HomeMy WebLinkAbout1995_08_17 Board of Architectural Review Minutes AMENDED MINUTES OF THE REGULAR MEETING OF THE BOARD OF ARCHITECTURAL REVIEW OF THE TOWN OF MAMARONECK AUGUST 17, 1995, IN THE SENIOR CENTER, TOWN CENTER 740 WEST BOSTON POST ROAD, MAMARONECK, NEW YORK Present: E. Jacobson Also present: Marguerite Roma Recording Secretary CALL TO ORDER The meeting was called to order by Chairman Wassman at 8:00 P.M. APPROVAL OF MINUTES Mr. Wassman stated there would be no Minutes submitted for review or approval due to the change of staff, and the review and approval of previous Minutes will be postponed to the next meeting. Mr. Wassman announced to the applicants that any decision reached this evening, even though there is a quorum of 3 members present, will have to be a unanimous decision. Also, any applicant may withdraw his application without prejudice for a later hearing when there may or may not be more than a quorum present. Mr. Wassman also advised the applicants that the conditions which the Board of Architectural Review (B.A.R.) sets will have to be complied with. Any questions should subsequently be checked by the applicant with the Building Department to clarify what the conditions are. There will be no issuance of any Certificate of Occupancy (CO) until all of the conditions are complied with. Movie Stars - 1298 Boston Post Road - Block 410 Lot 463 - sign application and store front. Bob Lewis with White Plains sign appeared with Chris McDonald of Movie Stars, who is in charge of development in different areas. Mr. Lewis discussed a change on the plans, the red lettering stating "The Entertainment Superstore," is being omitted from the sign. Mr. Lewis presented a new sign proposal for a sign with corporate logo, orange/yellow/green, a 3-dimensional affect. The maximum height of the letters are 2 ft. 2 in., lower case are scaled down, the length is 7 ft. Sign will be centered over the entrance way. A small notification about return deposit is to be placed on door of drop box "6 x 12", "drop tapes here" and the lower portion a black aluminum surface, and Board of Architectural Review August 17, 1995 Page 2 black around all windows and doors. A detailed discussion followed. Mr. Lewis showed a sample of the channel letter, demonstrating the illumination. Ms. Williams asked about the colors across the sign. Mr. Lewis agreed to use the red, grading to the yellow colors, the same as CVS red. Mr. Jakubowski discussed the border around the letters, which will be purple around the letters. Mr. Lewis said they will match the existing sides, then incorporate purple on the panel. The three signs shown on the drawings were not presented, i.e. the MOOVIE posters, which are interior signs and not regulated by the Board. Ms. Williams questioned the need for the signs. Mr. Lewis stated it was for illustration purposes only, utilizing less than 25% of space. A detailed discussion followed regarding merchandizing in the area. On a motion made of Mr. Wassman and seconded by Ms. Williams, the following resolution was unanimously approved: WHEREAS, Chris McDonald of Movie Stars has submitted an application to the Building Inspector, together with plans for a sign application and store front on the premises located at 1298 Boston Post Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 410 Lot 463; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that review by the Board of Architectural Review is required; and WHEREAS, Mr. McDonald has submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; and NOW, THEREFORE, BE IT RESOLVED, that the subject application be and the same is granted with the following conditions: 1. That the application that had been submitted was amended to delete the words, "The Entertainment Superstore," retaining only the word MOOVIES centered above the main entrance door; 2. The sign MOOVIES will retain the shaded color scheme going from red to yellow, starting with the red similar to CVS; 3. The sign lettering size will be similar to the anodized surface of the CVS signs; 4. The back unilluminated image of the sign will be a shadowed green and purple backdrop; Board of Architectural Review August 17, 1995 Page 3 5. The existing door will be eliminated with a glass upper half placed as shown; the lower half being black aluminum similar to the new aluminum store front with a letter drop and lettering similar to, "drop tapes here;" 6. The drop will be about 6 in. by 12 in. and the letters will be approximately 2 in. characters; 7. It was noted that the other store fronts in this facade are all clear anodized aluminum. This is black, but it is perfectly appropriate because it is in the front that already has dark green marble; 8. The wood will be taken out, marble will be buffed and refinished. Clock Tower Associates - 2 Madison Avenue - Block 133 Lot 602 - modification of previous B.A.R. approval for one window. Mr. Wassman restated there were three members present, and any decision reached this evening must be unanimous, or held over for a meeting when more members are present without any prejudice, if the applicant desired. Bob Stanziale, architect from New Rochelle, spoke representing the applicant. The initial approval was granted December 8, 1994 for the replacement of the windows on the second floor of the Madison Avenue elevation of Washington Square and the short return around the building facing the apartment building. There are various type windows. The replaced windows were all supposed to be Type 4 windows, 4 ft. wide, but because of the smaller size windows that go around the bend, 2 ft. 10 in. wide, there were no windows in Type 4 to match, so a decision was made to have a window fabricated to match the others with a fixed top and a small hopper on the bottom that would match the Type 4 windows approved for installation, Type 5 which is narrower than the others. Ultimately, within the next year or two, all of these windows will be replaced on the second floor because of the poor condition of same. Also, small planters were installed in lieu of trees that were recommended at the December 8, 1994 meeting. Mr. Immerman said it was very clear in the requirements that the one window on the east curved should not be changed unless all of them were going to be done, the owner clearly didn't follow the resolution, and that is totally inappropriate and in total disrespect to this Board, and the only condition on which he will accept is with the proviso that remaining windows on the curve are changed to match. A detailed discussion ensued. The Board concurred with Mr. Immerman, providing a reasonable time, say one year, was agreed upon. Mr. Jakubowski said if granted, we should insure compliance and a C.O. cannot be issued until it is complied with, and a cash bond of $4,000 should be posted to insure work will progress as stated above. Board of Architectural Review August 17, 1995 Page 4 Mr. Immerman suggested that this matter be carried over to the next meeting to give Mr. Stanziale an opportunity to discuss the matter with the applicant. Mr. Immerman made a motion to adjourn this case to the next meeting of the B.A.R. for the convenience of the applicant which was seconded and approved. J&F Chatsworth, Ltd. (Joe Sparano) - 1 Vine Street- Block 126 Lot 730 - new sign. Mr. Wassman stated he didn't feel this application was sufficient to reach an agreement this evening in favor of the applicant. The Board should have an elevation of the building, not just a section of this building. The conditions are that we have pictures of the building and we have a submission of the sign on the building and that is not on this application and that we have colors of the sign. If those elements are going to be submitted now, we may be able to proceed. Joe Sparano, owner of J&F Chatsworth, appeared and stated that he wanted to replace the Citgo sign with a new smaller "Gulf" sign. Irwin Nighterman, SOS Fuel Oil, Director of Developmental Marketing, representing Gulf to assist Mr. Sparano in getting his station branded as a Gulf station appeared. He stated that the sign presented is smaller than the existing sign, it removes signs on islands and has Gulf's colors which cannot be changed. Mr. Wassman stated that the B.A.R. does not have to approve a submission simply because it is a company's logo. A detailed discussion ensued regarding the many colors on the sign. Insert words in a single color, with the proper letter size, but not all the credit cards. The size is enormous, 7 ft. x 7 1/2 ft., the former sign was larger. Mr. Sparano mentioned other stations and signs which were located in the Villages of Mamaroneck and Larchmont. Ms. Williams stated this B.A.R. is for the Unincorporated Town of Mamaroneck and acts to implement the Town's ordinance and sign law. Mr. Jakubowski read the denial, stating the sign as proposed is not conforming pursuant to Section 11 which would restrict the maximum height of a sign to 32 in. Further, the applicant must provide documentation that sizing for all the signs on the building related to this tenancy do not exceed 100 sq. ft. total area. Mr. Jakubowski stated there is no documentation as to what is on the building. He stated the Gulf symbol exceeds the maximum height of pictorial matter, which is 24 in. The sign is proposed at 6 ft. 2 1/8 in. high, which exceeds the 32 in. maximum height allowed pursuant to 11 B, and removable price numbers constitute a temporary sign condition and are prohibited by Section 7 G and 13 and definitions pursuant to Section 4. Further, the use of more than two type faces on the sign are prohibited pursuant to Section 8 D(4) and the colors are not a minimum pursuant to Section 8 D(5). Mr. Jakubowski stated that the applicants are before the B.A.R. for them to make a recommendation to the Zoning Board regarding what is acceptable to the B.A.R. A Board of Architectural Review August 17, 1995 Page 5 discussion followed. It was suggested to the applicant the Board will refer the matter over to the Zoning Board. A discussion followed. Ms. Williams would like to do away with the temporary pricing, credit card and just have a Gulf sign. Ms. Williams asked about all the other lettering on the building. Mr. Jakubowski stated it is probably nonconforming, and in two and one-half years it would have to come off, under the new sign law. Mr. Immerman affirmed. Mr. Wassman suggested the applicant does not have an overall presentation and the Board is trying to define the overall recommendation to the Zoning Board, the matter should be postponed. A discussed followed regarding signs in the windows. Mr. Immerman would like to make a recommendation to the Zoning Board that a variance be considered to a 6 ft. round Gulf sign centered above the garage door, and that all nonconforming signage on the overall building, and any new signage comply, with our Architectural Review Board's sign code. Mr. Jakubowski said a permanent sign on glass of 8 sq. ft. is allowed. On a motion duly made and seconded by Ms. Williams, the following resolution was unanimously approved to go before the Zoning Board: WHEREAS, Joe Sparano of J&F Chatsworth, Ltd. has submitted an application to the Building Inspector, together with plans for a new sign on the premises located at 1 Vine Street and known on the Tax Assessment Map of the Town of Mamaroneck as Block 126 Lot 730; and WHEREAS, the Building Inspector has declined to issue such permit on the grounds that review by the Board of Architectural Review is required; and WHEREAS, Mr. Sparano has submitted an application for approval to the Board; and WHEREAS, this Board has examined the plans, inspected the site, reviewed the application and has heard all persons interested in this application; and NOW, THEREFORE, BE IT RESOLVED, that the subject application be and the same is granted with the following conditions: 1. The recommendation will be made for a backlighted Gulf sign 6 ft. in diameter; 2. all other signs must comply with the sign code; 3. the total square footage be 100 sq. ft.; Board of Architectural Review August 17, 1995 Page 6 4. color and character of letters to be in the same character of Gulf; 5. the station will have two pumps; and 6. there will be no canopies over the pumps. Mr. Jakubowski will inspect the existing signs, measure the square footage. Mr. Jakubowksi asked the applicant to submit some better pictures of the building, so that the Zoning Board can view them. MISCELLANEOUS MATTERS Mr. Immerman asked a question about a sign at the rear of Chatsworth Gardens apartment's parking lot. Mr. Jakubowski will investigate the signage at 16 North Chatsworth.
