HomeMy WebLinkAbout1921_06_01 Town Board Minutes Meeting of the Town Board TOWN OF MAMARONECK held, June 1st, 1921 The meeting was called to order by Supervisor Burton at 8.45 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins, Dudley and Shafer, Sewer Commissioners Stevens, Palmer and Mitchell Clerk Sherman, Counsellor Gamble. Upon motion, it was voted to dispense with the reading of minutes of meetings not yet approved. The meeting was called for the purpose of financing the sewer proposition and after considerable discussion, it was left to the Commission to notify the Town Clerk as to date of calling next meeting. A petition from the Board of Assessors in relation to an erroneous assessment on property on Prospect Avenue, known as Sec. 9, Block 39, Lot 11 in the amount of $7,000, stating that the correct assessment should be $5,000, was received and read and upon motion, duly seconded, it was VOTED, that the Supervisor be and he hereby is authorized and empowered to to see that the necessary action be taken to have same corrected. CARRIED. Petitions presented by property owners of Fire District No. 1, for a proposition to spend $65,000, for the erection of a new fire house was received, read, approved and ordered filed with with the Town Clerk, and is as follows; To the Town Board, Town Clerk, Town of Mamaroneck, N.Y. We, the undersigned, duly qualified electors, property owners, and taxpayers of Fire District No.1 of the Town of Mamaroneck, whose names appear on the last preceding assessment roll of said Town, do hereby respectfully petition the Town Board of the Town of Mamaroneck, pursuant to the provisions of Chapter 561 laws of 1921 of the State of New York, to wit: An Act, "To provide for the submission of a proposition to the voters of Fire District No. 1 of the Town of Mamaroneck, New York, for the acquisition of a site by private purchase or condemn- nation, and the construction of a new fire house in said district, and, if such proposition is adopted, authorizing the issue of not to exceed Sixty Five thousand dollars of bonds to provide for the said acquisition of said site and the erection of said building. To submit to the electors of the aforesaid Fire District No. One of the Town of Mamaroneck at a special election to be called and held in the manner in the manner provided in the aforesaid act and to be voted upon by ballot, the following proposition: "Shall Fire District No. 1 of the Town of Mamaroneck, acquire a site by private purchase or condemnation, and construct a new fire house in said District at a cost of not to exceed sixty five thousand dollars? Justice Frederick P.Shafer moved and Justice P.H. Collins seconded the adoption of the following resolutions: RESOLVED, by the Town Board of the Town of Mamaroneck, Pursuant to the provisions of an act of the Legislature of the State of New York entitled: An act to provide for the submission of a proposition to the voters of Fire District No. 1 of the Town of Mamaroneck, New York, for the acq- isition of a site, by private purchase or condemnation, and the construction of a new fire house in said fire district, and, if such proposition is adopted, auth- orizing the issue of not to exceed sixty- five thousand dollars of bonds to provide for the said acquisition of said site and the erection of said building, "approved May 4th, 1921, constituting chapter 561 of the Laws of 1921, there shall be sub- mitted to the electors of fire district No.1 of the Town of Mamaroneck, at a spec- ial election to be held July 1st, 1921, the following proposition: "Shall Fire District No.1 of the Town of Mamaroneck acquire a site by private purchase or condemnation, and construct a new fire house in said district at a cost of not to exceed sixty-five thousand dollars? FURTHER RESOLVED, that notice of the time and place of said election, together with a copy of proposition to be submitted thereat, shall be published for three con- secutive weeks immediately preceding the week in which such election shall be held in the Larchmont Times, a newspaper pub- lished in the Town of Mamaroneck, and shall be posted in the following five pub- lic places in said District for the same period of time: Weaver St. Fire House, Edgewood Road Auxiliary Fire House, Weaver Street Bulletin Board- Intersection of Myrtle and Chatsworth Ave. Bulletin Board- Intersection Myrtle and Weaver Street Fire Station No.3, - Forest and Rock- ingstone Avenue. Said election shall be held at the present firehouse, Edgewood Road, Town of Mamaroneck and the votes shall be canvassed by the inspectors of election duly appointed,- Wm. I. Palmer, Chas.H.Lighte, Harry A.Schwartz, and Ralph Cheney, who are hereby appointed special election officers for the purpose of canvassing votes to be cast at said elec- tion. The vote on such proposition shall be by ballot. FURTHER RESOLVED, that the notice of elec- tion shall be in substantially the follow- ing form: TOWN OF MAMARONECK FIRE DISTRICT NUMBER ONE NOTICE OF SPECIAL ELECTION TO BE HELD JULY 1, 1921. Notice is hereby given that a special elec- tion of the duly qualified electors of fire District No. 1 of the Town of Mamaroneck will be held at the present fire house, Edgewood Road, in the Town of Mamaroneck on Friday July 1, 1921, at which the foll- owing proposition will be submitted- . "Shall Fire District No. 1 of the Town of Mamaroneck, acquire a site by private pur- chase or condemnation, and construct a new fire house in said district at a cost of not to exceed sixty-five thousand dollars? The polls will be open between the hours of 6.00 A.M.and 8.00 P.M. To entitle a person to vote upon such propostion, he or she must have the qualifications prescribed b y Section 53 of the Town Law for an elector at a Town meeting, namely that the voter (he or she) is the owner of property in the Town assessed to him or her upon the last preceding assessment roll thereof. The rollbeing called upon the adoption of the foregoing resolution, the following members of the Town Board voted aye; Messrs.Burton, Collins, Boyd, Shafer and Sherman. A communication was received from the Sewer Commisioners of the Town of Mamaroneck in relation to the payment of bills incurred by the Commission was read, ordered placed on file and the following resolution was adopted. WHEREAS, THE Sewer Commissioners of Dist. No. 1 of the Town of Mamaroneck has requested the payment of certain claim aggregating $6,412.49 for engineering and other expenses incurred in connection with the sewer system which is about to be constructed within said District; and WHEREAS, the said sum of $6,412.49 has been levied and assessed upon the taxable property lying within said Sewer District; Now Therefore be it RESOLVED, that the Supervisor be and he hereby is requested, authorized and empowered to borrow upon the credit of the Sewer District No. 1 of the Town of Mamaroneck, the sum of $6,412.49 for which he shall issue in the name of said Sewer District and under the seal of the Town of Mamaroneck, one or more certif- icates of indebtedness, each of such denomin- ation as the Supervisor may determine. Said certificates of indebtedness shall be signed by the Supervisor, attested by the Town Clerk or his Deputy, shall bear interest at the rate of not more than six (6%) per centum per annum and shall be made payable at such time as the Supervisor may fix. and it is further RESOLVED, that the Supervisor be and hereby is further authorized and empow- ered to dispose of said certificates of indebtedness for not less than the par value thereofs. The question being taken upon the foregoing resolution same was upon ROLL CALL unanimously adopted. Upon motion, the meeting adjourned at 11. 30 P.M. John C.Fairchild Town Clerk Deputy Clerk.
