AMENDED MINUTES OF THE REGULAR MEETING OF THE BOARD OF ARCHITECTURAL REVIEW OF THE TOWN OF MAMARONECK FEBRUARY 18, 1999, IN THE SENIOR CENTER, TOWN CENTER 740 WEST BOSTON POST ROAD, MAMARONECK, NEW YORK Present: Robert M. The meeting was called to order by Acting Chairman Immerman at 8:00 p.m. 8 1 APPROVAL OF MINUTES Mr. Immerman asked if the Board had reviewed the Minutes of the January 21, 1999 Board meeting, and if there were any additions and/or corrections. After some discussion and corrections noted, the Minutes of that meeting will be held over until the next Board, as there are not enough people present who were at that meeting. Mr. Immerman officially welcomed the new Board member, Sue Ellen Commender, to the meeting. Chairman Immerman informed the Board that the COUGHLIN GROUP, INC./John M. Coughlin- 178 Myrtle Boulevard - Block 133 Lot 627.2 - sign (adjourned 1/21/99) has requested an adjournment. Chairman Immerman read the application as follows: COUNTRY CURTAINS/Edward Robinson - 1331 Boston Post Road - Block 411 Lot 119 - signs; facade Ed Robinson of Country Curtains appeared to address the Board, along with Marilyn Hansen also of Country Curtains. Mr. Robinson informed the Board that County Curtains is a mail-order business that currently has nineteen retail stores in the northeast and would like to open a store at the above location. He said also present is Carlos Eglar from the sign company, Capital Awnings, in Jamaica, Queens, who made up a sample sign for the Board to consider. Mr. Robinson said the "T" is 18 in., they have asked for 24 in. lettering as the small "o" is actually about 50% or 6 in. and would like the small lettering to be 12 in. After some discussion among the board members and Ms. Hansen regarding lettering size, Ms. Hansen said that the upper case will be at 2 ft., the lower case will be at 1 ft. Ms. Washington asked Ms. Hansen to give the Board some information about the size of the old lettering. Ms. Hansen said she believes it was at 21/2 ft., at which time a discussion ensued regarding the size of the lettering on the awning. Board of Architectural Review February 18, 1999 Page 2 Mr. Wassman said a comparison should not be made to the sign that was previously there, because that was before there was a sign ordinance. Any comparisons would be irrelevant, with which Mr. Carpaneto agreed. Mr. Immerman said the elevation does not show the top of the letter lined up and said he assumes the drawing is more accurate than the sample, at which time a discussion ensued regarding same. Mr. Spagnola questions the suggestion that the awning, which presently wraps all the way around the building on three sides, will have a major impact; it is all blue and the proposal is to remove a portion and make it a new color. He doesn't like the blue, thinks the green is much nicer but feels the Board really has to consider it because there are other stores around the corner that are consistent with the color. Mr. Spagnola said the applicant is saying the awning is not going to light up,just the letters, and asked if that is correct. Mr. Eglar said just the lettering will light up. Mr. Spagnola said the entire awning lights up at this point. What is going to happen is that it is going to go three-quarters and stop, then go dark, with lighted letters. He thinks it will look really bad for the whole building. Country Curtains might look good, but the rest of the building will not. After further discussion, Ms. Hansen said they can make the awning return. Mr. Wassman said he has been very disturbed about the Blockbuster awning being illuminated and what it is. Mr. Spagnola said he thinks going with a dark, non-illuminated material and not illuminated letters is much better. Mr. Wassman asked if the Board can encourage that to happen for the rest of the building. Mr. Immerman said he does not know, the owner is not present to say if they are willing to do that. The Board continued discussing encouraging this to happen, hoping to make an improvement of the overall properties. Mr. Spagnola asked if green is the corporate color. Mr. Robinson said that the corporate colors are beige and brown. A discussion ensued regarding the choice of the color blue used for Blockbuster. Mr. Immerman asked if the applicant would be uncomfortable considering the blue with the white letters? Ms. Hansen had an actual piece of the fabric, which the Board looked at. Ms. Commender said one of the blue fabrics is close to the blue that exists now. Mr. Eglar said the light is going to come from the bottom. Mr. Spagnola said that whatever color is decided upon for Country Curtains, the material is different, it is an opaque material, as opposed to what exists next door. He thinks what the Board is saying that if it Q is blue during the day, it will be a little bit better than the proposed green. On the other hand, blues never match. Board of Architectural Review February 18, 1999 Page 3 ® Ms. Hansen said it was considered too, having the green next to the blue, and how it might look. Two people back at the home office that work with colors all the time felt comfortable that the blue and the green would not be too drastic. Mr. Immerman said one of the concerns the Board has been asked in the past, is to try to be consistent in single properties and signage. He thinks going from blue to green is not in keeping with that degree of consistency. Mr. Spagnola asked for an explanation of how the awnings that exist are going to be terminated at the junction point and asked if a new end is being recreated for the Blockbuster. Ms. Hansen said yes and explained the procedure to the Board, along with Mr. Eglar who said it will be a one piece awning. The Board members said no matter what color, it is going to look strange. After further discussion, Mr. Spagnola said the question is whether the Board is going to ask that this be consistent with what currently exists or not. Ms. Washington feels this is the opportunity to suggest to the applicant what the Board wants it to do. Mr. Spagnola said he goes on the record that if the Board agrees that this is going in the direction as stated, there is no way they are not going to let the rest of the building match what currently exists, with which the Board agreed, whenever any changes are to be made to the adjacent awnings. © Mr. Immerman said he would be only too happy if that would happen. Mr. Spagnola said it is an exceptionally important corner and all the Board knows it. Mr. Wassman said as far as being consistent or following the rules of dedication about uniformity and conformance, some bold steps must be taken to get the corner property re-established in the proper identification. A discussion ensued regarding joining this kind of awning, preferably in blue, with two different colored materials with a physical reveal space between the two or a channel. A modest channel reveal was recommended. Mr. Spagnola said the white letters on the dark field will be a very elegant look. Ms. Hansen informed the Board about arrangements made that the signage will be prepared, contingent upon Board approval of the selected awning color. Mr. Immerman said rather than make the applicant wait a month for an additional submission of colors, a similar approval can be granted as done for 1-800-Flowers who sent a new drawing, it was delivered round-robin and eventually signed off on. Mr. Robinson asked what the Board was more interested in. Mr. Spagnola said he thinks the darker navy would be best. It will not be matched, is still dark, you will see the contrast and it is still in the family. Ms. Immerman asked if there were any other issues about the logo. Ms. Commender asked a question about the front of the building. In the application there is a flower box. She asked if Ms. Hansen is considering something like that in the front of this store. Board of Architectural Review February 18, 1999 Page 4 OMs. Hansen said sure. Mr. Robinson said it can be done in the rear entrance also. Mr. Wassman said Ms. Commender brings to this Board something they have not had for a while, some aesthetic choice in landscaping and the Board looks to her for guidance in that way. A discussion ensued about the drive-through and how individuals were using that to drop off returns to Blockbuster. Ms. Hansen said she understood that in the plan for redoing Hommocks Road, a portion will be lost. On a motion made by Ms. Washington, seconded by Mr. Spagnola, the following resolution was unanimously ADOPTED: WHEREAS, Country Curtains Retail,Inc. has submitted an application to the Building Inspector, together with plans to remove and recover the existing vinyl waterfall awning with green canvass to which will be affixed COUNTRY CURTAINS in white lettering. A new awning with a COUNTRY CURTAINS sign will be installed over the rear entrance; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that the review by the Board of Architectural Review is required; and WHEREAS, Country Curtains Retail, Inc. submitted an application for approval to the Board; and © WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; and NOW, THEREFORE, BE IT RESOLVED, that the subject application be and the same is GRANTED, subject to the following conditions: 1. The awning on the Boston Post Road and Old Hommocks Road front facade of the building be approved with the amendments discussed as follows: a. The color be changed to a dark blue; b. The lettering and the style of the sign is accepted as presented on the drawing; c. There be a one inch channel reveal where the Country Curtain sign joins the Blockbuster Video sign. d. There will be planters in the front of the building toward the sides of the doors. Mr. Immerman asked who is responsible for restoring the underside, and that should be addressed. Ms. Hansen said it has not yet been unveiled, so they don't know exactly what they are up against. The Board then addressed the next application for Country Curtains, the rear facade site improvements. Ms. Washington said that she liked the computer drawing showing the metal window and sidelight and country curtains, then she sees the residential looking wooden door and she is having difficulty seeing this with the back elevation. Board of Architectural Review February 18, 1999 Page 5 Mr. Immerman said he thought it was going to be all glass. Ms. Hansen said it shows all glass, but they did use an oak door on the back of another stucco building and explained the details. Ms. Hansen said it is a big improvement. Mr. Robinson explained the doors on the drawing before the Board. Mr. Spagnola said he has a hard time with the shape of the awning in relation to the flat, stream-lined structure. A lengthy discussion ensued regarding the shape of the awning, the position of the awning and where it ends. The proposed doors were then discussed. Mr. Robinson said the door done in Manhassett is actually a wood door that has one strip of light over the door knob and more for protection for people as they are exiting the store to see if there is someone coming in. It is a narrower piece of glass. It is a more commercial looking door, but it has a wood look to it and one light for protection. Ms. Hansen said a glass and metal door can be done in the back. Mr. Immerman said that the pictures says new glass door, metal frame and sidelight and asked if that is what is what Ms. Hansen is willing to do at this point, with which Ms. Hansen agreed. Mr. Immerman asked if Ms. Hansen will have the logo as shown on the waterfall awning. Ms. Hansen said the two lines will require a variance from the Zoning Board of Appeals, because only one line is allowed. If they used one line, it would be cramped. Mr. Immerman asked if the garage door is going to be repainted. Ms. Hansen said it will probably be repainted. Mr. Immerman said it is a terrible parking lot, and with the people coming and going from Blockbuster egress can be a problem. Mr. Robinson said they are only going to be opened one evening, which is a Thursday night. Most of the Blockbuster traffic is just after dinner. They don't anticipate too much congestion. Mr. Immerman asked whose garage it is. Mr. Robinson said the garage is Season's Too. It goes into their storage. Ms. Washington asked about the side door. Mr. Immerman asked if the side door is just a service entrance. Mr. Robinson said it is just a service entrance to be used by the employees, deliveries and to the stock area. ® Mr. Immerman hopes there is enough dimension to get a reasonable stair. Mr. Robinson said it was looked at. Mr. Immerman said the whole side shown in the picture is a disgrace. Board of Architectural Review February 18, 1999 Page 6 IIIMs. Commender said including the wall. The wall needs stuccoing. The trees need to be looked at. Ms. Hansen said she agrees with the Board 100%. Mr. Immerman said there is a panel in the front, covered with plywood. Ms. Hansen said that will be taken care of. It is part of this application. Mr. Immerman asked about the type of door there. Ms. Hansen said a plain metal door will be put there and trimmed out. Mr. Wassman asked what happens over the top. Ms. Hansen said Mrs. Novack had said she was going to do some work along that side of the building, and she volunteered to clean up the side to make it accessible for seven cars to park. Mr. Immerman wants to go on record, since it is not Ms. Hansen's responsibility, stating that the side of the building needs to be cleaned up including all of the electric service. Ms. Commender said that the trees are not in good shape. Ms. Hansen asked Mr. Carpaneto if there is a bylaw for cutting down the trees in the front. Mr. Carpaneto said yes, the Town has a Tree Ordinance. IIIMr. Wassman stated he wished somehow the Board could petition the landlord to do the things the Board wants done in improving the building. After review and discussion, on a motion made by Mr. Spagnola, seconded by Ms. Washington, the following resolution was unanimously ADOPTED: WHEREAS, Country Curtains Retail,Inc.has submitted an application to the Building Inspector, together with plans for lighting, facade and site improvements; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that the review by the Board of Architectural Review is required; and WHEREAS, Country Curtains Retail, Inc. submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; and NOW, THEREFORE, BE IT RESOLVED,that the subject application be and the same is GRANTED, subject to the following conditions: 1. At the rear entrance to the parking lot the owners will be permitted to match the front awnings proposed,the curve shape coming 3 ft.off the building as shown in the drawing. • 2. The fabric will match the final selected fabric to be used in the front of the building. 3. The lettering will be in two lines as shown on the drawings, in white. Board of Architectural Review February 18, 1999 Page 7 © 4. The door will be glass with metal frame sidelight in the rear entrance. 5. Flower boxes installed in the back. 6. The top of the proposed awning at the rear entry door facing the parking lot should align with the top line of the adjacent openings. 7. The side employee entrance door on Old Hommocks Road will be a white painted door. 8. The Board is asking the owner to look into cleaning up the side of the building, restore and paint the facade, look at the condition of the trees and the exposed wiring on the side and the mechanical openings on the facade. 9. Close off the opening in the front and stucco it, which is now just painted plywood. 10. Install a more modern looking single overhead light above the side entry door for the employees. 11. The entry door will be a flat painted door, not paneled. Ms. Washington commented on the work to be performed in the three bathrooms. Ms. Commender commented on her concerns in the front building regarding the trees and some sort of balance, at which time a discussion ensued regarding that issue. She suggested on the corner of Hommocks Road and the Boston Post Road be edged with Belgium Block to be uniform around the front. © Acting Chairman Immerman read the next application as follows: NEW YORK SPORTS CLUBS/Anthony Fodera - 13-19 Madison Avenue -Block 132 Lot 469-signs Mr. Immerman said there are two issues, one is a directory sign for the shopping center and the other is signage on the building. He asked Mr. Carpaneto if there is a question about the two signs at that location since there is a sign on the Thruway entrance/exit near the corner. Mr. Carpaneto said there is no question nor a problem. It is the front, a separate street, Maxwell Avenue. Mr. Spagnola said the store fronts on that street. Mr. Carpaneto said Mr. Spagnola is referring to the fact that the sign is not on that store. Mr. Carpaneto said he thinks it is alright because there is a frontage on the building, at which time a discussion ensued regarding that fact. Mr. Immerman asked the Board to first discuss the building signage and asked the applicant to make his presentation, before the Board raises their questions and comments. Bernard Giarraputo, a partner in the L.S. Sign Company, Brooklyn, New York, appeared and addressed the Board on behalf of the New York Sports Club, along with Ned Ferrarone, the owner of 13-19 Madison Avenue. Mr. Giarraputo said the front of the building will have the corporate logo, NYSC, which is an illuminated box. The letters will be neon channel letters, above the windows,illuminated by red neon, with red covers and a white return. The trough is whatever color is on the building, so it blends into the building. Ms. Washington asked where the nearest NYSC located. Mr. Giarraputo said there is a NYSC in Mamaroneck, next to the Sound Federal on Palmer. Board of Architectural Review February 18, 1999 Page 8 © Mr. Spagnola asked if there was similar signage in Mamaroneck, which Ms. Washington verified. Mr. Giarraputo said they also have, to blend in the storefront at other locations in Croton,New Brunswick, and Danbury as well, a blue and yellow line. The line will be the same height, divided in half by the blue and yellow. Mr. Immerman asked if it was a painted line, which was verified by Mr. Giarraputo. He said it will only be the height of the letter "N". Ms. Washington asked about the square footage. Mr. Carpaneto said the signage is 100 sq. ft. per frontage. Mr. Giarraputo said it is a less lighted area than what presently exists, which will be coming down. Ms. Commender asked if there is some limitation to linear ft. Mr. Carpaneto read from the code, that regardless of the size of lettering or frontage of the property may a sign exceed 100 sq. ft. It is limited to 100 sq. ft. The length of the size has nothing to do with it. Ms. Commender then referred to Section 175-11B, which states that no sign shall exceed fifty(50) ft. and more than one (1) sign for each business establishment is permitted, provided that the combined signs do not exceed the maximum limitations for a single sign for each frontage. She said the proposed signage comes to 87.6 ft. as she included the stripe. Ms. Commender was concerned about the relationship of the length of the proposed sign to the side wall, as Mr. Ferrarone said there was a setback with another 20 ft. ® of wall, so that the space was viewed "larger" as one drove by. A lengthy discussion ensued regarding the lines on the building. Mr. Spagnola asked what is on the windows where it says New York Sports Club. Mr. Giarraputo said that is frosted glass. Mr. Immerman said you cannot frost glass, put lettering on it and not count it as signage. Mr. Spagnola said there are existing lines on the windows and possibly they are considering taking those down and installing the frosted material for more privacy. He does not think they should have big letters along the bottom. Mr. Immerman said he does not think that is permitted under the Sign Ordinance. It was stated, at this time, that that is not part of the application. Mr. Immerman said he is not sure if the placement of the sign above might change or not, because the applicant has left out two (2) doors which the drawing doesn't show. He asked if the applicant wants to shift anything or not. Mr. Giarraputo said nothing will be shifted. The placement will stay the same. Mr. Immerman said a drawing was presented to the Board that is inaccurate. © Mr. Giarraputo said he would like to center the stripe over the occupied space. Ms. Washington asked if anything would be kept over the door. Mr. Giarraputo said no. Board of Architectural Review February 18, 1999 Page 9 ® Mr. Immerman feels the logo belongs over the door. Mr. Wassman asked if the word entrance will be put over the door. Mr. Giarraputo said no, as it has been used for ten years. Mr. Immerman said he has a more pressing concern. He said this sign with its bright red letters is going to face a lot of residential windows and he has concern that it is going to be disturbing to all those apartments because the bright red will be more contrasting than the existing sign. Presently those residents are complaining about the Coughlin lighted sign which is not a neon illuminated sign,just a sign with a flood light on the side of his building. Mr. Immerman would like to know how it can be toned down. Mr. Giarraputo said he can use a translucent film on the inside, as used in hospitals, facing a residential area. Inside the letter a red translucent film is laminated, which knocks it down a little bit. Ms. Commender said the other doors have a black and white look and then red and asked if it blends in with the rest of the shopping center. Mr. Giarraputo said the red is New York Sport's Clubs corporate colors. He said when it is a red logo and white background, blue lettering is used. Whenever it is channel lettering, they use red lettering with a white return. Mr. Wassman made a comparison to the Lexus signage and said the number of letters in the red as proposed to be used on this signage will be a very glaring bright light unless it is substantially suppressed. It should be 20 footcandles at 25 ft. and said that should not be exceeded. © Mr. Immerman said this is going to make the Washington Square apartment residents very unhappy. Mr. Giarraputo said the sign that exists is 3 ft. and what is proposed is only a 12 in. letter. Mr. Wassman said it is the redness. He thinks Mr. Giarraputo's idea is rather impressive, but would not worry about it relating to the other two signs which are very insignificant, that being the liquor store and cleaners. Mr. Giarraputo said initially the neighbors complained about the brightness of the signage on the roof underneath the parking lot and the angles were changed which worked out pretty well. Mr. Spagnola would like to propose doing away with the striping on the side. He doesn't know if it is really needed, it is not consistently used on all New York Sport's Club sites. The applicant has a 23 ft. illuminated sign, plus the 4 ft. 6 in. logo which is going to be illuminated. It is exceeding the length, and he would rather eliminate it completely. Mr. Spagnola doesn't think it is necessary at all. He thinks the red letters used the way they are will be nice and clean looking, bright and sporty. In addition, the applicant is not proposing to do it on all the sides. Mr. Spagnola asked if the lines are a part of the total square footage or is it another whole facade. Mr. Carpaneto said it can be added together in the percentage. A discussion ensued regarding the square footage. Mr. Immerman said there is something inaccurate about the drawing, because there is not a flat parapet on the elevation. Mr. Giarraputo said it can be seen clearly in the photographs. Mr. Immerman said the applicant has to define how high the sign is and what the overall height is, as the parapet changes height. • Board of Architectural Review February 18, 1999 Page 10 ® Ms. Washington said she thinks the sign has to be the height of the cleaner's sign. Mr. Spagnola said the size of the sign on the side of the building is 20 ft. long. In front it shows 23 ft. long. Mr. Giarraputo said it is the smaller one. The "K" in the front is 18 in., on the side it will be 16 in. Mr. Immerman asked if the height of the letters is the same. Mr. Giarraputo said no, the detail is shown on the submitted sheets. Mr. Immerman summarized this matter, stating the Board approved the logo and channel letters with the turning down of the degree of illumination. The logo will be shifted to be centered between the two (2) doors on the left. Eliminate the blue and yellow and its aluminum channel. Remove any designation of New York Sports Club from the inside of the windows,because that counts as the sign and is not permitted in the sign code that is on the front parking lot elevation. On the side elevation, revisit the accurate building height and then move the New York Sports Club sign toward the rear leaving about 6 ft. from the edge. No stripe on the side either. Mr. Immerman said he cannot answer accurately what the relation should be, because there is not an accurate elevation. Ideally, the bottom of it ought to line up with the bottom of front signs, if it works. The problem is that the parapet is lower. Mr. Giarraputo said why not make it centered from the store front window, the top of the parapet wall, and centered between there, as you will not see it as it is so far to the back of the building. You won't see both of them together. A lengthy discussion ensued regarding this matter. Mr. Immerman said all the signs will be the same reduced intensity. On a motion made by Ms. Washington, seconded by Mr. Wassman, the following resolution was unanimously ADOPTED: WHEREAS, New York Sports Clubs have submitted an application to the Building Inspector, together with plans to install one new illuminated logo and letters/side wall - exposure to I-95 exit; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that the review by the Board of Architectural Review is required; and WHEREAS, New York Sports Clubs submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; and NOW, THEREFORE, BE IT RESOLVED, that the subject application be and the same is GRANTED,subject to the following conditions: 1. Approved the logo and channel letters with the turning down of the degree of illumination. 2. The logo will be shifted to be centered between the two (2) doors on the left. 1101 3. Remove any designation of New York Sports Club from the inside of the windows, because that counts as the sign and is not permitted in the sign code that is on the front parking lot elevation. 5. Mr. Immerman said the Board now has to review the directory sign. Mr. Giarraputo reviewed with the Board the application and pictures submitted regarding this sign. Mr. Immerman asked how thick the sign is. Mr. Giarraputo said sign is 10 in. deep. Mr. Wassman asked Mr. Giarraputo to describe the sign, which he proceeded to do. A lengthy discussion ensued regarding whether it is a pole or directory sign, using the Staples sign as an example. Mr. Giarraputo said the sign is very important, because the building is set back more than 125 ft. When traveling down Myrtle Boulevard, the italian restaurant on the corner of the building blocks out the frontage. Mr. Spagnola reiterated that the sign is an all white back-lit background with all black letters, with which Mr. Giarraputo agreed. Mr. Giarraputo continued to discuss the colors of the signage and the reversing of the lines around the sign. Ms. Commender said she thought the code stated that a logo cannot be on a sign. Mr. Wassman requested that this part of the application be deferred without prejudice to allow the Board time to research the law on this matter. A discussion then ensued regarding the interpretation of a pole sign. Mr. Carpaneto said he can seek input from the Zoning Board attorney on this matter. Mr. Giarraputo asked if he could continue with the presentation on the layout and if it is determined that it is a pole sign at least the layout will be approved. Mr. Wassman said if it has to be a monument sign,he may not want that layout. There is also the question about the use of a logo on this sign, which also has to be researched as well. He does not feel a fair decision can be rendered on this application. After further discussion, Mr. Immerman said considering the application does not make any sense. If it is not a pole sign but a directory sign, it cannot have a logo on a directory and the applicant will have to come back with a revision without the logo. A legal determination is needed whether it is a pole sign or not a pole sign. If it is not a pole sign and is a directory sign, then the application can be resubmitted without the logo. If it is a pole sign, then the applicant will have to determine what to submit. Mr. Wassman said the applicant can ask for a temporary sign. On a motion duly made and seconded, it was unanimously RESOLVED, that this matter, to remove existing free-standing sign/utilizing the same pole and erect a new sign, be and hereby is, adjourned to the March 18, 1999 meeting. Mr. Immerman asked if there was any other business. Mr. Spagnola asked if they are planning on painting the 1-800-Flowers in green. Mr. Carpaneto said he did not have the application this evening to answer that question. After some discussion, Mr. Spagnola asked that Mr. Carpaneto check into this matter. Mr. Immerman had Minutes of the meetings regarding this matter, and said it stated that the canopy will be repaired and painted a beige color that works with the existing brick. There will be an accent stripe in the same olive green that is proposed to be used for the base. Mr. Washington said the very top canopy is supposed to be green.
