Robert Wassman, Chairman Robert 'merman Edward Z. Jacobson Joan Williams Absent: James Fleming Pamela Washington Also present: Barry Weprin, Town Councilman Stephen V. Altieri, Town Administrator CAH TO ORDER The meeting was called to order by Chairman Wassman at 8:00 PM. APPROVAL OF MINUTES On motion of Mrs. Williams, seconded by Mr. Wassman, the minutes for July 21, 1994 were unanimously approved. AGENDA CHANGE Mr. Wassman announced that as a moratorium for decisions about cellular telephone antennas had been passed by the Town Board, he would deal with the application of the Eleven Alden Tenants Corp. first. ELEVEN ALDEN TENANTS CORP. - Alden House - 11 Alden Road - Block 404 Lot 131 - Cellular installation. Mr. Wassman announced that the Town's Counsel, Steven Silverberg, had stated that the matter was not to be heard. David Snyder, attorney for the corporation, ask permission to address the Board. He stated that, in his opinion, the BAR was not covered in the new law. Mr. Snyder took exception to Mr. Silverberg's condition and stated that he felt that his client's rights under due process were being violated. On motion of Mr. Wassman, seconded by Mr. 'merman, the Board unanimously agreed with Mr. Silverberg's instructions. Pending a receipt of a written opinion to the contrary, the Board adjourned the matter to the next meeting. NEXT MEETING The Board set its next meeting for September 22, 1994. Board of Architectural Review August 18, 1994 -2- DJ LARCH REALTY TRUST - (Larchmont Diner) - 2399 Boston Post Road - Block 505 Lot 433 - Approve plans for facade, sign and rear addition Mrs. Bonsteel explained that only one final plan had been provided as a courtesy to the chairman as the application had been previously approved by the Board. Mrs. Williams stated that she felt each member should have gotten plans in advance of the meeting. The members were not satisfied with this drawing and requested that the applicant submit one with a more appropriate site presentation and sign information. On motion of Mr. Wassman, seconded by Mr. 'merman, the matter was unanimously adjourned to the next meeting. DOCS - 1380 Boston Post Road - Block 409 Lot 192 - Landscaping and Site Plan. Prior to the meeting, the applicant had requested an adjournment to the September meeting. PIZZA AND BREW - 1262 Boston Post Road - Block 407 Lot 192 - Facade John Racanelli, owner and builder, appeared. He submitted color copies of as-built pictures. Mr. Immerman complained about the many changes made during construction; Mrs. Bonsteel stated that the applicant had been issued a Notice of Violation. Mr. Racanelli stated that he wanted to satisfy this Board and that changes to the approved plans had been made because of an inaccurate survey and structural limitations discovered during the building process. Mr. 'merman had kept his modified drawing and noted that the windows did not match those approved; that a single door had been okayed, not a double one; that little coach lights had been installed without permission; that the facade sign band installed seemed to be out of kilter with the other sign bands in the shopping center; that it was not installed centered between piers; and that the sign was differently made than the sign design approved. Mr. Wassman was annoyed that there were no as-built drawings submitted by the applicant. He asked Mr. Racanelli to submit drawings to this Board that will show the lights, the location of the sign and its style, the arrangement of the windows and a cross-section of the structure that caused the variation in the windows. On motion of Mr. Wassman, seconded by Mr. Jacobson, this matter was unanimously adjourned to the September meeting. Board of Architectural Review August 18, 1994 -3- MAMARONECK UNIT OWNERS' CORP. - Mamaroneck Gardens - 100 Richbell Road Block 408 Lot 290 - Apartment alterations. Roy Raved, builder, appeared for the corporation. He stated that ten years ago storage roans had been converted to apartments and that the new owners wanted to legalize this use. The area way needs to be updated for access to the apartments; the corporation will plant shrubs there. On motion of Mrs. Williams, seconded by Mr. Immmerrnan, the Board unanimously accepted Drawing A-2 of the applicant and stipulated the planting of yews which shall be 4 feet tall, 3 feet on center. TOWN OF MAMARONECK - Hammocks Park Apartments - Hammocks Road - Block 411 Lot 169 - Landscaping Stephen V. Altieri, Town Administrator, appeared. He stated that the landscaping plan had been reviewed and that it was decided to plant more trees and shrubs along Boston Post Road and Hammocks Road. These plans have been submitted to the State Department of Transportation, but so far DOT has been commenting on traffic problems. Mr. Altieri stated that the Town would replace any tree that does not survive and that he anticipated making a presentation, probably in September, to this Board concerning the consolidation and uniformity of signage for the Town/School facilities at the corner. He anticipated that there would be monument signs. Liselotte Novak, owner of 1353 Boston Post Road, appeared. She complained about the fence installed at Blockbuster without prior notice to her but had no problems with the apartment landscaping. On motion of Mrs. Williams, seconded by Mr. Wassman, the Board unanimously approved Drawing No. SD-4, dated 7/19/94 for landscaping at Hammocks Park apartments. ADJOURNMENT On motion of Mr. Jacobson, seconded by Mr. Wassman, the members unanimously adjourned the meeting at 8:58 PM. Bonnie M. Burdick, Recording Sec'y
