MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD NOVEMBER 19, 1975, IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 P.M.

OLD BUSINESS
1. Adopt Preliminary Budget and Set Date for Public Hearing on
Budget
The Supervisor recommended adoption of the Preliminary Budget for
It 1976 as herewith presented urging its adoption this evening so
that the date could be fixed for the public hearing thereon as
required by law. She further noted that its adoption at this
time would make it possible to have copies thereof available by
� November 24th thus permitting study of the proposed budget prior
to the public hearing. Further, she continued, since the Annual
Budget had to be adopted on or before midnight of December 20th
and since the Preliminary Budget, upon its adoption, could be
amended (either raised or lowered), Mrs. Helwig recommended that
the hearing be held.on Wednesday evening, December 3, 1975.
Whereupon on motion.by Deputy Supervisor Vandernoot, seconded by
Councilman Bloom, it was unanimously
RESOLVED, that this Town Board does hereby
approve as the Preliminary Budget of this
Town for the fiscal year beginning on the
first day of January 1976, the itemized
statement of estimated revenues and expen-
ditures hereto attached and made a part of this
resolution;
and be it further
RESOLVED, that such Preliminary Budget shall
be filed in the office of the Town Clerk, where
it shall be available for inspection by any
interested person at all reasonable hours;

and be it further
RESOLVED, that the Town Clerk give Notice
of public hearing in the manner provided
in Section 108 of the Town Law, and that
the Notice be published and posted in sub-
stantially the following form:
Public Notice
Notice is hereby given that the Preliminary
Budget of the Town of Mamaroneck, New York,
consisting of the estimated revenues and
expenditures for the year 1976, has been
completed and filed in the Office of the
Town Clerk of said Town, where the same may
be examined by any person interested therein,
and that a public hearing thereon will be
held by and before the Town Board of said
Town on Wednesday evening, December 3rd at
8:15 o'clock in the Auditorium of the
Weaver Street Firehouse, Weaver Street,
Town of Mamaroneck, New York, at which time
and place all those who appear and are
interested will be given an opportunity to
be heard with respect to said Preliminary
Budget, or any part or item thereof.
Please take further notice, that the pro-
posed salaries of the members of the
Town Board are as follows:
Supervisor- $12,000; Town Councilman (4) -
$2,500 each; and that the proposed salary
of the Town Clerk is $13,450.

RESOLVED, that the Notice shall be published in
the following newspaper having general circula-
tion within the Town: The. Mamaroneck Daily Times,
on November 21, 1975.
During the discussion after adoption of the resolution, the
following items were brought to the Board's attention in some
detail:
a) The questionnaire regarding the proposed joint
Town-Village collection of garbage and rubbish
aimed toward a potential reduction of service
and costs, which the Supervisor briefly reviewed;
A question was raised by Mrs. Margaret Shultz as
to whether the present 3-times a week pick-up
in the Unincorporated Area might be reduced to
twice-a-week.
In answer the Supervisor stated that while there
was no definite determination as yet, it was hoped
that the present 3-times a week schedule would
continue.

b) A rather strong request that more time be
provided to the Town so that more skating
time at the Bubble could be sold under con-
tract to the Hockey Leagues in the County
needing the availability of ice, which
might necessitate the negotiation of a new
schedule of time for the school district's
use of said ice;
c) A similarly strong and urgent request that
the Board give every possible consideration
this year to "holding the line" or reducing
employee costs during all negotiations with
Police, Fire, CSEA and AFSCME (garbage)
Unions.
2. Report to Board on Parking Survey by Town Clerk and Set Date
for Public Hearing
The Town Clerk reported on the procedures she had followed after
the Tenants Council had advised the Supervisor of the need for
the availability of' 24-hour.°parking in Lot #3, and referred to
her memorandum addressed to the Town Board under date of November 17,
1975, in which she outlined her recommendations and the reasons
thereof, which was herewith ordered received and filed as part of
the record of this meeting.
Thereupon, pursuant to the Town Clerk's recommendation, on motion
by Councilman McMillan, seconded by Councilman Bloom, it was unani-
mously
RESOLVED, that this Board hereby fixes the
date of December 17, 1975, the second regular
meeting in December, for holding a Public
Hearing for the purpose of considering an
amendment to Chapter IX-F. of the General
Ordinances of the Town of Mamaroneck entitled
"Parking Lots, Overnight" so as to permit
24-hour parking, 8:30 a.m. to 8:30 a.m. in
Parking Lot #3 situated at Myrtle Boulevard and
Chatsworth Avenue, Town of Mamaroneck.
and be it further
RESOLVED, that. the Clerk be and she hereby
is authorized to publish in the official
newspaper of the Town of Mamaroneck, The
Daily Times, Notice of such hearing as re-
quired by law.
3. Authorization.to Sign CSEA Contract
Pursuant to Deputy Supervisor Vandernoot's statement that although
contract agreement had been reached with the CSEA earlier in the
year, there had been some delay in the printing of the contract
which is now ready for signing by the Supervisor on behalf of the

Town, on motion by Councilman Bloom, seconded by Councilman
McMillan, the following resolution was unanimously adopted:
RESOLVED, that the Supervisor be and she
hereby is authorized to sign on behalf
of the Town of Mamaroneck, the contract
between the said Town and the Town of
Mamaroneck Unit, Westchester Chapter,
Civil Service Employees Association for
the Two-year period beginning January 1,
1975 and terminating December 31, 1976.
4. Appointment(s) •- CAP Board of Directors
Following the Supervisor's resume of Mrs. Grissom's and Mr. Mulcahy's
particular qualifications for this service and pursuant to her
recommendation that they both be appointed as members of the Board
of Directors of the Community Action Program, on motion by Council-
; man Bloom, seconded by Deputy Supervisor Vandernoot, it was unani-
mously
RESOLVED, that this Board hereby appoints
Mrs. Selena M. Grissom of 126 Richbell Road,
Town and Mr. George Mulcahy, 172 Myrtle
Boulevard, Town, as members of the Board of
Directors of the Community Action Program
effective immediately and to serve the coming
year.
NEW BUSINESS
1. Set Date for Public Hearing re Code
The Supervisor stated that she, the Town Attorney and the Town Clerk
had conferred with a representative of General Code Publishers Corp.
of Spencerport, New York regarding the compilation, renumbering and
tabulating of local laws, ordinances and resolutions in the Code of
the Town of Mamaroneck and in order to make this amended Code official,
a public hearing would have to be held. And thereupon, following a
discussion in which it was suggested that a copy of the revised Code
be placed in the local library and also in which questions were raised
about the possibility of printing separately certain sections of the
Code, on motion by Councilman Bloom, seconded by Councilman McMillan,
the following resolution was-adopted by unanimous vote of the Board:
RESOLVED, that a public hearing will be
held by this Board at its regular meeting
on Wednesday evening, December 17, 1975
in the Auditorium of the Weaver Street
Firehouse, Weaver Street, Town of Mamaro-
neck, for the purpose of considering the
enactment of a local law to compile, re-
number and tabulate local laws, ordinances
and resolutions of the Town of Mamaroneck
from existing numbers with adoption and
effective dates to newly assigned number-
ing by chapter and section.
and be it further
RESOLVED, that the Clerk be and she hereby
is authorized to publish in the official
newspaper of the Town of Mamaroneck, The
Daily Times, Notice of such hearing as
required by law.

2. Salary Authorizations - Recreation
Pursuant to memoranda addressed to the Board by the Superintendent
of Recreation under dates of November 10 and 14, 1975, herewith
presented and ordered received and filed, on motion by Deputy
Supervisor Vandernoot, seconded by Councilman Bloom, the following
resolution was unanimously adopted:

3. Resolution - Provide Credit for Police Service with Another
Department
Deputy Supervisor Vandernoot presented the long standing problem of
granting retirement credit to two policemen for service in other
communities before they joined the Town department and stated that
the $23,984.00 is to be included in the 1976 budget for Ptl. Anthony
L. Lifrieri and Ptl. William Coy. Thereupon, on his motion which
was seconded by Councilman Bloom, it was unanimously
RESOLVED, that this Board hereby elects,
in accordance with subdivision g of
Section 384-d of the Retirement and Social
Security Law, to assume all of the additional
cost on account of previous service as an
III officer or member of any other department
or force by any present or future officers
or members of the Town of Mamaroneck Police
Department who are or become members of the
New York State Policemen's and Firemen's
Retirement System and elect or are required
i to contribute under the provisions of Section
384-d of the Retirement and Social Security Law.

Some discussion followed in which it was pointed out by
Councilman Bloom that since the state law mandates that
this must be extended to any future officer, Chief Barasch
has been alerted regarding the hiring of new personnel.
COMMUNICATIONS
1. Mr. Ira Freireich, 287 Weaver Street, Town, requested that
he be removed from the agenda of this meeting.
2. Resignation - Mrs. Elaine Samuels
Supervisor Helwig presented a letter addressed to the Board by
Mrs. Elaine Samuels under date of October 27, 1975, tendering
her resignation as Chairman of the Senior Citizens Council which
was herewith ordered received and filed.
Deputy Supervisor Vandernoot expressed regret and paid tribute to
Mrs. Samuels for her many contributions and accomplishments in
the development of senior services in the Town and thanked her for
a tremendous job and for the extraordinary services she provided,
and on his motion which was seconded by Councilman McMillan, it
was unanimously
RESOLVED, that this Board with regret
reluctantly accepts the resignation of
Mrs. Elaine Samuels as Chairman of the
Senior Citizens Council effective
immediately and expresses to her its
thanks and appreciation for the services
and contributions to the elderly of this
community.
3. Letter, Girl Scout Council
A letter addressed to the Supervisor by Thekla Bloch under date of
November 12, 1975, in which she requests the Board to consider
making exceptions for non-profit organizations in the local law
regulating garage sales, was herewith presented and ordered re-
ceived and filed and referred to the Town Attorney for his
recommendation.
4. Housing Code Enforcement Conference

The Supervisor presented a communication from the Housing Action
Council announcing a one-day conference to be held on Thursday,
December 4, 1975 at 85 Court Street in White Plains, which was
ordered received and filed.
5. Housing. Action Reporter
Supervisor Helwig presented the November, 1975 issue of the Housing
Action Reporter which was ordered received and filed.

THE SUPERVISOR
1. Report re Flood Control - Larchmont Reservoir
Mrs. Helwig reported that preparations are being made for a
meeting to be held soon with the residents living in the area
surrounding the Larchmont Reservoir.
2. November 25th - Michael A. Tripicco Day
The Supervisor spoke of the Board of Education's proclamation
of "Michael Tripicco Day", and suggested that the Town join
with them in this designation and whereupon Councilman Bloom
moved and Councilman McMillan seconded that Mrs. Helwig's
recommendation be followed and thereupon the foregoing reso-
lution was unanimously adopted with each of the members of
the Board individually expressing his tribute to Mr. Tripicco:
WHEREAS, Michael A. Tripicco has served the Union Free
School District #1, Mamaroneck, New York for
more than fifty years as Head Custodian of our
High School •.and since 1956 as Supervisor of
Buildings and Grounds for the entire system,
and
WHEREAS, "Mike" has served with dedication and effective-
ness, with real concern for the people of the
community and willingness to go far beyond the
call of duty in serving them,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Mamaroneck
hereby designates Tuesday - November 25th as
Michael A. Tripicco Day
in the Town of Mamaroneck in tribute to him
and to his extraordinary record of service
to the residents of the School District and
Town.

NOT ON AGENDA
The Town Attorney presented his memorandum addressed to the
Supervisor under date of November 17, 1975, herewith ordered
received and filed as part of the record of this meeting, and
in accordance with the Assessor's and his recommendation, the
following resolution was unanimously adopted:
WHEREAS, heretofore writs of certiorari
were obtained by 1825 Palmer Associates
owners of property known and described
as Block 603, Parcel 113 on the Tax
Assessment Map and Assessment Roll of
the Town of Mamaroneck, for the follow-
ing years: 1974 for taxes of 1975 and
1975 for taxes of 1976;
and
WHEREAS, the Town .Attorney recommends to
this Board that the proceedings be settled
and discontinued upon the reduction of
certain of these assessments;
NOW, THEREFORE, BE IT
RESOLVED, that the assessments for the years
1974 for taxes of 1975 and 1975 for taxes of
1976 upon property owned by 1825 Palmer Asso-
ciates and described on the Assessment Map
and Assessment Roll of the Town of Mamaroneck
as Block 603, Parcel 113, be reduced as follows:

RESOLVED, that the Town Attorney is hereby authorized and
directed to sign the necessary stipulations to obtain an
order of the Supreme Court providing for such reductions.

ADJOURNMENT
There being no further business to come before the meeting, on
motion duly made and seconded, it was declared adjourned at
10:12 P.M. , to reconvene on December 3, 1975.

The meeting.. of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board Meeting.
