Robert Wassman, Chairman Robert Immerman James Fleming Edward Z. Jacobson Pamela Washington Joan Williams Also present: William E. Jakubowski, Building Inspector William J. Gerety, Assistant Building Inspector CALL TO ORDER The meeting was called to order by Chairman Wassman at 8:03 PM. APPROVAL OF MINUTES On motion of Mr. Jacobson, seconded by Mr. Immerman, the Minutes of April 20, 1995 were approved as corrected. TAI YUNG YAO - d/b/a Danny King Restaurant - 176 Myrtle Boulevard - Block 133 Lot 642 - Sign. Mr. Tai appeared, accompanied by Michael Mutari of Signmaster of Yonkers and Dr. and Mrs. John McIntyre, owners of the building. Mr. Mutari explained that it was proposed to use the existing sign box with blue lettering and a translucent white background. Mr. Wassman stated that the building was a poor example of architecture in the Town and wondered whether something could be done about the sign at Riviera Hair Stylists. The members questioned the size of some of the words and requested that only one type face be used. The Mclntyres want to fix up the front of their building and submitted a brochure with an example of a paving stone. They were requested to bring in a list of the plantings for the proposed planting beds. On motion of Mr. Wassman, seconded by Mrs. Washington, the following resolution was unanimously adopted. Board of Architectural Review June 15, 1995 -2- WHEREAS, Tai Yung Yao, d/b/a Danny King Restaurant, has submitted an application to the Building Inspector, together with plans, for a sign on the premises located at 176 Myrtle Boulevard and known on the Tax Assessment Map of the Town of Mamaroneck as Block 133 Lot 642; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that review by the Board of Architectural Review is required; and WHEREAS, Mr. Tai submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; NOW, THEREFORE BE IT RESOLVED, that an application for a sign for Danny King Restaurant located at 176 Myrtle Boulevard, said premises being known and designated on the Tax Assessment Map of the Town of Mamaroneck as Block 133 Lot 642, be and the same is granted with the following conditions: 1. The lettering shall be an opaque blue, matching the submitted sample, on a translucent white background. 2. All letters shall be in Helvetica style. 3. The first row of letters, "Danny King" shall be 5 inches high; the second row of letters, "Chinese & Japanese Food" shall be 7 inches high; and "Take Out", "833-2967" and "Free Delivery" shall be 3 inches high. "Tel:" shall be eliminated from the plan. 4. The sign may be illuminated at a later date. 5. This sign permission is temporary and is granted for only 90 days conditioned upon the owners' plans to upgrade the sidewalk in front of the building 6. Planting beds shall be installed by the owners as per plans filed with Building Department. 7. The extraneous fixtures above the sign for Riviera Hair Stylists shall be removed. Board of Architectural Review June 15, 1995 -3- DHILLON SINGH d/b/a Max (Gasoline Station) - 2517 Boston Post Road - Block 504 Lot 642 - Sign. Mr. Singh appeared. Mr. Wassman stated that the planting area is in deplorable condition and that the shrubs have been worn into the ground which is something that did not happen with a few weeks of neglected watering. Mr. Jacobson found the red and black colors to be harsh and wondered why the colors on the gas pumps were red and green. Mr. Singh stated that Max is a brand of gasoline which nineteen other stations in the area sell. Mr. Jakubowski stated that there is a violation against the property for the sign change and the condition of the premises. Solac Realty, the owner, has made application for a Special Permit which will be heard at the July Planning Board meeting. Said permit cannot be issued until the violations are cleared up. The members reiterated some of the problems at the site. The grass is too high and fifty per cent of the planting is dead and must be replaced. Richard Coico, President of the Pryer Manor Association, appeared. He stated that the maintenance is deplorable and that there is an abundance of litter. On motion of Mr. Immerman, seconded by Mr. Jacobson, the following resolution was unanimously adopted. WHEREAS, Dhillon Singh, d/b/a Max (Gasoline Station), has submitted an application to the Building Inspector, together with plans, for a sign on the premises located at 2517 Boston Post Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 504 Lot 101; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that review by the Board of Architectural Review is required; and WHEREAS, Mr. Singh submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; NOW, THEREFORE BE IT RESOLVED, that an application for a sign for the Max Gasoline Station located at 2517 Boston Post Road, said premises being known and designated on the Tax Assessment Map of the Town of Mamaroneck as Block 504 Lot 101, be and the same is denied. Board of Architectural Review June 15, 1995 -4- The members requested that the applicant use the color scheme from the gasoline pumps and design the monument sign to confirm with the sign law. JOHN CALDARARO -d/b/a J.B. Tiptons - 1420 Boston Post Road - Block 409 Lot 131 - Window logos. Mr. Fleming recused himself from the deliberations as he was the architect for the project and was representing the ownership of the building as President of the 11 Alden Road Tenants Association. Mr. Immerman noted that this application was another instance of business people installing something without approval of the Board of Architectural Review, and Mrs. Washington suggested instituting a financial penalty for such occurrences. Mr. Caldararo and Mr. Fleming stated that a craftsman who had been etching glass dividers on the interior of the restaurant had placed initials on the door and four window panes at a time when neither Mr. Caldararo or Mr. Fleming was on the site. Mr. Wassman reminded the Board that the Gap had been denied logo installations. Mr. Immerman found the initials to be most unattractive and that their impact dilutes the presentation made by the applicant previously. He stated that a completely different style of graphics was being used. Mr. Jakubowski read the relevant portions from the Sign Ordinance (Definitions and 11 E), and the Board agreed that the logos were illegal. He stated that the applicant would need to go to the Zoning Board for permission for the logos. When the open items for the restaurant were enumerated, Mr. Fleming stated that the owners and the tenant, Quadrille Realty, want to preserve the pediment on the corner of the building. When asked about a temporary Certificate of Occupancy to facilitate the scheduled opening, Mr. Jakubowski stated that he was reluctant to give a temporary Certificate of Occupancy in the summer when planting can be done without payment of a large bond. There was a great deal of vituperation expressed by Mr. Fleming. He claimed that the building ownership was being held hostage and made a veiled threat to sue the Board and, by extension, the Town. Mr. Fleming stated that it was the intention of the ownership of the apartment building to make a great many cosmetic changes to the structure. It was his contention that the BAR had used the leverage of the sign approval to add many issues that were not on the table. The Board members reiterated their desire for the applicant and the building management to comply with the conditions of the past approval and stated that as there were no alternate plans available for review they could not consider changes. Mr. Jakubowski stated that he wanted to consult the Town Counsel on these issues and suggested that a special meeting of the BAR might be necessary. Board of Architectural Review June 15, 1995 -5- When faced with more delay in getting the Certificate of Occupancy, Mr. Caldararo stated that he had already invested $100,000.00 in the restaurant and that he was withdrawing his application. Mr. Wassman stated his regret at this course of events. The following resolution was approved by the consensus of the Board although no vote was taken. WHEREAS, John Caldararo, d/b/a J. B. Tiptons restaurant, has submitted an application to the Building Inspector, together with plans, for five sandblasted logos on the premises located at 1420 Boston Post Road (11 Alden Road) and known on the Tax Assessment Map of the Town of Mamaroneck as Block 409 Lot 131; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that review by the Board of Architectural Review is required; and WHEREAS, Mr. Caldararo submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; NOW, THEREFORE BE IT RESOLVED, that an application for five logos for J. B. Tiptons restaurant located at 1420 Boston Post Road (11 Alden Road), said premises being known and designated on the Tax Assessment Map of the Town of Mamaroneck as Block 409 Lot 131, is referred to the Planning Board for variance. No vote was taken, and the matter was adjourned pending further submission by the applicant. On motion of Mr. Wassman, seconded by Mrs. Williams, this matter was unanimously adjourned pending further submission by the applicant.
