MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD NOVEMBER 6th,
1974 IN THE AUDITORIUM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

TRIBUTE TO CHARLES J. GRONBERG
"On October 19th three days after our last Board meeting,"
Mrs. Helwig said, "we lost Charles Gronberg who was not
only a mainstay of the Town for the twenty-nine years he
served as Town Clerk but an exemplary public servant, a
man of great knowledge and wisdom, and a friend to all of-
. the people of this Town."
"Charley was always at his post at any hour of the day or
night for he made the Town his life and its people were en-
riched by his decision. He has been greatly missed at
Board meetings and during the times in these past months
when he could not come to the office. It was typical of him
that he came as often as he could because of his devotion to
the Town and his desire to be on his job -- and when he
could not come, he gave much help and direction from his
front porch. I am sure that others on this Board wish to
pay tribute to him and express their sympathy to his sis-
ters and brother too", Mrs. Helwig concluded.
Councilman Vandernoot added that though Charley had
never married, he was one of the greatest "Father fig-
ures" the Town had ever known and Councilman Bloom said
that what had been said certainly typified and represented
the feelings of all of us and we shall all miss Charley very
very much.
A moment of silence was then observed by all present in
honor of Mr. Gronberg, in whose memory the Supervisor
said the meeting would stand adjourned this evening with

an In Memoriam resolution spread upon the minutes in public
tribute to him and sent to his family with the sympathy and
condolences of this Board, the Town staff and all of the resi-
dents of the community.
OLD BUSINESS
1 . Report - Emergency Tenants
Protection Act
The Supervisor stated that following the September 4th hearing,
the Board had given additional study to the information received
in reply to the questionnaires sent to both tenants and landlords
and requested Mr. Vandernoot to speak to this matter since he
had spent a great deal of time in reviewing and analyzing the
answers .
Mr. Vandernoot stated that in going over the tenants' replies
he had particularly noted that there was no evidence of rent
gouging in the Town -- excessive rent increases being definitely
in the minority.
Councilman White then presented a prepared review of the legal
framework of the Act which held that the housing emergency re-
quired for its adoption did not exist in the Town.
Councilman McMillan, in turn, presented a prepared statement
asserting the opposite to be the case, quoting from the Law the
basis for determination of a local "emergency."
The Supervisor then referred to the invitation of the Apartment
Owners' Council to work with the Board in an effort to reach an
agreement that would be mutually beneficial to the tenants and
owners in the Town without recourse to adoption of the Act.
This proposal she said she felt merited serious consideration
and study by the Board prior to adopting the Act inasmuch as
its benefits seemed very uncertain at this time.
Councilman McMillan did not agree and said he felt this offer
was made only because of the pressure now existent in this
situation and he again emphasized that he believed only adop-
tion of the Act could provide the much needed balance be-
tween tenant and landlord in the bargaining position.
During the ensuing discussion, Mrs. Bernard Russell of 18
Mountain Road, Mrs. Jean Kapp of 8 Heather Lane, Mr.
John Ibelli of 987 Palmer Avenue and Mrs. Peggy Snyder of
31 Seton Road addressed questions concerning the question-
naires to the tenants and landlords- to the Supervisor and
Deputy Supervisor and Mr. Irving Scharf of 334 Richbell
Road spoke at length to his position in favor of the adoption
of the Act.
Councilman McMillan then after reiterating his position
moved the adoption of the Emergency Tenants Protection Act
of 1974. There was no second to this motion whereupon it
failed and thereupon Councilman Bloom moved that action on
adoption of the Act be deferred pending the Board's study of

negotiating a rent control agreement with the Apartment Owners
Council. The motion was seconded by Councilman Vandernoot
and thereupon adopted by a majority vote of four"ayes" to one
"naye", Councilman McMillan so voting because of his stand in
the matter.
THE SUPERVISOR --
The Supervisor with the consent of the Board at this time inter-
rupted the regular order of business so as to hear those resi-
dents of Stonewall Lane who had requested an audience this
evening and thereupon recognized Mr. and Mrs. James Banks,
Mr. and Mrs. Fred Claar, Dr. and Mrs. Stanley Drachman
and Mr. and Mrs. Morton H. Green.
Dr. Drachman thanked the Supervisor, and as spokesman for
the group presented a lengthy and detailed request to the Board
for the Town to take over, repair and maintain the two spur
roads leading from Stonewall Lane to their premises which
were located on property owned by Mrs. Idella Marx.
A discussion of some length followed during which each of the
concerned parties discussed various legal aspects of the situ-
ation with the Town Attorney, and which concluded upon the
Board suggesting that the parties concerned meet with the At-
torney with their title reports, easements, etc. so that a fur-
ther effort could be made to resolve this matter.
NOT ON THE AGENDA
Mr. Jerome Osterweil --
Upon recognition, Mr. Osterweil, President of the Little League
again requested a contribution to the League -- suggesting pro-
vision of the long-requested field at Hommocks.
Councilman McMillan suggested that this matter be tabled pend-
ing the Board's receipt of the information it had requested from
Mr. Osterweil regarding the use of the school fields.
Return to Regular Order of Business
The Supervisor then stated that the next matter on the agenda
Item--2 under Old Business on the agenda would now be
considered.
OLD-BUSINESS
2. Fixing Dates of Public Hearings on:
a) Purchase of Trucks - Garbage District No. 1
Pursuant to the Comptroller's request, on motion by Councilman
Vandernoot, seconded by Councilman McMillan, the following
resolution was offered:

WHEREAS, the Town Board of the Town of Ma-
maroneck, Westchestester County, New York,
has had under consideration the purchase of
three 1974 Diamond Reo Model DC 10142
trucks with 18 cubic yard refuse bodies to be
used for garbage and refuse collection purposes
for Refuse and Garbage District No. 1 in said
Town; and
WHEREAS, the amount proposed to be expended
for the purchase of said trucks is $74,940.; and
WHEREAS, it is now desired to call:=a public
hearing pursuant to Section 202-b of the Town
Law upon such matter;
NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of
Mamaroneck, Westchester County, New York
as follows:
Section 1 . A meeting of the Town Board of
Mamaroneck, Westchester County, New York,
will be held at the Weaver Street Firehouse,
Weaver Street in the Town of Mamaroneck, New
York, in said Town, at 8:15 o'clock p.m. ,
Eastern Daylight Saving Time, on the 20th day
of November, 1974, for the purpose of con-
ducting a public hearing upon the aforesaid mat-
ter, at which time and place said Town Board
will hear all persons interested in the subject
matter thereof.
Section 2. The Town Clerk is hereby au-
thorized and directed to cause a notice of said
public hearing to be published once in The Daily
Times, the official newspaper of said Town, and
posted in the manner provided by law, which no-
tice shall be in substantially the following form,
to-wit:
NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Town Board
of the Town. of Mamaroneck, Westchester County,
New York will meet at Weaver Street Firehouse,
in the saidrrTown'on the 20tht day of November,
1974, at 8:15 ;&cl ock p.m. , Eastern Standard
Time, for the purpose of conducting a public
hearing in relation to the proposed purchase of
three 1974 Diamond Reo Model DC 10142 trucks
with 18 cubic yard refuse bodies to be used for
garbage and refuse collection purposes for Refuse
and Garbage District No. 1 in said Twin. The
maximum amount proposed to be expended there-
for is $74,940. , including $2,450. to be provided
by a trade-in of three used vehicles. At such
time and place said Town Board will hear all per-
sons interested in the subject matter of said hearing.

b) Proposed Local Law -- Regulating
and Controlling Police Alarm Systems
Following presentation and brief review of the above proposed
Local Law as revised , in reply to the Supervisor's request
that a date for public hearing thereon be fixed, on motion by
Countilman Bloom and seconded by Councilman White, the
Board unanimously ordered that the hearing be held at the next
regular meeting on November 20th and authorized publication
of the Notice therefor as required by law.
c) Proposed Local Law -- Operation
of Certain Motor Vehicles
Again following presentation and brief review of this proposed
Local Law as revised by Councilmen White and Bloom so as to
be more definitive, on motion by Councilman White and sec-
onded by Councilman Vandernoot, the Board unanimously or-
dered that the hearing thereon be held at the next meeting on
November 20th and authorized publication of the Notice there-
for as required by law.
3. Authorization for Salary Adjustment
Chief of Police
Pursuant to recommendation of the Police Commission presented

by Councilman Vandernoot and herewith ordered received and
filed, on his motion which was seconded by Councilman White,
it was unanimously
RESOLVED, that the salary of Police Chief
Robert M. Barasch be adjusted from
$19,526.00 to $21 ,526.00, to be effective
retroactive to October 1st, 1974.
NEW BUSINESS
1 . Engineer's Request -- Authorization
to Advertise for Bids for Sewer Improvements
Following presentation of a memorandum addressed to the Board
by the Engineer under today's date and herewith ordered re-
ceived and filed, since there were questions on detail which could
not be answered in the Engineer's absence, the Board unani-
mously ordered that this request be tabled pending further re-
port by the Engineer.
2. Salary Authorizations - Recreation
Pursuant to memoranda addressed to the Board by the Superin-
tendent of Recreation under dates of October 28th and November
yth, 1974 herewith presented and ordered received and filed, on
motion by Councilman Vandernoot and seconded by Councilman
McMillan, it was unanimously
RESOLVED, that this Board hereby authorizes
that John Perri, Recreation Assistant for Main-
tenance, and Mercedes Yans, Recreation As-
sistant for Special Education, be compensated
at the rate of $2.80 per hour, effective as of
October 29th, 1974.
3. Authorization to Compensate the Estate
of Charles J. Gronberg for Unused
Vacation Time
Councilman Vandernoot, in requEsting this authorization, said
that as all of the members of the Board were aware, Charley
had served for the past twenty-nine years without ever taking
any vacations and that he therefore recommended that his Es-
tate be compensated in the amount of $3,000.00 for his 1973
and '74 vacations, which he so moved.
Councilman Bloom seconded the motion with the observation
that he felt this was entirely appropriate and thereupon it
was so ordered by unanimous vote of the Board.

COMMUNICATIONS
1 . Letter, Acting Chief Keresey, Larchmont
A letter addressed addressed to Mrs. Helwig by Acting Police
Chief Keresey of the Village of Larchmont under date of Octo-
ber 31st, 1974 commending the Town Police Chief and Detec-
tive Division on their assistance in a Larchmont bank robbery
was presented and ordered received and filed.
2. Letter, Mrs. Betty Franklin
A letter addressed to Mrs. Helwig by Mrs. Franklin under
date of October 31st, 1974 accepting appointment to the .
Commission of Human Rights was presented and herewith or-
dered received and filed.
3. New York State Department of
Transportation Notice - Petition
of Beechmont Bus Service
Upon the Town Attorney's report that no action was needed
by the Town on the foregoing petition, it was herewith or-
dered received and filed.
4. Notice of Meeting - Village of Larchmont
Zoning Board of Appeals
Following the Town Attorney's advice that no action was re-
quired by the Town, the Notice was herewith ordered re-
ceived and filed.

for the month of October, 1974.
Reports of the Receiver of Taxes and Assess-
ments for the months of September and Oc-
tober, 1974.
The Supervisor --
1 . Presentation of Departmental Budget Requests
as filed with the Town Clerk's Office
The Supervisor submitted for the record the Tentative Budget
consisting of the 1975 Departmental Requests as officially

filed in the Town Clerk's office on October 30th, 1974 as re-`
quired by law, and again reviewed the schedule of dates on
the budget as presented at the last meeting.
Mrs. Helwig also explained that these requests represented
everything asked for by all departments and were subject to
concentrated review, modification, and revision by the Tcwn
Board in its preparation of the 1975 Preliminary Budget on
which a public hearing must be held on or before December
10th. Since the date of the first meeting in December had
been changed by resolution at tha last meeting from the 4th
to the 11th, she now requesters that the date of the 11th be
changed to the 10th, Tuesday evening, so that the hearing
could be held in conformance with law. And thereupon on
motion by Councilman White and seconded by Councilman
Bloom, the Board unanimously ordered that the first meet-
ing in December be held on Tuesday, December 10th, 1974
with public hearing on the adoption of the 1975 Preliminary
Budget held on that evening and authorized publication of
the Notice for said hearing as required by law.
2. Authorization for Salary Adjustment
for Lavenia Brewer
"At the beginning of this meeting", the Supervisor said, "we
recognized the impact upon us all of Mr. Gronberg's illness
which began in February and culminated in his untimely
death on October 19th."
"During Village Elections in March, Mrs. Brewer, the Dep-
uty Town Clerk, carried on the necessary work in connection .
with Village Elections under Charley's direction. From the
date of Mr. Gronberg's second admission to the hospital on
May 2nd, she carried on the responsibilities cf the Town
Clerk's office, supervised the necessary work in connection
with redistricting that had been recommended, conducted
the special registration in the summer, the primary election
in September, regular registration in October and in the
past six weeks has performed all of the duties of the Town
Clerk. She has taken no vacation time at all in 1974."
"Without the knowledge of the Town that Lavenia Brewer has
gained in her nineteen years of experience, her personal ded-
ication to serving the people of the Town, and the extraor-
ordinary amount of time beyond the call of duty that she has
given to the duties of the Clerk's office in addition to per-
forming all her usual duties, we could never have met this
crisis. Mrs. Brewer is entitled to our thanks and grati-
tude for an extraordinary performance. In recognition of
the job she has done, I am recommending that Mrs. Brewer's
salary for 1974 be amended to the amount of $15,695. ret-
reactive to May 1st, 1974."
Whereupon on a motion by Councilman Vandernoot and sec-
onded by all of the members of the Board with their thanks
and appreciation, it was unanimously so ordered.

. Request for Assessment Adjustment
(Block 602-Parcel 701)
Pursuant to memorandum addressed to the Board by the As-
sessor under date of July 24th, 1974 and pending until this
date as presented herewith by Mr. Vandernoot and ordered
received and filed for the record, on his motion, seconded by
Councilman White, it was unanimously
RESOLVED, that in accordance with the Board of
Review's approval this Board hereby authorizes
that the assessed value of the property known as
Block 602-Parcel 701 and located at 1941-1959
Palmer Avenue on the Assessment Map of the
Town of Mamaroneck be reduced as follows for the
period 1974-1975:

and be it further
RESOLVED, that in accordance with the recom-
mendation of the Board of Review, this Board
hereby authorizes that the assessed value of this
property for the years 1971-1972, 1972-1973,
and 1973-1974 be adjusted as follows providing
the pending Writs of Certiorari filed for those
years are withdrawn:

2. Petition for Correction of

Pursuant to memorandum addressed to the Board by the As-
sessor under date of October 23rd, 1974 herewith presented
and ordered received and filed for the record, on motion by
Mr. Vandernoot, seconded by Mr. Bloom, it was unanimously
RESOLVED, that pursuant to Subdivision #1 , Sec-
tion 557 of the Westchester County Administrative
Code, this Board hereby authorizes that the Assess-
ment Roll of the Town of Mamaroneck for the year
1974-1975 for 1975 taxes be corrected so as to
read as follows:

3. Apportionment
Upon the Deputy Supervisor's presentation of the following
apportionment herewith ordered received and filed for the
record, on his motion-, seconded by Ccuncilman McMillan,
the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented a peti-
tion for the correction of the assessment roll
for certain years pursuant to the provisions of
Section 557, Subdivision #1 , of the Westches-
ter County Administrative Code,
and
WHEREAS, after due consideration this Board
finds it desirable to grant said petition for the
correction of said assessment roll,
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll of 1973-1974,
2nd half school taxes of 1974, which shows property
now appearing on the roll as follows:

Mr. McMillan reported the receipt of a certified copy of the
resolution adopted by the Village of Mamaroneck approving

the employment of Mrs. Frances Thurston by the Larchmont
Mamaroneck Narcotics Guidance Council which was herewith
ordered received and filed.
ADJOURNMENT
There being no further business to come before the Board,
on motion duly made and seconded, the meeting, to reconvene
on November 20th, 1974, was declared adjourned at 11 :00
o'clock in respect to the memory of --

Town Clerk
and the following resolution, unanimously moved and adopted,
was spread upon the minutes in public and permanent tribute
to Mr. Gronberg with a copy thereof forwarded to his family
with the deepest sympathy of this Board.

In Memoriam
Whereas , Charles J. Gronberg, Town Clerk of the
Town of Mamaroneck since January 1st,
1946, died on October 19th, 1974;
and
Whereas , Charles J. Gronberg served the Town
and all its residents faithfully and zeal-
ously during his twenty-nine years as an
elected public official;
and
Whereas , Charles J. Gronberg served his Country
with exceptional heroism as a member
of the United States Army during World
War II;
and
Whereas , as a private citizen and life-long resi-
dent, he dedicated his life to the better-
ment of the people of the Town and was
ever willing to lend his support to organ-
izations that served the citizens of our
community, especially those that served
our youth;
Now , Therefore , Be It
Resolved , that we, the members of this Board,
herewith record our sense of privilege in
having known and worked with
Charles J. Gronberg; our appreciation
for the many contributions of this extraor-
dinary public servant and our deep sorrow
at the loss of a friend;
and be it further
Resolved , that this meeting stand adjourned in tri-
bute to the memory of --

and that a copy of this resolution be sent

The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.
1 . Claims
Pursuant to memorandum addressed to the Commission by the
Deputy Comptroller under today's date, herewith presented
and ordered received and filed, on motion by Commissioner
Bloom and seconded by Commissioner White, it was

2. Report
Commissioner Bloom presented the following report which was
ordered received and filed for the record:
Fire Report for the month of October, 1974.
3. The Fire Chief --
In response to Commissioner Bloom's question as to whether
there were any matters the Chief would like to present to the
Commission, he reported briefly on the following:

1 . Leaf Fires
The Chief reported on the very large number of fires which
involved leaves -- and requested that everything possible be
done to complete their collection.
In reply, Mr. Aitchison the Highway Superintendent assurred
the Chief that the Highway Department was working steadily
on this and even on Saturdays -- and that the program was
now well along toward completion.
2. Request for Beepers
The Chief reported that the Council was working with Dr.
Grant re this request (the use of Beepers in place of the
fire horn) and would report further as soon as some definite
decision had been reached.
ADJOURNMENT
There being no further business to come before the meeting, it
was declared adjourned at 11 :10 p.m. , to reconvene on Decem-
ber 10th, 1974, on motion unanimously made and seconded.
