drive Sidewalks • Reconstruction of the Senior Center Parking Lot In addition to the above list, the Town was intending to file a grant this June for the 2022 CDBG cycle for interior renovations at the Senior Center. Suffice to say the CDBG Program has been of great benefit to the Town. There are now thirty local governments in Westchester that are members of the Urban County Consortium. Over the last several years more communities have signed on to be members of the consortium. The Urban County Consortium is only open to Towns, Villages and small cities in Westchester. New Rochelle, Yonkers, White Plains and Mt. Vernon each have their own CDBG programs. It would be my recommendation that the Town of Mamaroneck remain a member of the Co:nsort�i',m at t is ti e. My family has owned this property since 1979 (a span of 42 years). The property is a vacant lot with a dilapidated garage in the real, of the property. A picture evidencing the garage is attached hereto for your review. As YOU may also be aware, on March 10, 2021, the 'Town Planning Board approved our application for a single- fan-iily home. A copy of that resolution is attached hereto for your review. As part of that resolution, we were required to dernolish the existing dilapidated gar -age and erect a new garage as part of the new single-family home. Since the time of the approval, we have taken all necessary steps to comply with the Town's application for a clerr�iolition permit including interfacing with Con Ed to make sure all requirements have been adhered to. Notably, the Building Department employees and members of the Town Engineer's office have been extremely helpful in providing guidance and information. Most recently, we were advised that on April 21, 2021, Town Board Unanimously approved a 6-rnonth aroratorium for the demolition of more than 50% of the main building on a lot lying within a residential district. While we certainly appreciate the _Gown's decision to Study the effects of the erection of larger homes, we respectfully request our application for the demolition of the existing garage be excluded from the ri-ioratoriurn. As I am certain you will agree, the imposition of the moratoriUr"n postdated our approval of the Planning Board's resolution, More importantly, it appears the intent of the moratoriUrrl Would be inconsistent to Page 27 of 62 our application for demolition. The Town Planning Board carefully studied our application and received comments from the public prior to voting on the approved resolution. Furthermore, I do not believe the moratorium intended to preclude the demolition of an accessory dilapidated garage that has not been in use since the early 1990's. As defined in the Town's building code definitions, a private Garage is An accessory building or part of a main building used only for the storage of motor vehicles as an accessory use. The code further describes a Main building as A building in which is conducted the main or principal use of the lot on which said building is situated. As you will note in the attached picture, the existing conditions clearly describe the structure was at one time a garage and certainly cannot be considered a principal use of the property. Prior to the issuance of a building permit, the Applicant shall demonstrate to the satisfaction of the Town Engineer, in consultation with the Town Building Inspector, that all proposed exterior HVAC equipment conforms with modern industry standards for sound emission and that best practices for sound mitigation have been implemented. 9. Prior to the issuance of a Certificate of Occupancy or a Certificate of Completion, the Applicant shall deliver to the Town Building Inspector an "as built" survey, including, but not limited to, all constructed site utilities and stormwater management structures. 10. In accordance with Section 178-17.13 of the Residential Site Plan Law, no Certificate of Occupancy or Certificate of Completion shall be issued until all of the required conditions of this approval have been met. 11. The term "Applicant" is used herein with the intent to impose a future obligation or condition on the Applicant, as defined above, and on any successor or assignee in/of an ownership interest of the Property or any portion thereof. 12. All tree removal, tree protection and landscape plantings shall be in compliance with the approved Plans and Chapter 207 of the Town Code (Trees), to the satisfaction of the Town Environmental Planner. In accordance with Section 178-14 of the Town Code, the Applicant shall be required to pay to the Town its actual cost of technical reviews, including, without limitation, consulting fees, prior to the issuance of any Town permits. 15. If there is to be mechanical rock removal, subject to the following, as well as any then applicable law and/or moratorium: (a) To the satisfaction of the Town Engineer, the Applicant shall hire and compensate a professional firm (hereinafter referred to as the "Professional Firm") to inspect and record the condition of all structures (including retaining walls) adjacent to or across the street from the Property prior to the commencement of mechanical rock removal, and to monitor and document it. (b) Within a reasonable time prior to the start of mechanical rock removal, all the owners of such properties and any additional nearby properties recommended by the Professional Firm shall be contacted, in writing, by the Applicant or the Professional Firm, to arrange a pre -condition survey, to be conducted at the Applicant's expense. (c) The Applicant shall be required to pay the reasonable cost of repairs resulting from damage caused by the mechanical rock removal. (d) Prior to issuance of a Certificate of Occupancy or Certificate of Completion, the Applicant shall submit, to the satisfaction of the Town Engineer, all inspection reports related to the mechanical rock removal. (e) No mechanical rock removal permit shall be issued unless the applicant has a dust mitigation plan approved by the Town Building Department. Such dust mitigation plan shall incorporate the best dust control practices including, but not limited to, a water spray system (air suppression or surface wetting). Portable hand water sprinklers or hose sprinklers are acceptable means of wetting for dust control if the water sprays or jets shall break the water stream into small droplets or otherwise provide effective wetting. The dust mitigation plan shall include measures to control water runoff as a result of any water spray program. (f) The portion of trucks and other vehicles used to transport particulate matter shall be covered and any particulate matter kept on site shall be sufficiently wetted or stored to prevent particulate matter from becoming airborne. (g) Suitable drainage means shall be provided for the removal of water and sludge which drains from the operation. (h) Soil or debris piles shall be moistened if dust is being emitted from the piles due to prevailing winds and not from a momentary gust. Adequately secured tarps, plastic or other material may be required by the Building Department to further reduce dust emissions. Boston Post Road, Mamaroneck, NY 10543 (Town). Recitals Whereas, the Town has received a grant from the State of New York to conduct a Municipal Food Scraps Reduction, Food Donation and Food Scraps Recycling Program (Grant), and Whereas, the Grant requires the Town, among other things, to conduct cooking demonstrations, and below. Whereas, the Town wishes to engage Calcutta Kitchens to perform the services described Now, therefore, intending to be bound the parties agree to the following: 1. Calcutta Kitchens will conduct two cooking demonstrations at the Down to Earth Larchmont "Farmers' Market" that will show how commonly discarded food scarps can be transformed into nutritious meals that will not only save money but will minimize wasted food. Each demonstration is to be an hour total in length, they may be split up into two segments. Calcutta Kitchens shall coordinate the exact date and time of day to perform the demonstrations with Elisabeth Radow, Town Sustainability Volunteer. These services shall be completed by August 1, 2021. Page 47 of 62 2. Calcutta Kitchens will be responsible for providing the food that will be cooked and the equipment necessary to conduct the demonstrations. 3. The Town will pay Calcutta Kitchens the sum of five hundred and no/100ths ($500.00) dollars for each demonstration for a total of one thousand and no/100ths ($1,000.00) dollars if both demonstrations occur. Calcutta Kitchens shall bear all expenses incurred in the course of its performance. The Town will not be billed for any such expenses, as its total obligation to Calcutta Kitchens under this Agreement shall not exceed one thousand and no/100ths ($1,000.00) dollars. 4. Calcutta Kitchens will submit an invoice to the Town of five hundred and 00/100 ($500.00) dollars after each demonstration conducted. 5. To the fullest extent permitted by law, Calcutta Kitchens shall indemnify and hold the Town and its officers, agents, consultants, volunteers and employees harmless from and against all claims, damages, losses and expenses, including but not limited to attorneys' fees, arising out of or resulting from the performance of the services under this Agreement by it or anyone acting pursuant to its direction. This obligation shall not be construed to negate, abridge, or otherwise reduce any other right or obligation of indemnity that Calcutta Kitchens otherwise has. 6. If there is a material breach of this Agreement by Calcutta Kitchens, the Town may terminate this Agreement upon three days' notice. Notice of termination can be given by way of electronic communication or written correspondence. Except if there is a material breach by Calcutta Kitchens, either party may terminate this Agreement for any reason or for no reason at all, by giving the other party five days' written notice of the decision to terminate. M I I I III i USTSTOW.W.7 Page 50 of 62 Agreement This agreement entered into on , 2021 between the Greenburgh Nature Center with offices at 99 Dromore Road, Scarsdale, NY 10583 (GNC), the Town of Mamaroneck, a municipal corporation with offices located at 740 West Boston Post Road, Mamaroneck, New York 10543 (Town), the Mamaroneck Union Free School District, a municipal corporation with offices located at 1000 West Boston Post Road, Mamaroneck, New York 10543 (School District) and Larchmont Mamaroneck Community Television, Inc. with offices located at 740 West Boston Post Road, Mamaroneck, New York 10543 (LMC) Recitals Whereas, the Town has received a grant from the State of New York to conduct a Municipal Food Scraps Reduction, Food Donation and Food Scraps Recycling Program (Grant), and Whereas, due to concerns about health while the COVID-19 virus remains a matter of public concern, in lieu of in-person presentations, there will be a series of videos on food scrap reduction, food donation and food recycling performed by representatives of GNC and produced by LMC, and Whereas, the Town will use proceeds of the Grant to pay GNC and LMC for the services each will render, and Whereas, since the services to be rendered are primarily for the benefit of the students and personnel of the School District, the School District will reimburse the Town for such expenditures not covered by the Grant made in connection with this agreement that are approved by the School District before they are incurred, and 1 Page 51 of 62 Now, therefore, intending to be bound, the parties agree to the following: 1. In consultation with the Town, the School District and the persons administering the Grant, GNC shall write and perform scripts for nine (9) videos covering the following topics: a. Plants & Photosynthesis b. What is Climate Change? c. What is Compost? d. Tour of a Compost Pile e. How Does Composting Reduce Greenhouse Gas Emissions f. Tour of Recycling Bins g. Tour of Beekeeping Exhibit h. Tour of Rooftop Gardens i. Tour of Hydroponics System that teach strategies and comprehensive practices (Practices) that can be used by the custodial staff, students, cafeteria staff, food service employees of the School District and others to reduce the amount of wasted food, to sort food scraps and to recycle wasted food. For performance of the services set forth in his paragraph, the Town will pay GNC the sum of four thousand and no/100ths ($4,000.00) dollars, reduced by four hundred forty-five and no/100ths ($445.00) dollars for each video not performed. 2. LMC shall send a sufficient sized and trained crew and the proper equipment to film each performance by the GNC, shall edit each video to a length of time acceptable to the School District representative, Taryn Delaney and shall distribute electronic copies, via email or file transfer, of each video to the School District, Town, and GNC. LMC may retain a copy of each video for its own use. Filming shall commence by August 1, 2021 and the video series shall be delivered by September 30, 2021. For performance of the services set forth in this paragraph, the Town will pay LMC at the 4 Page 52 of 62 rate of fifty and no/100ths ($50.00) dollars per hour for editing the videos and at the rates contained on the annexed schedule for filming and producing such videos. Under no circumstances shall LMC be entitled to receive from the Town more than four thousand and no/100ths ($4,000.00) dollars. 3. If there are expenditures to be made by the Town pursuant to this agreement to GNC or LMC which the Grant money cannot be used to pay or which exceed the amount allocated for these services by the Grant, the Town may request the School District to reimburse the Town for such expenditures before they are incurred. If the School District does not agree to reimburse the Town for such expenditures, the Town shall have the option of either paying or not incurring such expenditures. 4. All of the parties shall have the right to broadcast or show each video and the School District shall deliver to GNC or the Town copies of each video that GNC or the Town requests. 5. GNC, the Town and the School District hereby rescind the agreement regarding the subject matter of this agreement that the three of them entered into on 2019. As required, Ms. Barberio passed the Civil Service test and is reachable on the list. If appointed, she will be required to serve a probationary period of fifty-two (52) weeks. It is recommended that Ms. Barberio be appointed effective June 3, 2021 at an annual salary of $54,693. This position is reflected in the 2021 budget at the stated salary. Ms. Barberio has worked part-time in the Highway Department since January 2020. Her prior work experience includes having worked as a program coordinator for a home care agency for more than ten (10) years and prior to joining the Town she worked as a patient engagement specialist/coordinator for a home care agency in New Jersey. Her current job duties include, responding to resident issues involving roads, sidewalks, trees, sewers, property damages, etc., preparing and processing vouchers, submitting payroll reports, maintaining the Town's fleet roster, ensuring vehicles and equipment are properly insured, registering vehicles with the Department of Motor Vehicles, distributing various reports and mail, responding to internal and external emails and responding to Freedom of Information Law (FOIL) requests, as well as other job duties. In addition, Ms. Barberio provides administrative support to Alan Casterella, General Foreman and Mike Pinto, Fleet Manager. As a full-time employee, Ms. Barberio will be assigned additional responsibilities. According to Mr. Casterella and Mr. Pinto, Ms. Barberio, has proven to be an asset to the overall operations of the Highway Department and Central Garage. Ms. Barberio is a dedicated and conscientious worker and professional in her dealings with staff, as well as the public.
