MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD SEPTEMBER 1, 1976, IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 P.M.

PUBLIC HEARING (adjourned) : Amendment to Plumbing Code
On motion by Councilman McMillan, seconded by Councilman Perone,
the hearing, which had been adjourned on August 4, 1976, was
declared reconvened.
Supervisor Vandernoot briefly reviewed the proposal and the
Board members individually reiterated their feelings and once
again offered their reasons for being opposed to the amendment,
the concensus of which was its rigidity and its being a deterrant
to otherwise qualified plumbers.
Since no one wished to be heard either in favor of or in opposi-
tion to the amendment, on motion by Councilman DeMaio, seconded
by Councilman Bloom, it was unanimously
RESOLVED, that this hearing be and it
hereby is declared closed.
Upon the Supervisor's query as to the Board's pleasure, on motion
by Councilman Perone, seconded by Councilman DeMaio, it was unani-
mously
RESOLVED, that this Board hereby rejects
the proposal to amend the Town_ of Mamaro-
neck Plumbing Code.

NEW BUSINESS
1. Acceptance - Conservation Advisory Commission's
Annual Report
The Supervisor presented the Commission's very fine Annual Report
and referred specifically to page 23 stating that the problems
at the glass recycling center have been solved since designations
have been made regarding cleanup.
After some complimentary remarks by Councilman Bloom and his
reference to the Commission's eligibility to become a Board,
which has yet to be discussed by the Town Board with the C.A.C. ,
on his motion, seconded by Councilman McMillan, it was unanimously
RESOLVED, that this Board hereby approves
the Annual Report of the Conservation Ad-
visory Commission of the Town of Mamaroneck
for the year 1975 with a vote of thanks and
appreciation to the Chairman and all members
of the Commission.
Supervisor Vandernoot noted for the information of all in atten-
dance that members of the Commission will be present at this
Board's next regular meeting on October 6, 1976 to answer questions
regarding the report. He further stated that the long awaited
opportunity to honor two retired members of the Commission will
take place at that meeting also.
2. Application - Cook's Restaurant - Refrigerator Building
Pursuant to a memorandum dated August 26, 1976 addressed to the
III Town Board by William Paonessa, Building and Plumbing Inspector
in relation to the application submitted by Irving Cook to install
an outside refrigerator building on the westerly side of Block 412
Parcel 449, and in accordance with the Zoning Code, it was unani-
mously so ordered that the application be referred to the Planning
Board for their study and recommendations. It was noted that a
similar building has been installed at McDonald's.
3. Salary Authorizations - Recreation
Pursuant to memorandum addressed to the Board by the Superintendent
of Recreation under date of August 12, 1976, herewith presented
and ordered received and filed, on motion by Councilman McMillan,
seconded by Councilman Perone, the following resolution was unani-
mously adopted:
RESOLVED, that as recommended by the Recrea-
tion Commission, this Board hereby authorizes
that the following persons engaged as Recreation
Attendants and the following persons engaged as
Life Guards at the Hommocks Pool be compensated

at the rate of $2.25 and $2.50 per hour
respectively, effective as of September 7,
1976:

4. Appointment of Dog Enumerator for 1976-77
In accordance with usual yearly request as required by law, and
in accordance with the Town Clerk's recommendation, on motion
by Councilman Bloom, seconded by Councilman Perone, it was unani-
mously
RESOLVED, that pursuant to Section 108 of
the Agriculture and Markets Law, David
Vaughn of 311A Mamaroneck Avenue, Mamaro-
neck, be and he hereby is appointed Dog
Enumerator of the Town of Mamaroneck
(Unincorporated Area) for the year 1977.
5. Authorization for Publication of 1976 Polling Places
Pursuant to the Town Clerk's requests for designation of the
1976 Polling Places and authorization for the publication of
notices, after Councilman Bloom asked the reporter from the
Daily Times to give prominent coverage to the local registra-
tion, on Councilman DeMaio's motion, which was seconded by
Councilman Bloom, it was unanimously
RESOLVED, that in accordance with the
provisions of Section 76 and Section
354 of the Election Law, this Board
hereby designates a place for each
Election District in the Town as shown
on the lists hereto attached, and
authorizes the publication in the offi-
cial newspaper of the Town of Mamaroneck,
The Daily Times, on September 24, 1976
and October 1, 1976, a Notice listing
the places of registration and general
election, briefly describing each district.

COMMUNICATIONS
1. N.Y.S. Department of Transportation
A letter addressed to the Supervisor by the Regional Traffic
Engineer of the New York State Department of Transportation,
under date of August 30, 1976, stating that the Town's request
for a traffic signal at Weaver Street and Forest Avenue had
been denied, was presented and herewith ordered received and
filed. Some discussion followed in which it was pointed out
by the Supervisor that the Town cannot regulate the speed on
a State road, but could petition for a reduction in the speed
limit; this in answer to a request to have the speed limit
lowered on Weaver Street. A request was also made for speed
limit reduction on Maple Hill Drive to which the Supervisor
answered these matters would be referred to Chief Barasch
and-the Traffic Commission for consideration of stricter en-
forcement and posting of more signs.
THE SUPERVISOR
1. Proclamation - League of Women Voters Week
The Supervisor acknowledged receipt of a letter addressed to
him by Paula Willey, President of the Larchmont League of
Women Voters which was herewith ordered received and filed.
He further spoke of the League's contributions to the commu-
nity and thereupon in appreciation of their public service,
with the unanimous consent of the Board, he issued the follow-
ing proclamation:
II/ PROCLAMATION
WHEREAS, the strength and vitality of democratic
government lies in the informed parti-
cipation of all citizens,
and
WHEREAS, the League of Women Voters of Larchmont
and Mamaroneck in conjunction with other
local Leagues throughout the states of
New York, Connecticut, New Jersey and
Pennsylvania, will observe the week of
September 20 - 25 as League of Women
Voters Government Week, with the common
motto "Democracy Is Not A Spectator Sport,"
and
WHEREAS, the League of Women Voters has arranged a
number of activities designed to involve
all citizens in a program demonstrating
the structure, function and operation of
government at all levels,
I, Joseph Vandernoot, Supervisor, salute
the League of Women Voters of Larchmont
and Mamaroneck in its continuing campaign
to inform and involve all voters in the
election and operation of their govern-
ments, and proclaim the week of September 20
to be
League of Women Voters Government Week
in the Town of Mamaroneck.

NOT ON AGENDA
1. At this time the Supervisor acknowledged the presence of
Boris Feinman who stated that he was working with Elizabeth
Saenger in the Mamaroneck School System and gave a brief out-
line of the program in which they are attempting to acquaint
all students (Kindergarten - 12) with local government.
2. Mr. Vandernoot presented a newspaper article from the
Daily Argus and referred to the plight of Morris Stern and
his campaign to have legislation enacted to aid those indivi-
duals with catastrophic illnesses.
Because the entire Board agreed that medical costs for such
illnesses are phenomenal, the following resolution was
offered by Councilman Perone, who moved its adoption and
was seconded by Councilman DeMaio, to-wit:
WHEREAS, every year in the United States a
catastrophic illness strikes thou-
sands of individuals and families
bringing with it not only the ob-
vious physical and emotional suffer-
ing but also the specter of financial
ruin;
and
WHEREAS, due to ever-escalating costs of
hospitalization and medical treat-
ment, the financial impact of such
a catastrophic illness all too often
proves devastating for the individuals
concerned thereby effectively reducing
them to a life of poverty;
and
WHEREAS, existing private insurance coverage
as well as available public assistance
are inadequate to provide properly for
those stricken by a catastrophic illness;
NOW, THEREFORE, BE IT
RESOLVED, that this Board, the Town Board of the
Town of Mamaroneck, does hereby respect-
fully request its representatives in the
Congress of the United States in coordin-
ation with its representatives in the
Legislature of the State of New York to
enact legislation designed to create a
funded program to alleviate the devastating
financial burdens caused by those stricken
with a catastrophic illness.

THE COUNCILMEN
Mr. Bloom
1. Apportionment
Upon Mr. Bloom's presentation of the following apportionment
and on his motion, seconded by Councilman McMillan, the follow-
ing resolution was unanimously adopted:
WHEREAS, the Assessor has presented petition
for the correction of the assessment roll for
certain years pursuant to the provisions of
Section 557, Article 16 of the Westchester
County Tax Law;
and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petition for
the correction of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll of 1976-77
school taxes of 1976, which shows property
now appearing on the roll as follows:

THE TOWN ATTORNEY
1. Report on County Equalization Review Proceeding
Mr. Johnston announced that State authorities have upheld the
Westchester County Board of Equalization's policy of setting
assessments at a higher rate in the northern Westchester commu-
nities than those in the southern part of the County.
He further stated that this was good news for the Town of Mamaro-
neck since we were directly affected and had supported the
County's position.

ADJOURNMENT
There being no further business to come before the meeting, on
motion duly made and seconded, it was declared adjourned at
9:10 P.M. to reconvene on October 6, 1976.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.
1. Claims
Pursuant to the memorandum addressed to the Commission by the Deputy
Comptroller under date of September 1, 1976, herewith presented
and ordered received and filed, on motion by Commissioner Bloom
and seconded by Commissioner McMillan, it was unanimously

2. Authorization and Referendum - Purchase of Beepers
Pursuant to Commissioner Vandernoot's and Commissioner Bloom's
references to the matter of the purchase of beepers and related
equipment, and after some discussion similar to that occurring
at the July 8th meeting, the following resolution was offered
by Commissioner Bloom, who moved its adoption,seconded by
Commissioner DeMaio, to-wit:
BOND RESOLUTION DATED SEPTEMBER 1, 1976.
A RESOLUTION AUTHORIZING THE ACQUISITION,
OF AN ADDITION TO THE FIREMANIC COMMUNICA-
TION SYSTEM, CONSISTING OF REACH BEEPERS
AND RELATED EQUIPMENT, IN AND FOR THE TOWN
OF MAMARONECK FIRE DISTRICT IN THE TOWN OF
MAMARONECK, WESTCHESTER COUNTY, NEW YORK,

AT A MAXIMUM ESTIMATED COST OF $30,000 AND
AUTHORIZING THE ISSUANCE OF $23,000 SERIAL
BONDS OF SAID FIRE DISTRICT AND THE APPRO-
PRIATION AND EXPENDITURE OF $7,000 CURRENT
FUNDS OF SAID FIRE DISTRICT TO PAY THE COST
THEREOF.
BE IT RESOLVED, by the Board of Fire Commis-
sioners of the Town of Mamaroneck Fire District
in the Town of Mamaroneck, Westchester County,
New York, as follows:
Section 1. The acquisition of an addition
to the Firemanic Communication System, con-
sisting of REACH beepers and related equipment,
in and for the Town of Mamaroneck Fire District
in the Town of Mamaroneck, Westchester County,
New York, is hereby authorized at a maximum
estimated cost of $30,000.
Section 2. The plan for the financing of such
maximum estimated cost is as follows:
a) By the issuance of $23,000
serial bonds of said Fire
District hereby authorized
to be issued therefor pur-
suant to the Local Finance
Law; and
b) By the expenditure of $7,000
current funds of said Fire
District hereby appropriated
therefor.
Section 3. It is hereby determined that sub-
division 25 of paragraph a of Section 11.00
of the Local Finance Law applies to the afore-
said specific object or purpose, and that the
period of probable usefulness thereof is ten
years.
Section 4. The faith and credit of said Town
of Mamaroneck Fire District in the Town of
Mamaroneck, Westchester County, New York, are
hereby irrevocably pledged for the payment of
the principal of and interest on such bonds
as the same respectively become due and pay-
able. An annual appropriation shall be made
in each year sufficient to pay the principal
of and interest on such bonds becoming due
and payable in such year. There shall annually
be levied on all the taxable real property of
said Fire District, a tax without limitation
as to rate or amount sufficient to pay the prin-
cipal of and interest on such bonds as the same
become due and payable.
Section 5. Subject to the provisions of the
Local Finance Law, the power to authorize the
issuance of and to sell bond anticipation
notes in anticipation of the issuance and sale

of the serial bonds herein authorized,
including renewals of such notes, is
hereby delegated to the Fire District
Treasurer, the chief fiscal officer.
Such notes shall be of such terms, form
and contents, and shall be sold in such
manner, as may be prescribed by said
Fire District Treasurer, consistent with
the provisions of the Local Finance Law.
Section 6. The validity of such bonds
and bond anticipation notes may be con-
tested only if:
1) Such obligations are authorized
for an object or purpose for
which said Fire District is not
authorized to expend money, or
2). The provisions of law which
should be complied with at the
date of publication of this
resolution are not substantially
complied with,
and an action, suit or proceeding contesting
such validity is commenced within twenty days
after the date of such publication, or
3) Such obligations are authorized in
violation of the provisions of the
Constitution.
Section 7. Upon this resolution taking effect,
the same shall be published in full in The
Daily Times, which is hereby designated as the
official newspaper of said Fire District for
such purpose, together with a notice of the
Fire District Secretary in substantially the
form provided in Section 81.00 of the Local
Finance Law.
Section 8. This resolution is adopted subject
to approval at a special election of said Fire
District to be held on October 6, 1976.
The question of the adoption of the foregoing
resolution was duly put to a vote on roll call,
which resulted as follows:

The following resolution was offered by Commissioner Bloom
who moved its adoption, seconded by Commissioner DeMaio
to-wit:
BE IT RESOLVED, by the Board of Fire
Commissioners of the Town of Mamaro-
neck Fire District in the Town of
Mamaroneck, Westchester County, New
York, as. follows:
Section 1. A special election of the
qualified voters of the Town of Mamaro-
neck Fire District in the Town of Mamaro-
neck, Westchester County, New York, is
hereby authorized to be held on the 6th
day of October, 1976, between the hours
of 1:00 o'clock P.M. and 10:00 o'clock P.M. ,
Eastern Daylight Saving Time, to vote by
voting machine on the adoption or rejection
of the bond resolution heretofore adopted
at this meeting.
Section 2. The notice of such special
election shall be in substantially the
following form, to-wit:
NOTICE OF SPECIAL ELECTION
Town of Mamaroneck Fire District in the Town
of Mamaroneck, Westchester County, New York
NOTICE IS HEREBY GIVEN that, pursuant to
Section 38.00 of the Local Finance Law and
Section 179 of the Town Law, a special
election of the qualified voters of the
Town of Mamaroneck Fire District in the
Town of Mamaroneck, Westchester County,
New York, will be held at the Town of
Mamaroneck Fire House, Weaver Street,
Larchmont, New York, in said Fire District,
on the 6th day of October, 1976, between
the hours of 1:00 o'clock P.M. and 10:00
o'clock P.M. , Eastern Daylight Saving
Time, for the purpose of voting by Voting
machine on the adoption or rejection of the
following bond resolution:
BOND RESOLUTION DATED SEPTEMBER 1, 1976.

complied with,
and an action, suit or proceeding contesting

after the date of such publication, or
3) Such obligations are authorized
in violation of the provisions
of the Constitution.
Section 7. Upon this resolution taking effect,
the same shall be published in full in The Daily
Times, which is hereby designated as the official
newspaper of said Fire District for such purpose,
together with a notice of the Fire District
Secretary in substantially the form provided
in Section 81.00 of the Local Finance Law.

The polls will be kept open for the purpose of
voting during the aforesaid hours and the propo-
sition to be voted upon will be in substantially
the following form, to-wit:

IZING THE ACQUISITION OF AN ADDITION TO THE
FIREMANIC COMMUNICATION SYSTEM, CONSISTING OF
REACH BEEPERS AND RELATED EQUIPMENT, IN AND FOR
THE TOWN OF MAMARONECK FIRE DISTRICT IN THE
TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK,
AT A MAXIMUM ESTIMATED COST OF $30,000 AND AUTHORIZ-
ING THE ISSUANCE OF $23,000 SERIAL BONDS OF SAID
FIRE DISTRICT AND THE APPROPRIATION AND EXPENDI-
TURE OF. $7,000 CURRENT FUNDS OF SAID FIRE DISTRICT
TO PAY THE COST THEREOF.", duly adopted by the
Board of Fire Commissioners of said Fire District
on the 1st day of September, 1976, be approved?

Section 3. The Secretary of said Fire District
is hereby authorized to give notice of such
special election by publication once in The
Daily Times, a newspaper published in Mamaroneck,
New York, having a general circulation in said
Fire District, the first publication to be not
less than thirteen (13) nor more than twenty (20)
days prior to the date of such election. In
addition, said Secretary shall cause copies of
such notice to be posted conspicuously in five (5)
public places in said Fire District at least
thirteen (13) days prior to the date of such elec-
tion.
Section 4. The following resident fire district
electors of said Fire District who are not
officers of said Fire District, are hereby desig-
nated to act as election officers, respectively
indicated below:

Wilma Bakker )
Marion Behrens )
Joan Markowitz ) Inspectors and Ballot Clerks
Section 5. The persons named above shall be paid
the sum of $25.00 each for their services, with the
Chairman being paid $28.00 .
Section 6. This resolution shall take effect imme-
diately.
The question of the adoption of the foregoing reso-
lution was duly put to a vote on roll call, which
resulted as follows:

The resolution was thereupon declared duly adopted.
