TOWN OF MAMARONECK, HELD MARCH 3RD, 1976, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 P.M. ROLL CALL Present: Supervisor Vandernoot Councilman McMillan Councilman DeMaio Absent: Councilman Bloom Councilman Perone Also Present: Mrs. Miller - Town Clerk Mr. Johnston - Town Attorney Mr. Elfreich - Town Engineer Mr. Barasch - Chief of Police NOT ON AGENDA Prior to the presentation of the first order of business on this evening's agenda, Mr. Robert Degan of 919 Harmon Drive, Town asked to address the Board and, speaking on behalf of his neighbors, brought the Board up to date on the history of traffic problems on Harmon Drive and asked what can be done to alleviate those prob- lems on that street. He referred to the constant passing of speeding vehicles and wondered what the statistics were as to the number of tickets issued. The residents' suggestions were to make Harmon Drive a one-way street toward Weaver or to dead end the street at the Town-Village line. Due to the number of persons present this evening, at this time the Supervisor adjourned the meeting to reconvene immediately in the Auditorium. Police Chief Barasch continued the discussion relative to Harmon Drive and reported that he had spoken to this group and had given a summary of his recommendations to the Town Board and described what his and the Traffic Commission's intentions were relative to the problem. He stated that the installation of full stop signs at the Girl Scout House will be researched and arrangements have been made for more radar units to be posted on that street at certain times of the day. He also spoke of the need to lower the speed limit to 25 miles per hour which should be extended to Myrtle Boulevard because of its close proximity to Sts. John & Paul School and because the traffic patterns are similar to those of Harmon Drive. The Chief noted that the County Traffic Engineer will investi- gate the entire situation and in the meantime he wished to formulate a committee from among the residents to study the problem. -1- 249 3-3-76 Thereupon pursuant to Police Chief Barasch's request, on motion by Councilman McMillan, seconded by Councilman DeMaio, it was unanimously RESOLVED, that this Board hereby author- izes the Supervisor to execute the Town's request to the State Department of Trans- , portation for the speed limit to be reduced from 30 to 25 miles per hour on Harmon Drive between Weaver Street and the Mamaroneck Town and Mamaroneck Village line and Myrtle Boule- vard between Murray Avenue and Lakeside Drive with expeditious approval being a part of the request. OLD BUSINESS 1. Report - Settlement of Firefighters' Contract Supervisor Vandernoot reported that the Town and the paid fire fighters' union have agreed on a $700.00 pay increase for this year :(retroactive to January) which amounts to less than 5%. He noted that a two-year contract was settled in 1975 which left the 1976 salary item open for negotiation. 2. Authorization to Advertise for Bids - Maintenance Contract The Supervisor noted that the above mentioned contract had been approved at the last meeting, and stated that the Board thought the monthly sum applied only to the five months the bubble is up, but discovered later that the contract was for a full year totalling over $3,500.00, and a contract for that amount cannot be awarded without formal bidding. Thereupon in accordance with the Superintendent of Recreation's request and on motion by Councilman McMillan, seconded by Councilman DeMaio, it was unani- mously RESOLVED, that the resolution adopted at the February 18th Town Board meeting be and it hereby is rescinded; and be it further RESOLVED, that this Board hereby author- izes publication in the official newspaper of the Town of Mamaroneck, The Daily Times, of a Notice of Bids for a Maintenance and Service Contract for the Hommocks Ice Rink, said bids to be returnable on March 17, 1976 anf reported to the Town Board on March 17, 1976. 3. Set Date for Public Hearing - Dandry Application Mr. Vandernoot noted that although the Board had not received the recommendations of the Town Planning Board or the Westchester County Planning Board relative to the above mentioned application -2- 250 3-3-76 for rezoning, this Board wishes to set the date for a public hearing and thereupon on motion by Councilman McMillan, seconded by Councilman DeMaio, it was unanimously RESOLVED, that a public hearing will be held by this Board at its next regular meeting on Wednesday evening, March 17, 1976 in the Auditorium of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, for the purpose of considering the applica- tion of James Dandry for a change of zoning from OB-1 (Office Building) to LI (Light Industry) on the property known as Section 5, Block 501 Parcel 1; and be it further RESOLVED, that the Clerk be and she hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, the Notice of said hearing as required by law. At this time Mr. Vandernoot recognized the presence of the Republican candidate for Mayor of the Village of Larchmont, Maurice Noyer and his two running mates, Corinn Johnson and Robert Barry who urged the Board to keep in mind the inter- ests of the Village residents, particularly those in the Pine Brook area and consider any adverse effects the rezoning would have on them. NEW BUSINESS 1. Authorization to Collect 1976 State, County, Town and Special District Taxes Pursuant to the request of the Receiver of Taxes for authoriza- tion to collect the 1976 State, County, Town and Special District taxes and publish and post the necessary Notice therefore, on motion by Councilman McMillan, seconded by Councilman DeMaio, it was unanimously RESOLVED, that this Board hereby author- izes the Deputy Receiver of Taxes of the Town of Mamaroneck to collect the 1976 State, County, Town and Special District taxes and the water rents which become a lien on January 1st, 1976; and be it further RESOLVED, that in accordance with the pro- visions of Section 500 of the Westchester County Administrative Code, The Daily Times, the official newspaper published in the Village and the Town of Mamaroneck, be it hereby designated as the newspaper in which the Deputy Receiver of Taxes and Assessments shall publish the "Notice of the Collection of State, County, Town and Special District taxes and water rents"; -3- 251 3-3-76 and be it further RESOLVED, that in accordance with the provisions of Section 550 of the West- chester County Administrative Code, the Town Board does hereby direct the Deputy Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is known to said Deputy Re- ceiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. 2. Reappointment: Zoning Board of Appeals Councilman DeMaio called to attention the impending expiration of Mr. Andrew W. Boraczek's term of office on the Zoning Board of Appeals and with pleasure recommended his reappointment. Mr. Boraczek's contributions to the community as a member of this Board were commended and pleasure was expressed that he was willing to continue serving in this post, and thereupon on motion by Councilman DeMaio, seconded by Councilman McMillan, it was unanimously RESOLVED, that this Board hereby re- appoints Mr. Andrew W. Boraczek of 85 Valley Rd. , Town, a member of the Zoning Board of Appeals, to serve for a five-year term of office, effective immediately and terminating on February 19, 1981; and be it further RESOLVED, that Mr. Boraczek be so noti- fied. COMMUNICATIONS 1. Letter, Fred J. Anderson A letter addressed to the Board under date of March 1, 1976 by Fred J. Anderson of 129 Carleon Avenue, Town, noting his displeasure with the sign on the front lawn of the Court House and urging the Board to erect a more attractive sign, was herewith presented by Mr. Vandernoot, who stated that the matter would be looked into, and ordered received and filed. NOT ON AGENDA 2. Use of Voting Machines - Villages of Larchmont & Mamaroneck Pursuant to the requests of the two Village Clerks, both pre- sented and ordered received and filed, on motion by Councilman -4- 252 3-3-76 DeMaio, seconded by Councilman McMillan, it was unanimously RESOLVED, that this Board hereby grants the requests of the Villages of Larchmont and Mamaroneck for the use of 27 voting machines to be used in the Annual Village Elections of March 16, 1976. 3. Notice of Hearing - Village of Larchmont A Notice of Hearing of the Planning Commission of the Village of Larchmont was herewith presented and ordered received and filed. REPORTS The Town Clerk Regular Reports The Clerk presented the following reports which were ordered received and filed: Report of the Building & Plumbing Inspector for the month of February 1976. Report of the Town Clerk for the month of February 1976. For the record the Clerk reported that the Annual Report of the Supervisor for the Fiscal Year Ending December 31, 1975 and the Annual Report of the Fire District Treasurer for the Fiscal Year Ending December 31, 1975 had been filed with the State Department of Audit and Control, and that copies thereof were filed in the Clerk's Office and were available to any interested person. NOT ON AGENDA Following some discussion in which it was noted that this is the only municipality in the area that has not yet taken this legal step, and pursuant to the Town Clerk's request, on motion by Councilman DeMaio, seconded by Councilman McMillan, it was unani- mously RESOLVED, that in accordance with the Agriculture and Markets Law, the Town Clerk be and she hereby is authorized to take the necessary steps to have summonses issued to the dog owners who have failed to get 1976 licenses. NOT ON AGENDA Councilman DeMaio gave a brief overview of the February 1976 report of the Hommocks Ice Rink and stated that the gross income was up from the same month last year nearly 47% and attributed the increase to the addition of a concession and the rise in hourly rentals. -5- 253 3-3-76 THE SUPERVISOR 1. Report - County Solid Waste Program The Supervisor briefly reported on the March 1st meeting which he attended relative to the Westchester County Solid Waste Management Program and noted that he was not made aware of any new developments which would be of interest to the Town of Mamaroneck. THE ATTORNEY 1. J.R.R. Realty Certiorari Pursuant to the Attorney's request and in accordance with the Assessor's and his recommendation, also concurred by the attorney for the Board of Education, on a motion offered by Councilman McMillan and seconded by Councilman DeMaio, the following reso- lution was adopted by unanimous vote of the Board: WHEREAS, heretofore writs of certiorari were obtained by J.R.R. Realty, Inc. , owners of properties known and described as Block 408 Parcel 1 and Block 407 Parcel 269 on the Tax Assessment Map and the Assessment Roll of the Town of Mamaro- neck, for the following year: 1975 for taxes of 1976; and WHEREAS, the Town Attorney recommends to this Board that the proceedings be settled and discontinued upon the reduction of certain of these assessments; NOW, THEREFORE, BE IT RESOLVED, that the assessments for the year 1975 for taxes of 1976, upon properties owned by J.R.R. Realty, Inc. and described on the Assessment Map and Assessment Roll of the Town of Mamaroneck as Block 408 Parcel 1 and Block 407 Parcel 269, be re- duced as follows: From Assm't. Realty, Inc. be discontinued without costs as against either party; and be it further RESOLVED, that all refunds of taxes due by reason of such reductions be paid without interest; and be it further RESOLVED, that the Town Attorney is hereby authorized and directed to sign the necess- ary stipulations to obtain an order of the Supreme Court providing for such reductions. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:40 P.M. to reconvene on March 17, 1976. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1.
