TOWN OF MAMARONECK,
held, July 20th, 1921.
The meeting was called to order by Supervisor Burton
at 9.10 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Collins, Dudley and Shafer.
Deputy Clerk Sherman,
Counsellor Gamble.
Upon motion, the minutes of the meetings of May 18th,
25th, June 1st and 15th, 1921, were read and approved.
Supervisor Burton officially notified the Town Board
of the death of John C .Fairchild, Town Clerk whereupon the
following resolution was offered by Justice Dudley and seconded
by Justice Collins:
WHEREAS, this Town Board has learned with
deep regret of the death of John C.Fair-
child, for years Town Clerk of the Town
of Mamaroneck; and
WHEREAS, we his associates in town affairs,
who have worked with him, respected and
loved him for his many good qualities; and
WHEREAS, we desire to record in the
minutes of the Town Board the esteem and
regard in which we, his associates held
him, and likewise recored the unfailing
courtesy and willingness with which he
despatched all his duties as Town Clerk
for so many years, therefore be it
RESOLVED, that we, the members of the
Town Board, herewith record our deep
sorrow at the death of John C. Fairchild
Town Clerk of the Town of Mamaroneck, and
be it further
RESOLVED, that we express to his wife and
family our sincere and heartfelt sympathy,
and be it further
RESOLVED, that a copy of this resolution,
suitably inscribed, be sent to his family
and likewise be published in the public
press.
The question being taken upon the foregoing resolution,
same was unanimously carried.
The report of the Receiver of Taxes for the month of
June, 1921, was received, read ordered placed on file and is
as follow:

The report of the Building Commision of the Town of
Mamaroneck, was received, read, ordered placed on file
and is as follows:

I herewith report the amount of fees collected by
the Building Commission of the Town of Mamaroneck from the period
beginning May 27th, 1921 and ending June 24th, 1921 as follows:
Permits for the recetion and altering of buildings $39.00
Permits for blasting, 75.00

The Police report for the month of June, showing 30
arrests with fines amounting to $350.00 and reporting 11 lights

Supervisor.
A communication was received from the County Clerk in
relation to the designation of polling places and primary districts.
The matter was refdtred to the Clerk to be taken up at the next
meeting.
The Clerk presented a policy insuring the furniture and
fixtures in the Town Clerk's office. Same was ordered received
filed with the Clerk and the bill submitted to the Board of Aud-
itors for payment.
A statement of canvass of the special election held
at the Weaver Street fire house was received from the Board of
Inspectors of said election and after being read, it was moved
that the return be spread upon the minutes and filed with the
Town Clerk, and is as follows:
STATEMENT OF CANVAS
of the votes cast in Fire Dist.#1, of the Town of Mamaroneck, at
a special election called for the purpose, pursuant to Chapter
561 of the Laws of 1921, State of New York, which became a law
May 4th, 1921.
SUBJECT
"Shall Fire District 1 of the Town of Mamaroneck acquire a site
by private purchase or condemnation and construct a new fire house
in said district at a cost of not to exceed Sixty Five Thousand
dollars?
Votes in favor of proposition. 85
Votes against proposition, 58
Votes blank on proposition, 0
Total votes cast on proposition, 143

We, the undersigned, election officers duly appointed,
hereby ceftify that we have canvassed the vote cast for the prop-
osition "Shall Fire district #1 of the Town of Mamaroneck acquire
a site by private purchase or condemnation, and construct a new
fire house in said district at a cost of not to exceed Sixty five
thousand dollars?" and that the foregoing is a true and correct
statement thereof.

The Board of Sewer Commissioners of Sewer District #1
of the Town of Mamaroneck appeared before the Board and they
reported the amount of the cost of construction of the Sewer dispoal
plant and outlet sewer, determined as required by law, and
requested the Board to direct the issue and sale of bonds pursuant
to statute. They filed with the Board the report of said cost
reading as follows:-

Town of Mamaroneck,
8 Elm Street, Mamaroneck, N.Y.
Gentlemen:
On July 11th this Commission opened bids for the
construction of sewage disposal plant and outfall sewer. Based
on these estimates and the amounts heretofore expended and
contracted for, in the nature of Engineer's fees, real estate,
easements and rights of way, we herewith respectfully report to
you the amount of the cost of construction of the disposal plant
and outfall sewer, including the items above named, Sewer District
#1, Town of Mamaroneck, will be $130,000.00

We therefore request that you direct the issue and sale
of bonds for the aforesaid amount herein reported.

Upon motion, duly seconded it was
RESOLVED, that the report of the Sewer
Commissioners of Sewer district #1
of the Town of Mamaroneck be filed with
the Town Clerk.
CARRIED.
The Board then discussed the report and request of the
Sewer Commissioners that the Board authorize the issuance and
sale of $130,000.00 sewer district bonds.
Upon motion, duly seconded, it was
RESOLVED, that Counsel be and he hereby
is authorized and directed to prepare
resolutions to authorize the
issuance and sale of $130,000.00 sewer
district #1 bonds, pursuant to law and
it was
Further Resolved, that a special meeting
of the Board be called and held on July
29th, 1921, for consideration and action
upon the aforesaid resolutions.
The question being taken upon the foregoing resolution,
same was upon ROLL CALL, unanimously carried.
Judge Taylor was present and spoke in relation to
tax sales of 1885 and 1886 for the taxes of 1884 and 1885 of
lots 117 and 118 map of Hawley D. Clapp, showing receipts of
Supervisor Banta purporting to cover said items as being paid
whereupon the following resolution was presented:
WHEREAS, it appears from the records
of the receiver of Taxes that taxes
for the years 1888 and 1885 on lots
Nos 117 and 118 on map of Grand Park
Central subdivision, Town of Marnaro-
neck have never been marked paid, and
WHEREAS, said lots were sold to the
Town of Mamaroneck at tax sales held
October 5th, 1885 for the taxes for the
year 1884 and October 4th, 1886 for
taxes for the year 1885, and
WHEREAS, the present owner of the
aforesaid lots has now presented to
this Board a receipt dated December 15th,
1888 signed by M. Banta, Supervisor of
the Town of Mamaroneck at time, purport-
ing to show the payment of $19.91 and
$21.54 respectively in payment of the
taxes and other amounts due thereon,
which payments it appears have never
been noted it the records, now therefore
be it
RESOLVED, that the Supervisor and the
Receiver of Taxes, be and they hereby
are authorized and directed to mark the
the taxes for the years 1884 and 1885
on lots Nos 117 and 118 on map of Grand
Park, central subdivision, map of Hawley
Clapp, McIntyre Farms, Town of Mamaro-
neck, on his records as being paid in
accordance with aforesaid receipts.
The question being taken upon the foregoing resolution,
same was upon ROLL CALL unanimously adopted.
Messrs. Whitaker, Merritt and Moore a Committee from the
Weaver Street Fire Company was present and presented recommend-
ations in relation to the new fire house.
Upon motion, duly seconded it was
RESOLVED, that the Supervisor be
authorized and empowered to appoint
a Committee of 3 for the purpose
of securing options on property for
a site for the new fire house.
The question being taken upon the foregoing resolution,
same was upon ROLL CALL unanimously carried.
The Supervisor thereupon appointed Justice Collins,
Mr.Whitaker and himself.
Mr. Danz of the Weaver Street Fire Company was present
and spoke in relation to the new fire alarm system to be installed
in the new building.
Upon motion, duly seconded, it was
VOTED, that a Committee of 3 be
appointed to investigate and report
in relation to the installation of
fire alarm system in the new fire
house.
CARRIED,
The Supervisor thereupon appointed Justice Shafer,
Justice Dudley and Mr.Danz.
The Supervisor informed the Board that Section 130
of the Town Law of the State of New York, provided,®
"When a vacancy shall occur or exist in
a town office, the Town Board or a maj-
ority of them may, by an instrument
under their hands and seals, appoint a
suitable person to fill the vacancy
said person so appointed to hold office
during the unexpired term which term
will expire on the 31st day of December
next succeeding.
After discussion, the Town Board executed an instrument
under their hands and seals, pursuant to Section 130 of the Town
Law of the State of New York, duly appointed Frederick M'Sherman

THEREFORE, be it RESOLVED, that the Town
Board does hereby approve and confirm
the action of a majority of the Town Board
in appointing Frederick M,Sherman Town
Clerk for the unexpired term of office
until December 31st, 1921, and be it
FURTHER RESOLVED, that a copy of said
appointment be forthwith filed in the
office of the Town Clerk; and be it
FURTHER RESOLVED, that the salary of the
Town Clerk be and the same hereby is
fixed at Two Thousand Daollars(t2000.00)
per year, payable monthly, beginning
