C MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD MAY 1st, 1974, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Helwig Deputy Supervisor Vandernoot Councilman White Absent: Councilman Bloom Councilman McMillan Also Present: Mrs. Brewer - Deputy Clerk Mr. Johnston - Town Attorney Mr. Aitchison - Superintendent of Highways Mr. DeLuca - Comptroller Mr. Elfreich - Town Engineer APPROVAL OF MINUTES The minutes of the regular meetings of April 3rd and 17th, 'o 1974 were herewith presented and on motion duly made and seconded, approved as presented. OLD BUSINESS 1. Recreation Superintendent's Memo re April 17th Salary Authorization Pursuant to memorandum addressed to the Board by the Recreation Superintendent under today's date in accordance with the Board's request on April 17th herewith presented and ordered received and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that as recommended by the Recreation Superintendent, this Board hereby authorizes that Bennett Goodman, Recreation Assistant for the Basketball Program, be compensated at the rate of $6. per hour effective as of December 1st, 1973. (Not on the agenda) Pursuant to a second memorandum addressed to the Board under today's date by the Recreation Superintendent and submitted too late to be listed on the agenda herewith presented and ordered received and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that as recommended by the Recreation Superintendent, this Board hereby authorizes John Perri engaged as Recreation Attendant for maintenance be compensated at the rate of $2.50 per hour effective as of April 19th, 1974. - 1 - 256 2. Town Clerk's Report re Revision of Election Districts In the absence of the Town Clerk, Mrs. Helwig presented a re- port addressed to the Board by him under today's date re the division of the Election Districts which read as follows: "On Saturday morning, April 27, 1974, a meeting was held with Mr. Charles Wielgus, Chairman of the Mamaroneck Republican Town Committees Mrs. Saul Moroff, Chairman of the Mamaroneck Demo- cratic Town Committee and the writer to discuss the division of the 7th. , 9th. , and 12th. elec- tion districts. It was agreed to divide the present 9th. district into two districts. A part of the present 7th. district would be put into a new 9th. and the other portion of the 9th. district be called the 26th. The new 9th. district would be bounded on the north by Larchmont Avenue and East Avenue; on the west by the Village of Larchmont boundary line; on the south by Cliff Way, a small part of Stuy- vesant Avenue, and Mayhew Avenue; and on the east by the Boston Post Road. The 26th district will be bounded on the north by Cliff Way, a small part of Stuyvesant Avenue and Mayhew Avenue; on the east by the Boston Post Road; on the south by the Village of Larchmont boundary line and on the west by the Village of Larchmont boundary line. The boundary line for the 12th. election district would be Fenimore Road instead of the present line which is 1500 feet in from Fenimore Road. This would become a part of the present 24th. election district." The Supervisor explained that in the proposed division the pre- sent 9th. district with 873 voters as divided would have 528; the present 7th. district with 624, upon division, would have 350; the new district, the 26th. created from the balance of the present 9th. district, would have 602; the 24th. district now with 291, including the new portion from the present 12th. district would have 494; and the 12th. district, which had 913 voters, would be reduced to 710. She further stated that any presently registered voter would not have to reregister as their registration would be automat- ically transferred prior to the Fall Election. She then called to attention the map attached to Mr. Gronberg's report showing the new boundries and invited anyone interested to examine it more closely at the close of the meeting. Since the Committee had recommended the proposed divisions as set forth, she in- quired the Board's pleasure as to his request for formal approval of these changes. Whereupon on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously - 2 - RESOLVED, that the Election District Map submitted 2 S7 at this meeting, as amended, altering the Seventh and the Ninth Districts so as to add a new Election District to be known as the Twenty-sixth Election District of the Town of Mamaroneck, and also alter- ing the boundaries between the Twelfth and Twenty- fourth Election Districts of the Town of Mamaroneck, be and it hereby is approved: and be it FURTHER RESOLVED, that the boundaries of the said Seventh, Ninth, Twenty-sixth, Twelfth and Twenty- "' Election Districts in the Town of Mamaroneck, as shown on the said map, be and they hereby are de- scribed as follows : DISTRICT NO. 7 Beginning at a point where the center line of the Boston Post Road intersects the center line of Chats- worth Avenue; thence southwesterly along the center line of the Boston Post Road to its intersection with the center line of Larchmont Avenue; thence northwest- erly along the center line of Larchmont Avenue to its intersection with the center line of Palmer Avenue and the center line of East Avenue; thence northwesterly along the center line of East Avenue to its intersec- tion of the center line of North Avenue; thence north- westerly along the prolongation of the center line of East Avenue to its intersection with the center line of the Metropolitan Transportation Authority property; thence northeasterly along the center line of the said Metropolitan Transportation Authority property to its intersection with the center line of Chatsworth Avenue; thence southeasterly along the center line of Chatsworth Avenue to its intersection with the center line of the Boston Post Road and the point or place of beginning. DISTRICT NO. 12 Beginning at a point where the center line of Fen- imore Road intersects the Village of Mamaroneck-Town of Mamaroneck boundary line; thence southwesterly along said boundary line to its intersection with the center line of Rockland Avenue; thence westerly along the center line of Rockland Avenue to its intersection with the center line of Forest Avenue; thence south- easterly along the center line of Forest Avenue to its intersection with the center line of Holly Place; thence southwesterly along the center line of Holly Place to its intersection with the center line of Sheldrake Ave- nue; thence southerly along the center line of Sheldrake Avenue to its intersection with the center line of Forest Avenue; thence southwesterly along the center line of Forest Avenue to its intersection with the center line of Weaver Street; thence northerly along the center line of Weaver Street to its intersection with the Village of Scarsdale-Town of Mamaroneck boundary line; thence north- easterly along said boundary line to its intersection with the center line of Fenimore Road; thence southeasterly along the center line of Fenimore Road of its intersection with the Village of Mamaroneck-Town of Mamaroneck boundary line and the point or place of beginning. DISTRICT NO. 24 Beginning at a point where the boundary lines of the Town of Mamaroneck, Village of Mamaroneck and the Town of Harrison intersect; thence southeasterly along the said boundary line between the Village of Mamaroneck and the Town of Mamaroneck to its intersection with the center line of Fenimore Road; thence northwesterly along the center line of Fenimore Road to its intersection with the Village of Scarsdale-Town of Mamaroneck boundary line; thence northeasterly along said boundary line to its inter- section with the boundary line of the Town of Harrison; thence southerly along said boundary line to its intersection with the boundary line of the Village of Mamaroneck and the point or place of beginning. - 4 - Mrs. Shultz, upon recognition, inquired how many voters there were in each district at the present time? The Supervisor re- plied about 600 explaining that a division was requested by the County Board of Elections at such times as districts were in ex- cess of 950 maximum or in some cases to further accommodate the convenience of the voters. Mrs.. Shultz then inquired whether the Board had formally adopted the renumbering of Fenimore Road and if so, when it was effective? In reply, Mrs. Helwig said that it had been adopted on September 5th, 1973 to be effective as of July 1, 1974. 3. Engineer's Memo re Air Structure The Engineer reported verbally that the specifications and plans for the Air Structure at Hommocks were practically completed and that he expected to release them on May 8th with a bid date of May 21st and report thereon to the Board at its June 5th Meeting. NEW BUSINESS 1. Salary Authorization - Assistant Maintenance Man Pursuant to memorandum of the Board of Police Commissioners under date of April 23rd herewith presented and ordered re- ceived and filed, on motion by Councilman Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that this Board hereby authorizes that Michael Bruno of 111 Harmon Drive, Larchmont, be engaged as Assistant Mainten- ance Man to assist Ben Seagraves and to be compensated at the rate of $2.75 per hour effective as of May 20th, 1974. 2. Authorization - Police Chief Attend N.Y.S. Chiefs of Police Conference Pursuant to memorandum of the Police Commission under date of April 27th herewith presented and ordered received and filed, on motion by Councilman White, seconded by Councilman Vandernoot, it was unanimously RESOLVED, that this Board hereby authorizes that expenses in an amount not to exceed $75.00 be paid from the proper item in the 1974 Town of Mamaroneck Police Budget for the Police Chief's attendance of the N.Y.S. Annual Chiefs of Police Conference at the Pines Hotel in Monticello from August 11th - 16th, 1974; and be it further RESOLVED, that the use of car #5 is authorized for this trip. 3. Authorization - Sergeant Diamond & Detective Fuller Attend Tear Gas Seminar Pursuant to memorandum of the Board of Police Commissioners under date of April 27th, 1974 herewith presented and ordered received and filed, on motion by Councilman Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that this Board hereby authorizes that expenses in an amount not to exceed $150.00 each be paid from the proper item in the 1974 Police Department budget for Sergeant Peter Diamond and Detective Robert Fuller's attendance of a Tear Gas Seminar at the Ramada Inn, Indiana, Pennsylvania, June 17th - 19th, 1974; - 5 - and be it further RESOLVED, that the use of car #9 is authorized for this trip. 4. Authorization - Microfilming Records for Bicentennial by New York State The Supervisor presented to the Board an Agreement from the New York State American Revolution Bicentennial Commission re- " questing that the Town Clerk, as the official custodian of the Town of Mamaroneck records, be authorized to execute the Agree- ment with the State on behalf of the Town for the microfilming of the old Town records, which on motion by Councilman Vandernoot, seconded by Councilman White, was unanimously so ordered. 5. Authorization - Parade Murray Avenue School Country Day Fair The Supervisor reviewed a letter addressed to her by Mrs. Carol F. Cameron, Chairwoman of the Murray Avenue School Country Day Fair to be held at the School on May 18th, re- questing permission to open the Fair with a short ten-minute parade in front of the school at 10:45 a.m. as had been done last year. This request, she said, had been referred to Com- missioner Dennison of the County Public Works, the Police Chief and the Fire Chief from whom all of the necessary clearances had been received. Mrs. Helwig then inquired as to the Board's pleasure, where- upon on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously resolved that the request be approved in accordance with the conditions set forth in Com- missioner Dennison's letter of April 22nd, 1974, with a copy IIIthereof forwarded to Mrs. Cameron with copy of this resolution. 6. Authorization - Engineer & Highway Superintendent Attend A.P.W.A. Conference Pursuant to a memorandum Of the Town Engineer addressed to the Town Board under date of May 1st, 1974 herewith presented and ordered received and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that this Board hereby authorizes Mr. Charles Elfreich, Mr. William Aitchison and Mr. Morris Bufi to attend the Spring Meeting of the American Public Works Assoc- iation at Hicksville, L.I. , New York, on Wednesday, May 22nd, 1974 with expenses to be paid by the Town in an amount not to ex- ceed the sum of $54.00. COMMUNICATIONS 1. Letter of Resignation - Mrs. Rex Vincent, III Park Commission The Supervisor presented a letter tendering Mrs. Rex Vincent's resignation as a member of the Board of Park Commissioners, to be effective as of May 1st, because of moving to Georgia which was herewith ordered received and filed for the record. Each of the members of the Board expressed their regret and paid tribute to Mrs. Vincent for her many contributions to this community during the years she had served with such dedi- cation and ability and on motion unanimously made and seconded, adopted the following resolution to be spread upon the minutes of this meeting in public tribute to her: - 6 - WHEREAS, Mrs. Rex Vincent, a member of 2 61 the Board of Park Commissioners of Park District No. 1 of the Town of Mamaroneck since herappointment on January 2nd, 1963, has tendered her resignation, effect- ive as of May 1st, 1974, because she is leaving our community; and WHEREAS, during all of these years she has served not only on the Commission but as liaison to the Conservation Advisory Committee with great distinction; and WHEREAS, she has given freely of her time and talents and contributed much both to the beauty and usefulness of our parks which are enjoyed by our residents and admired by all who visit our Town; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck hereby accepts her resignation with deep regret and records its appreciation of the distinguished service and many contri- butions Mrs. Vincent has made to this community and its residents through her long and able ser- vice as a member of our Park Commission; and be it further RESOLVED, that this resolution be spread upon the minutes of this meeting as a public record of tribute to her, and that a copy thereof be forwarded to Mrs. Vincent with the thanks and gratitude of this Board and very best wishes to her in her new home and community. 2. Letter Mrs. H. W. Kapp - Ball Playing on Public Street Mrs. Helwig referred to a letter addressed to the Board by Mrs. H. W. Kapp of 6 Heather Lane under date of April 21st, 1974 con- cerning ball playing on public streets which was herewith ordered received and filed for the record. She called on the Attorney to whom the matter had been referred previously whereupon he stated that the Vehicule and Traffic Law by definition indicated that public streets were for the use of vehicular traffic only. For this reason, he said, it would seem that a local ordinance prohibiting ball playing in the street as requested by Mrs. Kapp was unnecessary and would be redundant. Mrs. Helwig then added that the Police Chief -had advised her that the patrols had been increased in the area of concern and further that Youth Officer Perritano had personally visited with the resi- dents to point out the hazards to the children as well as the ille- gality of using the public streets for play purposes. Councilman White stated that he understood Mrs. Kapp lived in a part of the Town where there were many many children and therefore could sympathize with her--but he agreed with the Town Attorney that an ordinance was not necessary. He further said, however, that increased patrols should be kept and that everything possible to make Mrs. Kapp's life easier and to keep the children safe should continue to be done. - 7 - 24;2 3. Notice of Hearing - Village of Mamaroneck Indoor Tennis Facility Receipt of the Notice of Public Hearing to be held by the Board of Trustees of the Village of Mamaroneck on the proposed Indoor Tennis Facility was herewith noted for the record and the Super- visor reported that in accordance with the Board's direction at the last Meeting, both the Attorney and the Planning Board Chair- man would attend the Hearing to register the Town's official ob- i' to the proposal. The Supervisor also noted for the record that she had received one more letter protesting the proposed facility from Mr. Walter E. Kolb of 10 Dudley Lane. 4. Notice of Hearing--Town of Harrison Rezoning A Notice of Public Hearing on the adoption of the proposed amended Zoning Ordinance of the Town of Harrison to be held on May 8th, 1974 was herewith presented and ordered received and filed since no adverse effect on the Town was anticipated from the proposed amended Zoning Ordinance. REPORTS The Town Clerk-- The Deputy Clerk presented the following reports which were ordered received and filed. Report of the Building and Plumbing Inspector for the month of April, 1974. Report of the Westchester Shore Humane Society, Inc. for the month of April, 1974. Report of the Municipal Dog Patrol for the month of April, 1974. Affidavit of Publication of the Annual Report of the Supervisor for 1973 in The Daily Times on April 17th, 1974. The Supervisor-- 1. Report on Safety Legislation a) Report on Safety Legislation For informational purposes, the Supervisor reviewed the pro- posed bill (S 7003) relating to installation of certain safety equipment on certain buses and other motor vehicles--which bill had been called to the Board's attention by Mrs. Susan Newman at the last Meeting. After some discussion, the Board unanimously agreed that any action on this bill be held pending the receipt of further information. b) County Home Rule Bill The Supervisor reported that this bill had been reported out of the Assembly Committee but that she had been unable to ascertain this evening whether or not it had as yet been reported out of the Senate Committee. - 8 - 3 2. Invitation - Interim Committee on Coalition of Larger Towns Mrs. Helwig reported to the Board that she was planning to attend a meeting in Smithtown on Monday, May 13th, 1974 which had been called by Supervisor Fitzpatrick with refer- ence to establishing an Interim Committee of Larger Towns within the New York State Association of Towns. The Deputy Supervisor-- 1. Assessor's Petition Correct Assessment Roll Pursuant to the Assessor's petition addressed to the Board under date of April 23rd, 1974 herewith presented and ordered received and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that pursuant to the provisions of Sub-Division #1, Section #557 of the Westchester County Administrative Code and in accordance with the petition of the Town Assessor, this Board hereby authorizes the correction of an erroneous assessment on the 1973-74 Assess- ment Roll for 1974 taxes from $12,600. to $7,600. for Veterans' Exemption from Real Property Taxation on the premises owned by Thomas A. Wallace, 6 Nancy Lane, Larchmont, New York, and known as Block 402, Parcel 306, on the Tax Assessment Roll of the Town of Mamaroneck. 2. Notice of Meeting re Equalization - Westchester County Tax Commission Mr. Vandernoot reported receipt of a Notice of Meeting re Equalization to be held by Chairman John W. Lane of the West- chester Tax Commission on May 13th :, 1974 and Mr. Doyle and he would attend. The Town Attorney-- 1. Report on Title Search - Jefferson Street The Attorney reported that the Title Guarantee Company had rendered its report on the title search on the Jefferson Street properties which was presently being reviewed by the Town Assessor and Engineer. ADJOURNMENT There being no further business to come before the meeting on motion duly made and seconded, it was declared adjourned at 9:10 p.m. , to reconvene on May 15th, 1974. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board Meeting. 1. Claims Upon presentation for payment by Commissioner Vandernoot and on his motion, seconded by Commissioner White, it was unanimously - 9 - RESOLVED, that this Commission hereby authorizes payment of the following Fire Department Claims as approved by the Fire Chief and audited by the Comptroller's office: Brigante Lawnmowers $ 8.10 Con Edison Co. of N.Y. , Inc. West. 240.98 Excelsior Garage & Machine Works, Inc. 339.68 New York Telephone Co. 11.34 Plaza Plaza Pharmacy 26.18 Roberts 517.10 William Smith Supplies, Inc. 99.90 $ 1,243.28 2. Reports Commissioner Vandernoot presented the Fire Department Report for the month of April 1974 which was ordered received and filed for the record. 3. Other Business - Fireman Ronald D. De Cositno At the Supervisor's invitation, Fireman De Cosimo reported on the progress of the proposed establishment of a local district Burn Center at the New Rochelle Hospital, requesting the Board's support for the project. He stated that the proposed unit would cost between $125,000. and $150,000. and take some 6 months to establish. In reply to a question as to whether a formal fund-raising cam- paign had been established, Mr. De Cosimo stated that although as of this date no formal newsletter had been issued, $5,000. had been received. The Supervisor asked Mr. De Cosimo whether she was correct that what he was seeking was the moral support--not financial support of the Commission and upon Mr. De Cosimo's affirmative reply, in- quired as to the Board's pleasure. Whereupon, on motion by Commissioner Vandernoot, seconded by Com- missioner White, it was unanimously RESOLVED, that the Board of Fire Com- missioners of the Town of Mamaroneck does hereby endorse and heartily sup- port the proposed establishment of a local District Burn Center at the New Rochelle Hospital. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:15 p.m. , to reconvene on May 15th, 1974.
